It was very disappointing that this couldnt go forward, but the fact is that this kind of sleaze campaign over the last three or four weeks was really too tough for me and my family and, you know, we just decided it was much better for donald trump to select someone who doesnt have a 30year paper trail. If people were looking at things i was writing 25 years ago and looking through my divorce records and it just was too difficult for us. I feel like ive let a lot of people down, the president most of all. He was incredibly nice and kind and when i told him about this and he understood, but, you know, im bummed out, frankly, that im not going to be over there at the fed because i think i could have brought some ideas that the fed really needs. Well talk about that in a bit. Moores withdrawal happened on the same day as the chairman of the Federal Reserve Jerome Powell ignored the request to lower Interest Rates and said he saw no reason for doing so. The dow is off about twothirds of a percent on the news that the fed not going to be reducing Interest Rates, which by the way, most mainstream liberal and conservative economists agree that right now is not a time to be lowering Interest Rates. Joining me now is auston goo goolsby. Heres the thing, the president put Jerome Powell in. There was no particular need to replace the existing the chairman of the Federal Reserve but he put Jerome Powell in. Powell did not seem to be doing his bidding. So he had two nominees to the Federal Reserve board and Jerome Powell a sayiis saying theres reason to be lowering Interest Rates at the moment. The president loses but maybe the economy wins. Correct. I think in the midst of all of this stuff going on, the Mueller Report and the attorney general and all those controversy, this was really a brazen, almost unprecedented play by the president to strong arm the fed. So you had the triple whammy of, first, the president getting up and publicly harranguing the fed chair, which was totally inappropriate interference with the independent fed while smu y simultaneously nominated two people, herman cain and steve moore, who have no experience on Monetary Policy or inflation that normally would be putting aside, it was a power play that failed but the president still has cards, right . He can still nominate someone else. There are 330 Million People in america, some of whom are actually economists. The president can appoint a likeminded person to the fed, but theres a construct at the fed that still cause it is to be a wellregarded institution because it seems to be a place that bases opinions on data and evidence. What does the president do here . So far. So far. Look, i think it will be harder than you think perhaps for the president to get what you call the likeminded people. So somebody whos going to be an explicit partisan and go to the fed and try to advocate in a political way, lets forget what the economy situation is, forget the financial situation, lets just do whats good for Donald Trumps political prospects, i think you would be hard pressed to find somebody who knows about mondetary policy or is an economist or about inflation or about banking, somebody who is an expert. I think it would be hard to get somebody who comports with that and given what weve just seen with the attorney general and given what weve seen with the acting heads of these agencies and their resistance, i think were going to be hard pressed to shove people through if all theyre going to do is be rubber stamps for the president. I think the president backed himself into a corner. There arent a lot of economists out there who dont think Economic Growth is a good thing. There are variations of how much growth is good and how that receipts to inflati relates to inflation, but generally speaking, most people want the economy to grow and want the stock market to perform well. Stephen moores thoughts were outside of the mainstream in some cases. Im not going to have any personal belittling with steve moore. Ive had friend live coly comba steve moore for years, debate on this program, on tv. Steve moore is a political figure, and his interest area is not Monetary Policy, is not inflation, is not banking, its not the financial system, its not anything that the fed has to do with. So, like herman cain, which is even more so, it was an explicit im going to pick two people who dont know about this but theyre for me, donald trump, and im going to try to shove them on to the fed. You and steve and i were probably together in some of th them. I want to turn to capitol hill now and the latest on attorney general william barr. After hours of testimony in front of the Senate Judiciary committee yesterday, attorney general william barr declined to appear for questioning in front of the house Judiciary Committee today over disagreements with the plan for him to face questions from committee lawyers. Now Democratic Committee members are moving closer to holding the attorney general in contempt of congress for refusing to comply with its subpoena for the full, unredacted release of Robert Muellers full report and the underlying evidence with it. Earli earlier nancy pelosi said he committed a crime. How sad it is, how sad it is for us to see the top Law Enforcement officer in our country misrepresenting,wi misrepresenting, withholding the truth from the congress of the United States. Reporter madam speaker, did he commit a crime . He lied to congress. Nobody is above the law. And a Statement Released said speaker pelosis baseless attack on the attorney general is reckless, irresponsible and false. Theres nobody on capitol hill that does not have a view on how william barr has handled this. Thats right. Democrats make the point that its one thing to have an attorney general who is devoted to the unitary executive theory, that the