Good morning and happy new year to everybody and id like to thank any fellow commissioner walker for chairing for me last year, i of the out but all good here Going Forward welcome to the wednesday, january 18, 2017, bic so a few announcements so start off the meeting wish everyone to a happy new year and welcome to the department of building inspection my announcements will be belief the commission wanted to acknowledge the staff over the last month, a big thank you to ed screening who helped to get a Construction Permit approved he said he was glad to know that San Francisco as a dedicated public to the citizens so thank you on that and thanks to joe duffy of Inspection Services that got a letter for taking the time with a complaint and that was actually forwarded to dpw regarding a wood playthings becoming dangerous during an upcoming storm the customer said that is an example of a apply employee going above and beyond and madam secretary thats the biggest set of compromises. Dwfrns model which relates our decisions are made as we Current Issues throughout the course of project and sign off by everybody and been wellreceived another major activity over the course is the fit gap analysis that was when we took all settles if the businesses over the last couple of months and had excel tells you what can be and cant be met there are 70 out of 200077 not met weve been reviewing those with the businesses throughout this week actually that activity is underway and getting a schedule the oc m the Management Plan we talked about in the last couple of months should be wrapping up in the next couple of weeks the biggest things were working on the fit gap so socialize that so everyone is understanding what is implemented and not implemented i use the phrase eyes wide open well know exactly what were getting and not getting we need to wrap up and received a draft from the vendor and in negotiation with the vender on exactly the draft what component of the plan and what the costs are associated so were in the middle of those negotiations so those are the too big things that are going on right now we are coming down to the last couple of weeks and wrapping up the contract; right . The statement of work is the highest priority thats basically the update im here to take your questions as well. Commissioner walker please. So when will we have our path forward at the next meeting the next meeting that will tell us how much it will be and how long that will take. Assuming the state negotiation are for the pro transacted well have them by next month. Okay. And the funding process; right . The work once we have a real dollar figure well know what paths to take to secure the funding well definitely assuming no bids to pickup in the negotiations well have this plan by next month. Still trying to keep the dollars figures low to have fewer hoops to jump through. Commissioner. I came to the process very late in the game so excuse me if this is a new even if question my understanding is we have a very for the one put into effect 200 and 77 characteristics to satisfy do you have any idea how many Planning System had and you know are we asking it to do more than it really can . Are repushing the limits on it whats your sense of that. My name is jerry i on the materials for this discussion item were very good i have two questions the first question is of the 70 requirements that currently out of scope are any of those requirements critical to the operation of the be would you mind if mr. Gregory comes it would be good conversation that would be two points thank you. People in having the discussions throughout the week again, we walk in with eyes wide open i dont think their critical but lets have that discussion throughout the week and let the business weigh in. In our words 70 out of 2000 you said is that a big number. No. No; right . Totally within the realm of give and take and open communication with the vendor. Okay. And the next question was the next question could we go out of 80 you know bringing a timeline throughout the course of negotiation trying to bring the timeline and looking to see if theres any possibility one of the key driving factors we need businesses to resume after the cut officers what did we leave out the Complaint Processing or certain types of permits; right . At first, it didnt look like there is look like we can move from the scope but looking at them closely and trying to have the discussions as we have the negotiations over the next few weeks thank you. Thank you commissioner president mccarthy this is an issue that has come before the public our department i think is got some really forwardlooking programs that are assisting especially with the tenant displacement so we want to make sure that all the department revolved in the process come and talk about the process and see what we can do to support making advances here and understanding resolutions to some of the buildings in securing housing thank you very much for coming in good morning Deputy Director Inspection Services im here to present today a Code Enforcement process dbis mandate to insure the safety of residents and buildings throughout the city safety remains the number one priority recent intersections with the result of public complaint and city referrals by dbi and City Attorney inspections since december 2nd dbi has 9 complaints referrals for possible safety harasses conditions and what is your were attended an educational workshop for the Fire Department on january a meeting to the Bravo Theatre xhaushg was in attention and the Fire Department the Fire Department were doing outreach out there trying to talk with the people to make things safe and given out fire extinguishers and give out smoke detectors there was a preview outreach moepg and had chief to answer questions for the safe conditions and wanted to let them know we have an open door policy you can b talk about any issues their unanimous we to investigate the complaint. So work with the tenants and owners and asking owners to visit us on mission and if you have questions we consult the Third Party Contractors for life safety issues and the outreach partners to sites before code compliant are clear to help the tenants weve been working with the Housing Division and were encouraging the outreach groups go up prior to our investigation and outreach. When we have a complaint we have to follow the Code Enforcement process we have a chart of Code Enforcement process and im sure your familiar if you have any questions i have to do the inspection if this is a violation we have to look at that and theres a director hearings whether an order of abatement or return to staff during the notice of violation we can work with the owner as long as their showing us a path forward we can work on the issues working closely is City Partners working closely with other citywide coordinator efforts to work with customers that are in need of abatement and enabling the funding to focus on fire safety weve increased that funding about 100,000 we also provided 2. 2 million in the creation of a proactive Safety Research program with the Fire Department over a two year period they can speak on their behalf for this outreach. Morning commissioners dan Fire Department fire marshall thank you for the opportunity to speak before you today id like to provide give you a little bit of background hopefully not too borrowing our scope in the Fire Department how that aligns with intifshgs warehouses to begin with our Authority Comes from the health and safety and the occupancy fire marshall that are adopted f and regulated by the state Fire Marshall Office we enforce the life safety codes those occupancies are a eir c and educational and schools and institutions to be hospital jails and certain types of boarding houses and misrepresent singlefamily dwellings and l labors a lashes not Public School the list is s f is m and b it is Storage Facilities m mercantile and b is business as in factories 3 didnt fall under our injured unless part of that actually then we get involved keep in mind what types of inspections we conduct inspections for any permits associated with those occupant so Construction Permit well be involved operation their regulate operations about 40 of them public assembled with one of them San Francisco youre