"justice scalia was an american hero. we owe it to him, and the nation, for the senate to ensure that the next president names his replacement." less than an hour later, senate majority leader mitch mcconnell declared, "this vacancy should not be filled until we have a new president." but president obama, who praised scalia as one of the most consequential thinkers ever to serve on the court, made it replacing him. >> i plan to fulfill my constitutional responsibilities to nominate a successor in due time. >> reporter: election year supreme court confirmations are extremely rare. the last president to nominate and confirm a justice in an election year was fdr, 76 years ago. but even then, his party controlled the senate. although scalia became a hero to conservatives and a nemesis to liberals, his own confirmation was entirely uncontroversial. he was approved 98-0. even joe biden voted to confirm him. the battle to replace him will play out in congress and on the campaign trail. it's already happening. >> we should not allow a lame duck president to essentially capture the supreme court in the waning months of his presidency. >> it is outrageous that republicans in the senate and on the campaign trail have already pledged to block any replacement that president obama nominates. >> reporter: as for who president obama will nominate, candidate republicans respect. such as merrick garland, chief judge of the d.c. circuit court of appeals, a moderate who has won praise from republicans. jane kelly, confirmed unanimously by the senate as a circuit court judge in 2013. and finally, sri srinavasan, who was confirmed as a circuit court judge 97-0 just three years ago and served in the administration of president george w. bush. he would be the first asian justice. the bar for a supreme court nomination is much higher, especially this one with justice scalia being a conservative icon and his replacement having the potential to switch the balance of power on this court from the conservatives to the liberals. jonathan karl, abc news, the white house. all right. we're going to move on to politics now. just five days until the nevada caucuses and a new sign how close the battle is there. hillary clinton is staying in nevada today where she has three events scheduled. she was supposed to attend an event in florida but her husband the former president will take her place there instead. attacked rival bernie sanders as a one-issue candidate who is proposing nothing more than breaking up the big banks. for his part, sanders was campaigning in nevada yesterday, as well. in fact, although there's no video of it, sanders and clinton attended the same african-american church service in las vegas. both listened to the other speak, sanders speaking first. the race in nevada is considered a neck and neck right now. today sanders is attending an event in michigan. a scare yesterday at arkansas state university turned out to be just a video shoot. the jonesboro campus put on lockdown after a report of armed fen near the student union. there were no arrests but a school spokesmen says the production crew should have let officials know. two months ago there was an actual threat when a man with a shotgun drove on to campus. the hunt is on in britain for the person responsible for a laser strike on a plane that forced a flight to return to the virgin atlantic flight was leaded for new york. the pilot said it happened about seven miles from heathrow airport. virgin says one of the pilots reported a medical issue, apparently linked to the laser strike. passengers were put up for the night and will fly to new york today. one more note from overseas, turkey is shelling kurdish militia in northern syria prompting the syrian government to protest at the u.n. in the meantime, new video shows syrian army helicopters dropping bombs in a suburb of damascus, the syrian capital. it all lessens the chances of a cease fire in the syrian civil war leaving little hope for people who are fleeing the fighting. abc's alex marquardt reports. >> reporter: relentless russian air strikes have reduced towns and villages in northern syria to rubble. and allowed the assad regime to besiege its biggest city aleppo. the offensive has sent a new flood of syrians, some 50,000, aid groups are now frantically building tents amid fears that hundreds of thousands more will soon be on their way. turkey is keeping the border closed for now. there's been a steady stream of trucks like this one delivering aid to the displaced inside syria. the few who are being allowed out are the wounded from the fighting. at the main hospital we met this 18-year-old. he told us those russian air strikes had leveled the villages where he's from. so his family moved only to have the house they were in struck, as well. shrapnel from the blast paralyzing him from the waist down. watchdog groups say the russian air campaign has killed 1,000 civilians. russia denies targeting them. the u.s. accused russia of focusing its bombing on rebels instead of isis and al qaeda. the u.s. and russia have to begin next week, but that alex marquardt on the turkey, syria boarder. pope francis celebrates mass today in the southern mexican state of chiapas. it's one of the poorest areas of the country. yesterday he visited a children's hospital in mexico city where a a production of our broadcast producer tony and his wife marissa. seven pounds, nine ounces. healthy, happy and cute. don't they look like -- >> they look so happy. good morning. i'm reena ninan. >> i'm kendis gibson. here are some of the top headlines we're following this morning on "world news now." death of a legal giant. after supreme court justice antonin scalia died in his sleep over the weekend. with the high court left shorthanded, republicans are looking to block the president from filling the empty seat. full coverage ahead. disgraced former new york governor eliot spitzer is being investigated for assault for allegedly choking his girlfriend at the plaza hotel. spitzer resigned in 2008 after being caught in a prostitution scandal. candy, flowers and one of the coldest days on record for -- in the northeast for valentine's day. rails snapped in the by thor cold causing delays for rail service. it was the coldest morning in boston in nearly 60 years. and the defense not the game last night in the toronto. all-star game ever. russell westbrook was the game's mvp. those are some of our top stories on this presidents day, monday, february 15th. good morning. hour with the new details we're learning on the death of supreme court justice antonin scalia. >> as the political fight over his seat gets under way, we hear from one of the people who saw scalia the final hours of his life. with more, here's abc's jim avila. >> reporter: justice antonin scalia died behind the drawn curtains of this room, peacefully and in his sleep. >> i was a firsthand