Bursts of gunfire slowing down crews, fighting dozens of those fires. Meantime, Police Responding with smoke, tear gas, bean bags, and more than 80 arrests. Now local Law Enforcement and the National Guard are stepping up their efforts to try and contain the violence. Mike tobin has been on the ground in ferguson, missouri, since last night. He is there now with the very latest. Mike, what are things looking like today . Not great by your background. No. Its pretty sad. Lots of destruction, and in the face of all of this destruction, the National Guard troops are deployed to the ferguson area. That in the face of criticism that we get from Business Owners that during all of the mayhem last night, you did see some police, but you didnt see the guardsmen on the frontline. More of them are coming. Keep in mind largely what the guardsmen do is sort of a background role. Theyll do things like security and that frees up the Police Officers to do what they have specifically trained to do. All right. We also heard from Michael Browns family through their attorney today. What did he have to say . Well, the representatives of the brown family say that they will continue to press this fight, and they turn their criticism on the testimony of officer Darren Wilson. Also, the county prosecutor and his decision to use a grand jury in this process. In their opinion that protected officer wilson from crossexamination. You had to scratch your head kind of like we all did to say when is the prosecutor going to crossexamine the killer of an unarmed person . A first year law student would have did a better job of crossexamining a killer of an unarmed person that the Prosecutors Office did. Also today, we had the county Prosecutors Office answering the criticism that the announcement was made late last night. Trying to make it an easy transition into all of the mayhem. The county Prosecutors Office says a decision was made for the 8 00 p. M. Local time announcement to give schoolchildren time to get home safe away from the trouble, give Business Owners time to shut down and make decisions about how they will protect their places of business. Also, the county pressures office said time for the media to set up and convey the message. Gretchen. Very interesting. Live on the ground, thank you so much. Were learning more about officer wilsons side of the story. Prosecutors in missouri releasing his testimony to the grand jury, describing his encounter with michael brown. Here is an excerpt. Wilson said brown looktd up at him and he had the most intense aggressive face. The only way i can describe it, it looks like a demon. Thats how angry he looked. He comes back towards me again with his hands up. Were getting a look at this new picture as well of wilson and others taken shortly after the encounter. As can you see, there is a wrus on wilsons face about two inches long. Eric guster is a criminal defense attorney and my guest on all of this. Good to see you. Good to see you. To parse this all down as to why no indictment was handed up in this case, how do you see it . I see it as a problem on the prosecutor because the prosecutor should have, number one, recused himself and allowed a special prosecutor to take this case. Why . Well, he had a vested interest in this case. Why . Mccullough knew Darren Wilson. He worked with this Police Officer, and he prosecuted cases with this Police Officer. When you have someone who works closely with someone, they should not be allowed to prosecute them. Especially Something Like this. That wouldnt change any of the evidence, would it . It could change how the case was presented because everything in a trial is about presentation. I read this information last night, and those were softball questions. Is this a prosecutors duty . I have interviewed other attorneys about this leading up to it. Is it a prosecutors duty to actually go in and present a case or was it smart for this particular prosecutor to just lay out all the evidence for the grand jury to be able to decide knowing that he would be under high scrutiny to make sure all the people were included. Thats why special prosecutors should have been assigned because he did not want to remove himself. He asked the governor to remove him. They were playing politics with this case. Mccullough should have stepped down, allowed a special prosecutor to be asigned to this case, and allow someone with no interest to present this case. Is that your only problem with it, the fact that you dont believe he asked officer Darren Wilson on the stand tough enough questions, and would that have been enough to have a grand jury see this differently . There were witnesses who came in who they seem to rely on just as well as the officers testimony . I believe wilson should have been charged for information and allowed for preliminary hearing. I saw everything, and in this case just like you know if you read something on paper, its about the inflexion of the persons voice. Its about how they present this evidence, how strongly they ask questions to get the answers that theyre looking for. They didnt even have to release all of this evidence. Its not typical in a grand jury situation, as you know, to release it. Im not sure that there would be a different conclusion. However, its about transparency and the ability for us and the community of ferguson who is suffering through this to see everything for themselves. We dont know how those questions were asked. We dont know how strongly they were asked, how strongly it was pressed, and from what i read last night, i was up late reading the transcript last night, they were softball questions to wilson. That is your opinion, and criminal defense attorney. Chief washington correspondent james rosen joins us live with this interesting tidbit to this whole story. Whats going to happen with this investigation, james . Gretchen, good afternoon. The grand jury verdict that served as the trigger for last nights spasm of violence in ferguson was the outcome of an investigation by the authorities of st. Louis county. For months a much quieter probe has been under water launched by attorney general eric holder. When i visited ferguson two weeks ago, i promised that the United States department of justice would continue to stand with the people there long after the National Headlines had faded. Today with our investigation into the Ferguson Police department and our Reform Efforts in st. Louis county, were taking significant steps towards keeping that promise. 