federal court, fighting for their rights against officers sweeping up and taking their possessions along the streets of denver. the hearing is this morning at the federal courthouse. colleen ferrara is live this morning and, colleen, nine people who are hopeless are suing the city in this case. >> reporter: you know, we have this group of homeless people filed, saying their constitutional rights are being violated by the city of denver during these homeless sweeps where the camps are all taken away and the city takes all their belong ings. the mayor said it was an attempt to get rid of unsanitary and unsafe conditions. according to the attorney representing the this case, he requested the homeless without i.d. be allowed to attend. they will have breakfast for the group of people and will hold a little bit of a news conference to talk about what they hope to accomplish today in that hearing so again, the hearing begins at 9:00 a.m. this is a battle we have seen for some time mcconey wasn't able to participate. he did fail to qualify by not reaching 10% of the polls. he's reaching 2%. >> bennett and next did qualify. bennett is leading in the polls but didn't stop either from speaking their mind. they spoke on the presidential race between clinton and trum . bennett made sure to bring up the lewd audio of trump comment on rim. now, next has flip-flopped on his reactions and whether or not he supports trump but bennett made his thoughts clear. >> i didn't hear. >> he suspend his endorsement of trump but is "trying to show him grace." he called out bennett for not being more critical of clinton. are you? you have yet to say anything. >> glenn urged ben tote say clinton was wrong when calling trump supporters "a basket of deplorables." he said he didn't spring when they sent out that notice saying they want to clear out these homeless camps. they were doing sweeps. the mayor at that time said some air yays were becoming unsafe, unhealthy, unsanitary. the homeless people are asking for relief from the sweeps where their profit is taken and they never see it again. they said the ordinance is not unconstitutional. according to the attorney representing the homeless, the court issued a rare order allowing homeless people without an i.d. to enter federal court and attend this hearing so they can be inside to see what happens when they take on the city. we will see activity taking place out here at 8:00 this morning. they're going to have a knew conference of what they hope to accomplish and we know are thousands of them out there, here in the city of denver. this lawsuit only involves nine of them, tarhonda, and it's an attorney in denver that's taken that on. the hearing beginsed begins at 9:00 this morning. >> they said the who did not get a fair trial because of his race. one of the jurors was biased against mexican people. other jurors said he made racial comments during deliberations in 2007. the jury found the man
