but again not affecting the freeway at the random lane west -- brand dome -- brandom lane west. today in washington the former acting attorney general sally yates will testify before the senate committee investigating the russian interference into the presidential election and yates is expected to tell lawmakers she warned the house about the contact between michael flynn and russia. she reportedly alerted the white house about the discrepancies between the michael flynn statements with this conversation with the russian ambassador. michael flynn was later fired. the fourth circuit u.s. court of appeals in richmond, virginia will hear arguments on the president trump travel ban to the six predominately muslim countries and will decide whether the travel ban violates the constitution. the ninth court of appeals in san francisco is looking at similar challenges of the travel ban and if the courts come up with different rulings legal experts say will probably go to the saturday morning around 10 am with the state on the first floor heard noises and saw a man prying open his window. the suspect took off. sunday evening at 8:15 pm a student reported seeing a man standing outside of his window possibly with the chain. when that person was spotted he also ran away in the victim said that he could've had another man with them. the suspect descriptions are similar, a hispanic male in his 30s. there could be new measures on campus soon and we are following reports that work will be done to make this path, "this scary path" making it safer and we will talk with students to get their take on what they feel about the campus safety and the recent incidents occurring over the weekend. it is 6:05 am. a san jose man facing charges of attempted murder of a police officer after firing shots at them yesterday and the third officer involved shooting in san jose within a week. yesterday was just before 8 am and the police say the suss back have been looking suspicious at the sporting goods store and when the police arrived the man pulled a gun and started shooting at them. the police officer return fire and no one was hurt. the police say the suspect jumped over a fence into the mobile home park and was arrested. they also found a handgun which they say it had been reported stolen in a burglary in 2013. >> the actions of the suspect were appalling and the continued violence toward law enforcement officers is equally appalling. >> the police say the suspect is believed to be homeless with a history of mental illness. the republicans in entire refinery. they had to release the chemical buildup to prevent the explosion inside the refinery and they will have to continue to do that as they bring the entire refinery back online but the smoke will be released on the north side so they can inspect the south side which could take several days. the fire at the san jose church being called suspicious and is started at 2 am yesterday at the church of the east on minnesota avenue. the firefighters quickly got it under control and the exterior of the building was damaged but the inside was not. the investigation into the cause of the fire continues. texas governor greg abbott signing the sanctuary city ban into law over the weekend and those opposed staged a protest outside of the governor's mansion in austin yesterday. the law will allow the police to ask if someone is in the u.s. illegally during a routine stop and threatening sheriff's with jail time if they do not cooperate with the agents, and the police chief in dallas, fort worth, austin and san antonio have publicly opposed the legislation. it is 6:14 am. for the most part the commute looks okay with some slowdowns. not a lie commute but we have some slowdowns on 280 to start off with northbound to 80 traffic not looking bad driving through downtown san jose. i 85 and 101 are okay. no major problems. as we look at the east bay commute slowing down on 880 and 680 we had earlier crash southbound at the bottom of the sunol grade. you will see the traffic out of dublin all the way down into fremont slower than what we would like to see. we received a tweet from someone saying there is a backup on the vasco road, and the marsh creek road is closed at the morgan territory road due to mudslide which could be putting more pressure on the other roads in that area. here is a look at the westbound bay bridge backed up for a 15 to 20 minute delay. it is 6:15 am. do we have new mudslide or the old mudslide? >> it is the same one but the chp has put a looking at the bodega bay water temperature at 47, 50 in san francisco and half moon bay at 51. when we get water temperatures that cold with the westerly breeze, they have no problem popping up the fog and low clouds. 40s and 50s, cool morning and 47 at the concord pavilion, 47 in black hawk and walnut creek, 50 at vallejo and martino's, and 30 in truckee. monterey at 50 in santa barbara at 46 in la 49 so it is cold down there today. the aerial flood advisories out for the west fork of the carson due to that snowmelt, and that goes through friday. keep an eye on that and also at the merced. secret funds connected with the office of janet napolitano, and we will explain how the discovery is pushing the state lawmakers to introduce new bills. >> reporter: one of the new bills proposed to the state lawmaker out of stockton punishing you t holding state funds by paying the administrators more than the governor makes and this is an ongoing issue over the past several years. the 2015-16 fiscal year, 712 use the administrators earned over $182,000 year, more than the base salary of the governor, and a 60% increase in the number of administrators that made the amount of money five years ago. this bill would propose the amendment to the california constitution to allow voters to decide whether to prevent the uc system from wasting and raising the tuition when the administrators make more money from the governor. a constitution amendment would be needed and unlike the cal state university system the uc system is autonomous from the legislature with their own government going back over 100 years. the only way the state legislature can compel the system to do anything is by threatening to withhold the money. they have been lobbying hard to prevent passage from any bills that will chip away at the autonomy and the situation may not be any different for the latest bill for possible action on the proposed constitutional amendment in the state senate. lawmakers have yet to take the next step on the bill. it is 6:24 am. san francisco has a new online way to apply for affordable housing opportunities calming and it will allow people to submit applications for affordable housing on the lottery online instead of submitting written applications to each project and then showing up the day of the lottery to see if the number is called. the odds are high with hundreds typically submitting applications when the affordable housing opportunities become available. it is 6:25 am. the nonprofit organization pledging $100 million to fight homelessness and they want to reduce the chronic homelessness by 50% within five years, and this is the biggest of its kind for a donation made to san francisco, used to crate new housing and imprudent mental health, and according to the moran journal, many in the school district have sent letters to the parents urging the parents to watch the series with their children and to have a conversation about the content . administrators are concerned about the graphic nature of the show in which a 17-year-old girl commits suicide. the series is receiving national criticism for glorifying teenage suicide in some administrators are worried about the possibility of copycat behavior. there is a chance that administrators believe, some of the students may identify with some of the same to the show because much of it was shot in marin and around the bay area. we should point out that on sunday netflix announced it has renewed the series "13 reasons why" for the second season.>> it has a lot of appeal because they shot the series around their and it is not recommended for younger kids under the age of 16 but they are curious because they want to see their town, their school, or whatever in the movie. >> that is my there is so much concern. >> reporter: they are afraid the kids will identify with the locations they are seeing, and it could trigger more emotions for the kids watching the show because uber driver who stopped at a gas station saturday night to use the bathroom when two man jumped in his car and told him to drive to pier 39, then pulling a gun to force him to drive around san francisco and ended up driving to richmond. the carjackers told the uber driver to take money out of his atm and they stole his car when the victim ran away. they're looking for the 2015 white toyota company nor did he have any properties to rent. two officers killed in their apartment in boston, dr. lina bolanos and dr. richard field were found after the police responded to calls with the man with the gun and reportedly the doctors were engaged to be married. the suspect started shooting at the police when they arrived on scene, and he was shot and wounded by the police. the police believed that they were targeted. the police in las vegas arrested a 27-year-old man they suspect killed a southern california man with a single punch and the police use this surveillance video to identify the suspect they say, james beach, walked away after punching a 45-year-old in las vegas for a bachelor party. the man fell unconscious to the ground and died four days later and survived by five children. beach known as james garcia is facing a charge of murder. some upset over the removal of the three confederate monuments and both sides facing off as hundreds gathered at the memorial honoring confederate general robert e lee. the city of new orleans will be taking down several monuments and one was taken down last month. the mayor of new orleans says that statue puts the confederate on a pedestal which is out of step in today's values of racial diversity and inclusion. on the other side, supporters of the monument say this honors southern heritage and history. >> we