required to pull a permit for one of the regulated activities also, we conduct annual inspectors their owl rh1 and rh2 misrepresent residential unit we have 5 thousand units 9 units or greater condo and apartment buildings e, etc. The buildings that are 3 to 8 under the housing section realm we inspect every highrise 6 hundred highrises in San Francisco we inspect schools three hundred plus in San Francisco and jails we inspect every two years thats our mandate what we are required to inspect so oh, part of inspection is whenever we receive a complaint from an agency or public or the Health Department we respond to any of those referrals that are forwarded to us so how does that all align with chairs warehouses well see if it is brand new facility well only plan site plan for Fire Department assess and Fire Department water supply thats it the rest is on the actively if youre Storage Facility your 12 feet or hire you need a highrise permit well inspect so this date 15 in San Francisco we inspect annually and warehouses are warehouses safe they absolutely are safe when used and designed and permitted when theyre not safe when you change the use with with the going though the process the design plans comply with the code of the building and Fire Department with respect to the warehouses weve received 15 complaints we received 3 internal complaints and 12 referrals the referrals are from the Fire Department weve issued 3 orders to vacate order to vacate if you look at the fire keyed code the fire code states let me state this we cant be less restrictive we cant be less reflective fire code states in any illegal change of use with equipment the building shall be deemed unsafe period any adequate exiting the building shall be deemed unsafe in the fire wed coding another question an unsafe building we know the facility is unbeknownst safe does that end there in our opinion no if it is illegal change of use to a more hazard use from a Storage Facility to a Public Assembly or to a residential thats a more hazardous safety of the people in the building so if you have an illegal change of use and a compromised egress with a number of exiting is the inadequate if there were an event in our opinion youre likely not able to get out thats where we order to vacate to date all 3 are abated weve been working with the City Attorney with newcomers phone calls and were still working on that to refine that process we want to be fair and consistent with the understanding that our first mandate is so keep people safe the other thing id like to say we have questions how much time a week or two months i hear 60 days, we in San Francisco over the last 10 years two to three construction fires a year on average so in the Fire Department opinion if you have an event in the building next week and you have people four or five will not get out thats the question that we struggle with we take to it very seriously and understand that people get displaced first and foremost thats our main goal ill be happy to answer any questions you may have. Commissioner walker please. Thank you so much for coming this is obviously that is an important issue for a lot of us in the city and even in the bay area the when you determined when i issue an order to vacate was it in the 3 buildings pause the assembly use or because of residential use telling me what okay spurred your one with both an assembly and residential above and the other ones were residential. You know theres been suggestions hey walk through do an inspection and tells you if it is safe lets contact take a 5 thousand square feet warehouse for example, a factor of 5 hundred per person designing that occupancy by design all any safety features to protect the egress now a Public Assembly any factor is not 5 it could be 5 or 7 or 15 now im designing the building for 3 exits and certain types of hardware with the doors, etc. Not so easy to walk in and say its safe thats why in my opinion when the fire code states an illegal change of use we assume that is unsafe not vetted and not reviewed the other was a storage area with 1 beds with styrofoam walls dividing the bedrooms and less than 7 feet with sheetrock exposed wiring and tapes, etc. Bars on the window if theres a fire youll not going to get out what that in mind when you have a fire it is not easy to move most fires most people woman by smoke you cant see your hand in front of your face youll not know with the door is does that answer your question. Yes. It does. Commissioner gilman please. I have a question which is more suggestive if we as a city involved more in the Code Enforcement program you think that can help situations that program can outreach to the owners and up to code before you get to inspection. Thats a difficult question ive been asked did question what concerns you what concerns me is not what we know that goes a long way to knowing what we dont know, however, from the owner has to go through planning for a change of use with the zoning we dont know essentially your issuing a occupations i think to our the if we Work Together to build fire and planning came up with a program to address all the buildings and have some kind of system in place where speed up the process so people are displaced would minimize the mind as much as possible. Okay. Thank you thank you a quick question just so the 15 complaints you got norman in my given year what is the level of complaint. We dont get those complaints that is all new we dont get them a couple a year at the most we dont get them. No. You dont get them. Were getting more and more complaint and commend the Building Department i hope all the department will deter all the information this is relatively a new issue were dealing with. Commissioner lee please. The origin of those complaints are they from people around the warehouses or People Living in the warehouses. I can speak to the 3 we received directly i cant speak to the Building Department we were referred to. One of them was one of our Engine Companies responded to a medical and it didnt look right or safe this looks like a ghost ship we responded to and an arson team members without outofsight and noticed an issue we get internally and then one, if a complainant from the public we get a mixture. We have had existing buildings for many years and your people go out through i mean it is a tough job to make the decisions i guess the question is would you are you more aggressive than in the past or the same policies i know that is a delicate question because of displacement in the warehouses a major concern but the people in the commission and through the city and so on and for people a way of life to protect. Understood. I can only to the last 18 months this is again relatively new to me my mindset has not changed if we are out on a scene for whatever reason through a complaint or for whatever reason we do something that rise to a level that the occupants are 2, 3, 4 danger potentially an active event we need to take every step possible to clear that problem to your point this is were getting complaint and more referrals a new process we didnt get those before thats a difficult question to answer. There is a kind of a concern there is might be opportunity for some people to you know make it into a complaint and make it into something you know trying to balance that. When we make that decision first of all, we want to be consistent in the approach with the captains from the Code Enforcement shell inspector everyone of these and have a file a Committee Even if 3 of us our champion the head of Code Enforcement and myself and the fire marshall we review case by case. Yeah. With the understanding if we make this call people will be displaced but then again, if youre one of the 2 or 3 hundred fires if it happens to be this what did that mean for the people in our opinion youre most likely not getting ousted of this we have to take action. Commissioner walker. Code enforcement Outreach Program we have at dbi and i think you guys are working with them on some of the cases. Correct. I think i speak for our department we want to make that available because the issues of displacement need to be addressed as were doing all of this what is the cost of that as going out in enforcing and how do we do it in a way that recently the People Living there