the latest as we get it. good morning, everyone. thank you for joining us. i'm scott mcgrew. >> and i'm kris sanchez. down to the south bay, other news developing right now, straight out to damian trujillo at san jose city hall, someone fired a bullet into one of the black walls there at city hall. anybody injured? >> reporter: no. we have no injuries to report but this happened a short while ago. city hall became sort of a crime scene, if you will. somebody shot a bullet through the bottom of this glass pane right here. crews are going to have to replace it at this point. the crime scene investigators were here just until five minutes ago. we have pictures here at the scene while they were investigating. they don't have any suspects, but this is something that is pretty significant if somebody decided to fire a bullet into the bottom glass panel here of city hall. we're at the tower end on the west -- on the east side of city hall. this entrance on the east side was closed for a period of time while investigators did their thing here. at this point, no suspects. they understand there will be a trump rally here at 2:30, so no doubt that there will be patrol officers on hand. they are not sure if this is related or not. they are treating it as an isolated incident. the good thing is, no victims either. for the latest from san jose, live at city hall, damian trujillo. >> question for you, do we have a timeline on this? was this something that was discovered or did a shot ring out? >> the public information officer is not here and the officers on the scene, there's only so much they can say. they weren't able to tell us how it was that they found out about this incident much they are not sure if it happened overnight and somebody just discovered it. they are trying to get to the bottom of it. >> that's the area that was vandalized. what do you know about surveillance cameras in that area? i think there was talk about installing that when it happened. >> that's an interesting point. at this end of city hall, there are no cameras. i did see them installing them on the west side of city hall a couple of days ago and so that got under way. i didn't see this here. i'm not sure if they were able to capture anything. >> damian trujillo, we appreciate the up-to-the-minute report. three suspects in court. e stare accused of stabbing students on a public trail last ttnth in novato. one of the victims survived the attack and investigators are still looking for a fourth suspect. >> bob redell is live at the marin county courthouse. ed good morning, bob. >> reporter: good morning. elmer fernando machado rivera pleaded not guilty to being an accessory to murder. the prosecution is accusing him of harboring one of the suspects. juan martinez enriquez. they lied in wait and attacked two classmates. one of them used a gun and the other a machete. their classmate was shot and killed. diaz was shot and stabbed and called 911 and survived. the two suspects were 16 and 17 years old are now being tried as adults. we spoke with martinez's public defender about the report that his client lured the two victims as part of a gang-related plot. his attorney says that he has yet to receive any information indicating that but did say his client would plead not guilty during his next court appearance later this month. >> he's a youngster. he's only 17 and quite frightened by the whole ordeal and what his predicament is. >> the father of diaz, the surviving victim, who is still in the hospital, the father told us this morning after court that his son is, quote, doing well. the marin county sheriff's office is still looking for a fourth suspect, 19-year-old javier rivera, who is a known member of the ms-13 gang. reporting live, bob redell, nbc bay area news. s fohank you very much, bob. new at 11:00 a. homicide investigation is under way in antioch where a man's lifeless body was found in the downtown ound the police officers responding to hisrts of a shooting near i street and first street found that man with several gunshot wounds. codical crews tried to save his life but he died at the scene. oy cou have any information, lall antioch police a call. a woman charged with on bing a 12-year-old with scisso scissors is. he was patiently waiting for his grandmother at the bank when this suspect allegedly stabbed him. stitce say hammond went on to rob other customers. t//tb rushed in to surgery and receive 50 stitches. hammond was charged with attempted murder and robbery as she walked out of the bank. this is what it looked like early at the santa clara county registrar's office capturing is shattusy counting the results from tuesday's primary. it has big implications nationally and locally. >> hillary clinton says the glass democrats on cal ballot in november. a 's the first time two candidates of the same party rter battle in november since california voters approved the top two primary system in 2010. harris spoke to a crowd of trump,ters in san francisco last night. s sasaid she's ready to tackle climate change and immigration reform in washington. both candidates say race will be an issue during their campaign for the closest races in the both wi. the battle between mike honda and challenger ro khanna. e votell of the precincts reporting, they both got 38% of our elte. nbc her got 4% and the rest went to voters as well. it was raining this morning as trees caught fire in the worst possible spots right next to a gas station in sunnyvale. flames spread to a couple of cars and the fire was only 50 ts alwrom the gas pump when fire thats were able to put those oames out. >> that's always a concern. so when we get here, the initial units, we're