Just wanted to get started as mayor to repair relations with groups such as the police union who he fought with over pension reform. Im going to sit down with them as soon as theyre ready to sit down and look forward the finding ways to Work Together on issues of common concern. Reporter the police union is skeptical. Politics is rough and tumble. We all know that. And its the day after the election. And what happens is you try to leave that behind you. The adults come out, meet in a room and try to ork through the issues. Reporter San Jose State University political analyst Melinda Jackson is optimistic. Once we do have a final result, i think everybody will dust themselves off and get back to work. And i think that if liccardo is the new mayor of san jose, the police union will have to work with him. Also too close to call, the congressional race in the silicon valley. Mike honda and ro khanna still waiting, along with the rest of us for the ballots to be counted. Here is the latest. Honda holds a slim lead. This is Getting National attention. Scott budman is in san jose. Scott, youre in the heart of the silicon valley, the heart of technology. Were still reviewing the ballots the oldfashioned way. Very old school, raj. It could take a while. The registrar of voter here is in san jose say it could be several days before we have a final count. I spoke earlier today with the honda and khanna campaigns. They will not speak out until we get closer to a final count. Here is why its taking so long. With the 17th district race still too close to call, candidates and voters are frustrated. But hang tight. There is still a lot of counting to be done. Voters, candidates, the public should just be patient, because we have a process that we need to follow step by step, including that we must process the vote by mail ballots first. And those have to be completed before we can begin the process of the provisional ballots. Reporter and the Santa Clara County registrar of voters says as many as 150,000 vote by mail ballots still have to be counted. Then they can move on to the provisional ballot. Its slow, because while we live in a hightech immediate results oriented world, ballot counting is still largely done by hand before it reaches the hightech machines. Well open those ballots. And we call it opening and flattening, literally taking the ballots out, removing stubbs, looking for take, rips, tape that might be on there. Reporter its an old school process that even in the heart of the tech world, will take a while. Keeping everyone waiting. And as for how long well wait, the registrar says it will likely be deep into the weekend before they finish counting all the mailin ballots. And only then can they start on the provisional ballots. Reporting live in san jose, scott budman, nbc bay area news. Scott, thank you. As predicted now, voter turnout was low. Current estimates show less than 30 of californias registered voters actually cast ballots. Here in the bay area, take a look at the numbers. Napa and Alameda County saw the lowest turnout, about 28 . Nearly 41 in marin county. And voter turnout was even higher in Sonoma County at about 45 . Oakland City Council Woman libby schaaf declared victory today as well. But its not official yet. Schaaf thanked the public for its support. She said its clear that voters are looking for a new direction for oakland, and she vowed to make Public Safety her top priority. We need more police. But we also need better policing. We need to invest in successful intervention and prevention program, and also go after the root causes of crime. Thats jobs, better wages, which im very excited about the measure of ff. So oaklanders are getting a raise this year. Schaaf also says better schools is part of that Public Safety equation. Outgoing mayor jean quan congratulated schaaf and said well do everything we can to ensure a seamless transition as we dedicate ourselves to making oakland a safer, more prosperous home for everybody. Voters in San Francisco and oakland overwhelmingly approved the pay raise. But this wasnt an easy decision for many people. Nbc bay areas Mark Matthews talked with workers, employers, and customers about what this is going to cost. He joins us from San Francisco in the marina district. Mark . Reporter well, raj, its in San Francisco going to go from 10. 74 an hour up to 15 an hour over the next four years. In oakland, its going to rise up from 9 an hour to 12. 25. And that will happen in march. And here in the maisch that district, its pretty easy to find people supporting it. Among the lunch time crowd we talked to, Sarah Remington is pretty typical. I think its absolutely necessary in a city like this. Reporter remington is all for raising the minimum wage for workers like yessica gomez. But behind the counter, she isnt so sure. Yes, i understand its more money for us. But too much for gas and food and rent that we have to afford. Reporter gomez is already working two minimum wage jobs. If prices rise, she is going to be desperate. Its going to make everybody else triple what theyre already working to succeed in life. Reporter in the less affluent mission district, Elizabeth Cornejo is working 12 hours a day, seven days a week. She welcomes the raise. I know that life is very hard. Everything