And then there is this on going back and forth over where we stand with getting the president out of office with only 12 days to go. Theres the impeachment process, seems like an uphill battle. The 25th amendment process, seems like a nonstarter as far as the Vice President has to say. Where does this go from here . Were on that, talking to a former confidant top security official of the United States, rick granel. Im neil cavuto with your world. First from john roberts and the confirmation from the president that he will not go to the inauguration. He is the fourth president to consider and decide on doing just that. John has covered all previous three that did the exact same thing. See you, my friend. Yeah, i like good for being 150 years. Good afternoon, neil. No surprise to me that the president has decided not to go to the inauguration. He made it official in a tweet this morning. To all of those that asked, i wont be going to the inauguration january 20th. There you go. Make it official there. As you mentioned, hes the fourth president. The others were the father and some duo of john adams and John Quincy Adams and Andrew Johnson in 1969 that was unsaysed by grants win and having been impeached himself that he decided not to attend. And talk of impeachment or legal exposure gains a little traction here in washington. The president acknowledging in a video last night that the election is over and that its now time for the white house to move toward an orderly transition to the next administration. Listen here. Now congress has certified the results. A new administration will be inaugurated january 20th. My focus now turns to ensuring a smooth, order through transition of power. Nancy pelosi, the speaker of the house on the left there, has been threatening impeachment if mike pence did not invoke the 25th amendment to remove the president from power after the Vice President s office made it clear he was not even going to entertain that. Shes now saying that the president will be impeached if he doesnt immediately resign, which could begin as early as monday. Heres what the speaker said about it. Yesterday the president of the United States i believe cited an armed insurrection against america. A very dangerous person that should not continue in office. This is urgent. This is emergency of the highest magnitude. The other question here is if there is enough republican senators that would sign on to a potential conviction in the senate. Were getting an indication that theres a few at least. Would you have the 2 3s majority with the open seat now in georgia, 66 required in order to convict the president. Its unclear whether theres that number of republicans that would sign on to a conviction. An also an issue in time. Can you get it done before the 20th. Doesnt seem like theres an appetite to try the president after he leaves office. Defections in the administration continued last night. The education secretary betsy devos joining elaine chao saying she will step down as a result of what happened wednesday. A scathing condemnation of the president saying the behavior was unconscionable for our country. No mistaking the impact the president s rhetoric had on the situation and its the Inflection Point for me. Nancy pelosi says that she called the chairman of the joint chiefs of staff, mark milley earlier today to inquire about the status of the Nuclear Forces and whether or not President Trump would be able to launch a nuclear attack. The Chairmans Office said that the answer to her question regarding the process of Nuclear Command authority, you know, neil, its getting to the point where it seems one side is kind of trying to make this as bad as they possibly can over the next 11 days. But im hearing from white house staff that what theyre trying to do is just get through the next 11 days to bring this plane in for a landing. Make a smooth transition to the biden administration. Well see if that is possible. Yeah. Plant the seeds of a nuclear war. Its getting crazy now. Thanks, john roberts. Good job. So young all of these centuries here. Touche. Meantime here, i do want to go to the invite that is out there from the president elect to the Vice President that he is welcome at his inauguration. But joe biden is very happy to hear at least in thoughts that donald trump wont be at the inauguration. Peter doocy is here to sort this out. Peter . Neil, i was just in with the president elect. He said hes about too hop on a call with nancy pelosi and talk about his agenda and whatever else Top Democrats want to talk about. If its the impeachment, he says he trusts the house. He said hes glad his predecessor isnt coming. I was told on the way over here that he indicated he wasnt going to show up at the inauguration. One of the few things he and i agreed on. Its a good thing him not showing up. Biden has long said he doesnt think the country can survive another four eyes of donald trump and he ran to unite the country. Something that he thinks just got easier after angry Trump Supporters rioted their way into the capitol. I think it makes my job easier, quite frankly. Ive had a number of my republican colleagues, former colleagues, i used to serve in the senate a long time, call me. They are many of them are outraged and disappointed and embarrassed and mortified by the president s conduct as i am. As democrats are. I think i have said from the beginning and i have not changed my view, my overarching objective is to unify this country. We must unify the country. Bill and i asked the president elect on his way out of the theater about the newly announced covid19 plan. If he wants to release all available doses as