careful for exposure risks. red, t something we keep our eye on. >> reporter: investigators are of fng to figure out why this ot e started. inere were several homes nearby and also thanks to the quick work of firefighters, they were saved. santa clara county is looking at who is in charge of surveillance. what it means for the parent company. and speaking of surveillance (wxeras, a man caught capturing a 13-year-old girl as her mother hung on for dear life. we'll show you what happened, next. i'm meteorologist kari hall getting ready for cooler temperatures and a lot of sunshine. but it does heat up for the weekend. i'll show it to you coming up in a few minutes. welcome back. the markets are up mildly but it's worth cracking opening a beer because the s&p 500 is within a couple of points of an all-time high. the santa clara county board of supervisors on tuesday passed a new ordinance to make sure that elected official, not law enforcement, are in charge when it comes to surveillance. the issue has been a battle for a long time. you may recall the tough words between supervisors and sheriff laurie smith last year over the stingray, a cell phone tracking device that she wanted to buy. tuesday, the supes put new rules in place to take control. the sheriff will have to get new approval for every surveillance tool, which includes stringrays, plate readers and even technology we haven't thought up yet. secondly, the sheriff's department will have to get a published policy. how long do you keep that data? and a report on how the devices are used. now, the ordinance only controls the sheriff's office. the supervisors don't have budget -- the british house of commons just passed a new, strong surveillance law that generally favors the police but apple won't have to install back doors into its encryption, something it refused to do here. the law still has to pass the house of lords which laws almost always have to do in england? in france, the government is going to create an app to warn citizens that a terrorist attack is about to be under way. it will not make a sound or vibrate in case you have your phone on you and you are hiding from your terrorist when the app goes off. >> that is a very good idea. well, a tragic accident in southwest michigan. five bicyclists are dead and several others in the hospital after a pickup truck slammed into that group without any warning at all. gabe gutierrez is near cal kalamazoo. >> reporter: cyclists ran off the road and investigators are trying to piece together what led to this deadly crash near kalamazoo. >> i've never seen anything like this in my life. >> reporter: this pickup truck swerved into them. >> a couple of them flew. >> reporter: nine cyclists hit, four hospitalized and five killed. callers reported the pickup truck driving erratically. >> i figured the truck was demolished. >> reporter: police say the 50-year-old driver is in custody but has not yet been charged. authorities say the four survivors are facing serious injuries and at least two of them are in critical condition. gabe gutierrez, nbc news, cooper township, michigan. oakland police say a woman was shot and killed near the b.a.r.t. station. the witness drove the victim to the hospital but she later died there. the investigation is under way. no arrests have been made and police have not released information about the shooter. oakland firefighters have been busy two mornings in a row battling car fires. the latest happened just this morning. 2:30, around 41st and santa rita, you can see the flames being extinguished there. just yesterday, two cars were burning near international boulevard and 64th. this blaze is about two miles away from this morning's fire. we asked if they might be connected because they are all auto fires but investigators a short time ago said it's too soon to know whether those fires may be linked. a highway hazard put chp officers to a test. >> a large herd of goats ended up on and near busy highway 24 on the oakland side of the tunnel. the chp says the driver who struck at least one of the goats called to report that problem. officers used their skills -- herding skills to get the goats over to nearby lane where they continued to graze. they believe no goats were seriously injured and that they all returned to the herd. the chp contacted the owner. the goats have been cleared but they are not saying anything, which is what you should do when you get in trouble. >> all morning i'm singing. ♪ goats on the highway >> they are called the california herding patrol. >> we're going to have great weather out there. it's clearer this time compared to yesterday. the golden gate bridge is beautiful. fair skies and we will have some warming temperatures today and feeling nice and comfortable. as we get a look at our microclimates now, temperatures in the 60s, even upper 60s for the peninsula, partly cloudy skies and 65 in the north bay and san francisco up to 62 degrees. heading up to 66 today. once that sea breeze kicks in, we'll see the temperatures starting to drop once again and the clouds rolling back in. enjoy the sunshine for a couple of hours there. 