is expensive. Reporter in the mission, the price of housing has shot through the roof, forcing out those who cant afford the stay. And at la mission market, the new tech money has been bad for business. So i lost family that used to shop here weekly, spent 300 or 400. And i gained customers that come in for starbucks or a red bull once a week. Reporter for this grocer, the techies arent his customers. Its the families that are moving out. He tells me he really cant afford another hit. If i raise the prices to cover the minimum wage increase, and i lose 10 or 15 of my customers, thats it. Im done. Reporter he says it could actually put him out of business. The minimum wage increases will not happen in a vacuum. As you can see, there are other forces at work in the communities we went to. You talk to the people involved, it gets complicated. Thousands of gallons of water gushing out of a broken water main today. All that water just gone. The map shows where its happening at villages parkway east of highway 101. Thats in san jose. Nbc bay areas Michelle Roberts is live at the scene with the latest and have they been able to shut that water off yet . It happened about an hour ago they were able to shut the water off. Now theyre making repairs. Take a look behind me. They have to fix the broken pipe. And the fire hydrant that actually fell through the sidewalk because of the water damage, this water was flowing for about four hours this afternoon. In total, an estimated 90,000 gallons of water were wasted. It looks like a waste. But they just said the thing broke. No one hit it. Reporter the concrete supporting a fire hydrant on villages parkway caved due to gushing water today. For hours thousands of gallons of water poured into the road in southeast san jose. It probably just was an older pipe. But we will follow up on that in the coming days. Reporter carrie romanow is the director of very services in san jose. She says the pipe that feeds the fire hydrant burst just before 1 00 this afternoon. Its a waste. We ought to be out here with buckets i guess picking it up so that we can use it. Reporter as crews spent hours trying to find the source of the leak, water continued to pool in the middle of the intersection. A troubling sight in the middle of a drought. It also had an impact on nearby businesses. And completely dead. So its eating up our money. Reporter he works at the caspian village. He said the restaurant had to send a chef home early after crews blocked off the entrance to their parking lot. Its been dead. We were lucky to get three or four tables in before they started blocking off the plaza. But other than that its been completely slow. Reporter business was slow, but the surrounding homes and businesses stayed dry. The storm drains have adequately collected all of the runoff. Were happy that no water made its way into a residence or business. Reporter homes and businesses in the area had normal Water Service throughout this issue. But the intersection of Village Parkway and Highlands Estate is still blocked off. Drivers are being diverted around the corner into the parking lot to get around this. It could be a long night of repairs here. Michelle roberts, nbc bay area news. It wasnt an act of mercy or something sinister. An east bay man has admitted to killing his wife. He says it was a mercy killing. 72yearold Jerry Canfield confessed to Alameda Police that he shot his 72yearold wife in the head. She had been ill. He allegedly told investigators last week the two had previously agreed he would end her life if illness left her in constant pain. Canfield has been charged with murder. Its helped many victims of the south napa earthquake deliberately need. New numbers show state and federal Disaster Assistance now adds up to more than 2. 4 million. The numbers come a week after a federal disaster declaration was included to include homeowners in sonoma and napa county. The center opened last weekend and many people are still rebuilding after the earthquake hit in august. Nearly 1900 homeowners and renters have applied for fema assistance. Both sides of the sex ed debate are expected to sound off. Its definitely a sensitive topic. And i believe parents should be fully informed what theyre going to be taught. Reporter robin chance is not happy at all with what she calls a lack of information surrounding alcanes high schools Sex Education class. When she found out her 15yearold daughter would be taught the birds and the bees by planned parenthood, she started asking questions. I was never given the planned parenthood material. I was not given their outline. Again, i asked nine times. Reporter when Community Member Camille Julio got wind of it, she started sounding the alarms, forming a group called no to irresponsible Sex Education. We want them to take planned parenthood out of the picture. Well want them to tear up the contract. We want them to say we do not need you in the schools. Its been happening for well over a decade. Reporter havent says he doesnt understand the commotion. He says planned parenthood has been providing a biasfree High Quality Program for years. Theyre an agency that provides educators who have an expertise who receive an awful lot of training and are very comfortable facilitating a conversation with students. Reporter but while a few parents have expressed concern, the district says most have no complaints. Rika piercy is one of them. If planned parenthood is willing to do it, if the school can do it, they can probably do it better than me, because my kids, when they hit about 13, theyre not listening to a whole lot that i say. Today was another one of those days where the classic onshore wind were not with us. We had dry, hot offshore areas of easterly winds fuelled by this area of High Pressure. And that produced temperatures that were not only at 78 degrees in walnut creek, but yes, 78 in San Francisco. 