The body was found near the Mountain Home inn parking lot, where authorities found the car of a woman reported missing yesterday. More now from kpix 5s sharon chin. Reporter it took searchers about an hour to find the body of a woman that Authorities Say appears to match the description and clothes of missing 50yearold Marie Christine sanner of mill valley. Theres no obvious sign of the cause of death to this person. Reporter marie is an avid hiker who was with her dog and a male friend. He wanted to keep hiking in the dark and she wanted to go home. So she turned around with her dog. Deputies say only her dog made it back to her car. Her father reported her missing launching a search s a body was found in a Drainage Ditch off trail. She may have possibly fallen maybe 40 or 50 feet down into the drainage which sadly is covered with large rocks and boulders. Reporter deputies say the womans body was found less than a mile from where searchers recovered a menlo park womans body last weekend. Both found in drainage difference with no obvious signs of trauma. We havent identified anything criminal in either one of these cases. Reporter they seem so similar. Why is it that you believe there is no link . Well, im basing it based on my experience having been with the Sheriffs Office here for 30 years, eight years with the searchandrescue unit. Its not uncommon that we come up here on a frequent basis to help and assist people who have fallen or become injured here. Reporter the mystery is making frequent hikers think twice. Two people that passed away here, id be a little nervous around here. Dont go hiking by yourself. Thats just a cardinal rule. You dont go off the trails. And new this morning, a quickthinking witness got people and their pets out of a burning home near petaluma overnight. The home on lakeville highway there near cannon lane caught fire shortly before 2 a. M. Starting in the garage. Take a look, the entire structure just lit up very quickly. Matthew connolly just happened to be driving by at the time ran to the house and woke up all three people inside. There was a car that was already pulled over calling the ambulance. I asked him if he went and knocked on the doors or anything. And he said no. I just ran towards the house. I knocked on the windows and doors and luckily, people came out, heard me. Lucky indeed. Everyone did get out safely. The garage and the two cars destroyed and there was some damage to the main house, as well. And developing news on the ferry that sank in south korea. Today prosecutors are seeking arrest warrants for the three crew members. Investigators are focusing on the sharp turn the boat took just before it started listing. And also on whether an Evacuation Order should have happened sooner. 28 people are confirmed dead after the ferry sank on wednesday. 270 others are missing. Many of the passengers were High School Students and teachers on a school trip. Well, theres at least one glimmer of hope. A 6yearold was rescued from the ferry yesterday and still alive. Her parents and brother still missing. Prosecutors want an arrest warrant for the 69yearold captain and here he is, he is hiding his face. He says he is ashamed. Police believe he may have been one of the first people off the sinking ship. Well, it took crews half into it to get this bart train back on track. It derailed near the North Concord station last night as the train was headed to the train yard. No injuries. The derailment did not impact the evening commute. And this happened before near the concord station. In february, a train jumped the tracks hanging over the edge. The damage tied up service for several days. And some more bad news for bart. Cal osha has fined the Transit Agency 210,000 for the death of two workers last year. The men were working on the tracks in walnut creek when they were hit and killed by a bart train. 5 06 now. Happening today, commemorations to mark 108 years since a massive earthquake devastated much of the bay area. Kpix 5s anne makovec joining us live from San Francisco, where events are getting under way. Good morning, anne. Reporter good morning. In five minutes, it will be 108 years since the 1906 earthquake hit here in San Francisco. This is Lottas Fountain here behind me on kearney and market and a ceremony is going on as it does every year to commemorate this event. This fountain served as a Meeting Point during the chaos of that day in 1906. Heres some footage from that period devastating fires breaking out after the earthquake destroying over 80 of San Francisco. Around 3,000 people were killed in the quake and its aftermath. Its remembered as one of the worst natural disasters in history of the united states. We need to remember this. We need to be prepared. And this is all about remembering our great history and singing our beautiful songs and just keeping it alive. Reporter after the ceremony here on Market Street, the commemoration moves to the mission where two fire hydrants will be painted. This is video from