Happening now richmond, a Contentious School Board meeting over plans to launch an rotc program at a local high school. It is a military training program. Many California High Schools have rotc training on campus. The Contra Costa School Board approved bringing it here. But then were surprised by the antiwar activists reaction. Board members are reviewing the decision tonight. The rotc costs the school distribute 100,000 a year. Punishment is causing raised eyebrows tonight. The mother is outraged saying that her son was required to clean bathrooms for six days. Did the mom not know this was happening as of day one of that punishment . Reporter the mom did not know. She had no idea. And the mother claims that her son was simply a bystander, not a participant to a bullying incident that took place out here on the playground. She does not believe her son should have been punished at all, let alone assigned to clean bathrooms. Even now, after so long, i still cant believe it. Reporter she gets choked up just thinking about the School Punishment she says her 11yearold son endured. She says ishmael, a 5th grader, was given bathroom cleanup duty for taking part in an alleged play ground bullying incident on april 30. School logs show ishmael cleaned the bathrooms for six days. Reporter they had him picking up papers from the paper from the floor and they were attaching urine for week and one day. So six days. Reporter she says her son was no more than a by stander and ended up getting whooping cough and missing four days of school due to the bathroom cleanup. His health was compromised. He should not have been put in that situation without ut as parents being told. Those things are very common as a positive way to deal with consequences. Reporter a spokesman for the Berkley Unified School District says the case is being investigated. But a letter sent to the mother says staff have been directed not have students clean bathrooms under any circumstances. Honestly, i feel like the child has stretched the truth and doesnt want to come forward at this point. And its miss directed energy. Reporter some parents believe ishmaels family are blowing things out of proportion, saying that the boy could have chosen other cleanup duties. Buttist mother says cleaning bathrooms should never have been an option, certainly not without his parents knowledge. I dont even know what to say. I just think its so wrong, and it should never have happened to my son, to your son or anybodys son. Reporter now ishmaels mother acknowledges that her son and the other boy assigned to the bathroom duty were instructed to pick up paper towels and sweep the bathroom only, however, the boys were not supervised. The former bart officer who shot oscar grant in 2009 is back in a court room taking the stand. This time its a civil lawsuit. Oscar grants father whos serving a life sentence for murder is suing for violation of his civil rights. He says he deprived him of having a relationship with his son. He says he accidently grabbed his gun instead of his taser, but in this trial, lawyers hope to disprove that defense by showing he was adequately trained to handle his weapons. He drew his firearm because he thought, mistakenly thought, that oscar grant had a gun. You dont go and bring a taser out to try to defend yourself when youre presented with a gun. So that shows that he intended to kill him. The trial continues friday morning. Now bart feels the father is not entitled to the money hes asking for. Theyll try to show the father and son had no relationship. A follow up now to a story we first brought you last night. San Jose City Council hit medical marijuana clubs with new rules that in most cases will forsmany clubs to move. Today with a whole lot of money on the line, we learned about those clubs, what they plan to do next. Scott budman is live outside city hall. And this is an update. Reporter there is big business in medical marijuana, and local pot clubs claim to be making a lot of money and generating a lot of tex revenue for the city. But even a hot spot can be the site of a cold war, and that seems to be what we have here. Let stephanie know reporter medical marijuana clubs are still doing business but in something of a haze today after san jose voted to impose a new round of regulations. It effectively makes it impossible to run a Cannabis Club in san jose. Reporter new rules that would limit hours of operation, mandate round the clock security and force the majority of clubs to move. I think overall, the biggest problem is its a burdensome, overregulatory system that wont make it, that nobody will be able to operate under. How many doses . Reporter that said, regulations like these have been threatened before. And some clubs, along with their customers, say theyre not ready to give up yet. Its fully arbitrary. So for them to feel that they should close down considering the taxes theyre collecting this is needed. You hear a lot of negativity in san jose with medical marijuana, how they want to regulate it, but i think the people on the negative side is getting more voice than the people on the positive side. Their ad campaign claims this bus removes 120 cars from your commute every day. Where did they get that number . A spokesperson gave us their formula. 100,000 monthly riders, divided by roughly 21 working days in a month, divided by 39 corporate shuttles owned by the Company Gives you around 120 cars saved per shuttle. But does one person driven equal one car saved . Recent Research Suggests this logic is not bulletproof. We found that half of the people said they would drive alone if not for the shuttles. That was the General Number over a variety of shuttle providers. Reporter this is david and his coauthor. They are master students in city planning who study on the impact of corporate shuttles is one of the most comprehensive and often cited to date. We asked what riders would do without the service. She sought punishment for the male student she says assaulted her. She says stanford has dragged its feet on this issue. Her final appeal has been denied. She has pushed for the student to be expelled. While he cant walk at graduation, he can get his degree. The university ruled the man is not a threat to campus. A fishing trip near gilroy today involved no hooks, no bait, no fishing poles. Staff from the state fish and Wildlife Department used nets and buckets to scoop up juvenile steelhead trout. The stream levels are so low the fish cant migrate into the ocean. The fish couldnt find their way back. So workers today moved the fish further inland where theres more water. So San Francisco, instead of mid60s, going down to 60 for tomorrow. The east bay,8 78 is going to b your average, and the south bay, 73 degrees. So it is cooler weather. It looks like places like santa rosa will have the most below average day since april 1 as we take a look at the rest of the numbers throughout this week. So, again, some of the coolest weather weve seen in over two months for parts of the bay area. Lets get you to the three day forecast. Thursday is going to be the coolest day of the week. Friday, temperatures warm up to 77 and then low 80s by saturday. In the peninsula, also warming wetherby the weekend. San francisco, not quite in the 70s by the weekend. But its going to get close. What we uncovered that might change their ways. And there are ways to get out of a ticket if you show up to court and the officer does not. Were trying to explain what our Investigative Unit has uncovered. Tony . A closer look at that free pass. Weve spent months digging through thousands of Court Records. What we found has prompted major changes at Law Enforcement agencies. Yes, they are paid to write tickets. But theyre also paid to show up in court. We know they write tickets. Hundreds and hundreds of times. 