Reporter the registrar says it will invite the public to witness the recount. Dave cortese told me he does not believe the recount will change the outcome of this race. I heard back from sam liccardo about 15 minutes ago. He told me he supports anything that will increase the confidence of the outcome of the ballot counting process here in Santa Clara County. And by the way, the registrar wanted to make sure that she got out the word that because of the criticism on the vote count process, she says this was the fastest time in the last four general elections that she has reported the election results, contrary to popular belief. A big rig carrying dirt blew a tire and overturned on the southbound side near mckee road. The driver trapped, had to be rescued. He was rushed to a legal hospital. Luckily no one else was involved in the accident and no one else was hurt. The dirt did scatter across the left three lanes which blocked them for some four hours. All lanes finally reopened just about 90 minutes ago. Well, it brought some much needed rain to the bay area, but it also caused lots of problems. The rain overnight toppling trees in San Francisco, one of which came crashing down on a man near the citys mission district. He was left with serious injuries. We have Team Coverage for you tonight. Chief meteorologist jeff ranieri is tracking the totals. But we begin with Christie Smith in San Francisco with the trouble that that storm stirred up. Christie . Reporter and dpw says specifically older ficus trees can be really problematic for things like limb failure. This one here had to be cut down. They say that generally they dont like to remove tree, but theyre looking at a more aggressive Removal Program for certain ficus trees. But some question if that really tackles the issue with city trees. A large section of trees fell at 23rd and popotrero in the missi when he came around, there was two other men trying to lift the tree and he was trying to lift the tree with them. But it was too heavy. And he was pinned underneath the branch. Reporter that man seriously injured. After the rains, public works says four or five trees came down. Most of them large ficus trees. What happens oftentimes is the water accumulates on a tree. And if the tree is vulnerable, the weight from that water can bring it down. Sometimes we also see that the roots get a little bit loose. Reporter she says ficus trees are no longer used as city trees. The one on potrero was just pruned in october. Dan flanagan with friends of the urban forest says there is an issue in general, though, with Adequate Funding and care. They can only afford to go out and inspect or prune a tree every 12 years. And it should be on a three to fiveyear cycle. Right now its about 10 to 12 years on our regular inspection schedule. Depending on the variety of tree, the age of the tree, the location, inspections could be every one to two years, every four to five years. But we know were not inspecting the trees on a regular basis as much as we should be, as much as we would like to be. And thats really a resource issue. Reporter and they tell us these ficus trees were planted about 40 to 50 years ago. I also wanted to mention Supervisor Scott Wiener has been working on this issue, he says trying to come up with a longterm funding solution for care and maintenance of city trees. Governor brown met with western leaders today to talk about ways to help growers stay in business with these limited water supplies. According to a uc davis study, californias water shortage will add up to a billion dollars loss for farmers. And so i think the drought will test our imagination and our science, our technology and our political capacity to collaborate. Last tuesday, california voters approved a 7. 5 billion water bond measure to expand storage of the states water supply. New at 6 00, offduty cops hoping to help pedestrians stay safer on the streets of san jose. Sjpd has received a grant that will pay offduty cops to look for people rolling through stop signs and crosswalks. Here is nbc bay areas michelle roberts. Reporter the San Jose Police department has been stretched thin. Last year there were 36 motorcycle cops patrolling the streets. Now only 12. We have to be a little smarter with our enforcement. Reporter start steven pains received a 350,000 grant from the state. The money will be used to pay for officers to warn and cite drivers rolling through stop signs and speeding. Were taking officers on their days off or before the shift and after their shift. What were doing is putting them in an area to work specifically for those type of violations. Reporter the grant comes after a drunk driver hit and killed a 74yearold woman in East San Jose on tuesday. The victim is the 21st pedestrian to be killed in san jose this year. It will be great to have more Police Officers presence. Reporter police say theyll be targeting areas like willow glen, where there are busy roadways and a lot of foot traffic. Many pedestrians welcome the increased enforcement. I think people go really fast. And theyre looking either for Parking Spaces that could