The specific area theyre looking at is a grouping of trees. Crews from the Oakland Public Works department is doing digging. This is connection to a cold case that is five years older or possibly older. Police came out to the site yesterday as part of the investigation and today returned, contacted the fbi and asked for assistance. They are providing help with forensic analysis of whatever is unearthed at this site. We contacted opd and asked for more about the cold case, the investigation. They released a statement that says the Oakland Police department is conducting an investigation in connection with a crime that occurred. At this time, there is no Additional Information that can be released. End of quotation. We dont know exactly what they are looking for. We know it is a cold case. Were told that they could be looking for human remains more than or at least five years old. Possibly older than five years recognize. As soon as we get more information, we will bring it to you on air or online or through social media. Ktvu fox 2 news. Just by seeing the truck traffic behind you, there is no halting of the operations there at the port of oakland due to this investigation . Police blocked off one lane of 7th street going this way. That is slowing traffic a little bit and Restricted Movement on the sidewalk on that side of the street. But beyond that, i dont think this is impacting the operations at the port. Now to Sonoma County where an investigation is underway on the campus of Sonoma State University. After a partially buried body was discovered yesterday. Allie rasmus has been covering the investigation throughout the day. She joins us with the latest. Reporter the Sonoma CountySheriffs Office is investigating this as a suspicious death. A coroner and pathologist should be arriving to the scene any minute. They will be starting the process of excavating this body and determining the manner of death. A Sonoma County sheriffs helicopter circled over the Sonoma State University campus this morning, taking pictures of the crime scene in the heavily wooded field below. It is described as a shallow grave. Reporter Sonoma CountySpokesman Says a campus landscape worker found the body yesterday afternoon. It was discovered in a field about 200 yards away from parking lot m which is between the Green Music Center and the expressway. The sergeant says the remains are not badly decomposed. They are unable to determine the age, gender or race of the body so far. We will go through every grain of birth to get clothing and samples and do every kind of trace evidence they can from the scene. It is a slow, methodical search. It takes a long time. It may be today or tomorrow. Or tomorrow. Reporter and Sonoma County sheriffs detectives have been going through the missing persons report but found no obvious connection to the body found here. Students and staff here at Sonoma State University have been notified of the investigation going on. This area behind us is on the far edge of campus. Eddie ruis is being held on murder and attempted burglary charges. He is the man in Surveillance Video taken in july at a building at willow and 1st street, near where a man identified as david muland was shot and killed. Police say he was robbed by ruiz and shot while chasing him. Anyone with information is urged to call the San Jose Police departments homicide unit. This is every homeowners worst nightmare. New at noon, the city of San Francisco have filed a lawsuit against the developers of the millennium tower. Tom is live with for of what we have learned. My offices investigation shows that the developer Mission StreetDevelopment Llc knew for at least a year before they began selling condo minute ups that this 58story residential building was sinking much faster than expected. Yet, they went ahead and sold condominiums for a handsome profit without telling the buyers about the situation, even though they were legally required to disclose it. Right now, federal investigators are at the scene of a massive fire that burned a building under construction in oakland. The investigators from the bureau of alcohol, tobacco, firearms and explosives arrived this morning to inspect that damaged department building. The atf is the only agency that investigates fires and arson. Flames from the fire could be seen across the city Early Morning hours. Crews spent hours controlling the fire and remained at the scene overnight to make sure that the flames were out. It is no secret that bart is an aging Transit System in need of repairs. On this election day, voters will decide on a multi billion bond measure that the agency says will pay for upgrades. Opponents of measure rr questions if the money will be spent fixing the system. While voters make their choice, bart is shining a light on one of the most critical problems. Alex savidge went to a leaking bart tunnel under the city of San Francisco that workers refer to as the rain forest. They say sometimes they need to wear rain coats when theyre down in this particular area. Bart has problems across the system but this one is a top priority. This is a spot under San Francisco where groundwater is constantly leaking through into the tunnel there. And all of that water can wreck havoc on the system. Reporter to get an up close look at one of barts most critical maintenance problems we boarded a work truck at the station in San Francisco and drove into the darkness towards the 16th street station. This tour of course happened in the overnight hours when the trains are not running. When we got out of the truck, bart facility superintendent tom delanie showed us where groundwater is constantly seeping through the tunnel walls. Delanie says