Thank you, lease you a. Developing news from san jose this morning where a twostory townhouse is considered a total loss after a big fire raced through it last night. It started just after 10 00. A car parked inside the ground floor garage caught fire. Flames quickly spread through the house. Three people inside the home escaped without being injured. One of those people ran back inside the house to rescue dogs who were trapped inside. They all managed to get out safely. 40 firefighters were called out to get the fire out by midnight. The cause is under investigation. Also in the south bay, a morgan Hill Elementary School teacher is in jail this morning, accused of sexually assaulting a young student inside a classroom and police are worried there may be more victims. Abc7 News ReporterAlyssa Harrington has the story. 52yearold John Arthur Lloyd is behind bars arrested on suspicion of sexually assaulting a child. Police say he inappropriately touched a student earn side his classroom at Paradise Valley elementary school. It occurred at the school on two different occasions, twice within the last 30 days. And during school hours. Lloyd was arrested at his home in hollister. The victim told a staff member here about her teachers behavior. That person told the principal, who called police. The superintendent sent home a letter and put lloyd on administrative leave. The number one priority is student safety, and that Student Learning continue to happen at that school. Parents are appalled by the allegations. Its shocking because its a closeknit school community. Amelia said his daughter had him as a teacher. She often stayed after school to get help on homework assignments. Knowing she was there by herself and with two other students afterhours is concerning. He has been he school since 2008, but in the School District since 2000. He teaches fifth grade and created a news letter with his students called room 9 times. Detectives are urge parents to talk with their kids to see if there are more victims. Abc7 news. After a Burglary Police made an arrest of one of the three sexual assaults reported near the u. C. Berkeley campus last saturday, all involving fraternities. A 20yearold is a u. C. Berkeley student. Hes accused of assaulting a woman at the frat house where he lives. They say hes not linked to the other two attacks which are under investigation. Hes being held in berkeley jail on 100,000 bail. The family of an oakland teenager declared brain dead say they have proof the girl is not brain dead. She was declared brain dead last year after surgery in oakland. Since then shes been on a ventilator in new jersey. Now the family has released video reportedly showing her responding to her mothers voice. Heres lilian kim. So she knows the difference between left and right, she knows her fingers. She said her daughter responds to her verbal commands. Proof, she said, the oakland teenager is alive, despite having been declared brain dead. In this clip she asks her to move her arm. Very good very, very good. And in this clip she asked jahi to move her foot. Come on. There you go very good winkfield and other family members gathered at their Attorneys Office to present evidence that they say proves she is not brain dead. Heres a photo of her about to get an mri in the presence. Experts retained by the family and an image of what the attorney said is of the childs brain. Theres jahis mri. This is unequivocal proof that jahi has not had her brain liquefied. Its sad. Its unfortunate they have not been put in a situation to accept reality. A bioethics medical professor has not seen the evidence but doubts shes alive. She said its common for people who are declared brain dead to have random movements if you videotape long enough you will have movements that correspond roughly with instructions. But despite the critics, her mother presses on. Shes going to court asking that her death certificate be reversed so she can get her home and get possible medical care in california. Shes at an undisclosed location in new jersey. I said as long as im living and im living and as long as she has one i will never let anybody disconnect her. The court date is scheduled for thursday. In San Francisco, lilian kim, abc news. Health officials have confirmed the first case of the quickly spreading enterovirus d68 in San Francisco. Five cases are reported in the bay area this year. A San Francisco child was admitted to a child last month, treated and discharged in good condition. Across the state 14 had illnesses. 13 respirator illnesses. Yesterday one in los angeles had limb paralysis, which is rare. Health Officials Say they are relieved the state has not seen as many cases as other parts of the country. I mean we definitely expect to see more cases, but today we believe it is positive that we have only 14 cases out of the very many weve tested for. No vaccine is available for the enterovirus. An investigation by the california Highway Patrol found no retaliation during the construction of the new span of the bridge. And also caltran didnt violate whistleblowers laws. If did find a pattern of Miss Management that left employees being fearful for raising concerns against the project. It did not address the safety of the bridge. We reported exclusively thursday night that he called an officer around the time the 911 officer was made. That was a san jose officer. Vic lee has more. This was audio of the Police Dispatch the night ray mcdonald is accused of physically abusing his fiancee. Listen closely. Theres a new her fiancee, we are taking her to the center. The dispatcher said theres a new r. P. , a new reporting party, meaning there was a prior 911 call to this incriminating one. Who made that 911 call, and did it differ from this one . Lawyers tell us the 911 calls are typically considered hearsay. Thats why the cop who macdonald called that night is so important. Reliable sources tell us the san jose Police Officer is Sergeant Shawn pritchard, and that he went to mcdonalds home after the 49er defensive end called him. Those same sources say it was either before or about the time that a 911 Domestic Violence call was made. They tell abc7 news pritchard also works in a secondary job as security at 49er games. Our sources say he was most likely offduty at the time. But lawyers we spoke with say that doesnt matter. If this case goes to trial. Attorney steven clark. On or offduty really isnt important. Its the fact that a Police Officer made certain observations. And those observations are key in the d. A. Evaluating when they should pursue this case to a trial. Lawyer dennis luca, a former lieutenant, also told us it told us it doesnt matter if you are offduty. If you stumble across a crime scene, you are still an officer of the law and as such you cant violate your duty. If you cross that line and engage in any sort of behavior or conduct that interferes with an official investigation, you can be the department can take action against you personally. Police sources tell us pritchard was most likely told to fill out a supplement Police Report outlining in