Is, he is more the president s lawyer than he is the lawyer for the United States and our constitution. I think he should recuse himself from the 14 criminal referrals that came out of the mueller inquiry. It turns out he didnt even look at the evidence. That is a report. It is not evensvillidence. If i were trump, i would fint them. I think this is trying to destroy him and his family. Did he commit a crime . He lied to congress. He lied to congress. This chairman wants to make a subpoena. A contempt charge. Almost like theyre daring to go to court. The only person who is actually equipped and desires to pursue justice in this whole deal is bob mueller were going to get into that in a moment. But first, got to cover this breaking news. The president s presumptive pick for the Federal Reserve reserve board ste board has withdrawn. The president made the announcement. As usual on twitter. Saying Stephen Moore, a great progrowth economist has decided to withdraw from the fed process. He won the battle of ideas, including tax cuts. Quote. All right. Tax cuts. Thats what it says. Okay. So steve moore is out. The markets have as a result of this, taken a bit of a dip. Sort of related to it because jay powell, the chairman of the Federal Reserve who youll remember was put in by donald trump, has suggested hes not cutting Interest Rates, which is what most would believe the right thing to do is. Yes, look at gdp. The growth weve had. Remember, Interest Rates get cut when you need the economy boosted. And excuse me, Stephen Moore for example has a bad history of having malleable or dishonest economic policy. Hes been saying for the past year, were in a deflationary environment. Which were not. Saying we were in hyper inflation, which means you should titan monetary policy, which we should not have. Remember when the financial crisis happened, thats when you saw central bankers here and abroad lower rate ts so they would make it easier to borrow money, start businesses, boost things. Hes given the exact opposite analysis. He went on cnbc this week and said i would be the right bik pic because i understand the president s economic agenda. The fed is an independent body that should never been influenced by the president. So all interesting points excement that isnt even why he was going to get the nomination. He was facing criticism from a bunch of senators because of controversial comments hes made. Some are what stephanie just talked about. But hes also made comments on gender and gender equality. Proposed getting rid of child labor laws. Mocked women in athletics. Says they shouldnt be coaches and refs and shouldnt serving beer. At College Basketball games. He suggested closing the gender wage gap would make families less stable. He said quote, first thing donald trump does as president is kick a black family out of public housing. It was a joke, a horrific joke and this is what he said in an interview this week. The biggest problem i see in the economy over the last 25 years, is what has happened to male earnings. I want everybodys wages to rise, of course, but people are talking about womens earnings. Theyve risen. The problem actually has been that the steady decline in male earnings. I think we should Pay Attention to that because i think that has very negative consequences for the economy and for society. That is absolutely ridiculous. According to the bureau of labor statistics, since 20 so 10, Weekly Earnings for men have risen by about 2. 1 . Womens have risen by 3. 9 during the same time. Remember, women are underpaid relative men so you should be seeing a higher game. The gender gap still exists, so no, men arent being paid less because these women climbing up the ladder. Were simply trying to ooefsh things out. It is stunning and embarrassing for moore to even Say Something like that. Yeah, remember a rate of growth, men and womens wages have been growing at a different ra rate. Not less. Theyre both positive. The rate of growth for women which are lower than mens have been growing at an increased rate. The end result is not necessarily better for women. Ali, he has been criticized not just liberal economists. Cato, have gone after him saying his economic policies do not make sense or they flipflop depending on the whims of the president of the United States. Lets bring in john har woord and kelly odonnell. Were going to get carried away for a second, but theres a political aspect to this. The president nominated two people to the Federal Reserve board to try and get his way. His way involves lower Interest Rates because he thinks thats going to increase market increases. He didnt get his way. And these were not formal nomination, but the president had a allowed this to be talked about publicly and thats where the space between actual talking about hermann cane or stuchb moore. That space is typically not filled with that. Also this is a highlight of how this white house and president in particular can stiles put forward swub whosomeone whos a friend, perhaps a supporter of his, without any vetting. Without seeing all of the potholes and problems along the path toward conconfirmation. This is really an indication of Senate Republicans who said no way. That they would not support him based on the Economic Issues he put out. Long time colleagues had moore on air force one with him and talked about nominating him. Had not actually sent the paperwork in. That sort of beside the point at this moment. What stands out is then the president withdrawing, say iing that moore would not be under consideration, but hed still like to work with him. It tells us theres a message from Senate Republicans who of course are responsible for confirming any president ial nomination of this level. So its not a house side issue. Its senate only. When you dont have Senate Republicans, you