A massive fouralarm warehouse fire continues it burn out of control as the camera zooms back. You can see the huge plume of smoke. All the water being poured on there. Michael in San Francisco with updates on rain. Morning drizzle. Lots of clouds. Lots of clouds. But in San Francisco now officially a. 02 from drizzle. There have been reports from half moon bay, san jose, back up to sausalito, francisco, and along the coast. So at least we are getting measurable precip. We will take anything we can get here. A system moving through right now. A lot of low and midlevel clouds that is holding up the temps. So more upper 40s or 50s even, 54 at sfo, san bruno. Some wet roads in jocelyn and d. C. , daily city. Lots of clouds. That will give way to partly sunny, partly cloudy, lot of high midlevel clouds. 50s, upper 50s, low 60s. Here is sal. Northbound 101, steve, is a mess because of this fire in san jose. Its very close to mickey. Its east julian street. The fire is in this area of the freeway here. So northbound 101 is backed up. 280 is also getting a little bit of a backup. Now, i would recommend as an alternate route for you, if you are coming into san jose, if you can just to use 85 up to 17 and then get up to the valley that way. Dont use 101 because it will be a lot of slow travelling. Chp called us and told us to ask drivers, to have drivers roll their windows up if you are driving on 101 near the fire. Obviously, the best advice is to try not to drive near that fire. Thats just a word to the wise. Now, lets go to the bay bridge toll plaza. 50minute de lay there. No problems on interstate 880 in oakland near the coliseum. Now lets go back to the desk. Thank you, sal. 7 03. And we are following breaking news of a massive warehouse fire in san jose. This is happening at an 80,000 square foot warehouse on north 28th and east julian streets. Nearby businesses are being evacuated. And we have just learned one school in the area, rocket ship discovery prep, will be closed today due to the fire. Ktvu channel 2 reporter alan savage is live at the scene where the roof of the warehouse has begun to collapse. Reporter this is a tough fight for firefighters here in san jose this morning. They are still trying to gain control of this massive warehouse fire. And as i step out of the way here you can see its still putting up just a huge plume of black smoke in this area. We are near 28th street and julian. I just spoke with a firefighter as he was walking by and he said there are several businesses burning here. Thats what they believe this money. One of them in all likelihood is a Roofing Company that caught fire. A neighboring Business Owner tells me he believes one business is a feed supply company that supplies feed for animals. At this point obviously firefighters havent had a chance to really get inside and figure out what exactly was inside these businesses. They are just fighting this massive fire from the outside in what they call defensive mode and using ladder trucks that you can see surrounding the fire and spraying it with water. Just trying to make sure these flames dont spread to any nearby businesses and any homes as well. There are a lot of neighboring homes and apartment complexes in this why. A lot of people woke up when the fire broke out and they got prepared to evacuate just in case they had to. Firefighters do believe that all of these businesses that are burning here this morning were empty at the time. There are no injuries that they know of, at least at this point. A fouralarm fire means a lot of Additional Resources have been called in here. About 45 firefighters are here right now battling these flames and trying to get control of this fire. And there was a man who owns the business that sort of is adjacent to the warehouse thats burning this morning. He came down here in a panic this morning. And i talked with him. He was worried his place might burn. Just, you know, shocked. When i drove over here they didnt want to let me get in. I was able to walk in and i noticed that it was the building behind my building. Reporter how close is the fire to your business . Its about, you know, 40 feet away from my building. Reporter but at this point that Business Owner told me he got a look inside. He got to go. His business and he was able to see that there was a pretty good buffer zone. At least we was there between the flames from this large fire and his business. So he doesnt think his place will catch fire. San jose firefighters just trying to basically corral these flames. It doesnt seem at this point there is any hope of saving this warehouse, which we understand could be a Roofing Company. And we do understand several other businesses likely have burned here this morning. And right now it is also possible that more resources, more firefighters could be called in here. This could be a long drawn out firefight this morning here in san jose. Well stay out here and bring you updates throughout the morning. Live this morning in san jose, alex savage, ktvu channel 2 news had. Thank you, alex. Its now 7 06. Also new this morning fives have knocked down a fire at a nearby historic home in san jose. The fire broke out around 2 a. M. On the porch of a house on south 17th street. A couple in the home managed to get out safely on their own. Firefighters did save some photo albums, but the home is badly damaged. My wife heard the smoke detector. I am a sound sleeper. She heard the smoke detector. You know, that was it. That got us out of the house. Fighting the fire posed a challenge to firefighters. The home was built in 1907 and firefighters say walls made of wood and plaster allowed the flames to spread quickly. The cause of the fire is under investigation. Time is now 7 05. Marin county reports the first two deaths from the h1n1 flu virus this winter. One victim was a man with Chronic Health problems. The other a woman described as perfectly healthy. Theres advice this morning about ways to protect yourself from the flu. Ktvus Tara Moriarty is at a 24 hour pharmacy in alameda where you can get a flu shot. Reporter yeah, this is a 24hour walgreens. A pharmacist here told us about two dozen people received a flu shot yesterday and one overnight and they have noticed a spike in the number of people getting shots recently. In san jose the problem is so bad so many people with flu like symptoms that at the Regional Medical center they have pitched a tent to handle the ip flux. It helps isolate those with the flu bug from other patients where they can receive treatment quickly without having to be admitted. One man told us this morning he got his flu shot back in october. Some of my friends i have coffee with, some of them said they think that there is some people that wont take the shot. They just refuse to take it because they think that after they get it, the shot, they get the flu. Well, that hasnt been proven. Reporter every year 15 to 35,000 people die of influenza. Doctors say the vaccine isnt 100 . Its only going to protect you 60 to 70 of the time. So it isnt perfect, but it is better than zero percent. Now, there have been at least a dozen flurelated deaths in california. Five confirmed here in the bay area. The two dave mentioned in marin county and then one each in alameda, contra costa and santa clara counties. If you have not gotten a shot yet, it is not too late. Live from alameda, Tara