executive has broad, sweeping authority. But they say when it comes to barr, he in their view is running interference for trump. Youve seen this escalation and tough talk from nancy pelosi, the House Speaker and from jerry nadler, who chairs the house Judiciary Committee. So this all follows this doublebarrelled disc that the d. O. J. Is issuing to house democrats. Barr was a noshow at the committee hearing, as you mentioned, and the d. O. J. Blew through the deadline yesterday for the d. O. J. To turn over the full unredacted Mueller Report. So the question now is what comes next. Heres jerry nadler in his own words. We are going to use what process we have in the courts and elsewhere to get the answers and the information we need, in particular the subpoena for the entire unredacted Mueller Report and the underlying documents was due yesterday the attorney general, we got a letter late last night, refusing to adhere to the subpoena. This is indefensible, and it is part of the attack on american democracy by this administration. We will make one more good faith attempt to negotiate and to get the access to the report that we need, and then if we dont get that, we will proceed to hold the attorney general in contempt and well go from there. Reporter when it comes to the specific timeline, nadler said he would give the attorney general a few more days, until around monday, and if they dont get what they want and he doesnt think that the a. G. Is acting in good faith, theyll move to hold him in contempt. It could take years as it goes through the court system and precedent does not bode well. But they only have a few options to put teeth behind their enforcement efforts. While barr didnt testify before the house, he had plenty to say yesterday. I want to take a second run to go through a few of this many. Lets start with the attorneys admission he did not actually review the underlying evidence in muellers report before submitting his principal conclusions in which he determined that the president did not obstruct justice. Remember, muellers report said, quote, if we had confidence after a thorough investigation of the facts that the president clearly did not commit obstruction of justice, we would so state. That was in the Mueller Report. Based on the facts and the applicable legal standards, however, we are unable to reach that judgment. With inthat in mind, listen to yesterdays exchange. My question is in reaching your conclusion, did you personally review all of the underlying evidence . No, we took did did mr. Rosenstein . No. We accepted the statements in the report as the factual record. We did not go underneath it to see whether or not they were accurate. We accepted it as accurate. All right. Then there was the moment where the attorney general basically asserted it was within the president s authority to replace an independent counsel, in this case the special counsel. Muellers report revealed in june of 2017 the president called then White House Counsel Don Mcgahn and directed him to have the special counsel removed. The report said, mcgahn recalled that the president called him at home twice and on both occasions directed him to call rosenstein and say that mueller had conflicts that precluded him from serving as special counsel. Listen to what the attorney general said about that yesterday. If the president is being falsely accused and he felt that this investigation was unfair, propelled by his political opponents and was hampering his ability to govern, that is not a corrupt motive for replaces an independent counsel. And then there was this telling moment, the point where barr was unable to answer whether the president or anyone in the white house ever suggested he open an investigation. Listen for yourself. Has the president or anyone at the white house ever asked or suggested that you open an investigation of anyone . Um, i wouldnt yes or no . Could you repeat that question . Has the president or anyone at the white house ever asked or suggested that you open an investigation of anyone . Yes or no, please, sir. The president or anybody else. Seems youd remember Something Like that and be able to tell us. Yeah, but im trying to grapple with the word suggest. I mean, there have been discussions of matters out there that they have not asked me to open an investigation but perhaps theyve suggested . I wouldnt say suggest. Hinted . I dont know. Inferred . You dont know . Okay. Wow. All right. To get into why all this matters, i want to bring in experts, attorney and former democratic congresswoman lynn holtzer, shes the author of the case for impeaching trump and former federal prosecutor who worked with Robert Mueller in the u. S. Attorneys office in d. C. And she is an msnbc legal analyst. It doesnt matter what you think of kamala harris, shes a former prosecutor a good one. These asking bill barr a question that by most standard, including those of my viewers and none of us who are lawyers was not that complicated a question. She then gave him a lot of space, suggested, hinted, inferred, sounded like she was ready to go down a list. The bottom line is bill barr couldnt say the president hasnt told him to investigate someone. Obviously there had been conversations and we need to know about it. Just from a practical like a practice aspect, a lawyer moment, that was very sweet because she wasnt one of these people who asks a question and then has the next question written by the staff. She listened to the answer and then followed up and followed up and followed up. It was a very nice lawyerly moment and very impressive and what it makes you think is someday sitting in the situation room, thats a person who knows how to press for answers that are important for the country. Liz, you have been in a position of being a prosecutor and youve also been in the