dont have a confirmable nominee. And thats what youve got with moore and cane. The president likes to tout the economy and thats important as he becomes candidate truch again. This is two big vacancies and two very spotty episodes in his stewardship of the economy when it comes to the Federal Reserve. But john, i discussed this with a former Administration Official very, very recently and he said to me this is President Trumps jam. He doesnt get humiliated. Stephen moore does. He throws out peoples names who are an f who Senate Republicans would say absolutely not, no way, jose, then he then slides in a c. Or a d minus then they start to say well hes better than the last guy or we know hes not going to push jay powell. But if powell simply gets things more stabilized the president does chip, chip, chip away. Well, a lot of people thought that after cane withdrew that moore had his ticket on to the fed. The judgment of republican economists were not qualified trt job. All of the writings and controversy and case of cane, the Sexual Harassment charges and case of steve, all the things he had said and written over the years, those add to it but the core element was that people like greg who was the head of the counsel of economic advisers under President Trump, said publicly as soon as moores name was floated, this guy does not belong on the fed. The senate should do its job and in the end, the senate did. Now i think we should note that before we got to this moment, President Trump has made a series of appointments to the fed that are widely applauded including jay powell. I think most people involved in business and economics they that people like powell and claire da have done a very good job. This is a moment where the president s keeps trying to play to his base and as stephanie just suggested, he may not mind, it may not be any skin off his knee if Stephen Moore gets be embarrassed and he can go to his base and say look what the these politically correct people tried to drum up about him and fire up his base even more. The point there though is that powell was lauded at a good choice, kelly, but increasingly, the president s been in a spinning match with him because hes not doing the president s bidding, which by the way, a chair of the Federal Reserve is not supposed to do. Its what Stephen Moore was willing to do. This is the problem. The good pick not with standing, the good pick is not doing what the president wants and by the way, kelly, because youve been through so many elections, you remember during the election cycle and prior to being president , donald trump felt the fed was keeping rate toos low and should be raising them so the president is new to this idea of keeping rates low. And the president is we have seen trying to put people in place in agencies across government that line up with where hes thinking not necessarily historically, but what works now. So thats one of the issues and well be watching closely whos in the pipeline for the these vacancies after cane and moore are out. We dont have any indication yet from the white house and we dont know. It will be interesting to watch, if the president will float names again as he did with these two men or do a more formal process of complete vet. Do some background checksing with the kinds of names and republican economists that john references to see who could get through and who would fill that space on Federal Reserve. The other thing although the president has control of this, typically president s dont have this kind of a political thrashing about with the fed on a daily basis and have a bit more space on the white house and those who handle monetary policy, but thats old think ng the trump era. John, quickly before we go, how damaging could moore have been . He was someone who repeatedly criticized, said Economic Statistics were phony. And then when it was politically convenient, pushed that we should go back to using the gold standard, which is widely penned by most relevant economists. The larger issue here which i think youre aloud iing to is t credibility of the Federal Reserve. Thats an immensely valuable thing to the yit yooiunited sta the United States economy. If you foster the impression by putting people on the fed who dont belong there or in the view of even people in the president s own party dont belong there, then you have the risk of people beginning not to look with authority on the decision of the Federal Reserve. Jay powell is somebody who does inspire that confidence. So to swrjanet yellen, so did b bernanke before them. But if you start putting people on who has you guys indicated at the top says well im on to push the president s economic agenda and its to get the president reelected, that is not what inspires confidence in our alloys and in our training partners an the rest of the world. I think the singular question, i hold in my hand the letter that i think stunned the nation at least, from mueller, an ex marine who wants to do his job who independeicated just th days afterward how disappointed he was that these documents had not been issued not only to the congress, but to the public. In a series of questions after that, barr said he had no conversation with mueller and gave the world is impression he was characterized the narrative that director mueller wanted him to do. And he just outright couldnt recall, didnt tell the truth. Its an indication of a series of questions that would follow about the whole issue of the obstruction of justice. This volume which is mighty, is a document against any other president of the United States that would raise question about their ability to lead. And particularly the one, the series on the obstruction, the whole litany of nine different elements. And throughout the hearing yesterday, the general whos supposed to be