40 fbi agents canvassed the neighborhood in question, interviewing witnesses, but the attorney general stated explicitly that that federal probe was conducted cooperatively with the counties. Not on a parallel track. It was always intended to supplement not suplant it. A fact that makes it unlikely that the federal probe will arrive at an outcome that is different from the counties. In addition, the feds interveeb in this case by commissioning a second autopsy of Michael Browns corps performed by a physician from the defense department. D. O. J. Launched the criminal probe we just discussed. Justice has also launched a separate investigation examine whenning the Ferguson Police department has exhibited a pattern or practice of unlawful conduct, a probe whose county yut come the attorney general tended prejudge when i told an audience that wholesale change would be coming to that department. Doj has initiated and the st. Louis county Police Department has accepted a reform effort for that Department Led by Community Policing instructors. There was one other federal intervention that took place last night, by the way, when that ban was lifted at 3 30 a. M. Central standard time. Gretchen. All right, james. Theres no doubt, theres no doubt, that the new defense secretary wants to close gitmo, right . Well, thats a litmus test. I dont think theyll hire anyone thats not on this side of that. Did simon just say its time for a reet set button . Is that the plan . I said reboot. Reboot. Yeah. Listen, this position this is an embarrassment. Were at war. We have been at war for the last six years, and that war is escalating, and, unfortunately, the revolving door at the pentagon is a tragic situation. Theyre changing that slot out like the drummer in spinal tap, and they cant keep doing this. We need stability in our Foreign Policy, and, yeah, chuck hagel is gone because the secretary of defense, he needs to sign on the dotted line literally that they only release gitmo prisoners if they dont pose a threat to our country. Right. That aint happening under chuck hagel. The real story behind all of this is apparently he did not want to sign off on these, and he begrudgingly he put it off for the last couple of months, simon. He begrudgingly let four or five of them be released a couple of weeks ago. Going forward, im not so sure he was going to be on the same page as the president , and that may have been the final thing for him. Yeah. I would be surprised if that was a major part of what happened given all the other issues in front of us. Remember, twothirds of all the detainees at gitmo were released by george bush. There were there are processes in place that are interagency, that has already cleared another 70. Were only down to 140 or so folks left there. Right. And so i think that the point all im saying is i think there was other defense secretaries that let folks go and clearly there was some tussle here. He wasnt yet. He does need congress to do this. However, lets face it, he has been asking congress for six years. They havent done what he said. He is frustrated with him. Based on simon and other democrats who rationalize the president s actions on immigration last week, i guessed the case has been made that the president could sign the dotted line and he can close down gitmo. I would love to see him try it. Is t should be interesting. We will have to wait and see. Could be just around the corner. Simon, larry, thank you. He is pushing his team very hard raising the issue weekly to make sure gitmo gets done. For sure the president s next pick for defense secretary will be someone who also wants it closed. That was hagels file nail in the coffin. Will the president be willing to engage in the huge political fight that will no doubt ensue . Remember, it was congress specifically the House Armed Services committee back in 2010 that rejected the administrations plan to bring gitmo detainees here to domestic prorz prisons. Or will the president just do an endaround again like immigration, and if he uses executive action to close gitmo, where will all the detainees go . The resid vichl rate for released gitmo detainees is grim. Some 30 go back to being terrorists. With 142 prisoners left at gitmo right now, what does that mean for the safety of our nation for the future . Coming up on the real story, where is the National Guard . Remember . National guard is supposed to be called in by the governor in missouri to assist local Law Enforcement in ferguson. Local officials and even some in nixons own administration are asking serious questions about the guards presence or lack thereof during last nightschao. The lawabiding sid zens, and the st. Louis region have a right to ask, this governor to answer some questions. Who is right here . The Lieutenant Governor questioning where the heck is the National Guard, or Governor Nixon not sending them in . I think in the story it takes it one step further. You have to go back, and peter kinder told the story earlier today on my radio show, and that is he got up this morning, and he heard a message from the ferguson mayor left on his voice mail, and it was the ferguson mayor pleading with somebody, anybody, can you get a message to the governor . We need the National Guard support. Im in the backyard of my house watching my town burn. They then could not get the g on the phone. The