opposed to right now where some are held back for second shots, how he can guarantee that everybody could get their second shot on time. He said he will talk about that thursday. Neil . Neil all right. Good job squeezing in questions again, peter doocy. John can here from quinnipiac on some of these measures. Democrats moving to impeachment or the 25th amendment, anything to get the president out of office right now. They seem like uphill battles to me. How would you define them . Yeah, its impossible. You can do the 25th amendment, but the Vice President said he wouldnt sign on. Neil, lets start here. If there was ever a president in our day other than nixon that deserved to be impeached and im a republican, it is donald trump. He should be impeached and convicted for what he did. If it happened a week after the election, i think there would be they would impeach him. He might get convicted. With 12 days to go no inauguration day, you would have to swear out articles and have them vote on that and have a trial in the senate. Im surprised at this point that the president elect doesnt come out and say, people, lets take a breath here and lets make a bad situation worse. Neil if you think about it, john, biden all but did by saying that is up to the house, the senate. Im moving, getting prepared for the 20th. Let me ask you about the 25th amendment thing. That involves the Vice President working with a majority of the cabinet to say we dont think the president is fit for office. Isnt that usually assigned for a president that might be doing under anesthesia for an operation or a situation where his health is in peril or could be temporarily idled. Not for Something Like this or am i wrong . Im smiling because you use the word usually. When it comes to the 25th amendment, we dont have a data set to form what is usual. Youre right. The 25th amendment has been used when the president has gone under for surgery, for anesthesia or whatever. Youre right. Such an unbelievable occasion if all of a sudden it were to happen this time. So theres no usual. Yes, usually used for that. Look, i think theres this is the first time that its been talked about in the case of a president. This is the first time in modern times its even been contemplated. Neil on the impeachment effort, nancy pelosi wants to do that. You have to have a lot of senators of both parties pursuing it in the senate. How likely is that . Again, given that time period, i mean, when they talk about speeding and impeachment process, that is not something generally our founders envision. Its not like, you know, a bullet, lets rocket through this . Yeah, lets switch from i always tell my students, this is not a Political Science course. Quinnipiac law school, my common law courses. Shes making a mistake. Youre not going to get an impeachment. I know you have between now to force something and whatever tonight and a lot of people on fox news talking about impeachment. We wont have an impeachment. I can tell you that right now. What youll see from this is from the republican standpoint, theyre doing the party a favor. Theyre making donald trump unviabliu unviable as a political candidate. They dont have to worry about that. Donald trump needed his base, but he also needed people that sort of held their nose and went to the voting booth and voted for themed. He lost those people. Bill your audio is breaking up here. I get your point. By the way, were going to raise that with his former top intelligence adviser, ric grenell. The pressure has been pick on the president right now to go ahead and leave. Hes of the opinion that this is getting too extreme. Well pursue that. Were also going to explore whether the Capitol Hill Police have been criticized for their handling of the protests, whether they refuse to help and service from the National Guard. A lot going back and forth. We dont know where its going. Just that it is far from ending. With Mortgage Rates at record lows just one call to newday can lower your payment and save you 3000 a year. Were getting word that National Guard troops will be brought in for the next 30 days in to washington that will include the inauguration. 62 from new york, virginia, pennsylvania and delaware. 1,100 from d. C. Capitol hill police can do more. 850 are taking various shifts on can toll hill. That is coming from Jennifer Griffin who has been following very closely. The security plans being put in place for the inauguration but well after that as well for the next again 30 days. Mike tobin right now with the latest details. How and why the Capitol Hill Police might have to defend more Going Forward. Hey, mike. What i can tell you, we have a statement from the family of offic offic offic offic officer stick nick. He was a veteran and served in Operation Enduring freedom. I can read you part of the statement. Its long. Part of what the family said is many of the details and the causes of brians injuries are unknown. Our family asked the public and the press to respect our wishes and not making brians passing a political issue. Police honor brians life and service and respect our privacy while we move forward in doing the same. Brian is a hero and thats what we want people to run. And he was a 12year veteran. He was injured while engaging with protesters. He got back to his decision and he collapsed. Sicknick succumbed to his injured. The feds will get involved. Acting attorney general stating the fbi and metropolitan Police Department will jointly investigate this case and the department of justice will spare no resources in investigating and Holding Accountable those responsible. Meantime, theres been arrests for those people