the chief Law Enforcement officer for the nation, continued to emphasize that the president could c exonera exonerate. The same narrative of rieally going against director mueller. That he didnt do his job. Zpl w. Why not today go through those nine juicy nukts in the 400 ages or the other issues that came up. You could have sat with bill barr today and gotten that information out there. The reason mueller wrote that letter is that he was worried that the correct narrative that they didnt get out there. Democrats have the opportunity to do to get it out and get loads of attention. Stephanie, you raise a good point. First of all, we expect to have director mueller in front of our committee so well hear from him directly and i dont know if you u heard me earlier, i really apologize to director mueller. As i said, an ex marine, who served when i was hear in congress for his name being sullied yesterday unfairly. It is really the fact that we had a narrative and the congress is article i power if you will to explain and educate the American People on the facts. And it was evident that we thought that the process that we have articulated was a fair process and all the members, we cannot extend the time on members, that would be five minutes. We would be willing to use the extended our, which the general did agree to, to be used by staff counsel, dually hired, not any outside contractors, who work for the Judiciary Committee. Nothing dissimilar from what was done by the senate during the kavanaugh hearings, so we didnt think there was anything inappropriate and the general does not have the authority to tell the United States congress how to do its job. We think the narrative for you, the First Amendment protected media and the American People would have been far more informative had we had both the membe membe members who were brilliant then a quiet moment, an hour. By the way, 30 to democrats and 30 to republicans we have no idea what they would do with it, but we think then the truth would come out from general barr. This is a letter sent from the white house lawyer working on matters related to russia. Sent to barr, the attorney general of the United States. And let me highlight some key things. This was obtained by b nbc news from a white house source. And this is significant for a few reasons. It is a blistering, which you could call attack i suppose on the special counsels report describing that report as suffering from what flood calls an extraordinary legal defect. That it fails to comply with the requirements of governing law. This fivepage letter in some, its five pages, essentially defends the white house decision to in effect stone wall or agree not to cooperate with house v t investigatio investigations. Flood is making the argument that just because the white house cooperated with the special counsel, Robert Mueller, in a variety of ways by providing document, by allowing officials to sit with special counsel interviewers, it doesnt mean that the white house feeling they need to provide this same level of cooperation to investigators. Let me read you this key part. This is from the white house lawyer, quote, it is one thing for a president to encourage complete cooperation and transparency and in a criminal investigation conducted largely within the executive branch. It is Something Else entire sli to allow his advisers to appear before congress and to answer questions relating to their communications with the president and each other. So the goes on to say the president is determined to protect from congressional skut scrutiny. Also by adviser to future president s. Basically saying if we let our folks cooperate with you now, what happens down the road in future administrations. It could be really problematic. Theres another interesting section in here. In addition to the whole let erat which were going to post so folks can read it. That the special counsels flood describes as exoneration statements can only be described add political. He says words like that dont belong in the criminal justice vocabulary. Thats a clear dig from Robert Muellers report and i know you remember the on strzbstruction did not cexonerate. This is a significant volley back explaining to bill barr and ineffect to the rest of the world what the rationale is for being able to say listen, we dont want our folks to be b able to talk with congress. We think weve done enough on the criminal side of it making arguments before that this is really political on the part of congressional democrats. Im curious to see how its going to be received by those Congress Congressional democrats with bill barr first though shaoing then not showing. Thank you for that reporting. Why we wanted to extended time with lawyers because we knew this would be an unfornt, long journey, but i will say to all of the writers of letters and obstruction of tactics are going to be used. Democrats again want to be deliberate and studied. We will have no one force us into an impeachment process. But we are not afraid of it. Were not running toward it, but were not running against it and so as long as the white house continues to flip at every drop of the hat or every inquiry, for example, general barr today sent this extensive letter about how he had offered a minute group of members of congress the ability to look at the unredacted version. Weve rejected that. That is not the format that we have chosen and frankly, there is a regulation that said release it in the public interest. Thats what director mueller said. So we will probably get a lot of letters. I think they are too late. I think the sish out of the door and frankly, it is time for us in a respectful manner to hold a hearing with general barr to get the unredacted materials. We may be moving on a procedure in the coming bays, we may continue to negotiate. But