President s attack bringing his past into the pot light. Al frankens political fate up in the air as Top Democrats say expulsion is possible. Missing do you means say Jared Kushner has not turned over all of his emails relating to wikileaks and now Robert Mueller is dropping a subpoena on the Trump Campaign. We begin with the tale of two responses. President trump goes after al franken over accusations of Sexual Harassment and on the allegations of roy moore pursued teen girls while he was in his 30s, silence. He blasted franken over this photo that shows him appearing to grope Leanne Tweeden while she was sleeping. They went on a trip for the uso. The picture is really bad and speaks a thousand words. Where do his hands go in pictures 2, 3, 4, 5, and 6 while she sleeps. Sarah must havy is joining us now. Whats behind the selective silence by the president . It is a little bit bizarre that the president has not weighed in on roy moore. He dodged questions on the issue and the white house made clear the president feels like alabama voters need to make a decision and its not up president to suggest he step aside, but we saw the tweet on al franken. It inserts the president in a very partisan way on an issue that has really crossed to the partisan divide. Of course across multiple industries throughout the United States. It is a little bit bizarre to see the president out here only commenting on allegations against a democrat while staying silent on a republican who is in the middle of a hotly contested senate race. Sorry there concern that the president is drawing renewed tension to pass the accusations of Sexual Misconduct against him . This was one of the concerns initially when he was not weighing in on roy moore. Sources told us that the president didnt want to draw attention to his own allegations of Sexual Misconduct against him. In the campaign, more than a dozen women accused the president of inappropriate behavior and the president came out and called them liars. It puts a spotlight back on that again today. The president drew attention to this photograph and that drew a lot of comparisons and questions if we should believe this photograph, why shouldnt we believe the old access Hollywood Tape where the president is suggesting he can grab women because he was famous. He was not the president at the time and got elected in spite of that. We will get back to you, sarah murray. Lets discuss all of this and moore with our legal analyst and federal prosecutor. Cnn prosecutors are here in the c in, n analyst david gregory. What do you make of the president who is going after al franken and staying silent when it comes to the candidate roy moore. The changes against the president are serious charges of hypocrisy. Hypocrisy allaround. I dont think he is easily shame and particularly cares about the fact that he is inviting renewed attention to the allegations against him. He is happy to go against the democratic senator for hypocrisy. On roy moore, for all the reasons we talked about in the past few days, there is a lot of political sensitivity about how republicans are putting pressure on moore. Knowing that the president can do a lot to affect the out come and he thinks its too dies tow do it. He doesnt have restraint aside from the fact that he made a decision here. What do you think . I think its a mistake to weigh in and points attention to things the president shouldnt want pointed attention to. Thats his own accusations. It was an unwise decision by the president and it does leave open that now he is in a situation where he has to comment and it seems clear in alabama that the people certainly are not going to abandon him and see this through. Now the president could be put in position to be at oughts with them. A dozen women made sexual accusations against the president. Jessica lee spoke to Anderson Cooper in october of last year and said that donald trump groped her during a flight back in the 1980s. Listen to this. The president as you remember said all of those women, about a dozen or so were lying. I actually think the election of donald trump has a lot to do with this empowerment of women and women speaking out that we are seeing in the last year. Women could have either seen his election as a defeat for women who spoke out about Sexual Harassment, but instead i think they saw it as a call to action and the strength in numbers are turning it into a watershed moment and changing the culture. Today i saw that the chair of the Democratic Party of florida was accused this morning of inappropriate behavior and had resigned by midmorning. I think its powerful when people in your own party call you out. Its what the democrats did in florida. All the ones running for governor. The guy was gone in a matter of hours. With 2kru6donald trump you see hypocrisy, politics and stupidity. Its hypocritical of him to call out al franken and not call out roy moore. It is politics because he doesnt want to go against his base in alabama and its stupid because as rick said, the only thing it does is highlight his own baggage on this issue. He not only said that all these women coming out last year during the campaign were lying, but he also said he was going to File Lawsuits against them. Listen to this. This is what he said last october. Every woman lied when they came forward to hurt my campaign. Total fabrication. The events never happened. Never. All of these liars will be sued after the election is over. So no lawsuits yet have been filed. Its doubtful any will be filed. Thats correct because he opened himself up to defamation calling these women liars. Its interesting comments about that seems to have become a guide book for other people who are accused. Roy moore has not attacked the credibility of the victim. They have gone after the alleged victim and the attorney, Gloria Allred and her connections to roev wade. They are not actually coming into fruition and what happens when you attack the credibility of the victim means that you renew the statute of limitations and say the criminal thing expired, but i invite scrutiny in terms of defamation or legal liability. For has been more than a year. I dont think the president of the United States is going to file a lawsuit. He won the election and that issue has been resolved and the American Public came down in his favor. I dont