last years gilding. Since water mains were broken during the earthquake, these were some of the few working hydrants at the time. They are credited with saving much of the city. Kiet, an independent auditor says some officers had sex while on duty lied about it and really didnt get in much trouble, either. Whats going on . Reporter yeah, its a scathing report indeed. Likely to prompt swift reaction from city hall. We were there when judge Ladoris Cordell handdelivered the report to the san jose Police Department yesterday. It highlights two cases where officers lied to cover up Sexual Misconduct while on duty. Those officers were punished but cordell recommends the Department Fire officers who lie. Really important, we believe, that this department have a zero tolerance policy if people if officers are absolutely found to have lied. And thats true for at least two cases that we profiled in chapter 6 on sustained cases. Reporter that was one of 15 recommendations. More details coming up in the next half hour. Negotiators have reached an agreement that could lead to an end to the violence in that Eastern European country. Cbs reporter Tara Mergener tells us the breakthrough came after 7 hours of talks in geneva. Reporter the russian flag still flies over the public building in the eastern ukrainian city. Prorussian activists say they wont honor an agreement between ukraine and russia meant to ease tension on the ground until the interim government in kiev resigns. Under the deal reached in geneva thursday, all sides must refrain from bloodshed. Illegal armed groups are required to disarm. And prorussian militants must turn over buildings they seized. If there is not progress over the course of these next days, then there will be additional, uhm, sanctions, additional costs as a consequence. Reporter the president is watching events closely and remains skeptical. I dont care we can be sure of anything at this point. I think there is the possibility, the prospect, that diplomacy may deescalate the situation. Reporter the agreement doesnt mention the annexation of crimea last month. So the accident involved a couple of big rigs northbound 880 by broadway and as you can see, it is stacking up to about fifth embarcadero so again some slight delays jammed up for an exit or two in the area. If you are traveling near the Oakland Coliseum things look good. But expect delays as you get closer to downtown oakland only impacting the northbound side by the way. Also in the south bay now, southbound 85 we had a solo car spinout. So this is actually blocking another couple of lanes. We are not seeing any delays on our sensors, however. But its approaching almaden expressway. So it looks like for the most part the south bay traveling through downtown san jose everything looks in the clear. Same thing at the bay bridge. Today prosecutors are now asking a court for an arrest warrant for the captain and two other crew members on board. 28 people are dead and about 270 are still missing. Reporter ko im has more on the investigation and the rescue effort. Reporter the ferry off south koreas coast is now completely under water. Strong currents have made it difficult for crews to look for possible survivors. The coast guard says divers got into the ships cargo area friday but couldnt reach the passenger quarters. Dozens are dead and nearly 300 people, mostly High School Students are still missing. Be rescuers pumped oxygen into the ferry to help anyone who may be trapped and still alive. Cranes are also now on standby to lift the ferry out of the water. Emotions remain high. Families of the victims are upset and want answers about what happened. The captain of the ship apologized. He is now under investigation. The coast guard is investigating whether his actions cost lives. Documents show he delayed an evacuation of the ferry for half an hour after an official onshore told the crew to consider abandoning ship. Now a Prosecutor Says the captain may not have been at the controls when the ship started to tilt. Investigators are trying to figure out if ferry capsized wednesday after a third mate ordered a turn that was too sharp. It was northbound 880 approaching broadway coming into downtown oakland involving two big rigs but again, just within the last few seconds they cleared all lanes so you may see a little slowing on the sensors from oak street just because theres obviously some activity there off to the right hand shoulder but much better news if you are now heading into downtown oakland. Again, all lanes clear. Heres a live look at some of our bridges. The Golden Gate Bridge they have four southbound lanes open in the commute direction. Everything looks great heading on to doyle drive in San Francisco. Southbound 85 almaden expressway turns out this was a twocar crash blocking two lanes. They are in the clearing stages now. The citys Police Department accused of protecting officers caught behaving badly. Kiet do is live in san jose and kiet, an independent auditor says