that stormed and showed up in the capitol. Richard barnett, the man photographed with his feet on the house speakers death, hes been arrested in little rock, arkansas. Theft of public property and violent entry. Derek evans has been arrested. His charges are not entirely clear. Its predicted he will be charged with illegally entering the capitol. A man marked mark leffingwell. Christopher Michael Albert entering the capitol illegally and had a 9 millimeter hand gull. And Maggie Kauffman had a pickup trump with molotov cocktails, home napalm and two rifles. And we have new information from the secretary of the army. When you spoke of the guardsman that will be here on the scene, they will possibly now be carrying weapons with live ammunition, neil. Bill mike, thank you very much. Incredible coverage this week. That is probably an understatement. Thanks very much. Mike tobin in our nations capitol. Lets go to Chris Swecker the former fbi assistant director. You probably might not have seen the pictures that were getting inside and outside the capitol. One thing that i did notice is in the wider shot, the cameras are everywhere. Corners of the building and all. So theyre going to have that resource to replay, look at, examine, which probably help them get the 13 individuals they have already. No doubt about it, neil. This video is going to be converted to still photos. Theyre going to break it down with individual face shots. Theyre going to send them to every Police Department in the country, sheriff department, Law Enforcement agency. Theyre going to appeal to the public. Theyre going to identify the main movers here. I fully anticipate to see more arrests, especially in the investigation of officer sicknick and the condolences to his family. Tragic death there. And of course, a review of what happened and why it happened. Neil you know, i get when you hear from the protesters, this wasnt us. But looked like hundreds that stormed in to the capitol. There was more than just a few. A good many of them were armed. How does that happen . Its baffling, neil. This was entirely predictable. If its predictable, its preventible. There should have been more officers, should have been more mobile forces, forces trained in crowd control. There should have been better equipment. In the capitol, they werent wellequipped. They didnt have the right training. There were some mobile force officers around but didnt seem like enough of them. Neil so Going Forward and now i know theyre welcoming that as the Capitol Police for federal help and National Guardsmen and more will be at the ready, but Going Forward, you always worry about what has happened at the white house since 911 where they closed off pennsylvania avenue in front of the white house. Its only pedestrian traffic now. Can you envision them doing Something Like that around the capitol . I do. They have already put up a seven or eight foot fence around the capitol. I used to jog around the capitol. The capitol will be less accessible to the public. Its the symbol of our democracy. Very sad. I expect to see layers on top of layers of security for the inauguration. I dont anticipate anything happening at the capitol during that time period. Its very sad what happened here. Neil no, i hear you. I hope youre right about that everything is a peaceful transfer of power and cooler heads prevail. Chris swecker, the former fbi assistant director. Thanks, chris, very much. Be safe. Thanks, neil. Neil meantime, two cabinet officials have bolted. The big exodus at the white house right now that involves two cabinet officials, other top the former officials that have said look, we cant wait until january 20th for various reasons. All of this at a time when others might be pondering the same thing. I caught up with ric grenell, the former acting National Director of intelligence. He said these resignations are overblown. All right. I apologize for that. We to not have the package on that. Let me get to the point of what he said in this. That, you know, while a penchant is of those that want to leave, the vast majority will stay there or plan to stay there. So theres no move afoot or something to worry about National Security. Others have said that would be a big concern if the top Security Officials were going to go. So lets get the read on this from franchesca chambers and the White House Correspondent there. I apologize for the confusion. Thanks for coming on here. Essentially from ric grenell were hearing not much ado about nothing but theres not a jail back here. What do you think . Theres been some resignations, neil. But to the point, theres a couple of cabinet secretaries but its not like the entire staff has resigned. Some people planned to leave because they knew the Electoral College vote was certified and they obtained new jobs and started them in some cases. So i will also note, neil, theres some former staffers that left weeks or months ago or even years ago that theyre a little frustrated right now with the coverage this is getting. Separating themselves, some vaulted the past too years, doing the president s bidding, doing things they didnt agree with. How bad is that . Its like the big bad wolf is no longer the big bad wolf. Theyre not intimidating and theyre moving on. What are you hearing . You know, you cannot overstate the risk that is happening in the Republican Party right now. There were never trumpers and people that already broke with the president before this. But now theres a whole new group of people from people in congress, like Mitch Mcconnell to current and former recently departed white house staffers, people in the gop that felt like nikki haley