and the laws weve passed protecting them so i just want to reinforce the partnership as commissioner gilman asked about would it help more if we had people who are really especially this is a specific type of building it is different than inlaw units the secondary unit it is monthly illegal occupancy but we protect those we protect the occupancy we want them i mean, we want to legalize them as the priority i eight hundred ask that everyone planning and fire think about our Code Enforcement Outreach Team and how we can strengthen it to support you. And support our partnership because our Housing Division uses it successfully in helping to deal with the tenancies issues we want to make that available i want to reinforce that. We appreciate that i appreciate that we welcome any assistance in the Building Department if i had my choice ill have the City Attorney and help and building and fire everyone dont get so many it is not manageable were talking about 15 or 20 it is doable that is a collaborative effort people are a different set of ice and evaluate each situation case by case. And to bring in planning thats the complicated part i know that we have things for planning that come up. Commissioner. I compliment you for thank you for all your hard work and delighted to see the department is actively and aggressively participating in all efforts to bring the uses into compliance with minimal displacement as we were charged by the board of supervisors and i think would be our intent anyway one of the tragedies of ghost ship one that we read their appeared to be a small number of residents that were killed that was almost all people from for the entertainment event we have the various degrees you have a warehouse that is a work spaces that is a live work and a live work including artists to the musical ream in bridging in large numbers of people and you referenced this clearly are you comfort that we have found the right path yet to involve the Entertainment Commission that all the players that you need you know especially to get reporting around where large gathering and any death is tragic large numbers of deaths likely will be more drastically and painful. What i will say is our closet relationship with the Building Department not the same that the Entertainment Commission we have a Good Relationship with the Entertainment Commission theres areas we can improve on that we will improve. Just want to ask a question a little bit off topic last year with supervisor wiener legislation how is that going does that address more the residential issues and i i know Code Enforcement. Yeah. Where we support a position in your department and. Yeah. So that point is our community Outreach Team. Yes. We spoke to reach out to the live work places and artist weve been involved and thank thank the Building Department and developing our program and been active to this date but only Getting Better each day i think that is very important to get the message out to talk about safety and general safety in particular the one thing ill caution the talks we give you dont want to give a false sense of security if you apply that to illegal change of use other issues in illegal change of use not addressed in the Public Safety in youre a mixed use with a residential blow youre required to have a 12 or hour fire barrier separation were not addressing that with the multiple smoke Emergency Rooms general safety the messaging is a good thing. We need to take this a step further with the change of use. I think that is something that also planning is going to discuss about trunking this and having issues that are extremely safety issues that need to be addressed very much and like in in law give people the time to do it in the Building Owner is in agreement hopefully i mean one of the things i want to see as a task force of the Different Department and stakeholders to colonel together and do this i mean back in im trying to think what year in the last noticing we to deal with the issues of our spaces and hopefully we can do that now and come forward with recommendations for short term and longterm use of those buildings so great. Sxhach and commissioners dan murder in the Second Degree with the Planning Department thank you for having me frankly not a greatest deal ill add with what our staff and Fire Department have weighed in it is appropriate to highlight one significant policy shift over the last 12 to 18 months that is relevant to this and the broader conversation which is a shift in our default by that i mean in years past when our staff has gone out in the field and seen a between our reaction to comply by removing that living space thats shifted that is different our mandate is to maintain to retain to find a way to legalize those spaces we want to minimize displacement categorically i think there is clearing a special asset to some of the community impacted by the Current Situation with folks that are challenged in todays Housing Market those folks that colonel prices some of the special staff in the city when their accommodation their spaces to live in are threatened we have a duty to explore all the options to bring them into compliance and find what way to avoid displacement we are working closely with our staff i think the fire marshall mentioned an opportunity to improve we plan on continuing that there is not a great deal to add i am talking about r ill be happy to respond. Im curious are you findings that landlord are willingable and excited to partner with planning with fire and what bringing their properties up to code i ask this question i dont want to displace anyone but not let a landlord to illegally live there and a code violation to walk away from the property im curious your findings of the Property Owners to comply. Thats a good question thats a difficult one a range and certainly Property Owners that want to engage with the city to find a way to continue housing the folks on the property and certainly those that feel quite the opposite he hesitate to generalize. Commissioner walker please. To that end that question is a little followup there are currently is a requirement for conditional use if he wish to remove the illegal unit so does the staff disclose the use that are artists living there this year an Assembly Artists that is speaking that is considered when the by the Planning Commission when they approve or make a decision about who to allow the expansion of housing that protected in any way. The full range of circumstances are considered who there and how long and there are a handful if the requirements and certain finding i believe contained in the Building Code collaborative with our staff regardless that analysis involves the whole range of factors surrounding the property. And we talked about this before the meeting is there opportunities to do temporary change of for instance, like many of the cases the owner might have Development Plans drood theyre trying to rent out theyre building for artists and whatnot is there an ability to negotiate after the change of use issues and the subsequent planning and Building Code requirement. Thank you for asking that thats a great question with two answers the first is under todays planning code this is a provision that allows for certain temporary uses it is a very particular code section that allows commissioners are familiar with allows particular types of temporary uses with an eye towards limit entertainment functions for example, once a month entertainment function can be legalize be it on a short time or ongoing basis the second part of question is that the deeper temporary use and an artist workspace along those lines is not under todays planning code can be contemplated it is something were interested in looking at just to be forthright the temporary dwelling is challenging but the notion of temporary xhafgs of space we are engaging with the agencies about what legislation might look like to accomplish that. Just under our fourth point you could possibly make some part of it temporary say for one month or whatever it is administratively or a conditional use. In fact, one of the property we were examining to the commissioner president vietor used this 45 massage overthecounter permit form that establishes a once a month entertainment function so while we do it is