Moriarty. Meantime, in canada the first confirmed death from bird flu in north america. Health Officials Say the victim was from alberta, canada, and had recently traveled to china. The h5n1 avian flu it contracted in asia or northeastern africa. Most people who die from the virus have come in close contact with infected birds. The Agriculture Department suspended operations at a foster farms chicken plant in Central California because it was infested with cockroaches. The usda says it took the action after seeing cockroaches near the processing line in the plant in livingston. Foster farms says it treated that plant yesterday afternoon. They hope to reopen soon once it gets the okay from the usda. It grosses me out. I mean, i eat chicken. The plant at livingston is one of three foster farms plants in Central California linked to a salmonella outbreak last year. Now, in a statement foster farms says, food safety is foster farms highest priority and the Company Took Actions immediately upon learning of any concern. Happening today, governor jerry brown will unveil his 155 billion state budget a day ahead of schedule because it was inadvertently posted to the department of finance website before it was introduced. Now, after years of facing massive deficits the state is actually looking at a sizable surplus. Economists predict california will have a 3. 2 billion operating surplus by the end of the fiscal year with a surplus possibly reaching 10 billion within three years. This is thanks to the passage of proposition 30 last year and the improving economy. Now, heres some details. Spending will include 70 billion for schools k12. Thats an increase of 22 billion from the last budget. The governor is proposing 670 million in new healthcare spending for personal health, dental care and Substance Abuse. Brown also wants welfare checks increased by 5 . And, this is important, the governor says he wants to be prudent so he wants a Rainy Day Fund of 1. 6 billion. Tori, time now 7 09. A bicyclist recovering this morning after being hit by a tow truck last night in San Francisco. It happened about 5 00 last night at 7th and folsom streets. Police say the cyclist was at fault. It was riding the wrong way on folsom when she was hit. Now, police are checking Surveillance Video of the crash. The driver of the tow truck is cooperating and is not expected to face charges. That accident is the latest crash involving cyclists and pedestrians in the city. A bicyclist was killed last fall a block away from there. There have also been several accidents involving pedestrians in the past week. It is 7 12. Palo alto police will stop using tasers to capture fleeing buy sidelinist. This follows an incident in 2012 when a 16yearold boy was nearly injured by an officer attempting to tase him. The Department Says it could result in injuries as it causes cyclists to lose muscle control and fall off their bike. Police are now looking into alternative ways to apprehend fleeing cyclists and any other persons in motion. All right. Tori, time is 7 12. Can a victim also be a bully . A local transgender student who claims to be the victim of bullying explains why she is now being charged with battery. Its being called bridge gate. A big fouralarm fire burning out of control in san jose near 28th and julian street. We have been all over this story this morning. Its huge. 70 firefighters are out there trying to put these flames out. Some local businesses have been evacuated. We also learned that a nearby school, rocket ship chart he prep, will stay closed today as a result of this. Also, if you are driving in the area its something that you can see, which is disrupting traffic as well. And sal has been telling people that if you are driving in the area keep your windows closed so you dont breathe any of this in. Again, this is breaking news in san jose near 28th and julian. We will have more live reports coming up in a couple of minutes. Two people recovering from burns this morning after an explosion at the amgen Biotech Company in south San Francisco. A worker was burned in the face after an explosion in a laboratory at the amgen complex on veterans boulevard. Another employee was burned on the hands. Officials still dont know what caused the explosion. It blew out windows on the third floor. This is the second accident there to hurt an employee in the past 12 months. The worker was also seriously burned while collecting waste back in may. It is 7 16. Just about one hour from now new Jersey Governor Chris Christie will hold a News Conference to respond to reports that his administration crowed highway lanes in an act of political retribution. Text and emails leverage temperature aides it to a huge traffic mess for several days last september on the George Washington bridge at fort lee, new jersey. This is one of the biggest bridges, one of the most used bridges in the new york metropolitan area. Now, the messages suggest it was political retaliation against the fort lee mayor for not supporting christies reelection campaign. Some analysts even say the socalled bridge gate could tarnish christies image that it could impact his run for the white house in 2016. The negative narrative. And if something comes up which plays into that stereotype, that is extraordinarily damaging. Governor christie has always denied that this the lane closures had any political incentive and he released a statement saying he is outraged and that he was misled by a member of his staff. We will provide coverage of christies News Conference. President obama is expected to meet with lawmakers today to talk about scaling back the ns as controversial surveillance programs. President obama reportedly is looking at tougher rules for when surveillance of foreign leaders is allowed. The president may also limit the ns as access to phone records and add a public advocate position to the court that hands down decisions on surveillance programs. The public advocate would present the case for protecting privacy and civil liberties. The man accused of kidnapping and killing morgan hill teenager sierra lamar may enter a plea this afternoon. A hearing for 22yearold antolin torres is set for this afternoon. He was arrested in may of 2012 two months after 15yearold sierra lamar was reported missing. Her body still has not been found. A plea hearing for Garcia Torres has been delayed several times the lawyers are debating whether all of the evidence has been shared. It is 8 19. Rather 7 19. Bart is telling riders to stay patient as new railcars will start pulling into stations in the next few years. Bart has placed an order for 365 additional cars from a new York Manufacturing plant. The first ten are expected to arrive in the spring of next year for testing. Bart plans to buy a total of 775 cars with most of the delivery beginning in early 2017. Something to look forward to. Lets get everybody out the door. Sal, you have been busy since you walked in . Yeah, this fire has really made a mess of the Silicon Valley commute. Northbound 101 is slower than it normally is. The smoke is plainly visable from 101 near mckee. Thick plaque smoke. You see the Aerial Companies from the Fire Department there. Chp is asking drivers to keep your windows up if you have to drive on 101 anywhere near the smoke. They have been calling the Media Outlets asking us to tell you about that. This smoke obviously not a good thing for you to have too much contact with. As little contact as possible. Northbound 101 is backed up all the way back to before the capitol expressway. All right. Lets move along and take a look at the bay bridge. We have a backup there as well. Traffic is backed up for a 15minute drive time. Westbound 24 has been pretty busy. This looks like the old 24 before the holiday break. Its about a 12minute drive between 680 walnut interchange and the tunnel. 