some officers had sex while on duty, lied about it and still kept their jobs. Reporter yeah. This has been a tough couple of years for San Jose Police. Were talking about budget cuts, low pay, understaffing, officers leaving to other departments having a hard time hiring officers on in the department all that and now this the annual Police Auditors report. Its out and it is not looking good. Reporter independent Police Auditor and former judge Ladoris Cordell handdelivered her Year End Report to the San Jose City clerks office. The 115page document raises concerns and recommends the department start firing officers caught lying to internal affairs investigators. Its really important, we believe, that this department have a zero tolerance policy. Reporter the report notes two sustained cases where officers had sex while on duty and later falsified reports or lied about the incidents. They were both disciplined but not fired. One case found a uniformed officer and a female School Employee had sex in a room at the school. She claims sexual assault. Internal affairs determined the officer provided false information in his police report. Cordell says most departments would have terminated him. But not san jose. Did an informal survey of other Police Departments around the country, and most of them told us that basically they have a rule, you lie, you die. Meaning you lie to internal affairs, you you you can no longer be in the department because thats the integrity of the department thats on on the line there. Reporter the report also found something surprising when it looked at allegations of excessive use of force by officers. There were 93 force allegations, people complaining about excessive force, that we audited in 2013. Not one of them was sustained. Since 2007, theres only been one sustained force as. Reporter cordell says its up to the city council to find out why so few allegations of force are upheld against officers. Its worthy of discussion to ask, well, whats going on . And new this morning a man was shot and killed in concord. And its the citys first homicide of the year. The victim was found dead in the area of adelaide and laguna streets around 9 00 last night. There is no suspect information and the victims name has not yet been released. Chevron wants to upgrade technology at its richmond refinery but a closer look at the 4,000page environmental reports reveals a whole lot more. The upgrade they propose would allow the refinery to process even dirtier crude than it already does now. That would double sulfur emissions. Sulfur corroded the piping in the crude unit at the refinery back in 2012 causing a massive explosion. Environmentalists are fighting this new plan. This community and any all the other communities along the refinery corridor have already been suffering disproportionate amounts of cancers, asthma and other respiratory illness. Its going to give opportunity for training for our community, for our youth to work, to bring crime down. It will bring in jobs and opportunities. The coalition of Union Workers supports chevrons proposed plans because, of course it will create new jobs and chevron admits sulphur emissions would increase but plans to reduce other toxins and Greenhouse Gases to compensate. 5 40 on this friday. No inj another bart train derailed near the North Concord station last night it was heading to a train yard when it derailed. No injuries were reported. Crews were out for hours trying to get it back on the traffic. The derailment didnt impact the evening commute. A distinctive and descriptive tshirt stated the obvious during a bank robbery recently. Sounds like its closer to the tunnel on westbound 80. They havent turned on the metering lights yet but they are working to clear it. Bridge crews are aware of it trying to clear it off to the island right now. In the meantime, you will find some slight delays on the eastern span of the bay bridge as well as the cash lanes so far not too bad. Live look out in oakland. Northbound 880 of course they cleared that Traffic Alert so now everything looks great from hayward all the way up into your downtown oakland exits. Livermore valley sluggish from north flynn past vasco. So far looks okay through the Altamont Pass so kind of an unusual traffic pattern forming there. But it is friday. So it is a little bit friday light now. And all those headlights you can see traffic coming towards 680. Mass transit by the way everything is on time. He gets stuck going around and around in a circle in london and cant ever catch the exit lane. Roundabouts can be confusing so heres a few tips for you. Number one, yield to cars to the left. And we stand a chance to especially get wet in the north bay. That might spread south, too. So to sum it up, sunny and mild today, warm temperatures through monday. And then cooler and wet on tuesday. Heading out to the beach, small craft advisories posted, wind waves up to 4 feet today and patchy fog out there. Forecast highs low to mid70s in the southland.