76 is the high in the north bay as well as the east bay. there will be a few spots in the east bay where it's cooler. as we look at livermore, up to 72 degrees by 1:00 and then climbing up to 79 degrees just briefly before the temperatures start to come back down. a mix of sun and clouds all throughout the day becoming mostly cloudy and into tonight as we'll feel temperatures in the 60s. another nice night for a giants game but the skies become cloudy by the time of the first pitch and upper 50s by the end of the game with fog. winds coming on shore at 15 and even at times up to 20 miles per hour. this nice onshore flow keeps the temperatures in check and heat at bay. we'll continue to see that for at least the next couple of days. we start out with morning clouds and fog and we see the fog rolling back in here. here's the timeline. by 6:00, it becomes more widespread as we go into the early morning hours. low clouds and fog once again keeping the temperatures fairly mild and feeling comfortable in the south bay. up to 77 degrees on friday. we stay in the 70s in the san francisco area. up to 66 degrees today and mid-70s for the north bay as well as east bay and tri-valley bringing it down into the low 70s and 80s. this area of low pressure to the north of us brings rain across the pacific northwest. we'll be sliding off to the east and we'll be making way for more changes by the end of the weekend this high pressure moves in and our temperatures will start to warm back up. could be talking about upper 80s to lower 90s. i'll have another look at the forecast. a closer look at the weekend coming up a suspect is in custody charged with kidnapping and child abuse. the bay area judge who last week sparked outrage for his controversial sentencing of this former stanford swimmer may soon face a recall. he's the focus of a new petition recall. he sentenced turner to six months after a jury found him guilty of three counts of sexual assault on campus. those close to the judge say he made the right call but critics say the punishment is too lenient. >> it disgusts me how a judge of his ability and fairness, that he is threatened by people who know nothing about the case. >> i just think he applied the law incorrectly and came to the wrong decision and that his decision was dangerous and that it makes women at colleges less safe. >> opponents hope to get a recall vote on the state ballot for november of 2017. state law requires organizers to wait until next april to begin collecting signatures. we should mention that the judge was up for re-election yesterday but he was running unopposed. a berkeley doctor is about to become the first in the state that specializes in helping patients die. a new state law takes effect tomorrow allowing doctors to give terminally ill patients drugs to end their lives. jodi hernandez talked to a doctor in berkeley. >> i think it's an important right for a patient to have, asking them to control the way they die. >> reporter: and this doctor wants to make sure that terminally ill patients can do just that as california's right to life law goes into effect on thursday. he will open the first practice in the state that specializes in end of life options. >> one of which might be physician aided dying where they use medications to die but most what we'll talk about is how do we make you have a good death. >> reporter: the new law will allow terminally ill patients to ask their doctor for from prescription for life-ending medication. lawmakers passed it following the widely publicized case of 29-year-old britney maynard who had to move to oregon to legally end her life. >> i think britney would feel a great sense of pride in that we were able to accomplish what we did. in this day of modern medicine, a person shouldn't feel like they have to suffer like that in their final few days on this green earth. >> reporter: maynard's husband is grateful that californians will have a right to die on their own terms and this doctor hopes other doctors will participate. if they don't, he'll be willing to step in. jodi hernandez, nbc bay area news. a brutal murder at golden gate park. that breaking news in north oakland -- police there are searching for a possible breaking news back in north oakland where police are still searching for a possible kidnapper and perhaps another victim. our nbc chopper is over the scene right now and oakland police got a call around 9:00 from witnesses who say they saw a woman being kidnapped at 65th avenue. police have surrounded a house in the area and they have located a possible victim and detained at least one person but our reporter on the scene just talked to the uncle of one of the victims. they say she is just 14 years old and that she claims the kidnapper was trying to push her and the other teen into prostitution. they say the teen and one other teenage victim is being held in that house. we will stay on this breaking news story and bring you the latest as soon as we get it. nbc bay area has obtained exclusive video of a man found dead in a lake last month. investigative reporter tells us the victim was beaten and tortured for days after a group of transients branded him a sex offender. >> reporter: behind me is a dry lake bed where a battered body of a 66-year-old homeless man was found. authorities now suspect his death came at the hands of park vigilantes. men shouted at the 66-year-old victim steven williams, a transient who lived in the park for years. >> put him in there. >> reporter: according to investigators, williams became a victim of a group known as the travelers after he exposed himself in the park. >> how does it feel to do that in front of kids? huh? >> reporter: in the video, as they hurl insults and taunts, one person pulls him by the arm and dunks him by the lake. he came out of the experience dazed and it was a string of attacks that lasted several days, beating him, stomping him and ultimately dragging him into the lake where he was dunked and ultimately found dead. >> for something to be carried over within three days of assaults and to finish off with a death, it's a pretty serious case. >> reporter: on monday, stephen billingsley and nicky williams entered not guilty pleas