overthecounter. I dont see any questions. Got somebody from planning so theyre here now any questions. I would like to have something more formal put together as far as the task force Going Forward on this so a few comments rosemary bosque, chief Housing Inspector. This motion of dealing with a path forward and dealing with the safety issues with regulatory agencies that are chiefly responsible to write things up to biefth and deal with hazardousus situations one of the things that you may consider is that the agency particularly write the notices and im so geared towards you know doing the Code Enforcement but to look at the innovative we do the inspections to have a better framework for identifying imminent hazards versus other hazards and documenting that and then that helps address because obviously housing code and the other measurement it is true not something done to code or not approved occupancy is inherently hazardous with that said, all the provisions with the resolution and the mayors directive trying to preserve housing whenever and wherever you see it can be done we need to be more initiative to identify highrisk and hazard versus other Code Violations i think in doing that and working together for the obviously this is evolving that perhaps we can get to a point of being able to address where the codes might allow some kind of tear occupancy you cant get interest if you dont come a time those types of things that is 3406d any task force is or as we work with fire and planning and the City Attorney and, etc. With the maybe highrisk behaviors we can get some of that mitigated and explain it in a notice or document then may give the Property Owner some sensibility when they talk to the industrial professionals how to address some of the facility issues and office space so maybe deal with displacement this is something i will strongly recommend. Thank you. Commissioner question. I believe your comments and from planning were very much to my feelings as well but you know weve had derivatives from the board of supervisors and mayor and comboushl ourselves the goal to bring those into compliance to have safety as our priority and minimize displacement to this community and setting up protocol whereby restricting entertainment use with the conditions exist having an immediate short time fixed is the debris. Estimation and corrective and aggressive interim steps with good conscious say we have mitigated reasonable amounts of hazards as we are aggressively pursuing owl means to bringing them into full compliance and minimizing displacement you know, i think it very clear it is everybodys goal so you know again documenting the full scope of the everything that is wrong having a planning overview of heres how you get there and rebuilding in fast track incentives for you want to do it were going to go out of our way to make this process as fast and it can be is clearly i think everybody interests so you know knowing that we are not only able to articulate these as being goals we put things in place so they become actions and work with the plans our workable plan is to group next steps i think we really need to take and everybody here is extremely interested in dbis role and working with all the partners to reach that goal. My feeling is that trying to legalize a illegal unit building is a complicated thing i mean, im hearing from fire telling the Property Owners you need to hear from building and building says Property Owners need took to do this and planning any say the same thing do this im wondering are there any avenues for a Property Owner do we have something for tenants do we have Something Like that for launders. One of the programs is the Apartment Owners Association so, i mean i think that one of the discussions was when there is special specialist buildings like this you bring in people with experience with those types of buildings that can advise. Many people are doing those types of buildings whether in their to solve from the abatement appeals hearings there are Property Owners clearly not understanding how complicated some of those things are. Yeah. I think in addition to having our department pull together and with the task force our Code Enforcement Outreach Program can say expanded to include people with experience in assembly as well as live work and residential and accessory use that type of thing go out as the first wave and advise so were able to act immediately on the health and safety to mediate and advise on longer term paths to solve all the issues that is the goal. It is it is and i recognition those issues are complicated and some Property Owners are just not wellversed in the communication and how to make things safe. Thats like economical was asking about expanding the Code Enforcement outreach an expanded need we should address through a program that works really well. So i think we need to go to Public Comment but in case anyone has to leave shift to daughter i like had that will come from planning thank you for coming here and obviously olivia thank you for coming out and thank the chief for giving you the time to come out here now straight to Public Comment thank you. Guess ill start tom from the Human Rights Committee as someone that is talking to a lot of tenants that live in the warehouses over the last foe weeks since the tragedy in oakland i have to say the city unfortunately has created an atmosphere of absolute terror of the folks in those plays through the inspection that are happening and i think that is really a tragedy because what it does that makes the people that live in those places front yard to coordinate with the city and agency thats not what we wanted unfortunately, that is what im seeing out there people are afraid to come forward and people are afraid to admit whatever there theyre afraid afraid theyll get displaced or losses their homes or art spaces whatever theyre more likely afraid to hide and tolerant living in the spaces and less likely to come forward and hold the people accountable we dont want that this is the unfortunate consequence so i really feel that the city needs to really working hard to make people feel safe people feel like theyll not be displaced or lost their homes and art spaces one way the city does that to work with the tenant advocates we have the trust of those folks we went out to 850 inspection that dbi was there everybody was there that he went through and showed up our being there are helped the tenants felt they felt more protected and satisfactory we were there to advise them on theyre right and that may happen we didnt interfere with the inspection but the atmosphere was really, really vital to this inspection i urge the department if you come together and Work Together to brings us in on the process were the people on the ground and have the trust of tenant and the folks in the warehouses we need to think of long Term Solution we think of short time reaction but we need to not be reacting from the gut but thinking in the long term how do we make it safe for people to come forward once this as blown over the people will continue living in the warehouses how who deal with that situation Going Forward and honestly dont think that was clear what happened with the Fire Department and that didnt help the situation and made more people faired scared i urge you work with us work with the tenants that live in those places we all Work Together and make people save and stop that thank you. Hello, im from the tenant union i want to thank everyone for working on this including the Fire Department we tell you everyday to be safe my first apartment was in an illegal space ive are had friends that lost spaces in the wakes of this fire and many of the people that have come to me for help as tenants have been terrified of the nighting they live in the spaces they live in and letting the city in to see whats going on and many of them, of course, they care about they safety many of them loss friends and roommates in the fires they feel it for deeply than anyone in the bay area i think they want to be safe but not homeless so i appreciate some of the thoughts that people had about i think someone was saying the different between immediate hazards and a real fires there was a single staircase that burned workplace minutes that was made out of palates a