61 in a 35 zone. Every day by Law Enforcement agencies around the bay area. Here you go, maam. July 7, 2014. 8 30 in the morning. But what happens if you fight a ticket . Our investigation dug into thousands of Court Records. Do officers show up in court . Department 55 is now in session. On a single day inside this Santa Clara County Traffic Court we watched as 11 of the 29 cases were thrown out. You lucked out also, the officer is not here. Dismissed by the court missioner. Officially dismissed for lack of prosecution. This matter will be dismissed. Due to Police Officer transfer. Law enforcement failing to appear in court. A loss of revenue for cities and counties. A loss of time and revenue for the courts. Theres no notes. No requests, your matters dismissed for lack of prosecution. When you heard those words, what did you think . I was actually excited. But at the same time i was still disappointed, because i wanted to point out how wrong he was. He didnt do his job. His job was, he ticketed. He should be here to tell me why. You get subpoenaed to court. You should be there. Hes now the director of the institute of criminal justice leadership at usf. Youve seen our numbers. Yes. Is this a problem . It is a problem. Its a problem today, yes. Hes talking about these numbers, the nbc bay area Investigative Unit investigated all traffic trials in 2013. Numbers that show that day in court was not rare. This matter will be dismissed. The records show if you decide to challenge a traffic ticket in Santa Clara County, 12 of the time you will win because the officer failed to appear. Our records also found, among the largest ticket writers, the Mountain View Police Department is the most likely to show up in court, making it 95 of the time. I think thats excellent. I think it reflects the expectation of the department and the dedication of the officer. But our analysis of Court Records found not everyone shares Mountain Views dedication. The redwood City Division of the california Highway Patrol failed to appear in court 20 of the time. And the San Jose Division of the chp did not make it to court 15 of the time. More than three times higher than the standard set by Mountain View police. Does the chp track these numbers . We dont, we havent tracked them that close. The tracking did fall by the wayside. Some of our tracking system. Captain les bishop is in charge of the chp division. Is missing court 15 of the time acceptable . Im not going to tell you what is acceptable or not acceptable until we take a good look at things. Theres always room for improvement, and we need to get better. Our investigation of records also found the san jose Police Department failing to appear for traffic trials 18 of the time. Was this number a surprise . We havent tracked Court Attendance for quite some time now because of staffing issues. The san jose Police Department had no idea how often its officers were missing court dates. Our computer analysis also found three san jose Police Officers missing more than 54 of their traffic trials last year. When you got these numbers, a bit of a wakeup call . I think for us, when we look at the numbers that were provided to us, we recognized the fact that we need to do a better job. Internal records reviewed by nbc bay area uncovered part of the problem. They showed san jose Police Officers failing to appear because of paperwork errors, officers not notified in time. And some officers retired or relocated to other departments. Whats that say to you as somebody in charge . There are lots of questions for us also. And thats something were going to look into, to see if there are valid reasons why they missed court. He knows his department will now change policy and protocols, including installing a computer tracking system to make sure his officers show up to trial. I am going to dismiss this, a lack of prosecution. And the california Highway Patrol also promising change. Your agency here in san jose is one of the highest in failing to appear. Will you share that with your patrol men . Oh, most certainly. Yeah. Thats, thats an easy question. Yes. Definitely, is it, is the message going to be a little bit stronger . I think all theyre going to have to do is turn the television on. So you might want to tknow i officers are disciplined for failing to appear in court. So did we. But those records are protected. Information not available to the public. The officers failing to appear clogged the court calendars. And it cost more than 300,000 in lost revenue. But the other thing you want to notice is a small sliver of fog right there, and thats going to be enough to keep the cool winds in place and drop our temperatures. Right now across the bay area you can see the 60s are in San Francisco. No drizzle right now, but likely a little bit of drizzle for tonight. The other concern we have is across the east bay, you can see the camera shaking around quite a bit. Wind gusts as high as 22 miles per hour. We have a tight wind gradient setting up. So thats going to be the primary disturber, lets say, in the weather at least through tonight. Lets get you to the forecast. And the thing that were tracking is actually pretty unusual for this time of the year. Weve got a decent storm situation in the pacific. Its going to bring rainfall to the pacific northwest. But the core is going to be way too far to the north to give us any rainfall. The storm track is going to mod rate our weather. Move right across Northern California and keep the fog in place. You can see thick clouds at the coastline. Also some low clouds here from marin, napa and sonoma counties and clouds for contra costa, even a little bit in the south bay. As we head throughout the afternoon hours we expect sunny skies for tomorrow, but a second consecutive day of stronger wind at the coastline, its going to bump temperatures down even more.