had to stay at the Republican National committee winter meeting that are now breaking with the president. Ive had a number of people tell me in the last couple days because of what happened at the capitol with the riot, that no longer see a path forward for donald trump to run in 2024. They dont see a past for it as a standard bearer of the party leader, which he would normally be and any outgoing president would be in their party. Neil good luck for them trying to thread that needle. Franchesca, we have already heard the president is not going to attend joe bidens inauguration. What is a quasi alert, joe biden held out an olive branch to the Vice President , mike pence, that he would like to have him at the inauguration. Hes gotten no commitment from the Vice President. Sounds like hes potentially entertaining it. What have you heard . Yeah, a lot that i heard with the Vice President has planned to go to the inauguration. But certainly no new word on that today from the Vice President or his team. With President Trump, its really no surprise many of the republicans ive talked to that he decided not to go to the inauguration. He was widely thought not to be attending. What he did today is confirm that he wouldnt be attending. So a big question is what does he do instead of attending the inauguration on january 20th . Its not really clear yet what his next steps are. Neil im not clear what hes doing now. What is the president doing now . The 12 remaining days. Any cabinet meetings been called or what . What is he doing to fill his time . Much of what will happen next is in flux. Internally they feel what happened the last couple days really shook up what they were doing before President Trump leaves office and the events that they were planning to do. Its tough to say with this president , he could come out at any time and decide to do something. So really tough to say what is happening with that. You know, we have not seen the president in front of cameras at least. He has taped prerecorded videos the past couple days. Since that rally near the white house, we have not seen the president. He hasnt taken questions from the press. We havent had a chance to ask him about any of these things. Neil thanks, franchesca. Yeomans work. Now ric grenell on the very points that franchesca was raising, what to make hoff this bolt from this administration and why he thinks the president of the United States is getting an unfair rap. Ric is next. I havent talked to any of them. I dont know what their reasoning is. But im very proud of the work that the Trump Administration has done, especially when it comes to America First. I dont think youll ever put that issue back in a bottle. I think its been unleashed. The American People are so much more cognizant of what matters when it comes to Foreign Policy and National Security. Theyre much more engaged. They see the benefit and they want to put America First. So i think what donald trump has done when it comes to really educating the citizenry about access to issues that washington types try to hold close to their chest and try to keep away from the American People, i dont think that that will go away. I think thats a very good goal and it was something that was achieved by donald trump. Neil are you worried that he botched it for himself . I readily agree with you. Some of the inroads that he made to take on china. What happened with the markets, the economy prior to the pandemic, the comeback in jobs since the pandemic. Theyre all substantive achievements. Again and again, he had a record of stomping on the message. Even to dangle over the election and a lot of it was palpable and understanding. He wouldnt let go. Some say he lit a match to the demonstrators. Maybe lost the senate for republicans as well. What to you make of that . He has destroyed that achievement, series of achievements, which are real. Look, i dont buy that, neil. I think 75 Million People voted for donald trump. I think the media in washington has neil you think as many of those would vote given all that weve seen . I do. I do. I think all of them and maybe even more simply because they now see what the media has done. I think you also have to remember, this is a different washington d. C. And the people in washington d. C. They have this feeding frenzy right now. And thats not what is happening out in the real world. I think that people understand that the media is biassed. So they take a lot of this rush to judgment with a grain of salt. I love the fact that every republican that i know, every republican that is in a position of power has condemned this riot, this political protest that turned into riot by some. Its outrageous, its animalistic. Every one should be identified neil many have condemned the president. Many have condemned the president , right . Let me finish this point. I love how the republicans have all condemned this. You go back to last summer and i think that we should not make a distinction between violence and portland or minneapolis or a baseball field in washington d. C. With what happened at the capitol. When political disagreements come violent, they should be called out immediately. I didnt see the same from the left. They pick and choose when they talk about this violence. I would go so far to say that joe biden and Kamala Harris have not been helpful in their comments. Yet they dont get the scrutiny because the media system and the political system in washington d. C. Is very different than the rest of the country. Its not being helped when we just do pileons. Neil i hear you on the media bias, the double standards. I guess what im getting at, the fact that so many