different situation than warehouses no light and those types of differences that inspectors were let in people of the safe to let in the inspectors they might have been different i hope that we can Work Together to try to bring tenant into protecting their own tenancies in terms of as tommy said a longterm situation to make sure we dont lose what we have left of our population thank you. Mr. President , and maam, Vice President that my name is mark you want to put a Historical Perspective im an attorney dealt with artists since the my law degree 1974 i started in that year, i graduated if hastings and moved into Howard Street an illegal warehouse and stayed there until 1989 i could afford an apartment in pets they were 400,000 a month i choose to live in a warehouse i love art and involved with the hotel in the late san jose for the state block for the cost of 40,000 i reason they have 20,000 down that was one of the best artist Living Spaces on the on the ground ive been in 3 City Attorney led Code Enforcement task force inspections in the last 15 years an 18yearold Artist Cooperative some of the artists live there over 19 years rebuilding now with a famous art ma dbe a bunch of people in 2006 i was brought in typical on the commissioner president vietor task force everybody is in fire and planning everybody City Attorney they found nothing wrong they were a little bit concerned about potential toxics stuck in the backward we cleaned that up they were back in 2010 and everything was fine abused i represent williams and the music hall a lot of occupancies up to one thousand people i know how to do that so we had clear path of travel we have battery exit signs and battery packs in all the bathrooms so from the power jumped they can see but whats the difference in 2010 or 2017 december what happened one unlike this circumstance there were 45 nov from the Electrical Department that had a two days before new years eve and told the people x so i think we have to if we want to save the habitat many have gone elsewhere we have to look at like an endangered the left hand freaked out over the electrical permit with a 3 day notice think about that thank you. I want to thank you all for coming this is a really important issue to the city obviously many reasons and i do think we need to well, i need to a commissioner formally support a process Going Forward with Proactive Solutions to this as planning and fire and our department and entertainment and the Arts Commission can colonel together to formalize a process that brings tenants in earlier i think the point about not wanting to frighten the people that are trying to help we want to make a path forward available i think that is vital we inviting to the tenants to come in and work with the Code Enforcement Outreach Team first i think that is complicated because once inspectors communitybased the job of the inspectors to make sure the building is safe having a first step with the tenants understand what is going to be happening and what their Voting Rights is a vital first step so hopefully my commissioners will support an effort that brings us together with a proactive set of recommendations to our department about how to deal with that shortterm and long term to do sort of more and more investigation on occupancy issues how we can move forward on some of those projects. That was one i obviously came up with a couple of days before we finalized the calendar we have a major storm i was driving through Market Street and a scalpel on the ground it was remarkable sometimes dont have more injuries the idea is a difficult process im trying to get my head around what procures do we scalpel and had a chat with the fire chief she was saying her department has responded to two or three as well i called that one in and so im trying to figure out do we have a policy in place one of the things that the chief recommend if a Breeder Department we all Work Together and got a plan to make sure the scalpels are correcting assembled at the end of the day ive had a scalpel theyre like sails the covering is important they have to be there because of dust and so on im trying it seems to me a tie off situations it seems to me is falling im interested how the department is there anyone from the public that wishes to speak takes this as manages the scalpels from the Department Point of view. Okay commissioners dan lourey dbi Inspection Services we have an administrative bulletin a preapplication requirement for safety and industrial safety permits for trej and demolitions and construction activities in that the construction of any building scapling i got ahold of a make sure the scapeing is secure and provide a two hours number that is important if someone seize a scalpel a Contact Number the person will come up that is of the streets we had a complaint on that was a number they contacted us joe duffy senior building inspector said a osha permit now if osha gets a call we call osha if we have a scalpel collapse theyll cite the building and lock down the building there is punitive damages with osha theyll have to go to Salvation Army and before they can start the operation osha has to come back and reinspect that scalpel to make sure it is proper and due to the recent storms the director himself he gave out to all dbi staff over the course of the doing the stickers please give this to contractor and that directs all upcoming increment conditions for the best practices with drainage and security of scalpeling and the construction to minimize any hazard that may present to others in the vicinity so what the director instructed us to hold up implicating and electrical to let everyone know to make sure that the scapling is secure sometimes they dont stucco or other things they insecure the scalpel and have to resecure it a lot of times thats where we run into a problem they disconnect and dont reconnect it it is same for materials on a roof whether when there is a high wind a sign goes up it is really, really important to secure the site weather conditions we have and the Pat Aaron Starr done gave inspection and sent out emails reminding inspectors to remind on the job sites at this point to let them know to keep an eye on the scalpels and let all the inspectors know as far as dbi them theyre on twitter and facebook and on our website weather about outreach there. We also have handouts youre prepared for the el nino storms and out there that gave safety procrastinations and secure the scapling we have outreach for scapling. So osha we would not issue a notice of violation if scapling was to make sure your scalpeling whether theres ohio we notice osha. We have an inspector on call twentyfour hour if every an incident call the 311 or the inspectors and call out our inspectors and we can barricade. Does dpw issues the permits. For the scapling and public rightofway. So we have Building Permits and all the information for that person on file we wouldnt know from the cancel e line inspectors were not out there. What we do if it at scalpel in the ab 25 well not issue that Building Permit until a skurtsd osha permit in the administration. So would dpw they dont inspect. They inspect it. They do. They do and thats a good conversation with the high winds we called dpw i reminded them please you know when you go out to check that make sure it is tied to the building anything on 36 feet high have angle osha permit. The one that i saw that collapsed are you telling you e telling me that the dbi inspector went out. Their supposed to inspect the scalpel. This was in bad shape the one i saw so so really it is dpw that are the reinforcer not dbi other than that we responded we responded but not monitoring officially or issuing the permit for the dpw. Dpw issues the permit over public rightofway. But you dont issue the permit; right . We issue on the ab 25 and make sure an osha permit if over 3 stories theyll not issue a permit until thats of interest when they come down were the respondents. Were the responders. F even though were for the responsible for checking that other than the fact that good policy and good housekeeping. We cant violate it but cant issue a notice of violation. We invite osha. Well, nobody inspections that does dbe e dpw come out during the process lets say a months construction where scapling do