We have developing news from the south by where police are trying to decide whether to pursue charges against a driver in connection with an accident that killed a threeyearold boy. Matt keller is in san jose with more on the tragic story. Very tragic. You can see the markings on the ground on oak and vine street from the police investigation. Across the street the memorial for the boy who was hit and killed on sunday. A 13yearold family friend was push him and holding the hand of his sixyearold sister and crossed the street in the crosswalk with the friend light and a driver turning left hit all three pedestrians. They were taken to the hospital. Two girled had minor injuries and the boy died an hour later at the hospital. He was blond head and blue eyed and smart threeyearold. Ive never seen a threeyearold so smart. He was brave. He was happy always. The driver stayed at scene. No arrests or citations have been made but the investigation continues. This is san joses 22nd fatality involving a pedestrian this year. His family lives in