National Guard was there. It was ready to go. It was deployed. It was in the city of st. Louis. Had he never got the order from the governor to engage. Youre there. What are you finding out about it why did the governor not do it . Its the 64,000 question. Then we were talking to some of the people involved in this, and they speculate that the Justice Department demanded, ordered, questioned, leaned on, Governor Nixon and said do not engage with the National Guard. So the question Governor Nixon has to answer is why . Why would you not engage the National Guard . The Police Needed it. There was clearly they were overmatched. They needed help. They needed more assets. Why, governor . Why did you not order the National Guard . Did the federal government and the Justice Department tell you for them to stand down . Why would the Justice Department in your mind do that . Its a great question. Maybe they didnt like the optics. Maybe they didnt like the idea of the National Guard. Maybe racheting it up. Maybe it was a question over property. They said let the property burn. Well take people over property. Let the businesses go. Its the exact same strategy they used back in october. This ferguson market, the Police Watched as it was looted in august. Now the National Guard watches as sams market closed down. Well show you the video right there. Ferguson market and liquor. Its emotional for a lot of people in st. Louis. I have lived in st. Louis 16 years, and i this is the longest i have ever lived anywhere, and the people of st. Louis take things personally, and were all crushed, and were all upset, and when i went to bed last night, i shed a tear. Im not embarrassed to say. I cried. When i saw that ferguson market go down, i cried myself to sleep. It was just so sad that we do not have the leaders that will help us get through this. Police say they eventually nabbed him outside one of the terminals. Michael browns Family Holding a News Conference with the reverend al that wereson rejecting the process that led to the grand jurys decision not to indict Police Officer Darren Wilson and demanding a change in the law. All of us here, civil rights leaders to say, that there is another way other than to explode. Many of us are condemned, but we are the vehicle to try and address these things. Yet, were considered incindiary, which in many ways were trying to show the constructive way for justice because after you burn stuff down, then what . Thats not going to get us justice. Lets bring in richard fouler, radio show host of the richard fouler show, who is live in ferguson today. Richard, al sharpton seemed to be saying a good message today that the way to get your message, you know, out is to not burn stuff down. What did you think . I agree there. I think the way to get your message out is peaceful. Not violent protesting. I got to tell you, this is not about the naacp or the National Action network or the kkk. This is about really how we find justice for michael brown, and, number two, how we rebuild and restore confidence in the system here in ferguson, missouri. Thats what we saw last night. Thats why the anger was there. I dont think we can judge those protesters until we understand, grech knowtche gretchen, how had he feel about a system that did them wrong. Does it help when somebody like al sharpton comes to the scene and says that, you know, you cant believe in this grand jury, that this prosecutor was wrong in the way that he chose to lead the grand jury that, they should have had a special prosecutor . I mean, what does that say about the legal system and the Justice System in this country that weve had for more than 200 years . Well, i got to tell you, this is not about al sharpton. If you look at the testimony and the evidence done from yesterday, i got a hands to read over some of it last night, and its very obvious that this prosecutor made a number of blunders. I mean, the first blunder of them all is you release a verdict at 9 00 at night on a week that he should have released it in the morning time. Beyond that, he never crossexamined the Police Officer. Then there wasnt this was a level prosecution whatsoever. Speaking of the timing, because there was a lot of talk about why would it come out at 8 00 p. M. Central time, which was ferguson time, 9 00 p. M. Eastern. A spokesperson now for the st. Louis county Prosecutors Office is saying this. We coordinated with Law Enforcement, gave schools time to get all Children Home in a safe location, gave businesses time to make a decision regarding their employees safety, prepare their statement, and then made the announcement. We also had to give media time to set up. Is that good enough for you, richard . Its not good enough. The simple fact is this verdict was rendered. The grand jury made a decision at 2 00. Schools and a lot of municipalities here in st. Louis were already closed. At the end of the day when you have a verdict released at nighttime in the deadness of night, what do you expect to happen . Theres anger. Anger met with force. You think that the timing of the day would have been any different . You dont think we would have seen anger at 2 00 p. M. . I absolutely do. We would have saw anger, but you wouldnt see the excessive violence that we saw, the Police Reaction that you saw, the tear gas, the smoke canisters. That would not have happened in the daylight. I think everybody agrees there. Serious blunder by the prosecutor. It might have continued into the night hours. I dont know if everybody agrees or not. Will you feel the same way about all of this if eric holders Justice Department investigation comes back with the exact same finding . Well, lisp, i think we have to wait and see. The good news for the brown family is that there is another investigation pending, but we all know that investigation is going to have a higher board to prove that there was indeed a civil rights violation. Well have to wait and see