7 19. Steve. A very good morning. Lets talk weather. Lots to talk about here. We have a little bit of drizzle, a little bit of light rain. Measurable amounts. The big question is why cant we get a lot of rain in here . Its called a blocking pattern. So a lot of low clouds. Fog showing up now late to the party but its here. Lets get the football forecast out of the way. Everything is fine. Mostly sunny. Partly cloudy. 5558 kickoff for charlotte. So everything looks good. Rain coming in saturday if you are traveling there. Morning drizzle. Lots of clouds. Even some light rain reports. Half moon bay airport said light rain. A lot of cloud cover. This afternoon we will start to see a little bit better conditions. Usually for january San Francisco picks up 4. 5 inches of rain. So far. 02. We will not see a dry january. Its something. The driest. 26 back in 1921. The reason being everything is blocked. Its just locked in. Its the hudson bay low up in canada and thats where the strong low is where a very strong area of High Pressure. Much stronger deeper systems have been developing. The extreme cold this last week one example of that. Coldest since february 1996. Then High Pressure weakens and releads and fires back up. There are hints the jetstream right now, the river up air going up 25,000 feet goes way up over us. You know that. I know that. There are hints the forecast model is trying to undercut the ridge. If this happens, we will get a lot of rain. The big question is if. The longrange models show it and then back off on it. I will believe it when the shortrange model, which is three to five days out, show it. They are not showing it at all. They show very warm conditions next week. 50s on the temps here for most. Upper 40s, low 50s. A lot of cloud cover. Drizzle in the morning. Fog gives way to hazy skies. Some of that morning drizzle has added up. A few wet roads. We havent had much precip. 50s or low 60s. Everyone is in the same temperature range. North bay, south bay, maybe a little bit warmer for a few. Overall a mild pattern ear. These are not cold systems. They are cool fronts going through. A call to conserve the ad campaign being launched in marin county to deal with record low rainfall. Plus, San Francisco General Hospital may have a different type of emergency. Medical professionals at San Francisco General Hospital tell ktvu they have been crime victims while they are at work. The employees say cameras, wallets, computers have been stolen during the day and after office hours. They say the problem is happening a lot and they know how at least some of the crimes occur. Through from the adjacent building. The door between the two buildings is normally closed, but they were able to open the door with some kind of jam. Now, the Sheriffs Department denies there are more reports of stolen property recently, but the department will meet with Hospital Management next week. Ferry service from San Francisco to the south bay began monday on a trial basis. Google shutting buses have been the target of recent protests. This is these are live pictures of a fouralarm fire. Its burning multiple businesses, including an 80,000 square foot warehouse. Its having a major impact on the area near julian and 28th streets. Our li 50s and low 60s. Heres sal. Steve, a fifth alarm has just been struck at that fire. Just heard it come down in san jose. So even more Fire Companies will be arriving on the scene. Chp asks you to watch out for the Fire Companies from all over the south bay. We want to let you know also that the traffic is going to be busy on 101. Its busy all over the place because people have heard about this and they are using 85 and 280 instead. But 101 is backed up basically from 85 all the way through. The fire is right at this location here. So please give yourself plenty of extra time. There have been some accidents on some of the side roads. There is a pretty bad accident in marin county right now southbound 101 at lucas valley road. Traffic is jammed from 37. Bay bridge toll plaza is backed up for a 15 to 25minute delay. More like 25 minutes now. We are getting deep in this backup. This is really back to normal now. And the morning commute is slow on 80 westbound coming in from berkeley at el cerrito into the breaking news from san jose. That huge massive warehouse fire leading to the evacuations of nearby buildings. Ktvus janine della vega is there to tell us how firefighters are also making sure everybody is safe. Good morning. Reporter good morning, dave. I just talked to a fire battalion chief who told me this fire has gone from four alarms to five alarms. You can see there is just a massive plume of smoke in the air. You can see the orange glow of the flames. They are attacking this fire from the outside. Can you see several fire engine ladders are in the air and they are just dousing this with water because in the last half hour weve learned that the fire has spread. I also want to show you that the firefighters here on the ground, they were just using what appeared to be a chainsaw to go through those fences. I am not sure what other tactics they are using to get from behind that fire to get access to all those commercial buildings. Lets go to some video that we took earlier this morning. There has been numerous explosions that weve been hearing here. This fire started at about 5 40. Thats when they got the call. When firefighters arrived they found a commercial warehouse completely engulfed in flames. This was observed also by several residents in the area who immediately left their apartments. Right now were being told that there is at least 70 firefighters on the scene. It will possibly go to 100 firefighters. Again they dont have this under control. As far as we know there have been three buildings that have burned so far. We are being told that name of the business is vintage tile and roof. There is also a number of other warehouses there. Again, were told they are all commercial buildings, that some may have insulation in them. Others are vacant. But because of all these explosions that we keep hearing they think that maybe thats propane tanks. Here is an explanation that a fire official just gave us a short time ago of why this fire seems to be spreading so fast and why its so black and thick. Construction of that building, first of all, from what i could tell was tar and gravel in the construction of the top of the roof. When that catches on fire it helps feed the fire because its oil based. So its going to burn more intense. Thats why the smoke is so black. Also, any of the debris that drops down to the ground like that from the roof causes an influx of air which causes a large explosion. You see a lot more flames go up after that. Reporter again, fire officials and firefighters are going to be here on the scene near 28th and julian and the surrounding area for a long time. I do want to show you exactly