they continue to check that. If an osha permit with the cancel e line we changing check the voltage on the scapling. Monthly. No an incident on the scapling theyll come out but now in the routinely check. Commissioners. Youre saying there is a gray area if it is not those on public rightofway dpw is not involved by 35 feet instead of 36, 3 stories than. Nobody. Nobody . Up to our division we would you know tell look at the scapling to see if it is properly secured for the on public rightofway and not on private property thats only were responsible. If theres an incident under 36 feet well innovative osha if there is a scalpel collapse. Thank you. Yeah. Okay. I mean im aware so when a scapling collapsed who inspected it what they inspected and the date we have to do i know when an inspector on my job site; right . Where does this record. Ill have to check with osha i can when we go out theyll cite it a record of certification. The last thing you want ocean on your job but robbed to a bad situation im talking about how to be more proactive you know and you know game is up cal osha at your job site. Then the notice from the director to tell all the inspectors to make sure the scalpel is secured. I get it; right . But who is responsible. Who do i blame for the scalpel on Market Street coming down. Contractors responsibility and absolutely but where is the report it was upright. You know im i know not our deal but that is director in dpw versus dbi im not sure why their issuing the permit if so on the sidewalk in this not given who snauflz it who it was installed. Issue that to osha will have to go out and inspector it. Its on the ground im talking about how to monitor that that before the storm comes im trying to get the person responsible for a permit issued other than us trying to do the right thing to make sure thats fine thats our job but if it is a dpw permit i never is dpw responding to it. Theyll contact us. Okay did you see i mean when you send out our inspectors to have a report we have to report to put up we dont know for sure other than the fact we might see something out there. Commissioner president mccarthy first of all, tom hui with the department of building inspection i know that is a difficult time the agency you know you asked for their report i dont know most of the time how to get their report directly you know we can request but you know how you know we deal with them all the time give it to you right away and lots things how the scapling falls sometimes Mother Nature and sometimes construction somebody cut a wire. Yeah. I know that happens and thats where our inspectors captures but you know. Sometimes, we cant capture it you walk day and the minute you walk away doing the inspecting someone cuts it first of all, the dpw gives the permit on the situation or public rightofway is due to the encroachment. My understanding he inspects it to make sure it is put to the building. They do a visual. Theres an issue there guys how many scaplings come down. I dont have it i know at least four of them. From the newspapers. A lot more than a couple i dont know for sure i think that is something we need to work on with a more expensive inspection dpw have to do more than look at the sidewalk a more you know . Bad for the Department One of these days and we might get blamed if someone gets seriously hurt this is a construction site it is dpw but it is a bad situation for us we dont have acquit that control to make sure it is correct on this day by this inspector and met all the requirement. Thats the problem i have scapling is a problem. When the high winds theyll drop the necessities. Thats proactive thats all good policy but have a voice in the permit policy and inspection policy we should be looking at this will eliminate so many scape livings come down the other half stands and the particular one 80 percent was on the ground i dont think that was put up correctly who inspected that and urban design group it was a pretty major to fair we have work to do on correcting those connecting those permits to make sure we have someone from dbi speak about that and so on and so on you know okay ill leave it at that maybe dan. If i could reach out to dpw and ask them to come a a meeting and make a presentations. What they inspect and how they inspect for the fourth level to make sure that is tied off. The biggest problem during the course there are issues that is really, really hard to monitor. I understand so when the permit is issued we stand there okay. All right. Okay. Seeing none, item 8 update on the february response requiring the programs and policies for performance based applications. Commissioners, i put this letter in our pages now my understanding is that everyone would have gotten this is about correct me madam secretary about a month ago. Yeah. Around december. And next month the department will come and give us the full presentation and im delighted to ask the department there is a lot of work and advising the different items in here and you know, i guess were you know weve had a lot of situations on the downtown area a year or so what drew me were an International City we are probably one of the most highrise buildings city in the world right now definitely in america and what it feels like you see all the cranes i want to highlight it as a commission we could get educated obvious complicated and the kind of procedures we have to address our highrise and Major Construction and all the way down to the soil and you know you know and kind of walk us through you know for example, the building what is that the policies we have in place for that and how complicated and who pays for what and kind of reinforce the public that our department responsibility and what they do to improve the large buildings and educate the public on what responsibility of the contractor and the builders and what theyre supposed to do to make the buildings as safe and spectacular as they are and so i if we could do it for next month ill not go through the items in money has any questions maybe they want to add a little bit more to this because or happy with what they got id like to know where we compare to los angeles and San Diego City Council san diego and how we asked the department theyve done a great job calling names everybody involved to give us a really simple format i looked forward to seeing that that february ill give you the option if for some reason selfdefense not ready ive not heard anything wont be ready any commissioner yes commissioner. It is wonderful i appreciate your doing this the only things ill add to the consideration youve already put in here i think that would be reasonable to consider direction with other or current likely future developments and sort of an area plan overview that seems to be one of the things that came up in supervisor peskin hearing that i think warrant addressing and as you rightly say looking at the best practices from other cities especially in high schematic areas is important i invite us even to reach out to you know some of the sister cities like tokyo that have incredible experience and standards for dealing with highrises in areas with seismic issues. Okay than no further questions i appreciate our patience and move on to the Public Comment. Public comment on item 8 . Seeing none, item 9 and i have a for the record the discussion and possible action on the proposed budget of the department of building inspection for fiscal years 20172018 and 20182019. So good afternoon, commissioners tara deputy City Attorney for the department of building inspection and before you is the proposed fiscal year 20172018 and 20182019 budget and similar to prior years this budget finds a variety of line items and salaries and positions and outreach etc. That will assist us in meeting our Strategic Plan goals these are reviewing and issuing permits conducting inspections, have delivery the High Quality Customer service and implementing the administrative practices as well as educating engaging our stakeholders so basically, weve been on a twoyear budget that twoyear budget schedule for several years the city has been every year last year, we put together a 20162017 and included 20172018 did 20172018 budget serves as the base budget for 20172018, 20182019 during the budget discussions we talked about