again, this is not a position of members of the Judiciary Committee to go after the president of the United States. Just like i dont think the members of the Judiciary Committee attempted to go after nixon, but there was a moment in history when the people of the United States said that we need a presidency in which we can have faith in. Were going work with this white house as long as we can to have hearings that will produce the truth on these matters and i would say this. On the russian collusion, this is not about a personal issue as much as it is about the National Security of the American People. For them not to have fractured elections where an enemy is engaged and by the way, all of us who know this the why would democratic members of the gang of eight who had the option to see a less redacted version of the report refuse . I would think theyd want to see everything they could if its really about National Security. Again, you raise a valid point and the response to it is this. Is this. Every Single Member of congress has a top secret classification. We choose to let the gang of eight or the Intelligence Committee on the ongoing matters of intelligence for this nation, but there is absolutely no reason why any congress, republican or democrat, cannot see the unredacted version. The white house knows this so does attorney general barr. For the purposes of National Security, the congress should see it. And therefore, know that what we were dealing with as i indicated with this is that we have a serious matter here, which is one of the reasons i introduced hr 53 that you have to report any engage. You the candidate with foreign operative within 72 hours. If that was inplace, director mueller would have had a law that he could have processed volume one on dealing with russian interference with the elections so to tell you that we narrow the focus of the individuals to a gang of eight or 12 is not what we believe is right and were not denying republicans, republicans will see it, too. National security issue and no matter what mr. Flood says about how long mr. Mueller was, you can read that report, its very c detailed and it talks about the campaign intimately engaged with foreign operatives who are our adversaries and we as the congress as a whole must get to the bottom of it on behalf of the American People. While the drama continues on capitol hill involving attorney general bill barr and possibly testifying, this is what we want to focus on. The actual evidence laid out in a special counsels report. Everybodys not going to have a chance to read the 438 pages, so lets dig through u this for you. Remember that mueller outlined ten instances of possible obstruction and left the decision to charge President Trump up to congress. Donald trump wanted comey to end the investigation saying quote, i hope you can see your way to letting this go. Number two, the president s response to the russia probe like when he toll then White House Counsel Don Mcgahn to stop then attorney general Jeff Sessions from recusing himself from the investigation. Number three, the termination of jim comey. Mueller found substantial evidence of truch trumps decision to fire him because the reluctance to say trump was not under investigation. Number four, the appointment of the special counsel and efforts to remove him. Donald trump told advisers the investigation was quote the end of his presidency number five. Efforts to curtail the special counsels investigation like when they directed the former Campaign Manager to have Jeff Sessions publicly announce that the probe was quote very unfair. Number six, efforts to prevent Public Disclosure of evidence. The president told his aides not to publicly release emails that revealed the set up of that Infamous Trump tower meeting back in 2017. And number seven, further efforts to have the attorney general take control of the investigation, trump pushed Jeff Sessions to publicly announce that he is no longer recused, but sessions didnt reverse his decision. Eight. The president s efforts to have mac began deny that the president had ordered him to remove mueller, but mcgahn told investigators the truth any way. Number nine, trumps conduct toward flynn, manafort and other b possible witnesses those are redakt mueller notes his sympathy tword them could be intended to limit their cooperation with the investigation and ten, trumps conduct toward michael cohen. Once cohen began cooperating, Donald Trumps relationship with him became hostile. On collusion, the report found no findings of direct conspiracy with russia. But it did note that the Trump Campaign knew about russian interference and that the campaign expect to benefit from information released by russian efforts. Lets not forget, there are still 14 open cases that Robert Mueller referred for outside prosecution. But the question will be with bill barr as the attorney general giving, will they be tainted. I want to share a tweet from eric holder where he writes any comp tant public corruption prosecutor would bring obstruction charges against trump and win. The only reason mueller did not was because of the flawed department of justice restriction against indicting a sit l president. So why is this important . Eric holder is saying its only because hes president. Theyre not criminal charges. Any other person who doesnt fall under the rules the president falls under would have been pursued. It doesnt mean that there wasnt wrong doing. Doesnt mean that the president was exonerateexonerated. So it is important, clearly Robert Mueller, to say the spirit of my letter with was not translated by bill barr. I was speaking with Border Patrol. They continue to insist it should be on congress. Now were going to fix the broke immigration system. These families say they have children. They say