a live picture of a school. A school this is the discovery rocket ship school that were being told is going to be closed today just because of, again, because of this fire thats going on. Again, the businesses, people who work around here arent going to be able to get to work. I also want to go back to a live picture of where im standing on the other side of the fire near 28th and julian. Its near the 101 and julian exit. You can see how the road is completely blocked off. There is a lot of lookyloos. People who heard about the fire, wanted to see it, you know. Authorities are sort of discouraging that, for people to stay away from the area. Again massive fire. We have seen a lot of flying embers. Fire officials are trying to get a handle on it. It has grown to five alarms. We will continue to monitor this situation and you will hear from people who did have to leave their apartments coming up in the next hour of mornings on 2. Reporting live from san jose, jeanine de la vega. Also new this morning Early Morning flames destroyed a house off highway 9 in santa cruz county. It was first spotted about midnight. Those flames quickly spread to a second home nearby before it was contained. The six people in both of those houses, they did escape. The investigation continues. Attorneys for one of several teenager boys accused of sexually assaulting a teenage girl in saratoga say her parents share some of the blame for her death. The San Francisco chronicle reports Defense Attorneys say audrey potts parents failed to get professional help for their daughters longstanding emotional problems. Attorneys also claim potts had had an argument with two of her friends in the days before her suicide. Potts took her life eight days after she fell asleep at a party after drinking heavily. Cellphone photos of her undressed with words written on her body were shared by students at her school. Some california lawmakers will be monitoring how the states public colleges handle student harassment and hate crimes. The committee will review policies and procedures at the california state university, university of california, and California Community college systems. This comes after last years racial bullying case at san jose state. The four white students accused of harassing their africanamerican roommate are now facing misdemeanor hate crime and battery charges. A transgender student from Hercules High School who claims it be a victim of bullying has now been charged with battery. Back in november 16yearold jewels gutierrez was involved in a fight with three girls that was captured on cellphone video. Jules claims she asked School Administrators for help but the bullying continued and thats why she fought back. The sophomore, however, is now charged with misdemeanor battery. It sends a message to bullies that you can bully individuals and that adults will then further victimize the person that you have been tormenting. Now, no charges were filed against the other people involved. Jules sister has set up an online petition to get prosecutors to drop those charges. A new campaign to stop the sexual trafficking of children will be launched today in alameda county. More than two dozen billboards will be unveiled today telling the offenders they are going to be prosecuted for buying or selling a child for sex. Ads will also be going up in bus shelters telling victims it is possible to escape. The fbi says oakland is a national hotspot for child trafficking. An estimated 100 children are sold for sex in oakland and any given night. 7 39. The arctic blast is continuing to pound the upper midwest. Some parts of minnesota could plunge as low as minus 30 degrees fahrenheit and the windchill could be 40 below. Some parts of the great lakes could receive up to a foot of snow. However, relief is on the way. Forecasters predict its the last stand before temperatures start rising this weekend. In nashville, tennessee, crews had to free two geese stuck in a frozen pond. Several people called the city after spotting the birds in a downtown park. The parks and recreation employees took a kayak to reach them and broke the ice with a mall let. One bird did have difficult itty to moving and was taken to shore to be examined. Its not clear how long they had been stuck. Time is 7 40. The marin municipal Water District wants residents to conserve water after the driest year on record in marin county. The Water District has launched the first ever wintertime ad campaign. They want people to cut back on using water. They are expanding on an earlier campaign urging people to take the 20gallon challenge. Thats reducing your water usage by that much every day. Probably shorter showers. Get a little smarter with the dishes. Do a little less laundry activity. Water district says if there is no significant rain by april 1st, mandatory Water Conservation measures may take effect. It is 7 40. The tern for the family of jahi mcmath says the health of the brain dead girl is improving. Christopher dolan went on twitter to say that doctors are optimistic jahis condition has stabilized from when she was taken from childrens oaklands childrens hospital. He says jahi is getting the treatment she should have received a month ago. He also confirmed the procedures to insert a breathing tube were a breathing and feeding tube were successful. It is 7 41. Two more local deaths due to the flu. The extra measures being put in place as the flu virus gets worse and worse all over the bay area. Bombs. Two people shot and a suspect holed up inside a house. Thats what triggered a Huge Police Response in san jose. The disturbing twist that has now become the center of an intense investigation. Good morning. 101 in san jose. Some slow traffic because of a huge warehouse fire. We also have a look at some of the other commutes in the valley and they are very slow. Well, all sorts of reports coming in on drizzle. Lots of fog out there as well. Can we get some good oldfashioned rain . Thats the big question before we warm up next week. Take a look at it coming up. Well, u. S. Stocks basically erasing both of yesterdays gains as investors considered accelerated tapering by the federal reserve. More increasing possibility as a drop in jobless claims. Further thoughts that tomorrows december payroll report will be a positive one. This could be bad news for investors. The dow is currently down 45. The nasdaq is down 12 and s p down 2. There is another good sign from the labor market. Firsttime jobless claims fell by 15,000 last week. 330,000 americans filed new Unemployment Insurance claims, and that is exactly what economists had forecast. They add early january can be volatile because Holiday Season jobs are ending. But it can be an indicator of which correction the direction the market is heading. Tomorrow the Labor Department releases the december jobs report. Macys stock is on fire. Its up over 8 right now after it announced it is eliminating 2,500 jobs across the country and shutting five stores. None of those stores are in california and most of the job cuts will come from administrative and behind the scenes positions. In san jose last night more than 20 sheriffs deputies responded to a report that a man had just killed two people and planted bombs inside and outside a home. But it turned out that call was a hoax. Now, according to the Santa Clara County Sheriffs Office the call