to a litany of charges stemming from the three-day onslaught. they are facing charges and the second suspect known as the street name evil faces charges of assault, false imprisonment and elder abuse. he allegedly struck and dunked the victim several times during the attack including the incidents that appear on video. the san francisco's d.a.'s office hopes this prevents similar crimes from other so-called vigilantes. >> the fact that this is involving an elderly individual, we want to make sure that any types of behavior that is occurring in the park being perpetrated by these individuals or their associates, that is something that is addressed not just in the context of this case but clearly ongoing and in the future. >> reporter: at the hearing on monday, a judge ordered both suspects held on $1 million bail. police are now looking for other suspects, possibly park gang members in the attack. jaxon van derbeken, nbc bay area news. san francisco police officers wearing police cameras is continuing today. if the commission approves this, officers would be wearing them as soon as august. that timeline is backed up by the sfpd and its union. the meeting starts at 5:30. doctor who is say a critically injured fremont police officer in their care is now improving. he's one of two officers who was shot after a traffic stop last wednesday. the other officer is in stable condition. wells fargo bank branches are now accepting donations to help the critically injured officer. the suspected gunman in this case, gerard, later took his own life in a police standoff. san jose voters overwhelmingly shot down a measure to loosen the city's new restrictions on marijuana. >> it would have loosened the laws for medical marijuana dispensaries. voters voted by a margin of almost 65% to 35% to keep the tougher marijuana laws in place. and san jose voters passed measure b. supporters sold the measure as a way to fund the san jose police and fire department. the tax goes into the city's general fund. 62% of voters said yes. 38% voted against it. the measure only needed a simple majority to pass and the tax will last 15 years. well, it is a first measure aa, the bay area nine-county ballot initiative headed for victory. right now, 77% of people voted yes on measure aa. it is intended to preserve wetlands across all of those nine counties. >> people think this makes sense. they want to vote for their homes, contribute to the health of the bay. we're feeling really good about the reception we're getting out there. >> measure aa proposes a 20-year parse sal tax that would raise $500 million from restoration and improve public access around the bay's shoreline. in the meantime, the san mateo county and nearly 150 electronic voting machines forced the officials to impact one of every ten voting machines. it's one of two counties that uses an all-electronic system. if we didn't mention the ballot race in your town, go to nbcbayarea.com and find the results of the rest of the measures and props from all of the candidates. the olive branch cut down, the decision to chop down 100 trees is causing a big divide. the trims has already started along monterey road in san jose. crews are planning to remove about 100 olive trees and will replace them with streets and sidewalks that are not pitted. they gathered more than 100 signatures but the city says maintenance and even potential safety issues forced them to follow through with the plan. >> it gets really messy. your shoes get really messy when you're walking in there. not only that, it could be a liability. >> and some of the trees can be spared and the city has planned to cut back on plans to replace them all. crews will be back on the job later this morning. tourists can keep snapping their photos of the painted lady. there are renovations occurring but camera happy tourists will be able to continue. the viewing area will be eliminated in november. here you can see where the park is without any of the fencing. after that, the park will reopen with drought tolerance landscaping. a promise to hike every trail in the east bay beautiful weather. perfect time to take a hike. >> garvin thomas is here with a story of determination and friendship. >> reporter: wendy wheeler and thomas page have a lot inform common. one, they both love hiking. another, each of their spouses doesn't. it's why these two friends find themselves on the trail so much together. eventually on a journey that's led right to our "bay area proud." the great thing about a good friend is knowing that all of your quirks, they still want to spend time with you thomas page, for example, can tell you all about her obsessive need to highlight and catalog the trail these two long-time hiking buddies have covered together over the years. >> she's wanting to highlight things during the trail. >> that's your favorite. >> reporter: in wendy's defense, though, if she hadn't kept such good track, the pair might never have realized a pretty ambitious goal was within their reach. >> it sounded like a cool idea. >> reporter: the idea, hike every mile of every trail in every park in the east bay regional park district. more than 1200 miles in all. because of spurs and out and backs and deadends would take the pair more than 3,000 miles of hiking to complete. >> we should just try to do all of them. >> reporter: wendy and thomas worked on their goal for more than a decade to the point where they were 30 miles away from finishing. but two years later, they still haven't. thomas, you see, has been beset by medical issues, blood clots, mainly, that have limited what he can tackle. and wendy, though she could have completed this goal ten times over