be hard to find, or theyre looking just around. He was killed while riding his bike to school, Monte Vista High School last month. He was hit by a truck driver who didnt see him in the bike lane. The citys Public Safety commission is meeting tonight. In fact, just about 20 minutes from now to discuss adding more crossing guards and Public Safety officers. Palo Alto City Council now backtracking over a controversial law that is only a year old. Last summer, councilmembers adopted a ban on car camping after complaints from residents. The move upset lots of homeless advocates and People Living in their cars. The law was supposed to go into effect this february, but the city now plans to repeal it after a similar law in los angeles was deemed illegal. The City Council Vote is expected to take place this coming monday. Believe it or not, a dip in our local housing prices, relatively speaking. Prices for bay area homes went way up from last year, but they dipped in october. For our nine county region, take a look. A the median sales price is 601,000. Thats down from 605,000 in september. Start your new orleans holiday at followyournola. Com. You may remember the metal plates that suddenly appeared on the bay bridge, creating commuter gridlock. Caltrans finally took them away, and now there is a new plan, a bridge fix that this time they say wont include plates or too many backups. Nbc bay areas Mark Matthews is along the embarcadero where the work will start tomorrow morning. And construction with no gridlock, thats a little hard to believe at this point. Well, for starter, jessica, they arent going to use the temporary steel plates that caused the backup on october 17th last month. Remember that commute . Take a look. Traffic on the bay bridge was so bad that friday morning, it took more than an hour to cross the eightmile span into San Francisco. The problem, temporary steel plates laid down over work that was going to begin to prerest pair a half dozen expansion joints. Drivers saw the warning signs, hit the brakes, and the rest was a mess. Did you notice people hitting their brakes . Yeah, everybody. Reporter after one very frustrating friday, caltrans decided that was enough. People in charge decided lets pull the plates off, lets regroup and try to come up with some different ways of doing things. Reporter the different ways involves quickdrying concrete. Caltrans says the plates wont be needed if they do the work at night and use concrete that sets in as little as 90 minutes. Our crews will be done by 5 00 a. M. Monday through friday. Reporter the work will start tomorrow night, and will continue six nights a week, starting at 8 00 p. M. And ending in time for the start of the morning commute at 5 00. On the downside, its going to cost a Million Dollars more and its going to take almost twice as long, 10 to 12 weeks ball. Spokesman for the meth Transportation Commission which is spending bridge toll money to do the work says what commuters are getting is worth it. Youre buying a lot more convenience for the hundreds of thousands of motorists that are traveling through that corridor every day. Reporter so an easier commute into San Francisco, but the first part of the replacing the expansion joints is going to be grinding out the old concrete. And that is going to be very loud. It certainly will be. And its going the start tomorrow night about 9 00. The grinding is going to take place from about 9 00 at night until 11 00 at night for the next oh, three months. In the past hour, the city manager sent a memo to mayor chuck reed and other city leaders outlining changes to the citys gift ordinance. This stems from our reporting. Nbc bay area broke the story yesterday. The police chief Larry Esquivel had accepted free tickets to a 49ers game. Now city policy in san jose limits gifts to 50 and prohibits free tickets to any sporting event. Esquivel acknowledged he violated the city policy. The assistant chief and deputy chief also admitted getting free tickets. Todays memo from the city manager confirms the people involved erred in accepting the tickets and outlines a new program. Internal affairs is also investigating. A south bay janitor arrested at work today, charged with possessing child pornography. Investigators arrested arturo perez at the Los Gatos Office building where he works. According to police that. Traced an ip address othrough the internet to his laptop. They served him with a search warrant after interviewing him. We did discover over 100 videos of child pornography. Now the age ranged from toddler to about 12 years old. Perez is booked into the Santa Clara County jail on 25,000 bail. Officers are now checking to see if there are any potential victims out there. Well we had water coming from the sky and water coming from the ground. This is what it look likes here. Giant water fountain really in the middle of the road. Really its a broken pipe shooting water 70 to 80 feet in the air. This happened in downtown walnut creek. A cap blew off the pipe around 11 45 last night. Crews finally fixed the problem a couple of hours later. Othankfully no businesses