think he needs a court of law to do the same. As anna was saying, this is a tumultuous time. You are seeing this in washington, d. C. And not just hollywood. I was interviewed by tmz the other day. Here in washington. I wonder what they are looking into. This is a real big problem. I look at the other side. This is also an opportunity for men in particular to take a step back and think about their behavior. Period. It only takes a few of your colleagues and friends losing positions and being outed, if you will, to begin to change behavior. Maybe in the end there could be a good message out of this that we will start to see. What we have been talking about, the thing that is so dangerous is lets not muck up an already tough moment by making some sort of partisan fight. Hypocrisy is certainly in the air. There is no question about that. To your point which is people in their own parties need to reckon with this behavior. A lot of whats going on about rethinking the reaction to bill clinton is part of that. Democrats have to reckon with their defensiveness of him and the way he treated women. I was called a prude because this was get over it. It has nothing to do with your job. Whether its true or not doesnt matter. Much of it was very true. On this issue of bill clinton, i want to play a clip. This is Kirstin Gillibrand of new york who is a democrat and was questioned as far as her attitude with bill clinton and the Monica Lewinsky scandal. Listen to this exchange she had with the new york times. Is it your view that president clinton should have stepped down at that time given the allegations . Yes. I think that is the appropriate response, but i think things have changed today and under those circumstances there should be a very different reaction. In light of this conversation we should have a very different conversation about President Trump and a very different conversation about allegations against him. Anna, go ahead. That was a very honest, blunt assessment and answer by Kirstin Gillibrand and a question that a lot of us are asking ourselves about bill clinton. Did we go too easy on him . Did people go too hard on his accusers. Was there victim shaming when that happened . A lot of things changed in the past 20 years and changed in the past 20 months. A lot has changed regarding Sexual Harassment in 20 weeks and 20 days. Its a very different panorama today than then. I think this is an opportunity for bill clinton to change his legacy. This is going to be part of his obituary and his legate and part of his history. I think this is a time for him to reflect on how that was treat and what he did. He might want to consider doing a public apology. A little reflection and having wise words for people and talking about why what he did was wrong. I think he should take the opportunity right now to apologize to the women. They were dragged through the mud back in the day. I agree. Obviously Monica Lewinsky in particular carrying a Scarlet Letter that has not been imprinted on bill clinton. We talk about the notion of apology. The court of Public Opinion reigns here. If you look at the track record, those who have made apologies and the consequences that have come down upon them through threats of being expelled if they take the senate or al franken in terms of the Ethics Committee or louis ck and the list goes on and on. We are incentivizing people to come forward, we are probably deincentivizing them to be contrite and show remorse and have an opinion on it. In doing so, the playbook is set. Roy moore denying whats happened and donald trump doing the same thing. In the court of Public Opinion, we will have the chance of credibility. Let me say this. 93yearold George Herbert walker bush who is wheelchair bound and frail is apologizing for having touched women on the rear end. I think bill clinton can do it because he can make a difference in the debate. It would be good for him and bring closure to the women. I agree. The hypocrisy. I agree. The point is not that they should not apologize or admit to poor conduct, they should do so. It is a joint effort to change society and if the idea is to allege, that wouldnt work in a court of law. They would have to have a solution or an actual out come. For me i think society will have a court of Public Opinion and the allegation and the apology as well as moving beyond that if its going to be vilification continued, they havent done much with the apology. With what rick was saying, this was a moment for men and all different realms of life. To take stock and this is not the first time it came up. With the 80s and 90s, they had another moment. Its not now you will have to be careful as a guy or you will be unjustly accused, but women are being believed. And so they are feeling more confident about coming forward and in greater numbers. Immediately al franken said i apologize and its not what roy moore is saying. I think its partly about truly getting it instead of thinking about a new realm of training. Its understanding what is this behavior . Its not how to be careful. Its called proper moral behavior. That could be a good thing that comes out of it. A lot more developing right now. You wanted more information which was understandable. Since then at least three more women have come forward. We have also learned from a former mall employee in alabama that moore was on a socalled mall watch list for approaching teenage girls. Is this enough information for you now . Wolf, i think its very important for your viewers to be reminded that this is a very, very difficult time for the state of alabama and our people. As these allegations continue to mount and continue to be vetted and investigated not just by cnn and other major networks, but by the team of alabama themselves. I believe that that will put them in a much stronger position to make a more well informed decision when the time comes for them to vote. Have you decided whether you believe he should step down or stay in the race . Well, i still am not sure whether or not the allegations are true. I know they are very damning and damaging. The thing thats the most frustrating and most disappointing is that these allegations reflect poorly on judge moore and our state as a whole because judge moore is a republican bearer in the senate race. Because of that for more than a week it put