detail what he saw and heard. When anita was diagnosed with Breast Cancer, she thought she would be forced to drop out of school. Thats when she heard of the Breast CancerEmergency Fund. I was thinking i can never reach my goal. But they stepped in, at least financially they give me the peace of mind and i can still maintain by dignity, okay, i can keep going to school, i can get through that. With can make it a lot easier for them to focus on their health and their families by covering their rent, utility bills, their basic living expenses. The majority of the women who get help live in under served communities. Many are single moms. Anita will now work at the organization to help asian women diagnosed with Breast Cancer navigate their way through the system. I found out, especially for the new immigrants, they dont know where to get help. They are lacking resources. October is Breast Cancer awareness month. It bit a 28yearold man on the knee thursday evening. The shark was about 10 feet long. The surfer was rush to the hospital and is expected to survive. Great white shark killed a surfer at the same beach in 2010 and in 2012 at another beach in the same area. The heat was too much to bear for one furry friend. New this morning, a renewed call from president obama to help struggling middle class families in america. The president is calling for a higher federal minimum wage to provide some relief with the eroding middle class incomes. He made the request during his weekly address. Its time to stop punishing some of the hardest working americans. Its time to raise the minimum wage. It will put more money in workers pockets. It will help 28 million americans. Recent surveys show a majority of the Small Business owner supports a gradual increase to 10. 10 an hour. The folks who keep blocking the minimum wage increase are running out of excuses. The republicans responded by blasting president obama for higher taxes and said that burdens Small Businesses. They made a call to repeal the president s affordable healthcare act. A new video was released by isis. This time it appears to show a beheading of a british hostage. Allen henning. Now an american hostage is threatened. Martha raditz reports. This is the 26yearold american, peter cassig, on his knees. A hooded isis fighter at his side, warning he could be the next victim of isis executioners. He is a former army ranger. He was in syria has an aid worker, saying he wanted to find purpose in his life. He became a medic and founded an organization to help refugees. But last year, at almost exactly this same time, he disappeared. The isis fighter in the video by his side, directing a message to president obama, saying you have started area bombardment which keeps striking our people. He then threatens to kill more americans. Just before cassig is shown, another british aid worker, allan henning, appears to be executed. The executioner, like the one who killed the three other hostages, has a british accent, but it is unclear whether it is the same man. The u. S. And arab partners have been pounding isis targets in syria and iraq. We watched the nonstop operations from the u. S. Aircraft carrier george h. W. Bush just days ago. With fighter jets loaded with bombs and missiles, headed for targets weather isis could be found. The targets are getting more difficult to spot, as senior officials said isis has now stopped using long convoys of vehicles, has taken off the black flags on equipment, and is trying to blend into the population. The perpetrator has been arrested and prosecuted. Michael finney has the story. I was totally taken in by his story. 89yearold clara has a hard time talking about this man. John guay of san jose. It makes me shutter to even think of it. She met guay two years ago when he called her, claiming he was referred by her long time broker. He told me that i hadnt been investing for a while, and i needed to see him. So she went and clara quickly grew fond of guay. He was friendly, polite, and given to quoting moral lessons from the bible. His story was that he was a good christian, and therefore i should trust him. And, so, lynn advised her to invest in a fund called blake financial services, and she didnt hesitate. I gave him the check, and he was going to invest it for me. Actually she wrote two checks, totaling 100,000. Guay promised a 3 return on her investment. Very friendly. He also befriended her daughter, Carla Sebastian of fremont, and her husband. Carla was impressed with his charm and his passion for quoting the bible. He said god wants you to earn interest. She invited him to christmas dinner. He brought his mother and daughter. And when guay suggested she should invest in blake financial, she didnt residents plants state either. I wrote him a check for 100,000. My check was for 25,000. Susan mateo and her partner, john, invested a total of 75,000 with guay. He had been their trusted advisor since 2001. We game friendly over the years. And so it came as a shock to susan, john, carla and clara, when they found out all the money they had given to guay was gone. At some point he turned from being a legitimate broker into a scam artist. The fraud came to light when carla asked for a statement of their account. He provided this document. Carla realized it was phoney. Then things got scary. My husband and i realized that he had scammed us. So i fired him on the phone, and he drove to castro valley, where my mom lives. Guay drove carlas elderly mother to chase bank and tried to put his name on her account. An alert teller called carla, then the police. He was getting them to invest their money in what turns out to be a nonexistent company. Almeda County District attorney nancy omalleys office charged guay with stealing the money from his clients. There was no blake financial services, there were no investments, and nearly 300,000 had vanished. I was devastated to begin with, of course. And i was shocked. Guay had once been a legitimate broker and now his license is revoked. Hes pleaded no contest to fraud and grand theft, and was sentenced in superior court to a year in jail. It affected me very deeply over many months. You think you can trust somebody and they betray you like this. Michael finney, 7 on your side. This light of recent data breaches, Governor Brown signed a new law to protect personal information make retailers obligated to help. He was inspired by last years massive data breach in target stores where million of customers de debit and credit card numbers were compromised and a similar breach against Neiman Marcus store. Right now its not illegal to sell your information to other companies. If someone buys your Social Security number, they have ready access to who you are, where you live, where you bank, where you shop, what credit cards you have, all your personally identifiable information. So it can be extremely damaging. The new law takes effect january 1st. It will prohibit the sale of Social Security numbers and obligate retailers to offer consumers protection such as credit monitoring for one year after a breach of their security.