republicans are challenging the president right now and some are even saying, you know, the press is a predictable case and we should pursue impeachment, get him out of office, were afraid what he might to. Where are you on that . I think this is a conversation that is intense in washington but its not intense out in the rest of america. I do not see any republicans that havent been always needling President Trump, who havent liked President Trump for the last four years suddenly coming forward and saying anything different. All of the voices that we keep hearing maybe are louder but they have been very consistently antitrump, never trumpers or people that just didnt like the president s style and therefore threw in the whole kind of get rid of him because i dont like his style. I dont have those fears. I think that President Trump is a nonpolitician. Absolutely. Theres a political establishment in washington d. C. That wants to keep putting him in to the political establishment box. So they judge him on youre not being a good politician. I think the rest of the country in many ways says we kind of like that. We like that theres somebody that is not a politician. Now, look, i think some of the president s great est at trtrib are problem areas. I think this president has done amazing work. His policies will live a long time. I can talk very long about the America First agenda and how important that is. I think theres a little feeding frenzy right now in washington. I dont see it outside of washington. Neil you know, rick, Richard Nixon said in an interview with david frost, i gave them a sword. What he was taking about, i did a lot of good. The media was always out to get me. Im paraphrasing here. With the watergate thing, kaboom. He didnt say that, but he said my style, my demeanor, my going after people, my inability to instill loyalty to people that came and went ultimately doomed me. You think the president s style of leadership very effective in getting a lot of things done and a lot of good things done, but in this case not being able to instill loyalty among Staff Members that came and went unprecedented in American History came back the bite him . This is a nonpolitician. You judge somebody by the political standards, you pick one National Security adviser and theyre supposed to stay x numbers of years. President trump doesnt think like that. I actually believe in total that that is a really good thing. That we shouldnt have these washington standards. The ways of washington are basically nancy pelosi gets to fly to san francisco, get her hair done and when shes outed by the Small Business owner for being a hypocrite . What does she say . She says you owe me an apology. Thats the washington way. Washington speak. Washington speak is you get to promise during the campaign that youre going to move the embassy to jerusalem and then when you get in Office Everyone is in on the joke that thats never going to happen because that was just a political promise. I think that these are just the ways of washington. We joke about the swamp. Its funny because we call at this time swamp but i think its an intellectual label. A swamp doesnt allow freshwater, fresh ideas to come in. A swamp is stale and its the same old same old and entraps you and gets you smelly. So i think what we need is outside perspective from washington. The washington establishment. I think its not thinking about americans. Bill i had asked whether its swampy on the part of the president to fire people via tweet or never to tell them they were out of there. Did that come back to haunt him . Did they really come back to be the loyalty thing that turned on him . The president that has had to endorse so many people leaving his administration might have created this cancerous environment himself. That is some of the things that apparently the house is looking at here that he planted the seed for this raid on the capitol this week and it is among the articles of impeachment that they are grasping now. One that says the president threatened the integrity of the democratic system, interfered with peaceful transition and imperilled the government, betraying his trust as president. The white house responding saying this is a waste of time. Stay with us. For skin that never holds you back dont settle for silver 1 for diabetic dry skin 1 for psoriasis symptom relief and 1 for eczema symptom relief gold bond champion your skin neil all right. Were just getting word that republican Lisa Murkowski is calling on the president to resign. She would be the first prominent republican to say that that is a good idea. We heard it out of ben sasse. Hes open to impeachment hearings in the United States senate. Lisa murkowski calling on the president to quit after the wall street journal urging much the same, good for the country for the president to leave and leave now despite all of these concerns. We should point out stocks put in a strong week. The first weekly gain of 2021. Many of the market averages in and out of a record high. The backdrop for that was something startling on the jobs front. Things not only slowed down but went into reverse. Jackie deangelis on the report saying are we headed for something bad. Jackie . Good afternoon, neil. A good question. The economy shed 140,000 jobs last month. The estimates were looking for a 50,000 job gain. The unemployment helped at 6. 