on that lens. Theres no telling what could happen there. Do you think there will be the same reaction . Will there be the same reaction if eric holders same investigation comes back with the same finding . Theres no telling. I think the people here in ferguson i think all across the country have lost confidence in our judicial system, whether its federal, whether its local, whether its state. You saw thousands of protesters from seattle to new york city saying we have lost confidence in the system. This is not the first time. This is not the second time. This is not the third time. Im sad to say it, but i dont think its going to be the last time that were going to see a Justice System fail the people of ferguson in this country. I think it will be interesting if eric holder who came there and showed his support for the brown family, if his investigation comes back with the same exact finding. That will be an interesting day. Chief White House Correspondent ed henry is live for us on the north lawn. The president called for calm last night. It was very interesting to watch that because at the same time on the other half of the tv screens, you were seeing all the violence. Were the people actually listening to president obama . Gretchen, youre so right. It didnt seem like a lot of people were listening. I was in the front row in the Briefing Room listening to the president. I didnt see that split screen. Neither did he. Youre right. When you look at these images, he is rying to say very positive words about how the nation needs to heal, come together, despite the division. Shops being burned down. Then there was Something Else that was interesting about what the president actually said. Listen. We are a nation built on the rule of law. We have to accept this decision of the grand jurys to make. There are americans who agree with it. There are americans who are deeply disappointed, even angry. As you can imagine republicans pounced on the president saying this is a nation founded on the rule of law since it was just a few days ago that he came out with these president ial memos that republicans on the hill believe went around Immigration Law to push through the president s agenda, gretchen. Yeah. That was an interesting thing to pick up on. The president heading out to continue to sell his immigration action. How hard this is a loaded question. How hard of a sell is that going to be . 48 saying no. I think what that shows more than anything is theres still division, and the president is going to have a lot of work to do. The white house says what do you want us to do today is focus on the economic benefits of his plan. As you know, the conservative Heritage Foundation has put out a paper suggesting that if more Illegal Immigrants become citizens, you may end up spending a lot of taxpayer money for government benefits that might also harm the economy. Thought they didnt have the capacity to do that, but they have the capacity to pay out all these bonuses. What we doemt know is whether irs employees who are behind in their taxes, who are delinquent in their taxes, according to the rules that he appointed to, those folks would still be getting bonuses. I have a question into the irs to find out the actual facts there, whether theyre going to make a special exception for them, but as of right now, judging by the email he sent to his employees yesterday, if im an irs employee, and i filed my tax return, but i havent paid my tacks, im still eligible for a bonus. Thats a real eye opener. What about the lois lerner situation . Remember, they said they just lost them, first of all. They make an accounting of how much they spend searching the emails. They said, hey, youre making us go through all the investigation, youre wasting our money. We could be doing other things with this money if you werent forcing us to investigate. Number two, is that they said they didnt have the resources to build the backup system in order to store all these emails, which is forcing us to go through all of this and try to find the emails. Now we find out theyre paying tens of millions of dollars, which is way more than either the backup system or the search time theyre paying for costs. No, its all a question of priorities there. They must think were really stupid. Anyway, the dew point of veterans fairs finally firing the head of its phoenix medical center. She was sharon helman. The man in the vehicle calling it a miracle. Things beginning to thaw out around buffalo, new york, after a series of recordbreaking storms dumping as much as seven feet of snow. Now flood warnings across five counties coming to a close in just a few hours, but for many people it could be a long time before things truly get back to normal. Reporter yeah, and lets face it buffalo is pretty familiar with snow but this is unprecedented. The folks here think they may have gotten 8 feet in that storm last week. A lot of heavy, thick stuff was no match for these glass ceilings. Let me take you back into this other room, this massive greenhouse. Just take a look at how badly this was damaged. We have three acres of greenhouses here that were damaged or destroyed. Some of these buildings were 30 to 40 years old, survived many storms. This one had just been refurbished six years ago but that glass no match for the snow. One of the owners of the Family Business already had thousands of seedlings and cuttings and small plants starting to grow in this series of greenhouses that were wiped out, all those plants were, many of them were, along with the facilities that must be completely rebuilt. This greenhouse is a total loss. The poles are all built and the structure above is all bent. Some of the greenhouses theres a few that have just some bent gutters. Well save a little space but maybe 10 of what we had we can resurrect out of this storm. Reporter and the damages, mark tells us, are in the millions of dollars, gretchen. Its so unfortunate.