79 in pacifica as well. And as we head throughout tomorrow, were going to see the winds shift a little bit. But the thing to remember is this area of High Pressure that has been producing the heat, and also the above average weather at least through parts of october. Its going to be staying with us. Its called an omega block. It resembles the greek letter omega with the shape that curves way up into canada and back down across the midwest. We dont have any rainfall coming. We know we need that but it is going to be dropping our temperatures as were tracking a little disturbance in the upperlevels of the atmosphere. Temperatures instead of the 80s like we had today will be dropping to 76 in the north bay. San francisco from the upper 70s down to 68. Trivalley 77. And a cooler day as well for the south bay. These are indeed good times for governor brown. He says california is working better than washington is. Political analyst larry ge t gerson is here. What do you see . Good news. Lots of it for jerry brown. He continues government that is just in a way unique. Almost perfect for him, yeah. He is going to be termed out. And therefore without concern of any of the tradeoffs that might be affecting his future there is another thing. He also has himself in a very favorable position with Public Opinion. And finally something else. What were seeing is he is working with an overwhelming democratic legislature, many whom have worked with him. Theyve had a productive four years together. Yes, this is a Good Environment for jerry brown. Combined all these things together put him in a very enviable situation that will allow brown hopefully from his point of view to cement his legacy as yes, the states only fourterm dorm. Indeed. He has public support. He has this political confidence. What is on his plate . Some Bold Initiative news that he could pursue. I think so. Lets start with high speed rail. We know weve got opposition with republicans in congress. We know some in the legislature as well. Brown is going to keep that train moving. He wants to keep it moving so that four years down the track, it will be pretty hard to stop it. And then were talking about infrastructure. Thats been this the news with proposition 1. Yes, in terms of water particularly, brown and browns father pat brown, he secured water approval of the states massive Water Project in 1960. But you know what . That was built for 23 Million People. Weve got 38 Million People in california today. With the same water capacity. So, yeah, proposition 1 was a start. But brown sees bigger things. And for him it may be Something Like the peripheral canal or some other big way of moving vast amounts of water that will be a big event, particularly for the delta. And then finally, the third rail, tax reform in the states highly progressive income tax system. You know what . Right now that system takes half of the tax, the progressive income tax from the top 1 of the population. Thats not so good longterm. And meanwhile, you have proposition 13. Yes, that mega proposition thats been around for so long. It starves local governments of so much badly needed revenue. So brown, he may take that big step forward and try to solve both these problems. Thats a biggie. But listen, hes got the time. Hes got the public in his back. And prop 13 has always been a political career killer. But he doesnt have anything to lose at this point. So can he get through . Well, thats always the question. You know, sometimes governors create legacies for themselves and they dont even know what is going on. Other times it hits them in the face. You know, there is the example for Arnold Schwarzenegger with ab 32. He didnt really have any idea what this would do in terms of Climate Change, the cap and trade idea. And yet its the forefront of the environmental movement. And then you had someone like pete wilds with his efforts at immigration reform. From his point of view, which meant no immigration reform, and with that wilson said, you know, were going to stop it all. That came to hit him back in the face. So now you have jerry brown. He has Public Opinion on his side. He has the legislature on his side. And he intends really to build something bold. And he is going to take those steps. You know what . But what theyre saying here in berkeley is moving forward they want to be very careful with the details in case other communities want to use what happened here as a template. Berkeley is always doing things that you never really count on, right . Reporter now the east Bay Community is the first city in the u. S. To pass a soda tax. David kaiser says the reasoning adds up. Weve got an obesity problem in this country that is getting worse. I think you see more and more kids that are prediabetic in junior high and high school. Reporter opponents were outspent. Opponents spent an estimated 2. 