the Mayors Office and imperatively to actually be two year fixed budget weep anticipate not to do a budget this year, however, the board of supervisors if approve that well be a twoyear budget thats why were doing it again this year for the twoyear budget 20172018 and 20182019 the Mayors Office submitted instructions to all departments with the Funding Department theyre required to have a 3 percent reduction in both fiscal years ongoing 2 percent reduction in fiscal year because of 400 million deficit over the next two years as the department didnt apply to us we dont get general fund but all department we should maintain the ftes were for the accepting to see an increase in budget revenues basically this chart basically these slides are just excerpt from the chart youll see our revenue continues to go up 20162017 we collected a lot of revenue and reduced the review in 20172018, in 20162017 because we anticipated a slow down also, because it as you can see in october of 2015 we had a few instructions reductions our year to date revenues were a lot lower than the same time last year well exceed our budget this year and because our revenues is so strong weve bumped up the projected revenues to previously they were going up a little bit. And thats primarily due to the two major Revenue Sources Building Permits and planned revenue revenues we have over 40 Revenue Sources and those two revenue resources are 57 percent of budget those projects are bans evaluation includes normally we bring in more revenue expenditures expenditures are proposed budget increases the expenditures now 71. 2 ill show you with the increases are. So if you look at our increases are primarily salaries and incentives that make up the largest expenditure and that is an adjustment with the Time Health Care is going up and other there youll see in the equipment line items for the continuation of the fleet replacement to make sure we have a fuelefficient replacement and some replacement on the it infrastructure servers and Network Equipment thats why that is going up and a slight increase in also the cbos to extend the seismic safety Outreach Program of citywide weve been doing it district by district remaining district well did it all at one time a decrease in work orders that decrease is primarily because of the work order to the Mayors Office of housing if you recall this year and next year were sending people to them to establish a Code Enforcement i spoke to the cfo he informed me their actively working to complete the hiring process for the budget we had 2 million in the this budget and 1 million in the next budget. I think thats a highlight if you want to go over more details up there anything you want to discuss with the budget ill be happy to answer any questions you may have. Commissioner gilman. Some of my questions might be naive i have about 4 questions my first is what happens to excess revenue. Goes to fund balance. So we could extend it in future year as we actually what weve done for the Controllers Office we established different reverses for some of the excess revenue we had a reserve for Retiree Health there is a deficit for throughout the city but because dbi and i think maybe the airport maybe the only two department weve set aside the money to cover that long term expense and have a fund we can use to offset when revenues are lower than expenditures like and rainy day funds. Your project by project a revenue of 2 housing unit 3 million but increased our expenditures by is . 5 million if. If so look at it is exceeding revenues expenditures are 71 million right there well have to have a difference in the reserve from the rainyday funds are correct to balance the budget. Okay. And thats mostly because of employee costs thats going up is Employee Retirement and health care. Yes. But thats the largest there pretty much the salaries and thats because i think i have something here that will show you that sometimes the picture maybe better than that looking at the numbers lets see if i have something here i included in our memo salaries are 64 percent and now once again an increase where commissioner mar year to year actually which we get other budget a base budget this was loaded in our base ill showing you how we Pay Attention to the 20172018 and 20162017 we have the actual budget to the marries theyll not see a big change theyll compare from base to base. Commissioner walker then commissioner. So looking at the amount that are transferred to the Mayors Office of housing on our Code Enforcement efforts i believe we did a work order for the Fire Department to pay for it for those of you who dont know we went through a fee evaluation at the request of our controller because we were making so much money new the Code Enforcement outreach we should be doing that thats part of what our job is so as we have added it back in i would like our commission to look at the possibility of funding oversee types of things longer term than the two and 3 years weve done to include those type of Code Enforcement support and partnering activities as part of our budget i think that we have to go through another fee evaluation every two years. Every 3 years weve started working on it. The more we commit to those obligates we can include if evaluating our budget so well look at the Fee Structure to see if it covers the costs including the costs as obligations to partner with other department i guess my point i want to see us do it ongoingly rather than the two years i think with for we did a 3 year commitment is that true or two years. A two years commitment. We can look at that and these are the things we can talk about as a commission to see the mandates by the board of supervisors and other departments what about carried out by us as building issues what we can talk about so this includes a reduced commitment in the second year correct to excuse me the Affordable Housing work order. This was part of making finland available to left hand to do Code Enforcement on building that need it in our Code Enforcement process so thats just an fyi make recommendations about that will increasing that or committing to it so just so talk about iowa our revenue and expenses are. Commissioner. Along the lines of commissioner gilmans question it appears that the request for 20172018 is about four and a half Million Dollars deficit of revenues to projected expenditures and it rides 5 million for 20182019 and i understand youve mentions before we have very substantial reserves so the first question is what the current balance in the reserve and my second question regarding that is you know a perception of seeing buildings anecdotally is slowing to some extent and we are still forecasting growth rather strong growth in revenue and in particular since the very large building are where were having the biggest followup in new projects and theyre the most lucrative in terms of generating fees any second question should we be more convert in forecast our revenues is that procedurally anecdotal and not correct. Let me find the revenue we are not project by project to increase our revenues from the projection our actual revenue will exceed that projection if you look at this chart. Right. Youll see that in the budget is 60 well more than exceed that thats why were going up up this chart may not be a good description. Thats the budget your exceeding it. In the current. Sorry if im taking your time. Sorry the 64 . Million is a budget of 60 million well get in the current year weve collected 35 million through december so our projection is actually for next year we go over the next item will be a total of 72 we dont know if this is the case but bans year to date that is what it will be we didnt want to be that aggressive so were trying to bump that up a little bit although the budget is due february twitter to the Controllers Office that wont be due to the board that will give us a few more months of revenues we can tryi to see wee been part of the reason we have a large surplus a weve been strooefrl convert thats with an of the reasons we have that and we have at this point probably over 35 million that will be available to use to supplement and, of course, from the revenue will be higher we will, using less so normally what happens we dont do a balancing of the budget until we work