A lot of people expected to take over the streets of downtown santa rosa later on today. They are outraged over the deadly shooting of that 13year old boy, andy lopez. It happened one week ago here in the spot where were standing. This field has turned into a memorial for the young man. This is where a Sonoma County sheriff avenue deputy opened fire on the teenager holding a replica ak47 that turned out to be a bb gun. Todays protests will start at noon here in santa rosa. People will converge on the Sonoma County Sheriffs Office on ventura avenue. Now, county offices and city hall will be closing at lunchtime in response to what is expected to be a laurk largescale demonstration. The Department Says lopez was holding an air soft gun that resembled an Assault Rifle and failed to put it down. Yesterday, they released the identity of the deputy. Hes 48yearold Erick Gelhaus. A 24year veteran of the department. According to his Linkedin Profile hes an iraq war veteran. One organizer believes the deputy didnt have to shoot. I think the community is tired of being somewhat persecuted. Always feeling they are suspicious in some way. But the santa rosa superintendent is encouraging kids to stay in class. He doesnt want them to leave class to take part in todays event. That plan to close city parks between midnight and 5 00 a. M. Now, the two dozen or so campers out there overnight said the plan would criminalize being poor. Superwiener says closing the supervisor says closing the park would fight Illegal Dumping and vandalism and the chief of police said that the protester said that plan would criminalize being poor. Both vandalism and dumping as well as sleeping in the parks are already illegal. What this would do is give the police and rangers extra agency to be in the parks. Reporter San Franciscos police chief did weigh in saying he supports the plan but he also says he wouldnt abuse any new powers. I know theres been some issue made that this would be used for a clearing of the park and we absolutely dont have the resources or the intention that thats how it would be used. The white house told nbc that people whose policies will be canceled will in most cases be automatically shifted to plans with better protections. And peter lee, the director of californias Health Insurance exchange, says he will not reveal how many californians have enrolled in the covered Healthcare Plan until midnovember. Shes accused of killing a couple in menlo park last week. Reitzells brother says she doesnt remember a thing. Now, shes accused of driving drunk and hitting and killing the couple as they walked their dog last thursday. The District Attorney says reitzell was driving with a blood alcohol level well above the legal limit of. 08. Her brother is offering his condolences to the family. But says that ever since their mother died a year ago, his sister has been on a downward spiral. She had an emotional breakdown, you know what i mean . Shes not medically, physically healthy. She has a lot of things going on in her mind. But for Something Like this to happen, i think its gonna take a toll on her. He says he visited her. She does not remember the accident. He also says that she suffers from other Mental Health conditions. Now, Court Records show that reitzell has had dozens of brushes with the law. Dating back to 1984. Meantime, the suspect wounded in Sundays Police shooting in San Franciscos Marina District is due to be formally charged today. Police say they were forced to open fire on the man after he allegedly beat and shot another person at chestnut and pierce streets. Ktvu has learned the name of the man wounded in that shooting is nabarez, junior. Hes listed in Critical Condition at San Francisco general hospital. Kids who live at an apartment complex in free montare being barred in playing in a certain area. That policy has sparked a federal lawsuit. They say they got a letter telling them their kids were not allowed to play in any of the grass throughout the complex. Well, federal Officials Say thats way too restrictive. The u. S. Department of justice has filed a lawsuit against the owners and operators of the woodland Garden Apartments, alleging they discriminated against families with children because they prohibited kids from playing in the common grassy areas of the complex. Federal Officials Say family with kids should have the same ability as other tenants to enjoy themselves. They say the complex is vite rye violating the fair housing act. They decided to sue after reviewing complaints from five families with children who live there. We spoke to a neighbor who said he would be upset if his complex had that policy. Sounds very strange. I think all of the apartments have been kidfriendly. Our kids play outside all of the time. I dont know where this is coming from. A little hard to believe. Reporter the staff there was reportedly concerned about the landscape being ruined at woodland. The lawsuit seeks a court order prohibiting woodland Garden Apartments from discriminating in the future, a civil penalty as well as monetary damages for the families. Thank you. 7 35. A San Francisco jury has awarded 3. 7 million to 15 firefighters who sued claiming age discrimination. Jurors found the San Francisco Fire Department guilty of tampering with promotions exams. Current and former firefighters claim a 2008 lieutenants exam was doctored after the initial scoring process and they were denied promotion. The majority of the jury agreed. Kind of validates everything that we always thought and this is the group that said, hey, wait a minute. This isnt right. The City Attorneys Office says it disagrees with the verdict and maintains theres no age discrimination within the Fire Department. Administrators have not said how the ruling would affect future exams. 7 35. Tesla says the latest fire of a model s sedan, once again, shows how the car protects the driver in a crash. A mexican newspaper posted this video here of a tesla sedan after it crashed through a concrete wall and ran into a tree. The driver was able to get out before that car burst into flames. Now, the company adds the driver is already buying another model s. This is the second time this month a model s was involved in a fiery crash. The earlier crash happened near seattle. Ten people in hayward now looking for a new place to live after an outofcontrol car crashed into an Apartment Building. Now, this happened yesterday afternoon at jackson and grand. A safety meeting is planned tonight in response to home burglaries in the mountains of southern Santa Clara County. One victim said armed men stole thousands of dollars in electronics, jewelry and a gun from his home on brush road and highway 17 on october 11th. As many as 1500 people could take over the streets of downtown santa rosa later on today. They are outraged over the deadly shooting of 13yearold andy lopez. It happened one week ago right here in this spot where were standing this morning where a large memorial has now been set up here by friends, neighbors and family members. This is where a Sonoma County sheriffs deputy opened fire on the teenager who was holding a replica ak47 that turned out to be a bb gun. Todays protest will start at about noon. The people will meet at two locations at the old Courthouse Square and at Santa Rosa Junior College and then those two groups will converge on the Sheriffs Department offices on ventura avenue. In response to this large demonstration county offices, city hall and the courthouse will all be closing at lunchtime. Lopez was shot seven times by that sheriffs deputy. The Department Says the teenager was holding an air soft gun that resembled an Assault Rifle and failed to put the weapon down. Yesterday the Sheriffs Department did release the identity of the deputy who was involved. 