were damaged. We want to see water, but falling from the sky. We dont want to lose everything we just gained last night by the broken pipes. You look at the Doppler Radar, and you have seen the storm system moving out towards the east and the south. But as many of you are driving around today, weve had some clouds. But youll also notice a little bit of drizzle. Enough to turn on the windshield wipers and smear everything around. You can see as we zoom in and get a closer fix of the Doppler Radar, these areas of light drizzle and mist throughout the richmond district, back through chinatown, and right along the embarcadero as well. I think its going to be a similar situation back for parts of the east bay tonight. Some Higher Elevations will help squeeze out additional moisture. All in all you may have mist through the evening hours. The rainfall totals across San Francisco, it was impressive. We had throughout downtown anywhere from. 27 to. 35. Back here towards the outer sunset,. 24. Our storm system was right on track with the expected totals, and continuing to boost up our rainfall season. We take you outside. The cloud cover has moved in. Temperatures in the 60s. Youll need the jacket out tonight. Might even be able to light a fire to keep yourself warm. You know youll need the extra blanket. The heater may make it too warm for you in the house. Tomorrows highs, well go a little warmer. Well see increased sunshine. Across the south bay, temperatures in the upper 60s with a mix of sun and clouds and a drying forecast. So the weather trend over the next few days does not have any rain in it. Saturday, sunday, and monday will stay dry. Temperatures will start to warm up in the south bay to some low 70s. And youll also see a similar scenario here for the peninsula as well. Now, for San Francisco, well even see temperatures reach the upper 60s by mondays forecast. For the north bay, east shore and also for the trivalley, no rain expected through next monday. But thats going to change. We are looking at possibly three storm systems in the next 11day period. But remember, even with this wet weather coming in, we are still one full water year behind. We need 20 inches to catch up in San Francisco. And at least 15 inches in san jose. On top of our typical rainfall season. So weve got a lot of catching up to do. Tonight a wedding planner is behind bars after failing to provide more than 60,000 worth of wedding ceremony services. San Francisco Police say stanley kwan owned a Wedding Planning business called to have and to hold. Investigators say kwan promised to provide wedding photography, bridesmaid dresses, tuxedo rentals, even limousine services. Police say he instead pocketed the money and the couples didnt find out until just before their weddings. It happened back in 2005, but kwan was only recently found and convicted. He is now serving four years in jail. Elmo is in trouble again. The street performer commonly called bad elmo was arrested near San Franciscos Fishermans Wharf forring a shop owner. Today the judge reduced sandlers bail to 150,000. Sandler has had previous runins with the law for harassing pedestrians in San Francisco as well as new york. New at 6 00 tonight, not safe at school. Thats how an Alarming Number of lgbt students say they feel in california classrooms. Many say they have been harassed both verbally and physically on campus. As Jodi Hernandez reports, educators say they have new information now that could help them turn that trend around. There were a lot of stories about how people experienced harassment, you know. Its namecalling, the tension of being in the boys group or the girls group in gym. Reporter those are the kind of things theyre hearing from the Gay Straight Alliance club. Concerns that are being echoed across the state. A newly released survey by the gay, lesbian and Straight Education Network says the majority of the states lgbt students dont feel safe at school. Eight out of ten students have heard homophobic remarks. Three out of ten have been physically harassed. These numbers dont lie. And there isnt enough being done, you know, period. Reporter the survey isnt so surprising to folks at oaklands transgender law center, who field thousands of calls for help every year. Hopefully its a reminder to school administrators, to public officials, to parents, to everyone to share their stories and Start Talking about this important issue. Reporter thats exactly what educators are doing in oakland. The district is creating Gaystraight Alliance clubs at every middle and high school, and rolling out new teaching materials that promote inclusiveness. Its vitally important that we have these programs for students, that they get the message coming from the administration and coming from the adults in their lives that being lgbtq is both okay and wonderful. A story about a secret email, power brokers and your power. Details of a private dinner between pg e and the states top power broker. And then overshadowing the landing, the controversy surrounding a scientist and that historic comet landing. We investigate a secret million request