alabama in a difficult position and a very damaging position nationwide as far as the spotlight is concerned. Thats not something we are very proud of. It sounds as if you might be relieved if he were to step down. Am i drawing the wrong conclusion . Its important to note when our people had their voices heard and their votes are counted, it will be clear how they process this information and what they believe should take place and who needs to represent us in washington, d. C. To fulfill the remaining time in senator sessions unexpired term. Mitch mcconnells office is getting ready to send a memo on the options Going Forward in alabama including Legal Options that prevent the run off election from taking place or keeping moore from being seated. Whats your reaction when you hear that . Wolf, i dont think any of those things are even worth discussing because we have shown in the past and we continue to show now that we know how to manage our elections and know how to ensure that we have safe and secure elections with integrity and credibility. Thats what we do in the office of the secretary of state. Thats what the governor has guaranteed. Our state law does not allow for a substitute candidate to be provided as a democrat or a republican. The state party said they continue to support judge moore in a formal way and i think its clear that on december 12th, the two candidates that are there, judge roy moore and the lawyer, doug jones will be the candidates for the people of alabama to consider. There could be a write in candidate, right . Most definitely. We are trying to educate the voters in the state of alabama and will have information prepared on december 12th. If they want to write in a candidate other than the two on the ballot, they will know where to do it and how to do it and to make sure their vote is counted if they submit that name. You are a republican and i want to ask about others in your Party Leaders in the party. What they are saying. First, this is the House Speaker, paul ryan. Listen to this. He should step aside. Number one, the allegations are credib credible. Number two, if he cares about the values and the people he claims to care about, he should step aside. President trumps daughter and adviser ivanka trump said as well and i will put it up, there is a special place in hell for people who prey on children. I have yet to see a valid explanation and have no reason to doubt the victimss accounts. Whats your reaction when you hear those republicans, the daughter of the president , the House Speaker and the Senate Majority letter for that matter when they offer those opinions . Wolf, i think those individuals and all individuals are entitled to their own opinions about what is occurringmeoccurrin occurring. I think one of the things your viewers would know is that the people of alabama are not going to support a candidate that has been identified as committing these crimes against women at any time in his life. Crimes that have been proven to be true that this individual would have been convicted of and still support that individual for elected office in any level in our state. The thing that is unfortunate about what occurred in this incidence, we dont know whether or not the allegations are true. There doesnt appear to be enough time to have them properly vetted. People have to take the information ask try to process it and hear the responses that are given and still determine whether or not they want to support judge moore or whether they want to support another candidate, either the Democrat Doug Jones or a write in candidate of their choice. The information that continues to come in from the national commentators is not helping to clear up the situation. In many ways it intended to cloud up the situation. That has been very difficult. Information continues to come up about what people can do to influence our elections or how ballot position can change or an election can be stalled or new names can be introduced. None of those things are true. Thats very disturbing. Its not Just National commentators. This is the speaker of the house and the Senate Majority letter. These are leaders that are strongly speaking out. Yes, sir. There position is to try to save the seat and make sure the republican majority is preserved, but that is only going to happen if judge roy moore wins the election. The special counsel Robert Mueller is turning up the heat on the Trump Campaign and issued a subpoena for more russiarelated documents because he doesnt think they turned over everything. They are asking Jared Kushner to turn over more documents as well. It shows kushner receive and forwarded documents about wikileaks and a russian backdoor overture and iner invites that were not included in the batch he turned over to the committee and they want to know why and if there is anything he left out. Laura, what do you make of the new subpoena from Robert Mueller and the implication of kushners failing to turn over the other emails to the Senate Judiciary committee. Im surprised the record keeps skipping. Why is there a trickling down of information about whether or not you handed over comprehensive information. On the other hand, one of the greatest things about the Mueller Probe is the grand jury. They have subpoena power. The purpose is to be able to get information and get the documents and get witnesses to come in and testify. As you are wrapping up any grand jury investigation, you want to capitalize the availability of that subpoena power. This could be a clean up measure to say i want to make sure we are capitalizing and get everything we need. It may or may not be a reflection of everything they have. It may more be they want to get the subpoena power to be comprehensive. This is a pattern that invites so much scrutiny and speculation and frankly this selective amnesia that keeps happening in light of the controversies, wikileaks this past week with donald trump jr. , this is not a novel concept. You think wikileaks was a problem a couple of days ago. I remember this conversation in my own life. And surprisingly failed to do so. I have the letter from the chairman of the ranking democrat on the Senate Judiciary committee. People you know, Chuck Grassley is the republican and Dianne Feinstein and the democrat. Its a tough letter to the lawyer representing Jared