came in 8 00 last night. Officers then responded to the home that the man described on fruit dale avenue. But when they went inside, they found the home empty. No explosives. That call came in from a cellphone which they are now trying to track down. Now, this all comes as a new law went into effect the first of this year. Its designed to put an end to those fake calls that some are now being called swatting where someone falsely reports an emergency and its often reported at a celebritys home. Now, this is video youre seeing of a Police Response if some training video in los angeles where they get a lot of these calls. Its called swatting because the nature of the emergency call is so urgent that the swat team is often called in. Police responded to a 911 call on wednesday claiming someone had a weapon at Justin Biebers home. Fake calls have been directed to the homes of ashton kutcher, tom cruise and miley cyrus. Under this new law callers or even their parents will be required to reimburse Police Agencies for the full cost of each emergency call, which can run as high as 10,000. The pranksters could also face up to a year in jail. A man with explosives strapped to a vest blew himself up at a military recruiting center. 21 army recruits were killed with dozens more injured. A growing number of young people are using Electronic Cigarettes to get high with thc oil. Thats the active ingredient in marijuana. The cdc doesnt have any facts or figures on how many teenagers are using ecigarettes with that thc oil, but 10 of students surveyed by the cdc in 2012 said they had used ecigarettes with nicotine or other additives. San franciscos commission on Community Investment and infrastructure has approved conceptual plans for the site. They include 16 blocks of new development, parks, and more than 1,500 new homes. 800 of which would be designated affordable home. Nearby the alice griffeth Housing Project would also be rebuilt. Plans include a new mixeduse retail, entertainment and Housing Development at the current Candlestick Park site. One of the most visable elements of Candlestick Park has become a hot item. Its San Franciscos recreation and Parks Department has sold 3,000 pairs of those orange plastic seats since they went on sale a month ago. The price has gone up by a 100 to 749 for a pair of seats. But it really has complicated matters in the south bay. As we move to San Francisco at the corner of 25th and crossover there is an injury accident there according to San Francisco police. 19th avenue and parker city are also very slow. Lets go to the bay bridge toll plaza. Thats cleared out. Seeing improvement here. It was up to 20 minutes. Now its like down to five, which is five. No problems on the bridge. And westbound 24 that traffic looks good as you drive from walnut creek to oakland. 8 02. Back to the desk. We are still following breaking news. What huge warehouse fire this morning in san jose. Look at the pictures. Its an 80,000 square foot warehouse on north 28th and east julian street. Now, several nearby businesses have been evacuated. The fire spread to nearby buildings. One area school, rocketship discovery prep, will stay closed today because of this fire. The ktvus alex savage has been out there for hours. Alex, there have been several explosions, too . Reporter yeah. This was a pretty dangerous situation early on. We just got an update from the fire captain here on scene. Obviously, flames, as you can see behind me, continuing to pour from this building. But they are beginning to gain some control and the fire at this point is no longer spreading. So a bit of good news out here. Firefighters have been battling these flames defensively for several hours this morning. Let me give you a sense of what things looked like when we first arrived at this scene early this morning. It was a very dangerous situation and we heard several large explosions. Firefighters say that may have been propane tanks inside some of these businesses that were burning here this morning. This is a huge building. 120 square foot commercial warehouse that holds several businesses, according to firefighters. One of those businesses, from what we can tell, is a place called vintage roof tile. Its also possible there are some other units in here that are vacant and are empty right now. The fire captain says that no one appears to have been hurt in this fire. It doesnt seem like anyone was inside any of these businesses when the fire broke out. Firefighters at this point dont exactly know how the fire started. But the construction of this warehouse certainly made this a very ditch fight. These metal core buildings are difficult. Its something we dont cut holes in or anything like that because they are so easily they collapse. We have to work off of ladders. But this fire was so heavily involved when we came on scene we instantly went defensive on the fire due to the size of the building and the construction of the corrugated roof and tar and gravel on the roof on one section. Reporter and this large fire has also caused another issue for people who live in this area. There is power out to a lot of people in the surrounding neighborhoods. Pg e intentionally deenergized lines around here because this fire was so large. We are told right now that pg e has about 4500 customers in the dark. Its unclear exactly how long the power will remain off for those folks. As we bring you back out to a live picture this morning, this is the back side of rocketship discovery prep Charter School. And you can see the proximity of this school to the fire. Its so close, in fact, that they have canceled classes for the day. So kids will not be coming to school at this Charter School today because of this large warehouse fire. Were told more resources still coming to this fire and now were told that firefighters will be coming in from some surrounding cities like santa clara and sunnyvale to help out. Alex savage, ktvu channel 2 news. Also new this morning san jose firefighters knocked down an Early Morning fire at an historic hem right here. It happened about 2 a. M. On the porch of a house on south 17th street. The couple inside escaped this safely on their own. Firefighters were able to save some family photo albums, but the house, it was badly damaged. My wife heard the smoke detector. I am a sound sleeper. She heard the smoke detector. You know, that was it. That got us out of the house. Fighting those flames were a challenge for the firefighters. This home was built back in 1907. Firefighters say the walls made out of wood and plaster, that allowed the flames to spread real fast. The cause of the fire still under investigation. Its 8 06. Doctors had cautioned that this flu season could strike early and hard, and it looks like their warning is coming true. Now two more deaths in the bay area are being blamed on the h1n1 flu virus. This morning ktvus Tara Moriarty has been talking to customers of a 24hour pharmacy in alameda. We understand that many have not gotten around to getting that shot yet . Reporter yeah, thats right. We have been asking folks all morning if they have gotten a shot and a lot of them said no. Some of them said they dont trust the shot. Some think they are going to get sick from it. Overall, the pharmacist here says he has seen a spike in the number of people who have gotten the shot recently. Now, there have been