position of being a legislator so youve seen that in action. What was going on there . The implication here as we have been seeing unfold over the course of the last few weeks is that william barr seemed to have been carrying Donald Trumps water on this one in deliberately misrepresenting what was going on in the Mueller Report. We have now learned that Robert Mueller himself sent a letter to william barr to say i think youre not really representing what i wrote or thought very accurately. Where do you think this leads . I dont know where it leads, but where we are now is in a very precarious moment for our democracy. We have an attorney general of the United States who is covering up for the president. We have an attorney general of the United States who may even have lied in two congressional hearings, one with regard to the one in the house when he was asked about the discomfort or the disagreements by the mueller staff and once in the senate when he was asked about whether mueller agreed with his conclusion and his statements were at best misleading and possibly false. We have an attorney general who admitted he didnt even read the underlying documents. But im not even sure he read the report. If we stop and think about cory bookers questioning of him, i thought to me this was one of the most shocking moments lets play this for a moment and we can talk about it. Lets play the core ey booker conversation. We have a document that shows over 200 connections between a president ial campaign and a foreign adversary, sharing information that would be illegal if you did it with a super pac, we know that what information was shared . Polling data was shared, sir. Its in the report. I can cite you the page. With who . Probably one of the most critical facts is whether or not Paul Manafort and to the extent to which Paul Manafort conspired with the russians, we have a possible conspiracy issue. Paul Paul Manafort did not cooperate with the special prosecutor about this so its possible you have and because its possibly because of president trumps stating to him be strong, in essence, dont cooperate, hes a good guy. So we have a situation in which the attorney general didnt seem to be familiar with one of the key facts. How can he come out and Paul Manafort is not a random guy in this whole thing. No, hes the campaign manager, he met with the russian that our Intelligence Community believes is connected to russian intelligence. He gave that person connected to russian intelligence during the Trump Campaign trump polling data. This is a corroboration, collusion and possibly conspiracy. How can the attorney general of the United States not know that fact and then on top of it make a decision that theres no evidence to warrant obstruction of justice . I mean, its just a complete were living in an alternative reality where they are making up the facts. They dont know the facts, they make them up and whats happened to our system of justice . So, cynthia, arguably the special counsels report is on the top three things, most important things that Robert Muellers ever done and top three most important things that William Barrs ever done but barr didnt talk to mueller about this. Barr didnt look at the underlying evidence, he testified to that and he didnt have a real conversation about the idea what did you find, what are you not telling me, what am i supposed to take away with this . That seems strange to someone like me who has never been a lawyer, seems odd that this is very important. Why did barr not have a conversation with mueller . The reason you dont understand it is because you assume like many of us did that barr would be an honest broker in this situation. He is not. He got this information, its 448 pages, i know youve read it. I read it. Its very dense. I had to read it several times. You cant read it in 48 hours and know whats in it. So what you would have to do and what would always happen in the department of justice if a supervisor was overruling the line prosecutor, which essentially is the situation we have here, is there would be a series of conversations and meetings. What happened . Why this testing of this. You said this about that witness but that doesnt make sense to me. What did do you about that . How come you didnt interview that witness . Thats the type of conversation that happens at the department of justice every day. It didnt happen here because it was preordained, all decided in advance. Thats the problem. Thanks to both of you. A major drug Company Founder has been convicted, accused of leading a scheme to bribe doctors into prescribing a fentanyl spray that fueled the opioid epidemic, meant for Cancer Patients suffering from the most severe kinds of pain. But prosecutors say these bribes and kickbacks motivated physicians to prescribe the pain killer to patients who didnt need it. Joining me is tom winter. This is the highest ranking pharmaceutical executive to be tried and convicted in a case involving the opioid epidemic. Thats correct. Its really kind of a shocking case. Most of the people that were given and prescribed this drug that was designed for Cancer Patients exhibiting the most extreme forms of pain actually did not have cancer. And the more that these doctors prescribed, the more money that they were given. There were kickbacks involved, there was also a rap video that was played at trial. So basically they traded a marketing video, put it to a popular rap song, even had their head Sales Executive dress up as a bottle of the drug that is highly addictive and parade around and extoll the virtues of getting these doctors to prescribe this drug. These are drugs that could get a patient hooked almost immediately. And this is a scheme that was perpetuated according to the charging documents up to the found are and up to the ceo level all