Kushner. Other parties have produced documents concerning a russianbacked or overture or dinner invite that mr. Kushner also forwarded and they say why department you forward them . His lawyer maintains they produced everything. I dont understand it. It makes all the sense in the world if you are under this type of investigation. Hes a seasoned guy and turning more over as opposed to less. I just dont get it. It does raise suspicions that its not the first time there have been at least three or four or five other cases that are supposed to be handed over. Eventually they were handed over. What we know is there is a revelation after the administration said nothing here, no collusion or cooperation. Russia was nothing. That thing . Thats nothing. Thats nothing either. The president of the United States said its a joke. Where is the pressure down the line to be transparent. These are fine lawyers. And there could be bad clients who are not putting over what they ought to. Its interesting because the senator just issued another statement saying President Trump has a blind spot when it comes to russia and cant figure out why. Can you . Maybe because they have something on him . It leads to speculation and the constant and consistent way that donald trump deals with russia and these investigations leads to questions that are lead to be answered. They are trying to work with trump. Trump doesnt have a blind spot when it comes to russia, but his relatives. Im not sure that in any other pedestrian, they would be allowed to stay . The inner circle of the white house with the amount of lapses, lies, lack of disclosure that this young man has exhibited. He is either lying or has the worst case of early on set memory loss that we have seen in history. He should go to a doctor. I believe that donald trump is acting the way he is because i dont believe he believes there was any russian collusion. I dont think he was involved in any of it and probably knew nothing about it. For him to react this way given his reactions on other things whether they were true or not in this case i think he feels he did nothing wrong. He knew nothing about it and he is reacting accordingly. I think the opposite. If there was something there, i dont think he would be. You think when he called out on russia to look out for the 33,000 emails on hillary that was just a coincidence . If i was colluding with the rugs, the last thing i would be talking about is colluding with the russians. That would still be inappropriate because there was a crime close to him. I accept that as a possibility, but he doesnt see it that way. Thats not going to placate them. When you me not to picture an elephant, the only thing i can picture is elephant. I invite scrutiny and speculation and the magnifying glass on the inner circle of trump gets bigger and bigger because of self inflicted wounds. A lot of people do and it would be so silly if one were involved in collusion. You made the logic of someone who is an a criminal. Muellers team and special counsel, the entire job is to find out about the moments of stupidity. The president s personal attorney saying this. The president is paying his own legal fees and doesnt want to deplete any funds that may be available to assist current and former staffers. They are working with the department of ethics to create a lawful mechanism for payment of fees for the staffers that is expected to be operational shortly. That statement from the president s lawyer. Everybody stand by. Much more happening including fireworks on capitol hill. How many times do we do this before we learn this . The finance committee advanced the plan and not because of plans erupting into a shouting match. He accused republicans are only trying to cut tax for the rich. That was the last straw for republican senator, orrin hatch. I think it would be nice just tonight before we go home to acknowledge this tax cut really is not for the middle class. Its for the rich. The whole thing about higher wages is a good selling point, but companies dont just give away higher wages. They just dont because they have more money. Corporations are sitting on a lot of prafts. I dont see wages going up. Spare us the bank shots. Spare us the sarcasm and the sat ire. Im going to say to you that i come from the poor people. I have been here working my whole stinking career. For people who dont have a chance. I really recent anybody saying im just doing this for the rich. Give me a break. I think you guys play that all the time and it gets told. Frankly you ought to quit it. The public believes it. Im getting sick and tired of it. True, its a nice political play. Lets bring in our congressional reporter to talk about this tax plan that just passed the committee in the senate. Its senator brown, correct . Its two things that are bad for the middle class. It repeals the individual mandate and the official score keepers in congress, it gets a little complicated and scored that as a tax increase on the lowest income americans in the country. The reason for that is if you take away the requirement that people have health insurance, they wont be getting it. They will see a tax increase. Republicans argue thats a major problem because if they are not getting tax, they are choosing not to have health insurance, thats not really a tax increase. The other thing is a lot of tax cuts sunset for the middle class. They are never going to actually let the tax cuts expire, but democrats say unless you necessary power, how do you know . They sunset or lapse after 10 years, but a lot of the big taxes for corporations continue indefinitely. Thats a big issue. Thanks very much for that. And secondarily, are they doing it for actual business or pretending they are going for business and using it for private travel or fundraising or something else. In the case of secretary zinke, take a lk at the numbers, three charter flights, several use of government aircraft, so far the cost is close to 72,000 taxpayer money. He has been very bullish saying look, its bs o quote him, and to listen to his explanation how he gets this cleared. Every time i travel, i submit the travel plan to the Ethics Department that evaluates it line by line to make sure that im above the law. And i follow the law. So thats the end of september. Hes saying every time he travels its well documented.