at least a dozen flurelated deaths in california. Five of them here in the bay area. Those two in marin that we mentioned and then one each in alameda, contra costa, and santa clara counties. In san jose there are so many patients with flu symptoms that Regional Medical center has pitched a tent to handle the influx. The hospital says the tent helps isolate those with the bugs from other patients where they can receive treatment without having to be admitted. One alameda man told us that the flu scares him. You got your flu shot this year . Of course i did. Reporter what was your main reason for getting it . Well, i work in Behavioral Health and its required or else i have to wear a mask. Reporter every year 15 to 35,000 people die of influenza. Doctors say the vaccine is not 100 effective. Its only going to protect you about 60 to 70 of the time. So its not foolproof, but it is better than nothing. So if you havent gotten a shot yet doctors say it is a good time to still get one. Live from alameda, Tara Moriarty, ktvu channel 2 news. 8 08. Meantime, in canada the first confirmed death from bird flu in north america. Health Officials Say the victim was from alberta, canada, and had recently traveled to china. The h5n1 avian flu is often contracted in either asia or northeastern africa. Most people who have died of the virus have come into close contact with infected birds. The Agriculture Department has suspended operations at a foster farms chicken plant in Central California because of an infestation of cockroaches. The usda says it took the action after seeing cockroaches near the processing line in the plant in livingston. Foster farms said it treated the facility yesterday afternoon and who he has to reopen soon once it gets the okay from the usda. It grosses me out. I mean, i eat chicken. The livingston plant is one of three foster farms plants in Central California linked to a salmonella outbreak last year in a statement foster farms says food safety is foster farms highest priority and the Company Took Action immediately upon learning of any concerns. 8 09. Happening today governor jerry brown will unveil his 155 billion state budget a day ahead of schedule because it was leaked to the media. And after years of big deficits this year california has a big sur plus. Economists predict california will have a 3. 2 billion operating surplus by the end of the fiscal year and that the surplus may reach 10 billion within three years. They are crediting the passage of proposition 30 last year and also the improving economy. Now, in the governors budget it includes 70 billion for schools k12. Thats up 22 billion from the last budget. The governor is proposing 670 million in new healthcare spending for mental health, dental care, and Substance Abuse programs. The governor also wants welfare checks to go up by 5 . And he wants a Rainy Day Fund of 1. 6 billion. 8 10. A bicyclist is recovering from serious injuries after being hit by a tow truck last night in San Francisco. It happened around 5 p. M. At 7th and folsom streets. Police say the bicyclist was at fault and was riding the wrong way on folsom when she was hit. The accident is just the latest crash involving bicyclists and pedestrians in the city. A bicyclist was killed a block away last fall. There have also been several accidents involving pedestrians in the last week. If anybody is riding the wrong way, i dont care what kind of vehicle theyre in or on, theyre up for some real problems. Police are reviewing Surveillance Video of the recent crash. He says he is embarrassed and humiliated by his aides actions and he has already fired one of them. At the top of your political operation that you do not have confidence in. As a result, ive instructed bill stepian to not place his name in nomination for state Party Chairman and he will not be considered for state Party Chairman, and ive instructed had him to withdraw his consultantsy with the republican governors association. If i cannot trust someones judgment i cannot ask others to do so and i would not place him at the head of my political operation because of the lack of judgment that was shown in the emails that were revealed yesterday. That has also been communicated to mr. Steppian last night. There is no doubt that bill has been one of my closest advisors over the last five years. And so for that, too, i am sad today to have to take this action. As i mentioned to you earlier, i spent all day you have been listening live to new Jersey Governor Chris Christie talking about what some are calling bridge gate. That was basically where texts and emails linking governor christies top aides to a huge traffic mess for several days last september on the George Washington bridge at fort lee, new jersey. That is a hugely important bridge. So many cars cross it. Its like the bay bridge or the Golden Gate Bridge here in the bay area. The messages that were uncovered yesterday suggest it was closing down a couple of those lanes was political retaliation against the fort lee mayor for not supporting christies reelection campaign. Now, we just heard christie say that he has fired his deputy chief of staff because of the emails involved and as recently as last month governor christie vi meantly denied that he or his staff had anything to do with the lane closures. You just heard there he said he didnt know about it but ultimately its his responsibility and some action has been taken. He said he has fired one of his Staff Members because she had lied to him. Now, there is speculation this still could have a big impact on christies expected run for the white house in 2016. He has been considered one of the gop front runners for that president ial run. There is a new development linked to the Asiana Airlines crash at sfo last july of the parts of the 16 yearold girl who was run over and killed by two fire trucks have filed a legal claim against the city of San Francisco. That claim may lead to a lawsuit. It accuses firefighters of knowingly putting the girl in harms way. It also accuses the Fire Department of not training firefighters to avoid hitting victims at a disaster scene. It is 8 19. In just a couple of hours a former advisor of oakland mayor jean quan will announce his own plans to try to become the next mayor of oakland. Dan siegel is expected to make his official announcement this morning. Siegel a well known civil rights attorney has lived in oakland since 1975. You can see all of the activity. We have been on this since 6 00 this morning and we just found out 4500 pg e customers have no power. As a result of fighting it fire. We will tell you how this fire is affecting other businesses, schools in the area. You can imagine the breathing air there, too. We will have a live report you coming up in just a minute. It is thursday, january 9. I am dave clark. Lets talk about weather and traffic. Steve has your forecast. I hope so there, dave. Clearing taking place to the north. Morning clouds. Then partly sunny. Partly cloudy. But it looks like most of the drizzle has ended there. A pretty good stretch for a while. High level clouds, midlevel clouds. Temperatures very mild. Near 50s for many or 54 for sfo. A couple of measurable amounts including in San Francisco. So we will not see a dry january. I will tell you there is some rapid clearing taking place to the north. Still clouds coming down. 30s up in the mountains. 