There was someone in the right of way and the train was not able to stop in time and struck the person. Reporter police tell us they do believe that that victim was a male. They cannot tell us how old he was. And again, they say they believe he was hit while trying to chase after his dog. Reporting live and i did want to also mention that this is not the first time that there has been an accident in this area. In january of this year a 14yearold girl on her bicycle was struck and killed in this same area. Reporting live in san jose, marianne favro, nba bay area news. Just into our newsroom as well, officials identified the pilot killed when his plane went down in the east bay yesterday. 63yearold jerry park from livermore was killed when he jumped out of the plane that was just about to crash. The plane took off from Livermore Municipal Airport just before 5 00 on saturday. Witnesses say a few minutes later that plane caught fire and went down. The crash sparked a brush fire just knot of the 580 and scorched 1 1 2 acres before firefighters were able to put it out. The federal Aviation Administration and the National Transportation safety board are now investigating the crash. Now to a developing story in iraq. Appears to be no end in sight for the growing violence. Over the weekend the sunni militant group isis captured more territory on iraqs border with syria. Its troops are making their way toward baghdad where hundreds are leaving the city. Secretary of state john kerry landed in jordan tonight. Hes expected to travel to iraq soon where the u. S. Is sending 300 military advisers. Many in the ree january and Many Americans are weary of more american involvement there. Kerry was asked if america was responsible for all the upheaval in iraq by invading the country more than a decade ago. Whats happening in iraq is not happening because of United States in terms of this current crisis. The United States shed blood and worked hard for years to provide iraqis the opportunity to have their own governance and have their own government. Kerry is meeting with middle eastern leaders hoping they will put pressure on iraqs president to form a new more inclusive government and do it quickly. They reveal the Santa Clara Valley Transportation Authority operate dozens of trains with faulty wheels. Some as recently as last month. They have the potential to derail. Lets bring in victory nguyen. Vicki. The 49er stadium opens in two months. The vta says it will be ready. These state inspection reports weve uncovered reveal a list of fixes theyve been slow to make. From the potential for headon collision for worn out train wheels. We investigate vta train safety. Vta trains travel at a top speed of 55 miles an hour carrying 34,000 riders a day. And sharing the road with thousands of cars. A vta insider with knowledge of how these trains are maintained and operated asked to be desguysed for fear of being fired. Is safety a priority at vta. Through a series of public records request the Investigative Unit obtained these state inspection reports that revealed vta failed to properly maintain critical signals at many of its trains. The report vt safety hazards for derailment and train colliding head on. In a summary 2014 vta has knowingly as willfully violated safety procedures and cpcu regulation and vta does not have the capability to repair and maintain safe vehicles. Records show in one unannounced visit that month state investors found multiple wheel defeks and worn out tread on four different trains. What kind of safety risk does this pose . Its a risk of derailment. Reporter paul king is the States Deputy director for rail safety. When your inspectors found these problems, what did they instruct the vta to do . Not run those vehicles. And we found that they did run them after that. Reporter king says as recently as last month more than a year after inspectors first cited problems, vta was still sending out trains with condemned wheels. Was vta at any time operating trains with defective wheels . No. Reporter michael is in charge of operations at vta. He says he didnt know that vta was running trains on wheels that didnt meet Safety Standards until we showed him the inspection report. This report says that one of the vehicles they inspected departed for service with condemned wheels. Im not aware of that. Reporter last may the state instructed vta to remove 29 trains from service to replace wheels that were out of compliance. Thats nearly a third of the entire fleet. The agency is running 55 of the 99 trains but in recent press releases vta says it will have 80 trains on the tracks by august. Thats it. Nice job. Reporter in time for the 9er season. Making the same progress over the next couple of months they made over the last year i dont think theyre going to be ready. Reporter and getting enough trains into compliance isnt vtas only problem. Did vta have multiple incidents last year where trains were headed toward each other on the same track . No, except that i will tell you that we operate single track sections so there are places where trains will have to wait for a train to go in the opposite direction, if that makes sense. Cpuc said on multiple occasions there were concerns about signals being crossed and those trains potentially colliding head on. Are you saying thats not true . The cpuc may have that concern. We do not have that concern. Reporter inspectors had that concern because of this. Multiple incidents in 2012 and 2013 where inspectors found problems with signals that were allowing trains to head toward each other on a single track in potential headon collisions. There would be signals between those trains. There would be another place for the train to stop, where the train would be required to stop. Would that happen at all ever . Even if there are signals in between, should two trains be heading toward each other . No. Reporter the reports note various reasons for the failures from Defective Electronics on the signals to deficiencies that cause confusion for vta controllers. In one instance inspectors said they were very concerned the trains were both traveling at a high rate of speed 55 miles an hour and 45 miles an hour toward each other before they stopped. It happened here on the line between fruit dale. Lets give you a better look from the sky. This is a 12 1 2mile stretch of track that north and southbound trains have to share. If they continue traveling at those speeds they would have collided in resz than a minute. There has never been an incident where vta trains, an accident where vta trains were in a headon collision. It disturbs me hes minimizing the problem. Theyre just lucky. Reporter russell is a rail safety expert that spent 20 years as an inspector with the National Transportation safety board. We asked him to review the state inspection report. It tells me that this maintenance problem has been going on for a long time. To the point now where its going to take a major fix to come back up to speed and make sure the cars are up to standard. Reporter inspectors say they are now asking the state commission for the power to Issue Citations when agencies dont fix their safety violations. Time has run out. Theyve had plenty of time to fix this. It hasnt gotten fixed. Reporter meanwhile, the vtas coo says the agency is working to fix the signal and wheel issues. We have very professional operators. I encourage everyone to ride vta. With ten of thousands of new riders meed some inside the agency say they want proof, not promises, that these trains are ready. Vta is currently running a little more than half of its existing trains. About 55 of 99. The agency insists it will have agency of its current trains up and running by august.