thousands of gallons of water pour in from an underground aquifer. You will be in here with rain gear on. Reporter all of the water that seeps into the tunnel in this area is highly acidic and corrosive. It eats away at the equipment, including the rails and rail pads. These here were just replaced five years. And ideally they would last for decades. You see the corrosion. Reporter crews are constantly replacing those parts, an extremely costly maintenance issue. The dripping on the rails can lead to failure and broken rails and Service Disruption snooze last may, this leaking tunnel caused a piece of rail to crack, which led to massive delays for bart system. It will cost several Million Dollars at least to plug the leaks. We need to bring in a clay substance that will go in and seal the inside of the tunnels. In between the tunnel wall and the steel case. Reporter if voters approve measure rr on election day, bart says some of that 3. 5 billion in bond money could be used to repair this problem and make other much needed improvements. But opponents of that bond measure say that bart has not spent money wisely in the past. Rr is a blank check. Its rewarding bad behavior. It is proving that were not going to force them to set smart priorities in the choices they make. Thats why im a no vote on the measure reluctantly. Reporter glacier says at least a third of the bond money from measure rr could be used to pay for employee salaries and benefits with no guarantee it will go towards system repairs. Whether the measure passes or not, bart says it will begin working on a permanent fix for the rain forest in a couple months and it could take several years to stop all of this water from pouring into the tunnel. Bart says if voters give measure rr the green light, that money would be dedicated to replacing Critical Infrastructure and making improvements to stations. If it passes, homeowners in San Francisco, alameda and Contra Costa County would see property taxes increase potentially for the next 50 years. And we will find out tuesday night. We will. The securities and Exchange Commission has launched an investigation into San Francisco based wells fargos sales practices. They are looking if they violated rules around disclosures and other matters related to sales practices. Wells fargo has been under fire after it was discovered that employees opened up 2 million bank and credit card accounts without authorization in order to meet sales goals. Taking a look at stocks. Flywheel taxi claims that uber is using Venture Capital dollars to lower prices and undercut competitors. It says once uber gets rid of its rivals it will be have a monopoly and charge higher prices. The shootings of unarmed men of black, racial profiling have long been issues that separate Law Enforcement and many in the communities they serve. Ktvus reporter Paul Chambers mediated the meeting. Reporter more than 30 men and women from all walks of life. Benjamin here. I was incarcerated for homicide. They came together at the masters barbershop in san leandro. The purpose, to have a town hall discussion about what facing the africanamerican and Latino Community when it comes to their dealings with Law Enforcement. There is this gap between the community and Police Officers and just the the criminal justice system. Reporter those here agreed that gap didnt just start. It is something that has been around for generations. Enerations. You know he was the black criminal. I have been in situations where i did not like the police. I grew up in oakland. Reporter nearly everyone in the shop said they had negative dealings with Law Enforcement or felt discriminated against at different times in their lives. A commonality for both sides. But the separation began to grow when the discussion dealt with difficult topics like fatal officerinvolved shootings. In 2009, oscar grant, an unarmed black man was shot and killed by a bart officer. Spent less time in jail than michael vick. Right. Thats a very difficult thing for a community to accept. Reporter in 2010, derrick jones, an oakland barber who was unarmed, shot and killed because police mistook his scale for a gun. And last year, mario wood who was armed with a knife was shot and killed by San Francisco police. Its a situation to me where officers either appear to be overly aggressive and or afraid of the situation and therefore respond in a way that to me is inappropriate in those cases. Reporter this topic led some to question, why must officers use lethal force when killing a suspect . We dont train officers to kill. Right. Thats not what theyre trained to do. Theyre trained to stop the threat. Reporter others asked, could an officer just wound the person by shooting them in a body part . I know my capabilities and i know how i shoot. I would probably miss an arm or a leg. And so it just so happened that rondo would travel down would travel down the field and hit someone else. Deadly force is called deadly force because it is meant to stop the threat. Not partially injure the threat or wound the threat. I understand using force when needed. But we see a lot of force being used when it is not necessary. Reporter she is referring to National Cases captured on video. In 2014, eric garner was standing outside of a new york store when police say he was illegally selling cigarettes. Garner died when officers put him in a chokehold. Garner was unarmed. In july of this year, castile shot four times in his car in minnesota after being pulled over for a broken taillight. He was armed but licensed to carry according to his fiance he was shot for reaching for proper papers for the weapon. September of this year, terrence crutcher, a 40year old father