50s in southern california. A lot of 40s around here. Expect for these higher clouds, tomorrow looks good. Sunshine and warm temperatures by sunday. If not then, monday, tuesday. Morning drizzle should be over. 50s for many on the terms. Here sal. Steve, we do have traffic troubles in many places. I want to show you some improvement. If you are trying to get to San Francisco the bay bridge is a good time to go. Traffic has recovered quite nicely. It was backed up for a longer delay, but now its only a very brief delay before we make it on to the bridge. San Francisco Park pro sidio at crossover a good area to avoid. This whole area of the city is terrible. We are also look at 280 in san jose. Northbound 280 looks okay. Thats because 101 traffic is very, very slow. I think people have just given up on getting into that part of the valley using 280 or 101. 85 is also very slow. You see 280 on the left heading south towards 101 is now feeling the effects of the 101 slow traffic. 8 32. Lets go back to the desk. Lets get back to our breaking news in san jose. That huge warehouse fire still burning at this hour. This started about 5 40 this morning. It has already destroyed a warehouse. It has caused evacuations, as well. Jeanine de la vega joining us live from san jose. Firefighters gave you an update seconds ago about the progress they are making . Reporter dave, they tell me 15 minutes ago they were able to knock down this fire and now they are concentrating on hotspots. People here in this area of 28th and julian are being told to shelter in place. You can see that the sky still has smoke in the air. I am not sure if you can make out the plume because of the drizzle and rain here. But from the top you can see there is really dousing this with the aerial ladders. Now, this fire we know is now five alarms. They are making Good Progress because all of this white smoke that you are seeing, thats a good sign that its running out of fuel. Now, the fire is burning at a commercial warehouse that is 120,000 square feet and holds various businesses. When firefighters arrived it was completely engulfed in flames and they were hearing explosions. They were initially told some of the buildings were vacant but others had insulation. There is a roofing and tile company here as well as a hay company. Some are built with metal. Others brick and they all share walls. But because of the materials inside, the way it was constructed, it really caused the fire to spread quickly. Nearly all the roofs collapsed and the fire spread throughout the building. Several apartment complexes are nearby and those residents who lived there selfevacuated. Within 20 or 30 feet you could feel the heat from the flames and everything and you just kept hearing buildings the buckling and the boom from the chemicals within the building and everything exploding and catching, igniting and stuff like that. So we were just, you know, concerned about that because of all the stuff when it was popping and blowing up and stuff. There was embers and stuff flying in the air and falling on top of cars. Reporter at least 100 firefighters are working on this fire. Again, they are fighting it from the outside from the aerial ladders. They called in Fire Departments from other cities to help them. They expect to be here several hours. Now, while the fire captain did tell me that they have knocked it down they are still not saying that its under control. Again, they need to concentrate on hotspots because this commercial warehouse is so big. They want to make sure nothing sparks back up. I want to mention there is a nearby elementary school, discovery rocketship, thats on the other side of the warehouse and were being told that that will be closed today. Again a police and fire want you to completely avoid this area near 28th and julian. Reporting live from san jose, jeanine de la vega. Its 8 35. Also new this morning, Early Morning flames destroyed a house off highway 9 in santa cruz county. It was first seen around midnight. Quickly spread to a second home nearby before it was finally contained. The six people in both of the houses, they did escape and an investigation continues. It is 8 35. Attorneys for one of several teenager boys accused of sexually assaulting a teenage girl in saratoga who later committed suicide say her parents share some of the blame for her death. The San Francisco chronicle reports Defense Attorneys say audrie potts parents failed to get professional help for their daughters longstanding emotional problems. Attorneys also claim potts had an argument with two of her friends in the days before her suicide. Potts took her life eight days after she fell asleep at a party after drinking heavily. Cellphone photos with her undressed with words written on her body were shared by students at her school. California lawmakers will be monitoring how the states public colleges handle student harassment and hate crimes. They will review policies and procedures at the california state university, university of california, and California Community college systems. This comes after last years racial bullying case at san jose state. The four white students accused of harassing their africanamerican roommate are now facing misdemeanor hate crime and battery charges. Our time is 8 36. A transgender student from Hercules High School who claims to be a victim of bullying has now been charged with battery. Back in november 16yearold Jules Gutierrez was involved in a fight. It was captured on cellphone video with three girls. Jules claims she had asked School Administrators for help but that the bullying continued. Thats why she was fighting back. Now, however, the sophomore is charged with misdemeanor battery. It sends a message to bullies that you can bully individuals and that adults will then further victimize the person that you have been tormenting. Now, no charges have been filed against the other people involved. Jules sister has set up an online petition trying to get prosecutors to drop the charges. An oakland bus stop located in front of a boys and girls clubs is still a drug haven for dealing and drug use. Some of the neighbors say they often find broken drug needles out there, trash, empty liquor bottles around the ac transit bus stop at international boulevard and 85th avenue. Children in the neighborhood who go to the boys and girls clubs nearby say they see a lot of that illegal activity. I see people and stuff and shooting up. We serve kids ages 617 and they have to pass by that in order to get to and from the club, to and from school, and to and from the church thats acrossed street. Last month ktvu first highlighted the problems with the bus stop. After our report the city as well as Clear Channel outdoors, which has a contract to maintain the shelters, sent crews out to clean it up. But now people say its just as bad as it was before. The arctic blast is continuing to pound the upper midwest. Some parts of minnesota could plunge as low as minus 30 degrees fahrenheit and the windchill could be 40 below. Some parts of the great lakes could receive up to a foot of snow. However, relief is on the way. Forecasters predict it is the last stand. The polar vortex before temperatures start rising this weekend. The marin municipal Water District is urging people to conserve water following the driest year on record in marin county. The