They allegedly beat an inmate to death last month inside the countys main jail. Kpix 5s kiet do is at the Santa Clara County courthouse in san jose where an arraignment happens today. Reporter they will be bused into court today from Alameda County where they were held in protective custody because its too dangerous for them to stay here at the jail where they work. Later on today we get a first look at the three men as they are arraigned. The sheriff has recommended murder charges. But that decision ultimately is up to the district attorney. The three, Rafael Rodriguez, jereh lubin and Matthew Farris, only rodriguez gave an interview telling the mercury news he didnt do it and doesnt know how the inmate was killed. Inmate Michael James tyree was found dead on august 27. He had lacerations to the spleen and liver and died of internal bleeding. The deputies were conducting a routine clothing search with the other inmates locked in for the night. Sources say the deputies became violent when tyree refused to take his medication. Investigators say there is Surveillance Video showing the three deputies entering tyrees cell about an hour before he was found. Im unable to disclose all of the evidence that points to the culpability of these three individuals. But its unmistakable that jereh lubin, Matthew Farris and Rafael Rodriguez committed in cowardly heinous act against an unarmed individual they were entrusted to protect. The d. A.