of four was on the side of the road with his vehicle awaiting assistance when officers responded to the stalled vehicle. After officers arrived, crutcher is seen walking away with his hands up. Moments later he was shot and killed by a tulsa Police Officers. The officer claimed she thought crutcher was reaching for a weapon. It turned out that crutcher was unarmed. There has been a lack of outcry from officers of color nationwide about the things that we see. And its very difficult for the community to accept that. When something happens in the community, since we cant stand up, we need you all to stand up. Because stuff is happening to us, to black folks, getting killed and murdered every day. There have been incidents where the officer made a mistake or they went a little too far. Reporter just that little bit of accountability some say will go a long way. When officers arent afraid to say their colleagues are wrong. Thats just one of several ways that this group is saying leads to solutions which can bring about change, that can heal the community. They recommend looking in the mirror and starting a conversation at home. We all have biases. And whether we know it or not, we do have them. In recognizing them, we take the first step in making a change. We have to educate not only public but officers in general. We need to respect each other. It starts with respect. Youre talking about economics. Youre talking about politics. Youre talking about education. Youre talking about a lot of things that need fixing. We have to educate everybody. You know, across the board. And it cant just be a conversation about Law Enforcement and they need to do better. Everybody has to do better. Reporter Paul Chambers, ktvu fox 2 news. The officers and Community Members agreed that one way of bridging the divide is to have more people of color occupying jobs in Law Enforcement. Former Oakland Police chief wen who resigned over the handling of the sex exploitation schedule is looking for a new job. He actually interviewed for a job as a Campus Police officer at uc berkeley and also applied to be an Alameda County sheriffs deputy but no position was open with the agency. The names of the finalist for the San Francisco police chief position may have been leaked. Tony chaplain did make the final cut as did deputy chief Denise Schmidt also on the short list. The San FranciscoPolice Commission submitted three names to mayor ed lee for consideration. The other finalist is from outside of the department. Mayor lee is taking his time and will likely wait until after the election to announce his choice. Two homicide suspects are under arrest in a foster city cold case. Doctor was found dead inside his foster city home. Police arrested 28yearold David Mitchell and 61yearold Willie Venable yesterday in San Bernardino county. Investigators have not disclosed a motive but stay it was not a random killing. Officials are in the process of transferring the suspects to the San Mateo County jail. Students at Santa Rosa High School are not leading vandals ruin their play. They broke in through a locked back door and damaged the set, props and the lighting board. This shows someone wearing a costume, throwing a spear from the stage. Theater art students spent long hours and days working on the set and are scrambling to repair the damage. Their fall production of trojan women opens tomorrow night. Just to see someone disrespect and disregard all of the hard work and love that we put into this program was just so disheartening and made me so upset. The School Principal says he doesnt think the vandal in the video is a student but he is not sure about that. Parents stepped up and helped damage the props. The weekend show will go on as scheduled. No surprise to bay area residents but commutes are getting worse. Now there is a new study to prove it. Janine de la vega has details that the study find thats commuters are driving 90 minutes or longer. Reporter here along 880 in milpitas, the southbound traffic coming into the south bay always gets jammed up on weekdays. Were told by drivers going back home in the northbound direction it takes much longer. A lot of these drivers are mega commuters which are people who travel 90 minutes or more one way to get to work. The joint venture Economic Institute released a report showing the number of mega commuters into the Silicon Valley has increased 5 . That is worse than what commuters in Los Angeles County face. The majority of the mega commuters are solo drivers coming from alameda, San Francisco and san joaquin valley. We spoke to a man who commutes. I have been doing it over 30 years now. Trying to pay the house off. And the money is better over here in the bay. How long are you spending in traffic. About an hour and a half one way. Has it gotten worse over the years. Yeah. On friday its like two and a half hours to get home. Its because everybody is working, you know, in the bay area. I got a motorcycle to skip all of that. But during the winter, you cant you cant ride in the rain. Reporter we spoke to a bus driver who said there are three bus yards in the south bay that have trailers and rvs set up for drivers who live 50 or more miles away. Many stay there during the week to avoid traffic. The study illustrates how well the economy is doing but it is impacting the housing costs and commutes. The problem will only get worse. By the time he was 20 he was an olympic gold medalist, taking the gold in greece in 2004. He turned pro later that year. Ward credits his late farther frank for making him the man he is today. Andre says his father, a single dad who raised him and his brother valued strength of character. That was so important to him.