made by one of the states most powerful public officials. In fact, he is one of the powerful people deciding how much you pay pg e. Tonight there is more trouble for the president of the states Public Utilities commission. Chief Investigative ReporterTony Kovaleski has been digging through hundreds of emails linked to his questionable relationship with pg e. Tony, a lot of talk about corruption here. Reporter raj, jesse, the accusations point as the current president s of the state Public Utilities commission. The u. S. Attorney is investigating, and so is the state attorney general. Tonight we investigate a telling email and an empty disclosure form. But this is unseemly and it crosses the line. Reporter its an email two power brokers thought you would never see. Well, it says that there are back room deelgs going on. Reporter and its this empty form, unreported payments required by law, never disclosed to the state. I think that escalates from the word cozy to corrupt. Reporter together they point directly to the current president of the Public Utilities commission. An awful lot of pride in reporter where is this going to end . I think some heads are going to roll. Reporter Loretta Lynch is the former president of the Public Utilities commission. The mayor of san bruno critical of the puc and in the wake of the 2010 deadly explosion in his explosion. And brit stradman is one of the attorneys who fought to uncover that email. The overall message is that there is something wrong with the Regulatory Environment in california. Reporter that wrong came to light inside this email, a communication Michael Peevey and his agency, the state puc fought to keep secret. The emails show that he went beyond inappropriateness to a straightout asking for money for favors. Reporter brian cherry wrote the email. He was a Vice President of pg e. The email reports on may 2010 dinner with peevey. It includes, referring to peevey now, mike stated very clearly he expects pg e to step up big. And we need to spend at least 1 million. According to the email, peevey wanted pg e to contribute to defeat a ballot proposition that would suspend the law governing californias fight against global warming. Cherry also wrote i asked for clarification and peevey said at least doesnt mean 1 million. It means a lot more. Thats solicitation as far as im concerned. 1 million. Reporter in an email, cherry also wrote, peevey expects pg e to contribute 100,000 to the celebration committee, referring to a nonprofit peevey engineered to fund the pucs 100 year celebration. You cannot say please pay for my dinner, please pay for my party, and please pay for the initiative that i like in exchange for favorable treatment that i will give you from my state appointment. Reporter so we now understand what the president of the puc wanted and the email also appears to outline what pg e needed. Cherry writes peevey is aware that we are looking for a good generate case decision, a reference to pg es proposed 20 rate increase. The email went on to say peevey is said to expect a decision in january around the time of the pucs 100th anniversary celebration. I told him i got the message. To me, that shows you do me a favor, ill do you a favor, lets scratch each others backs. Quid pro quo . Yes, absolutely. Reporter and that controversial email ended with this. All in all, we had a nice evening. Polished off two bottles of good pinot. Our investigation also followed the money. Take a look. Campaign disclosure forms show pg e contributed at least 650,000 to the campaign peevey suggested. And according to reports in the San Francisco chronicle, pg e spent at least 20,000 supporting the pucs 100year celebration inside San Franciscos julia morgan ballroom. They were in fact negotiating back and forth for favors. Reporter on peeveys part, after the dinner, he apparently went to bat for pg e in its move for a rate increase. This email to puc commissioners also written by cherry concludes with we encourage you to approve the alternate proposed decision of president peevey. Confirmation peevey supported pg es plan to charge more for electricity. I think absolutely a line was crossed here, without a doubt. Reporter Sarah Swanbeck is with californias common cause. The nonprofit considers itself a watchdog against corruption and abuse of power. He is the leader of this agency. So he should be held to a high, if not the highest standard of ethics. Reporter and this is where the legal gauntlet gets more complicated for peevey. California form 803 requires accountability. It allows the there will be to know any time a commissioner requests money for legislative or charitable purposes. Our investigation has learned Michael Peevey did not disclose his successful request for money from pg e. Not disclosing that, not making that Information Available to the public, i think that thats a huge problem. Mr. Peevey, Tony Kovaleski. I have a question, do you have a moment . Oh, god. Only a couple of questions. Reporter weve made several requests to talk to mr. Peevey during the past two years. And again this time president peevey has declined