smugglers are taking advantage of this and bringing these families in greater and greater numbers. Ive been here reporting on the boarder for quite a while. The numbers in the last few months are significant. This is larger than the 2014 crisis. The largest weve seen here in more than a decade. Not as much as they saw 20 years ago, but it is really significant. And what becomes of this . Whats the next step here . The Trump Administration is cutting aid for Central American countries. Some believe thats going the hurt the root of this problem and that families are going to continue to come here in very large numbers. Where is the border in relation to where you are . Wheres mexico . Which direction, where are people coming from . Right, the rio grande is over there. Were on a bridge and these families had walked over here. They get, they over the rio grande. We saw some walking just over there. You see these vehicles over here. This is u. S. Customs and border protection. They transported them to this spot right now where theyre being processed. Taking some of their shoe laces for securities and theyll be off to a Processing Center. What we saw with the new tent cities, the Border Patrol station here in the mccowen area had a capacity of 380. Yesterday, they had 1200 or so. So the numbers here are significant. It reads in part, quote, i was honored and grateful that you asked me to serve on the Federal Reserve board. Your economic policies have been a spectacular success for american workers. Trumpenomics has been vindicated. Ill go on a limb and call that a love letter. The Federal Reserve is not meant to be staffed with people who tell the president they like his thing. Whether to expect a position on the Federal Reserve board has nothing to do with it. The u. S. State department allowed at least seven foreign governments to represent property in Trump World Tower in 2017. A reuters exclusive said this was done without approval from congress. It sets up a potential violation of the constitutions emoluments clause. That bans u. S. Officials from accepting gifts or payments from foreign governments without congressional consent. Hes already the subject of a lawsuit by Congress Democrats accusing him of violating this clause. Reuters julia hart broke the story. Julia, who are the countries that have rented these properties and how did this come to be found out . I obtained the documents that showed the request from foreign governments to the state department seeking permission to rent or renew leases in the Trump World Tower under the freedom of information act. Foreign government is required to seek that permission from the state department when they buy, sell or lease u. S. Property. The foreign governments i was able to confirm actually did get their leases approved were iraq, kuwait, malaysia, thailand, slovak slovakia, the government of the European Union and saudi arabia. Some of those countries had already rented or purchased units in the building before, but legal experts say now those transactions should undergo scrutiny by congress because of trumps position. Elijah cummings, chairman of House Oversight has said that committee has been stonewalled to obtain this type of information. That being the case and your reporting, where do we go from sneer. Well, at this point its up to the committees to further investigate. Theres a lot that we dont know. The state Department Records i received only went up through the first eight months of trumps administration. I would be very curious to see how many requests from foreign governments came in after that point. Ill take a guess. A lot more. That bravery is ultimately what cost him his life. Officials say the gunman opened fire on 30 students. Riley rushed toward the attacker and, quote, took the speck off his feet. The gunman shot and killed riley as well as 19yearold ellis parlier. Rileys family says theyre not surprised by his heroic actions. Hes always brave, always been observant, selfless, altruistic. Honestly, when i thought about it and thought about riley, that if he was anywhere where Something Like that happened and turned away, he wouldnt be able to live with himself. Saved so many other people. It didnt matter what happened to him as long as others got out of there in one piece. That says a lot about him. No question, no doubt that he would have done what he did. I know thats what he expected others to do for each other. He did what he had to do. Here on capitol hill where nbc news obtained a letter that the president s white House Counsel sent to the attorney general last month taking issue with Robert Muellers report and makes a new argument for executive privilege. More on that in a moment. Here on the hill today, a single empty chair marked where we were supposed to see attorney general william barr. He was scheduled to testify in front of the democraticled House Judiciary Committee, but he refused citing concerns with how jerry nadler wanted to conduct the hearing. Earlier today chairman nadler ramped up the pressure on barr, promising the attorney generals defiance wont go unpunished it. We will all be held accountable in one way or the other. If he does not provide this committee with the information it demands and the respect it deserves, mr. Barrs moment of accountability will come soon enough. Meanwhile, House Speaker nancy pelosi came out swinging against barr during her Weekly Press Conference this morning, going so far as to say the attorney general committed a crime. Madam speaker, did the attorney general commit a crime . He lied to congress. He lied to congress. If anybody else did that, it would be considered a crime. Nobody is above the law. Should he go to jail for it . Theres a process involved here. And, as i said, ill say it again, the committee will act upon how we will proceed.