7 . The market was not overly optimistic about this. This was the largest one month loss in employment since april of 2020. What hit this report is the leisure and hospitality industry, a loss of 498,000 jobs. As we know, lock downs, travel restrictions continue to plague this sector and it going to take longer to recover than previously thought. But the issue, neil, is that come inauguration day, the incoming president will want to increase regulation and make tax changes as well as push for more stimulus. Biden talked about more covid relief aid. He didnt mention tax hikes per se. That could come next week when he lays out a more specific economic plan. So far what we know about the thinking is that folks making over 400,000 would see a 2. 6 hike. Corporate taxes would go up and longterm Capital Gains would taxed. Bottom line, estimates suggest the biden tax plan could reduce s p earnings by 7 and gross sectors would be hit the hardest at a time when the economy is still struggling. Neil all right, jackie, thanks. She was mentioning the jobs report among the hardest hit sectors, by the way, the restaurant industry. Food for thought. Were finding out more from Lisa Murkowski from alaska that she thinks the president should resign. Now she says i want him to resign. I want him out. He has caused enough damage. The closest of the republican senator to at least understand that the president should go would be ben sasse of nebraska who says hes open to impeachment hearings in the senate. Its going to be an uphill climb. Nevertheless in the house theres a move to get the ball rolling. Theyve already started working on drafting articles of impeachment including one that says the president threatens the integrity of the democratic system. That he imperiled a branch of government, betraying his trust as president. It goes on to say that the president gravely endangered u. S. Security and government institutions. This is part of what would be an uphill certainly timewise uphill effort. If they dont take it up until monday they are down to nine days before the presidency of donald trump would end anyway but we are keeping track of it. Democrats in a potentially growing number of republicans would be open to the idea. I think as john roberts was saying, it would be a tight timeline. As chad pergram has reported from congress it would be an aggressive timeline to put it mildly. But Lisa Murkowski has said, the wall street journal has said, just resign. The president has no intention of doing that, we understand. Hes not going to go to the biden inauguration. The other Late Development was that the Vice President invited by president like biden to go as a representative the people. So far joe biden offered that. Would like to have mike pence there. So far mike pence has not committed one where the other what he is going to do. We want to go back to something that Jackie Deangelis was focusing on, the underlying economy. The jobs reporting. The latest month of decline, a good chunk of jobs we have been seeing, job losses we have been seeing, not surprisingly in food and restaurant industries. When they are closed or limited hours or you cant go inside and have to rely on delivery or pickup, its not surprising that we are seeing better than 370,000 jobs. Caroline stein. Coowner of some of the best restaurants going. The problem is getting people to go to the restaurants in this environment. Thank you for coming. Thank you for having me. We are looking at a really long road ahead . Its been a painful, nine plus months and its not getting any better. Neil whats the latest word . I know its all over the place. Restaurants and establishments. It seems that there is no clear indications coming from authorities about when you can come even on a limited basis, start getting back to something approaching normal. Youre right. Theres been no word on that thats not surprising here in l. A. The case counter rising at an incredible rate. We were shut down for Outdoor Dining in november. We as well as other restaurants around the country let go of multiple employees. We laid off over a. D. At one of our locations in march and hired back some, hire them all back during our ppp loan in june. Women had to lay them off again. Brought back 30 people and had to lay them off again in november and now we are down to six employees. Neil what about federal relief coming your way . Will you be able to tap any of that . Yes, im hoping to get another ppp loan but the problem with those is they are only a temporary fix, especially for restaurants. They may work for other industries but if youre in that industry when you can actually be open and operate and bring in revenue, it actually doesnt benefit you. Lisa murkowski, republican senator from alaska, entertaining, mr. President , why dont you go ahead and resign and save us all the trouble . Chad pergram with the latest on that. Good afternoon. Lisa murkowski would be the first republican senator saying that the president should step down. That is significant. Keep in mind she has broken with president before. The president threatened that maybe he should engineer a primary challenge against her. She was a writein candidate in 2010 at apparently shes questioning her continued association with the Republican Party after the melee here at the capitol on wednesday and some of the things the president said which many here at the capitol believe triggered that. It does take twothirds to convict someone whether it be a federal judge or a cabinet officer or president of the United States. You have to get 67 votes if youre at full population senate theres a lot of republicans who might not want to vote on this maybe you would have fewer people and therefore your twothirds margin is less. Neil chad pergram, thank you. Well be pursuing senator murkowski to see if she wants to join us tomorrow. We look at this and others trying to push the president out a little early. Two weeks early.