with the Mayors Office and the Controllers Office like we finally list our revenues and submitted to the board things can change your; correct were seeing a slowing down but a slowing up from 84 million thats why that is still lower than krnl lower than what weve collected we do this budget two years and had no idea well bring in that much money and implementing the new fee study we drastically worked with the Controllers Office we lowered what we thought the impact would be and now bulging up a little bit more. I think we should consider asking the department to come back showing an increase in the categories i really do building in cross departmental im concerned about the testimony about the fair that is striking in the residents of the community and what we know that Something Like the city staff their incredible and our staff is incredible not the best people to do the direct outreach to the residents and for example, the sro program we contracted out the cbos to helping them navigate things we should consider what as happening from the warehouse previous receptions but all the residential foyers and displacement over the past year look at supplementaling that program but be the ones to talk to the resident not with all due respect with the Mayors Office of housing or Fire Department i think the outreach efforts should expand beyond the sro space in the geographical neighborhood we should consider expanding it. Commissioner walker please. I support that i also support because as were seeing it takes administrative staff within the departments to do the outreach so the how weve done it as a comprehensive program Code Enforcement Outreach Program is the nonprofits as well as all the entities someone in the it dont make any difference and fire i dont know well have someone officially at planning i think that a supporting up stick an important so it is comprehensive we have a process and have the partnerships that seem to work the best including the Code Enforcement staff that outreachs like jamie and our department and the fire Code Enforcement personnel that will bring in our team to come and do that so i would like to increase that all not for our seismic or the warehouse for illegal units, or a lot of the issues that effect the tenant is real an effective program. And especially for doing the work because in addition to identifying the work sometimes, the needs assistance in the form of a no interest loan thats what the loan program is intending not kwaflthd since were working on the policy so okay next dont see anymore on that. How do we do this. I guess. Can we look at that. How much we can increase that to facilitate existing in those areas. So you mentioned the variety of things those are all line items your landmarking for an increase in letting me put up the line items so we know what were talking about. You mentioned something else. The program with the Fire Department the Code Enforcement i mean, i dont know that im ready to propose an actual dollar amount there but support that ongoingly. So youre saying something past the 1 million if you look at the work order the last work order so this is the expenditure but this is the work order. Got it. The Fire Department is that one . 1 million this is. Down and it it goes to get the 20172018 and weve committed that to the 2340eks two years. Right. What is our cooperation with planning around Code Enforcement. Im not sure i cannot answer that question. So is the grants when it says city Grant Programs is that our nonprofit. Right. Right. And we have increased it for the seismic but i know that i do think that will require more assistance from them around warehousi warehousing. Dan dbi we work with the planning code together with our Code Enforcement dbi and planning. Okay. Okay. If it is a planning issue in a notice of violation we get on it they get the copies of Ethics Commission and have communication with us Code Enforcement is involved that our department. We dont pay support that with our fee is that correct . I dont know. No, we dont support that with our fees but directly related to dbi in the Building Code. I assume that planning code would do that and john ill defer to the City Attorney on that one. So let me just fast track if there was a dollar amount that commissioner walker and commissioner gilman have. Uhhuh. You put it into the wish lift and it is either agreed or disarrayed but have to justify how to get to that number how will you do that. One Million Dollars. One Million Dollars from us and then. But the new position. No a one hundred to tell us that they were has to do with supervisor wieners legislation no way dont worry about sidetrack how well do this well give you a dollar amount that goes to right but have to be a dollar amount attached to something. So the dollars amount attached to something you can make requests. Also, we have grants and we are in a first 5 years an rfp and this year is the first rfp for the grant and so in order for that proposal we will have to make sure it is something that can be covered in the existing rfp if not well have to start over and do another rfp. So im being theoretical we there by. Half a Million Dollar seismic and want to there to the volunteering to the Code Enforcement program and 3 equity we want to give one half a Million Dollars to broaden their outreach and possibly work more with a different start populations do include warehouses and other residential building is that something you can bring back and show us that from a perspective. Actually, i couldnt because it is comparing apples and oranges like the seismic safety is one thousand the easiest one the one hundred grant for each district maybe four or five and doing Different Things theyre doing outreach with targeted areas and maybe rosemary is a talk about that 5 hundred thousand i couldnt tell you what that will buy for i, what 5 hundred thousand will bow for seismic safety were getting another 5 districts to cover the city. Rosemary did you want to if the desire commissioner is to expand the Code Enforcement Outreach Program to address warehouses and illegal units lets put the seismic aside so for a minute the members of outreach that deal with the housing prevention issues are a little bit different so there are the definition active cannot we can, absolutely look at it and come back with educate everybody as to what those grants say right now with the services if you want to expand o we will need the sense of how much youll want to expand that and you know well address that because we do we dealt with those grants recently so. Were seeing the outreach with the warehouses this is a a new thing for them their needing to get educate the same for Housing Preservation theyre dealing with a different type of scenario and we do so this growing after a period of time as you said the other things that is coming into play ask that madam chair rosales legislation was respect the leg shotgun of twnldz for uses were seeing that were getting that input back from the outreach contractor we have happy to go look at those grants and come up with more information that directs us is that what you want to have happen. And also the issue because weve dealt with that in liquefaction of hoarding to help different issues we could use expanded outreach not in the areas where tare going to part of town different like singlefamily homes when it has the issues the issues are because we have a more its an issue of services needed necessarily rather than just inspections thats where it that would be helpful to ill be brief i dont want to talk about this further but pleased to hear about the Mayors Office of housing and Community Development moving forward with the surf funds some of the cases we see in the liquefaction go committee no money and now i heard 2 million and thats definitely will close some of the places well have people out there a long period of time. It would be good to be advised about the size of that fund i mean what is the need that we have potentially and how should we fund it in the future. Based on how its described in the Building Code great flexibility so i recommend from time to time you look at that we will definitely look at that list. That would be helpful too. So we can look at the details at the next time of the budget. Okay. Okay.