throughout the company. So today it was a guilty sweep of five people, including the companys founder were found guilty. They face up to 20 years in prison on a rico case eessentially that looked at the overarching behavior that was exhibited here. To date this is one of the significant prosecutions sought by the government and today resulted in five guilty verdicts. And drugs like this are usually for Cancer Patients in the latest stages where addiction is not much of a concern because the pain is so great. There are valid concerns i get from viewers about the fact that all of this attention to prescription pain killers is causing a lot of doctors not to diagnose or not to prescribe pain killers for other patients who are in chronic pain but thats a valid concern but fentanyl was never meant to be taken by anybody except those at the end of life or in the worst pain imaginable. Essentially correct. Save we had a candle here on set and we called in the new York City Fire department and used five fire hoses to put it out. Its ridiculous. When you start to involved medicare, medicaid and federally financed programs or federally sponsored programs, then that gives them a little bit of an access to entry here to be able to begin prosecutions, and certainly when you involve kickbacks and bribes that are used, thats something that definitely catches federal investigators attention. They brought this case here today. Yes, many people have very valid reasons for being on opiate medications and getting that level of pain relief. In this case, though, its very clear according to the charging documents that thats not what occurred and that these people were prescribed pain medications and opiates here, the subsys spray that went far beyond anything they would have needed. We have other business to talk about but we do have this breaking news that the mayor of baltimore after several weeks of investigation has resigned in a selfdealing book scandal. Can you give me the context of your thoughts on this . Sure. This has been a very troubled time in the city of baltimore. The mayor made the right decision today. She made the necessary decision today, and jack young, who has been the acting mayor, hes currently the head of the Baltimore City council will take over the reins and i should say that the maryland congressional delegation already met with jack young a few weeks ago, were going to do everything we can to support him and Baltimore City. Senator, let me ask you, i want to go back to bill barr and what is going on with all of these new revelations that weve had. Senator Richard Blumenthal of connecticut asked attorney general barr about your exchange with him last month during yesterdays hearings. Lets just listen to this together. Heres what bill barr had to say about that. If our control room can just play that exchange between senator blumenthal and attorney general william barr. Okay. Im going to hold off on that for now because were having some trouble getting that, senator. But the issue here is that bill barr, it turns out according to some people was not particularly honest with you and with others about what he knew and what was in the Mueller Report and that is starting to come out. Whats your take on it . Well, i think weve seen a series of deliberately misleading statements from bill barr. First of all, we had him put out his fourpage memo, which mischaracterized lots of the Mueller Report. Of course mueller sent him a letter, which had not been previously disclosed by barr expressing muellers concerns about that report. When i asked attorney general barr at a hearing weeks ago about whether or not bob mueller supported barrs conclusions, his answer was he did not know, which at the very least is misleading. I think deliberately misleading. The honest answer to that would have been, hey, i heard from bob mueller, in fact, i have a letter from bob mueller. Bob mueller has expressed some concerns with the conclusions that were reached. And thats what i asked him about and he clearly decided not to disclose that information at that moment. To me thats misleading to the congress and to the public. So, senator, you are a member of congress. So many members of congress are calling for the impeachment of william barr, many are calling senators and members of congress and president ial candidates are calling for him to resign. But lets just step up to 50,000 feet for at minute. This is kind of remarkable, right, the fact that bill barr didnt sit down with bob mueller in what is arguably the most important thing that both of them are ever going to do in their professional careers, the idea that bill barr had communication from Robert Mueller that indicated dissatisfaction in the way that barr had characterized the report and the fact that im not a lawyer and i could have represented the Mueller Report 430 pages of, 438 of it more accurately than bill barr appeared to and kept the public in the dark for a few weeks. What do we do about this . The reason that so many of us, including myself, have called on the torattorney gener to resign is because he is totally abusing the trust of the attorney general. He has become president trumps spokesman rather than the lawyer for the people. So what do we do . There are some who are in the house discussing impeachment. The challenge for the house, as you know, is they have so many ongoing investigations to try to hold this administration accountable, to try to get the facts out, theyre going to have to prioritize how they go about all these challenges. And so that is why this is such a difficult moment. But at the very least, in addition to getting bob mueller to give unfiltered testimony to the American People and to the congress, i think the house should call in a lot of the key witnesses that appear in the Mueller Report so the