our requests for an explanation. I dont believe he said anything publicly about this at all. But he just seems to continue feeling that business as usual is going to be accepted, and we wont stand for it. The regulator has stopped regulating, and instead is the lap dog of the regulated utilities. The system doesnt work that way. Its clearly broken, and its time to fix it. Reporter the states Fair Political Practices Commission has now joined the u. S. Attorney and the state attorney general in investigating president peevey in that email. Here is the problem. Its required and if not filled out, its a failure that can be punishable by a misdemeanor, including a fine and removal from office. President peevey will not seek another term. His final day is december 31st. Now after the email became public, pg e fired brian cherry and two other executives. The utility also declined to comment to us about this investigation. Gay rights advocates are praising todays recommendation from a federal committee that gay and bisexual men be allowed to donate blood for the First Time Since 1983. Critics have called the old rule discriminatory and outdated. Todays advisory goes to the food and drug administration, which will consider the change next month. Now the new recommendation is that gay men be allowed to donate blood if they have abstained from sex for a year. President obama is on the other side of the world. But it appears the political war is heating up on capitol hill. Two controversial issues getting traction tonight. Were talking about immigration and that keystone pipeline. Were going to fight the president tooth and nail if he continues down this path. Will not be shutting the government down, threatening to default on the national debt. Reporter however, they will be pushing to repeal obamacare. And tomorrow the house is expected to vote on the keystone xl pipeline measure. For six years now, the decision to send oil 11 miles 00 miles through the u. S. Has stalled, mostly because of concerns about the environment. But the bill is now gang support from house and senate democrats. Build the pipeline. Its the right thing to do. And thats just the way it is. Reporter even if the project clears capitol hill, the white house says the president could veto it. I think its fair to say that our dim view of these kinds of proposals has not changed. Reporter Republican Leaders say if the president vetoes the pipeline bill, they will bring it back in january when the gop officially controls both houses and tie to it a must pass spending bill. Temperatures in the 60s. Areas of clouds here from the north bay right on down to the south bay. So still expect those wet roadways for tonight. And our east shore camera, you can see it shaking around a little bit. Also gusty throughout the bridges. Winds from 10 to 15 miles per hour. Lets go ahead and take you into the forecast. And i really think the best thing that were going to find as we head throughout tomorrow morning is the fact that its going to be dry. But here is the other thing. Weve got that left overmoisture in the atmosphere. Temperatures continue to cool off for tonight. Thats going to help the air reach its condensation level. So i think that in part will bring us some patchy areas of dense fog. Its not too bad right now. Visibility at five miles and or better. But again, for tomorrow morning, we likely could see some of those patchy areas of fog. As you get a look at the cloud forecast, you can see areas of thick cloud from the north bay down to the south bay. And then throughout tomorrow morning, once again dense areas of fog. By the afternoon hours, well get some sunshine in here. And its looking all good. By this weekend, it really has been a close call on any potential rainfall that may come our way. So far it looks like forecast models keep rainfall well off to the north. So that may be better for your weekend. Well get you into a microclimate forecast as we head throughout our friday. And you can see weve got plenty of sunshine here in san jose and 68 degrees. Well also find temperatures in the upper 60s for morgan hill. For the peninsula, we should have a decent amount of sunshine for parts of foster city and also through palo alto and in San Francisco, numbers staying in the low 60s. Lets take you to the north bay, east bay and trivalley. Napa expecting 69 and sunny skies. Sunny acroissant rose and 67. And for the trivalley, numbers expected in the upper 60s as well. Its going to be a dryer day tomorrow with increased sunshine and temperatures staying cool. Well take you into the weather trend as we head throughout the next couple days. Its going to be dry on saturday, sunday, monday, and then by tuesday, thats when we start to get that possibility of rain coming back into the mix. So weve been mentioning this chance here of some rainfall as we head throughout next week. Here is how it lays out at the current moment. After todays storm, there is still a second, third, and possibly a fourth storm coming our way. The second one by wednesday. A third one by friday. And then a fourth one potentially by next sunday.