4 million compared to just over 1 million. Measure d needed a simple majority to pass, largely because of how it was written. It is a tax on distributors and not on consumers. Whether they pass it on is a choice that they make. But we think over time, there will be a drop in diabetes amongs children. Reporter the tax is a penny on ounce of a sugary drink. Berkeleys measure marks the first time a soda tax has been approved after more than two dozen failed efforts across the country. I see that where berkeley might be the first in something, theyre leading the nation in it. We think its foolhardy to think what happened in berkeley could happen anywhere else. So what can and cant the republicans do now that they run both chambers of commerce . That is the subject of our reality check. But how much of a crash can that red wave really have . We enlisted the help of bill whalen, Research Fellow at the Hoover Institution to sketch out the partys new parameters. Here are three key points he highlights. Republicans can now draft an honest to god budget and pass it and send to it the presidency. So they have the power of the purse string. Thats the first advantage. Power of the purse string. Secondly, they have complete power to investigate, not just power on the house side, but power on the senate side as well. All the investigationious have seen on the house side with darrell issa, you can now double down on that with the senate. Reporter another benefit, the power to investigate. Think about all of those benghazi hearings. And finally the third power they have is the power of nominations and appointments. All president ial nominations have to go through the senate. So now the republicans can decide how ms. Ble they want to make the president s life when it comes to judicial nominations. Raise your right hand to god reporter the power of nominations, which could include slamming the door on a Supreme Court prospect or two should anybody in the high court retire. All of these tools empower a newly minted Republicanled Congress. But lest those leaders get too comfortable. Here is two of the biggest mistakes the republicans can make. The president is a wounded beast, no question about that. But the president still contains formidable power. Its as simple as taking that big blue airplane and going wherever he wants to in america. The president is the last word when it comes to american politics because he has what . Executive authority and a veto pen. Reporter right now republicans already have a majority in the senate. They can add to their margin with three races still up for grabs. But even if they tack on all three, the party still will not be close to a 2 3 majority. We do have changes after the hotter day and sunny skies. Its no longer clear outside. Areas of clouds increasing. Temperatures in the 60s. Well certainly have changes in the atmosphere. Now you notice here in San Francisco, while we do have some clouds moving in, its not low clouds. Were not seeing any kind of thick fog. Its more of the high cloud deck. I still think were going to have a beautiful evening. Tomorrow much colder temperatures. Lets get a look at the microclimate weather forecast. The biggest change is the area of High Pressure that brought the heat is pushing way off towards the south. Thats going to make way for this cold front to speech across. Its rather weak. It is going to bring a temperature difference for tomorrow. Its only going to drop numbers 5 to 7 degrees. The coldest air is going to remain tucked up into the pacific northwest. The other key thing is westerly winds are going to be returning that should help out the air quality a little bit for tomorrow. It was pretty hazy out here for today. Tomorrow looks like were going to have moderate levels of air quality that will extend even into parts of the weekend. So hazy sunshine. Well keep a little clouds for tomorrow. Temperatures will also be cooler. I think its going to be comfortable too. San jose 74 degrees. We have 80 expected in morgan hill. For the coastline, largest changes again will be here in pacifica. After 70s today, going down to 66 tomorrow. Areas of fog. Palo alto, 72. San francisco dropping into the 60s. But still very comfortable if youre here visiting, 67, fantastic in downtown. We get you to the north bay, east bay and trivalley, heading up to wine country. 78 degrees. Mostly sunny for the east bay. Were going drop in oakland to 69. Heading back towards walnut creek expect some warmer weather. Temperatures in the mid to upper 70s for trivalley. Well get you into the next five days. You can see san jose, also San Francisco mainly sunny skies. And a huge string of 70degree temperatures thursday, friday, and saturday. Slightly warmer by sundays forecast. Some low 80s. And then well go back to the upper 70s there in san jose. And San Francisco once again looks fantastic this upcoming weekend. We know the holiday ice rink is open at union square. Could be a good weekend for that. A little on the mild side. But a good time to practice the skills on the ice. And one more thing here. Rain chance next week.