American People can hear from them directly. I mean, how many people have a chance to read a 400page report, right . But if you did read it, you would come to a different conclusion than bil bal barr di. Thats the sort of fascinating part. That is exactly right. That is why barr decided to put his misleading spin on this report from the beginning because he did not want the American People to have the unfiltered truth here. So we are playing catch up. We cant expect the public to read a 400page report. What we should do is allow the American People to hear the story unfold in hearings. And that has to be, it seems to me, the first step and then the congress can decide what comes after that. Senator, youve always been involved and concerned about the economy. Youre a member of the Senate Appropriations of banking, housing and urban affairs committees. Stephen moore, the president announced earlier in a tweet that he was withdrawing from consideration for Federal Reserve board of governors. You issued a statement which read Stephen Moore has long favored policies that favor corporate billionaires at the expense of main street. His distan for factually accurate Economic Projections and his comments about women should have disqualified him from the start. What is going on here with the president s appointees . Two of which have fall i dont know fallen from the wayside because they could not garner enough votes to be approved. This reminds me of what is called the gong show, right . Both candidates have been disqualified because they dont have enough support in the United States senate. Given the kind of nominees who have gotten through the senate, its a very low bar these days. So for steve moore to be disqualified because some republican senators wont support him is a sign of just how bad he would be on the Federal Reserve. This a guy who puts politics before facts. He is always spinning a party line rather than looking at the facts. And in addition to that, hes made awful comments about women and others. About 30 of children in foster care have severe emotional, behavioral and developmental problems and some children have physical health problems, but most are resilient and are determined to go on with their lives. Federal data shows that 44 of children in foster care during the 2017 fiscal year were white. 23 were africanamerican, and 21 were hispanic. Now despite the common perception that the majority of children in foster care are young, the average age is about 8. 5 years old. And on average a child spents just over a year and a half in foster care. The system is the title of new documentary titled foster. I have one of these children in my life. His name is patrick. I met him when he was 6 years old. Its been 25 years he just turned 31. Hes an example of the consistent care in a childs life can make. Whats the thing that needs to be sorted out or understood in our foster care system. There are a lot of misconceptions. Foster care is misunderstood. There are a lot of stereo types about everybody in the foster care system, case workers, children. Case workers are seen as child stealers. Children are seen as damaged goods, not able to have a successful life. The other thing thats important and you alluded to it here is that foster care system reflects some of the larger problems of our society that list of things i put up there. Those are the problems in our society. Theyre reflective of the fact that parents cant take care of their children. Neglect is the largest reason that kids are in foster care. Debra you represent so many voices in the film. You spoke with a social worker who spent her childhood in the foster care system. Lets listen to what she told you. I never wanted to be a social worker, thats for sure. A lot of my youth was spent in the Child Welfare system. I hated the system. And i hated social workers. A lot of negative things to say about dcsf, and everyone would say you need to walk in their shoes. You dont know what its like on their side. To be a true advocate you need to know where the other side is coming from. When i started this job, its very humbling because you dont know anything. You dont know anything but what they choose to tell you, and hopefully some of that is the truth so you can try to provide some services to the family. This job is hard. Deborah, what did you not know when you say you dont know anything about the system. You had some direct involvement in it. As you did this film, what surprised you the most . The billions of dollars spent on the system. The enormous caseloads that make it very, very challenging for anybody to devote time to children. And really the brain, how a childs life can be turned around by the proper intervention, Trauma Informed Care and people who are really dedicated to improving their lives. Mark what would go ahead. You see in the clip, the amount of paperwork. The paperwork represents the massive number of people the system tries to deal with. As someone in our film says, each case is individual. You cant look at them as statistics. Each of these kids has a remarkable potential. But its a government in many cases its something administered by some level of government. Is it, as we often think about Government Programs that are bad, broken or wasteful or whatever the case is. If you had to evaluate the foster care system, how would you rate it in america . There are people who have gone to the leaders and said theyll convene them and say, is there anybody here willing to say their system is working at an excellent level, none of them will. Its a bipartisan issue, theres been new legislation thats going to go into effect in october of this year, that moves from a reactive model that intervenes at a time of crisis to a preventative model that will try to help the parents and keep families together.