Water District has launched its first ever wintertime ad Campaign Calling on people to cut back on water usage. They are expanding on an earlier campaign urging people to take the 20gallon challenge reducing their water usage by that much every day. The number one message is to turn off your irrigation system. That should be the default. The Water District says if there is no significant rain by april 1st mandatory Water Conservation measures could go into effect. Time is 8 39. Local Blood Centers say their supplies are running low and they creditically need donations. The Stanford Blood Center says there are typically fewer donations of blood around the holidays. The center only has a twoday supply of 0positive blood and thats less than half the ideal amount. Its very critical because we dont see an end to the cold and flu season any time soon. We keep getting cancellation, we wont be able to build our supply. The Stanford Blood Center supplies blood to seven bay area hospitals including stanford and the ba. They say you can make an appointment or just drop in to donate blood. All right. It is 20 minutes before 9 00. It was not what it seemed. The reason authorities in san jose are now looking for the person who called 911 to report a crime. And crews here in san jose continue to battle a stubborn warehouse fire, but they do appear to be gaining the upper hand. Lets bring you up to date on some of the other top stories we are following. Marin county reports its first two deaths from the h1n1 flu virus this winter. A 63yearold man died late last month. A 48yearold woman died monday. Doctors say flu shots, they are no guarantee. They are still the most effective way to prevent the flu. In the meantime, san joses Regional Medical center is seeing so many flu patients they set up this big tent to isolate and treat them. Today governor jerry brown will unveil his state budget after years of big deficits, economists predict california will have a surplus by the end of this fiscal year. The governor wants to increase spending for schools, for healthcare, and for welfare. And in san jose there was this big story this morning. At least 100 firefighters in san jose still battling a massive warehouse fire. It has destroyed the warehouse and caused several evacuations. In this fire started after about 5 40 this morning. It has been burning for hours. Residents in the area of 28th and east julian street have been told to stay inside w he also learned that Empire Gardens Elementary School will be closed today. Rocketship discovery prep Charter School is also being closed all because of that warehouse fire. And ktvus alex savage, you have been there since early this morning. Whats the latest on getting this under control . Reporter dave, after several hours heresay firefighters do appear to be gaining the upper hand on this fire. A live look beyond here. You can see a lot of white smoke being put off by this fire now, and that means its not actively burning the way it was earlier this morning. Still you have quite a few ladder trucks surrounding this fire dumping water on it. Trying to make sure that it is all the way out. They do appear to have control right now and the flames are not spreading. At least according to a fire captain. This fire broke out before 6 00 this morning inside this 120 square foot commercial building that houses a number of businesses. One of them vintage roof and tile. Its also possible that some of the units in the warehouse are vacant as well. A fire captain told us that there doesnt appear to have been anybody inside the building at the time. We talked with one neighboring Business Owner who raced down here this morning worried that the fire was spread to the event hall that he owns. I came here. The firefighters, you know, going back and forth, you know, while i was waiting. But i never would have thought that it was next to my building. Reporter reporter how close was the fire to your business . Its about, you know, 40 feet away from my building. Reporter and this massive warehouse fire had a huge impact on people who live in this neighborhood. A lot of people had the power cut by pg e. Pg e had to deenergize some of the lines to help out firefighters here so this wasnt such a dangerous situation for them. 4500 customers remaining in the dark this morning. Back out to a live picture, you see this fire is still burning. But san jose firefighters have it under control at this point. Now they will work throughout the day. New this Morning Police in million peadis are searching for three suspects in an Early Morning home invasion. It happened just after midnight at a home on tahoe drive. Police say five people were in the house but were not seriously hurt. Anyone with information is asked to call the million peadis blid. Two people shot and bombs inside a home. Thats the call that officers got in san jose and that sparked a huge response. But as ktvus palm cook reports from the newsroom, the whole thing was a waste of officers time. Good morning. In san jose last night nearly 30 sheriffs deputies responded to a report that a man had just killed two people and planted bombs inside and outside a home. But as it turned out that call was a hoax. Now, according to the Santa Clara County Sheriffs Office they set up a perimeter around the area of fruit de fruit dale avenue. San jose fire, police, and emergency medical teams were all informed. We spoke to one man who lives next door to the scene. Just answered the door last night about like 10, you know. 9 or so. I dont know. And there was the Sheriffs Office with an Assault Rifle asking me a bunch of questions. They had to use minores access to the backyard here. Reporter but when the officers went inside that home they found it empty and no explosives. The call came from a cellphone which they are now trying to track down. This comes as a new law went into effect the first of this year. You are looking at training video and other response video from southern california. This law is designed to put an end to those fake calls where someone falsely reports an emergency. Now, this happens a lot in los angeles where they get many of these calls often to the homes of celebrities. Its called swatting because the nature of the emergency is so urgent that a swat team is often called in. Police responded to a 911 call on wednesday claiming someone had a weapon at Justin Biebers home. Fake calls have been directed to the homes of ashton kutcher, tom cruise and miley cyrus. Under the new law that went into effect the first of the year callers or even their parents will be required to reimburse Police Agencies for the full cost of each emergency call that turns out to be fake. Getting there on 880 through oakland is slow here driving up north past high street. It gets better at 23rd. When you get to the toll plaza the traffic is light. Now at 8 51 lets go to steve. A hearing for 22yearold antolin Garcia Torres is scheduled for 1 30 this afternoon. Garcia torres was arrested in may of 2012 two months after 15yearold sierra lamar was first reported missing. Her body has still not been found. A plea hearing for Garcia Torres has been delayed several times as lawyers debate whether all of the evidence has been shared. Barry bonds will have to wait for another shot at baseballs hall of fame. However, another slugger with bay area ties has been selected.