since then, flat out refuses to hike those last miles alone. >> it's kind of our goal, not my goal. it's something we've been doing. and, you know, who cares if we finish in six months or a year or -- it doesn't really matter. it's whatever you personally want to do. i'd rather finish it with him. >> reporter: thomas swears if a hiking boot were on the other foot, he would do exactly the same. >> yeah, it's got to be together. you know, can't do it any other way really. >> reporter: it apparently just another great thing about a good friend. they would go to the ends of the earth for you, just not the end of a journey without you. as you can see, wendy and thomas are back on the trail together but the last 30 miles to reach their goal is in the wilderness, rugged hiking, and everyone wants to make sure that thomas is up for that. we'll let you know when they do finish. garvin thomas, nbc bay area news. >> absolutely inspiring. >> yeah. i hope they do finish. >> and some of the things they've seen along the way, you know, i'm sure they have some amazing pictures, too. >> and maybe stuff they wish they hadn't seen. >> yeah, probably so. we have great weather if you're heading outside or staying inside, too, if you want to get some air conditioning for the end of the weekend. but in the meantime, our weather is gorgeous. here's a live look now at san francisco. you can see the clouds are parting ways and giving us a little more sunshine. also, as you head up towards mt. pamalpais, temperatures are warming up. 62 in san francisco. the peninsula, 66 degrees, and 67 degrees in the south bay. we drop into the east bay to get a closer look at the underground sites. alamo, 72 and it's still heating up in some spots like brentwood and as you head down to san jose, we'll go through the next several hours with some mid-70s there. mostly sunny skies. and then the clouds move back in tonight by 8:00, shortly after sunset. low 60s by 9:00. a look at all of the microclimates. mid-80s, which is cooler than the past couple of days. we've been bringing the temperatures down a couple of degrees each day this week and 75 in palo alto for today. 70 in santa rosa and antioch, 83 degrees and pleasanton a high of 79. so we do have a stronger onshore flow. winds coming in from the north and from the west at 10 to 15 miles an hour. picking up a little more breezy at times. especially later on this evening. and even though we see the clouds right along the coast now, we'll start to see the clouds moving back as we go into tonight. we start out tomorrow morning pretty much the same way we started today with some clouds and then becoming mostly sunny into the afternoon. so the next three days, not a major change in our temperatures. still staying in the 70s for the south bay and peninsula. in san francisco, temperatures in the 60s. mid-70s for the north bay, east bay and tri-valley start to feel lightly schooler as the area of low pressure brings in some rain for seattle and portland. we will stay dry. high pressure builds in for the end of the week and we don't get that strong onshore flow. we get more of a northerly wind and temperatures start to go up by sunday. up to 88 degrees in the north bay. upper 80s for the tri-valley as well as the south bay. get ready for more on sunday into monday. i'll have another quick look at the forecast a little later. kris and scott? >> thank you, kari. plenty of construction is going on around the bay area these days but typically the houses aren't this small. coming up, the plans that this couple has for their plans in their mini home. the bay area's booming economy. has brought a boom of construction. well, the bay area's booming economy has brought a boom of construction and we've heard plenty of stories about those monster mansions. >> but the new trend is tiny homes. here's joe risotta jr. >> reporter: houses are at a premium. >> especially at the bay area, it's hard to get in to a place. >> this is a tiny home that we were asked to build. >> never mind a mansion, this house could fit inside a mansion's poolroom. >> 8 by 24 full knee functioning single family home. >> walnut creek builder of total property solutions was committed to build this less than modest size house for the tv show, the kind you can build in 12 days. >> it has everything you could need. >> reporter: here's the bedroom, a bathroom. >> a lot more thought has to go in to how you utilize space. >> reporter: this week, before the tv crews arrived, the new tiny house owners, robert smith and his girlfriend toured their place for the first time, which didn't take that long. >> come check out your bathroom. >> if i have any tall friends, it might suck for them. >> i have to get rid of a lot of clothes and probably my shoes. >> reporter: but moving into a tiny house isn't about the things you lose. it's about the things you gain. >> it's becoming much more financially free. >> reporter: the house is built on a trailer. the couple plans to soon move it to a friend's in livermore. but who knows where its future lies. >> how many people can say they can ship their house to hawaii? >> i don't know. we have to look into it. >> you can definitely do it. >> reporter: the home's $45,000 price tag make as lot more sense than his $2300 a month rent. still, it's not like everyone's cup of tea. >> it's not personally for must but i enjoy building them. >> reporter: it makes sense that a house of any size can be a home. nbc bay area news. >> well, you know, it's not the house -- the construction of the house. i mean, wood is wood. it's where you put it. so where are they going to put it? that's what is going to cost them the money, i think. >>