witness. >> reporter: says the owner of the cibolo ranch in west texas where the judge had been a first time guest, scheduled to hunt quail saturday. his body discovered when he skipped both breakfast and lunch. >> he was totally peaceful. he's a man who went to sleep and just didn't wake up. >> reporter: the high-end hunting lodge and ranch was host this weekend to an exclusive group of mostly texan couples. justice scalia was the only famous guest. he arrived friday about noon, toured the property, did not join that day's hunt, but he did have dinner with the group overlooking the scenic lake. he said, it's been a very long day. up early this morning. had a long week. i'd like to be excused. >> reporter: others however, told investigators they heard the 79-year-old justice mention an illness. the county judge who pronounced him dead over the phone told abc news she talked with his doctor in washington who told her he had been ill and came to his office both wednesday and thursday before the trip. the scalia family, his nine children and wife, maureen, she says, objected to an autopsy. and after talking with investigators and u.s. marshals on the scene, she agreed one was not necessary. >> any signs of foul play could have easily caused that i ask for an autopsy. >> reporter: instead, the county judge says the death certificate will simply read natural causes due to his heart stopping. jim avila, abc news in west texas. scalia's replacement could impact the ideological makeup of the court as his body arrives experts are already looking at how his death could affect the outcome of several key votes. abc's jonathan karl on the fierce political debate over who gets tote select scalia's replacement. >> reporter: the battle lines over justice scalia's replacement on the supreme court were drawn in no time. republican presidential candidate ted cruz tweeting this five minutes before the supreme court or scalia's family confirmed he had died. "justice scalia was an american hero. we owe it to him, and the nation, for the senate to ensure that the next president names his replacement." less than an hour later, senate majority leader mitch mcconnell declared, "this vacancy should not be filled until we have a new president." but president obama, who praised scalia as one of the most serve on the court, made it replacing him. >> i plan to fulfill my to nominate a successor in due >> reporter: election year supreme court confirmations are extremely rare. the last president to nominate and confirm a justice in an election year was fdr, 76 years ago. but even then, his party controlled the senate. although scalia became a hero to conservatives and a nemesis to liberals, his own confirmation was entirely uncontroversial. he was approved 98-0. even joe biden voted to confirm the battle to replace him will play out in congress and on the campaign trail. it's already happening. >> we should not allow a lame duck president to essentially capture the supreme court in the waning months of his presidency. >> it is outrageous that republicans in the senate and on the campaign trail have already that president obama nominates. >> reporter: as for who president obama will nominate, he will likely choose a candidate republicans respect. such as merrick garland, chief judge of the d.c. circuit court of appeals, a moderate who has won praise from republicans. jane kelly, confirmed unanimously by the senate as a circuit court judge in 2013. and finally, sri srinavasan, who judge 97-0 just three years ago of president george w. bush. justice. the bar for a supreme court nomination is much higher, especially this one with justice scalia being a conservative icon and his replacement having the potential to switch the caucuses and a new sign how close the battle is there. hillary clinton is staying in nevada today where she has three events scheduled. she was supposed to attend an the former president will take her place there instead. at events yesterday, she attacked rival bernie sanders as a one-issue candidate who is proposing nothing more than breaking up the big banks. for his part, sanders was campaigning in nevada yesterday, as well. in fact, although there's no video of it, sanders and clinton attended the same african-american church service in las vegas. both listened to the other speak, sanders speaking first. the race in nevada is considered a neck and neck right now. today sanders is attending an event in michigan. a scare yesterday at arkansas state university turned out to be just a video shoot. the jonesboro campus put on lockdown after a report of armed fen near the student union. there were no arrests but a school spokesmen says the production crew should have let officials know. two months ago there was an actual threat when a man with a shotgun drove on to campus. the hunt is on in britain for the person responsible for a laser strike on a plane that forced a flight to return to the virgin atlantic flight was leaded for new york. the pilot said it happened about seven miles from heathrow airport. virgin says one of the pilots reported a medical issue, apparently linked to the laser strike. passengers were put up for the night and will fly to new york today. one more note from overseas, turkey is shelling kurdish militia in northern syria prompting the syrian government to protest at the u.n. in the meantime, new video shows syrian army helicopters dropping bombs in a suburb of damascus, the syrian capital. it all lessens the chances of a cease fire in the syrian civil war leaving little hope for people who are fleeing the fighting. abc's alex marquardt reports. >> reporter: relentless russian air strikes have reduced towns and villages in northern syria and allowed the assad regime to besiege its biggest city aleppo. the offensive has sent a new flood of syrians, some 50,000, toward the border with turkey. aid groups are now frantically building tents amid fears that soon be on their way. turkey is keeping the border closed for now. there's been a steady stream of trucks like this one delivering syria. the few who are being allowed out are the wounded from the fighting. at the main hospital we met this 18-year-old. he told us those russian air strikes had leveled the villages where he's from. so his family moved only to have the house they were in struck, as well. shrapnel from the blast paralyzing him from the waist down. watchdog groups say the russian air campaign has killed 1,000 civilians. russia denies targeting them. the u.s. accused russia of focusing its bombing on rebels instead of isis and al qaeda. there is a glimmer of hope. the u.s. and russia have announced a cease fire in syria to begin next week, but that hope threatens by distrust and ever deepening divisions. alex marquardt on the pope francis celebrates mass today in the southern mexican state of chiapas. it's one of the poorest areas of the
