Denise Valdez the parents of the victims say they were never notified about what happened and the school failed to investigate the report. Shakala alvaranga heard from shes live outside the Regional Justice Center to tell us more. Shakala Alvaranga dave and denise, this is the first ever bullying lawsuit against the Clark County School district that has gone before a judge. During Opening Statements today, both attorneys laid out a 6month timeline of what allegedly led up to this. I was going to try and kill myself. Shakala Alvaranga an emotional, heartbreaking testimony in court this morning. And why were u didnt see any like other options. Shakala Alvaranga the crushing statement came from a 13 year old boy. Now, his family. Is suing the Clark County School district. They want better antibullying policies. And accountability from the people, who they say failed them. The two young boys were then 6thgraders at greenspun middle school. Him homophobic names in band class. He said he reported the incident to the dean and was called in to talk about it but his parents were never notified and his bully wasnt disciplined. But, the districts lawyer, has a different story. It was 6th graders being 6th graders outside the presence of the teachers and nobody told the teachers or the School Administration that these homophobic names were being used. Shakala Alvaranga 6month timeline was laid out by attorneys. One of the victims says the attacks had gotten so bad, that he was stabbed in his private part with a pencil. He said he never reported the incident because he was too scared. Hearing things like that every day. It just makes you start to believe them. So i started to think that way about myself. What way . That i was fat and that i was weird for being one of the victims first reported the bullying, he never mentioned the homophobic slurs. The School District doesnt like bullying and you know, the schools have to wrestle with this everyday and i think they did a fine job in this case. Shakala Alvaranga this is a bench trial, which means there is no jury and a judge will hand down a ruling. It will continue tomorrow at 1 o clock in the afternoon. Crystal says a representative from the county was at her home saying it wasnt responsible for the damage and that this was her fault. crystal the man told me they would not be paying for it because it looked like the pole was damaged and i should have known and turned it in. michelle so did he literally tell you it was your job to inspect that light polees responsibility crystal i dont know i am a second grade teacher i dont know how to check that stuff out. michelle what on this pole did he say was the proof that it was rusted . All of this right here. And youre supposed to know that . Yeah Michelle Mortensen but she couldnt have. Because the base of the streetlight had a cover. All the streetlights in her neighborhood do. Even the one they replaced it damages to her car. Even her Insurance Company was in disbelief the county wasnt responsible. They got their lawyers on it. And soon learned there was no way the county was ever going to be held liable. Because a law on the books absolves them on everything in cases like these. michelle this law nrs 41. 033. Is why they are off the hook it basically says the government and Government Employees cant be held responsible for failure to p hazard. And they cant be sued. Its been on the books since the 60s. And therere been plenty of Supreme Court challenges. But victims almost always lose. I went to the county for comment. And to find out how often streetlights are inspected and maintained. But every request made. Was answered with an email like this one. Saying no one was available to comment. I dug a little deeper and learned the county doesnt even inspect or regularly maintain streetlights unless there is a request. This law. Still absolves them from responsibility.