48yearold Erick Gelhaus is a 24year veteran of the department. According to his Linkedin Profile, hes an iraq war veteran. One of the organizers of todays march say the deputy was too quick to open fire and says lopezs death has galvanized this community. They are outraged, sad, still fearful, of course. But i think theyve gotten to the point where they feel theyve had enough and are ready to speak out more. But santa rosas superintendent is encouraging all students to stay in school today. There are a number of groups involved in todays march from outside of this area as well. Now, Santa Rosa Police are investigating this deputy involved shooting along with the fbi also conducting their own investigation. Pam cook is in the studio with new insight were getting into this. A mentally and emotionally troubled woman, thats how Marjorie Reitzell is described by her brother. Shes accused of driving drunk and hitting and killing balbir singh and his wife kamal while they were out walking their dog in menlo park. Prosecutors say her blood alcohol level was. 15. And she was still on probation from a misdemeanor drunk driving offense last year. She went through a Substance Abuse program and was allowed to drive again but her brother says shes not mentally or physically healthy. My sister had a meltdown when my mother passed away last year. She had been on a downward spiral ever since. Prosecutors tell us that they have interviewed Marjorie Reitzell. They wont say what shes said. Say say they say her memory is foggy because of the accident and her intoxication. Her brother tells us she does not remember the accident and insists that she did not hit anyone with her car. Now, if convicted, marnlry reitzell margery reitzell faces up to 15 years in prison. Shes a she will be arraigned on those charges in court today. Dave . All right, pam. The suspect wounded in Sundays Police shooting in the Marina District is expected to be formally charged today. Police say they were forced to shoot and open fire on the man after he allegedly beat and shot another person at chestnut and pierce streets. Ktvu has learned the name of the man wounded is nabarez nobo junior. Hes listed in Critical Condition. Well, a bay area apartment complex has caught the eye of the department of justice and they have filed a lawsuit. It has to to with letting kids play on that it has to do with letting kids play on the property. Janine de la vega is joining us live from fremont. Its sounding like the apartment complex, they may have changed practices out there. Reporter people who livg here at the woodland guard living here at the woodland Garden Apartments were told their children were not allowed to play on the grass. I just spoke to a mom who said the policy has been changed and the kids can play on the graus but only if the grass but only if the parents are present. But a lawsuit has been filed alleging they discriminated against families with children. The suit says they prohibited kids from playing in the common grassy areas of the complex which is in a violation of the fair housing act. The lawsuit arose because five with children filed complaints with housing and urban development. We spoke to a neighbor who said he would be upset if his children were not allowed to play. I would like to hear more about whats going on and how they are taking up this case. But if they are telling they its not fair, i think they are pretty right there. Reporter several reviews stated management of the complex was threatening eviction 23 kids continued to play in the grass and instead suggested the kids be taken to the park. A San Francisco jury has awarded 3. 7 million to 15 firefighters who sued claiming age discrimination. Jurors found the San Francisco Fire Department guilty of tampering with promotions exams. Current and former firefighters claim a 2008 lieutenants exam was doctored after the initial scoring process and they were denied promotions. They are preparing for a large march that will take place this afternoon. As many as 1500 people could take part and take over the streets of downtown santa rosa. Theres a growing sense of acre over the shooting of andy lopez. You can see it here this morning. Some people visiting the memorial where he was shot last week by a sheriffs deputy. The teenager was holding a replica ak47 that turned out to be a bb gun. Todays protest will begin at noon. They will meet at old Courthouse Square and at Santa Rosa Junior College and they will converge on the Sheriffs Office at 2 00 this afternoon. There are also a number of other groups involved from outside of the area, including occupy oakland which is planning to bus people from Frank Ogawa Plaza up here to take part in the event. Now, lopez was shot seven times by that sheriffs deputy. One week ago today, the Department Says the teenager was holding an air soft gun that resembled an Assault Rifle and failed to put the weapon down when deputies showed up. Yesterday, the Sheriffs Department released the identify tie of the deputy who opened fire, Erick Gelhaus. A 24year veteran of the department. According to his Linkedin Profile, hes an iraq war veteran. Those taking part in the march believe the deputy didnt have to shoot. It wasnt fair for him and his family. Should have done something else, not shoot him seven times. Not fair. Reporter now, Santa Rosa Police are investigating this deputyinvolved shooting and so is the fbi. The sheriff up here in Sonoma County says he welcomes the outside investigation by federal investigators. Theres a post meantime on the justice for andy lopez Facebook Page that it is encouraging students to leave class today beginning at about 10 00 this morning to take part in this march. But santa rosas superintendent at the same time is encouraging students to stay in school. But as we bring you back out here live at the memorial, i was speaking with some of these young people over here. They tell me they plan to take part in the march. It was the second costliest storm on record after Hurricane Katrina with damage totaling 50 million 50 billion. More than 100 people were killed in the storm. Many people are still without homes and the rebuilding effort continues. The amount of chemicals making their way into the San Francisco bay is raising concern. According to the San Francisco chronicle, the chemicals are mainly used in homes and businesses and if unchecked could harm aquatic life. Experts say one chemical being found in the highest doses is fiprnal used in insecticides to kill insects in the home and fleas in pets. Lets check in with tara right now.
