We have a written report which i dont often do but i sent allot attachments. I want to give you a proper memo. Just a brief update on what were going chapter 16 or in other words, the protection ordinance which sounds much better to me. All the letters have been sent to the planning department. As you may recall was a very long pipeline that we had determined would meet the criteria, so it took a while in a big set of letters that has gone out. So, all those are out there and slowly but surely im getting kind of emails and phone calls from private sponsors sponsors asking me what they need to do next. So, the committee has met several times and i guess over course of a couple months weve come to the conclusion that we needed a form. One of the things that is attached here its three pages at the moment although its a work in progress, is a project sponsored form for projects within 300 feet of places of entertainment. You can take that home and take a look at it. Especially those of you on the committee, to see if its comprehensive enough. Ask the right questions so that we get a basis for if they come to you at the committee level. You know, the basic sort of discussion. So, next year we are in a proper hearing room to my thankfully for the committee which is far late and i put together a schedule because the president and i discussed the need for the frequency of the rvr meetings. We determine once a month is adequate based on, again, how many of these projects are coming in the length of time its taking to get them analyzed. So, there is a schedule here that i sent out to you guys last week, and for those of you on the committee, if theres any issues with the schedule but let me know for the year 2016. What things moved around. Space is really hard in city hall. So, i think that is it pretty much. I startedi just want to tell you it had been discussed and particularly, when charlesmet with a committee we should come up with a best practices kind of guide for sound studies being done for Residential Projects within 300 feet of places of entertainment. So i started to jam something out and spoke with charles on the phone as well as connected with the Health Department sound folks. So, i guess we are halfway through that, but again i think that can also be a work in progress. Something that we can send to people because, ideally will see these well before the soundwhere those tonight that will get you later is enough space. We have an opportunity to influence how the sound study is done and make sure its done in a way thats adequate or better than adequate. I have a question. For best practices how is this done done or how the jewelers use . How to conduct a proper sound study. Okay the other item under the policy update for the commission is related to the Cannabis Task force. The supervisor wiener created a task force, and a rules committee finally met to determine who would be the members of the Task Force Last thursday. It was like a monumental, all day, literally ninehour meeting. There are 14 seats. There were 40 odd candidates. Entertainment commission is involved because we sit as a nonvoting member of the task force and will be involved obviously heavily in terms of how organic interact with nightlife and nightlife businesses if and when cannabis becomes legal in 26 and get this is the citys effort to be prepared for something that seems somewhat inevitable although its not clear in what form. So, there are 17 possible ballot hedgers and at the state level, when and if something gets approved, the city wants to be prepared. So, the group is being staffed by the public Health Department, which i think is good. I think theyre going to be really on their game and supposed to meet in january for the first time and have maybe quarterly with some subcommittees as well. Ill keep the commission informed as we go along. As we need for the balance of 2016. On the topic of Commission Seats and vacancies, you see are missing somebody here and thats because as you know, commissionerleft the city. So we had to step off. We tried very hard to find the time at the board level to get another appointment in this calendar year but was not going to happen. So, we expect to be on Calendar Rules Committee with whomever applies to early january. I also attached images for the heck of it, the announcement which is been up on the web since november 19. The Vacancy Announcement is there. Its a publicly held c. If you have anyone that you may know that might be interested, you can point them to the web or give them this piece of paper. In addition, the ever so slow hr practice in the city is moving ahead and the position that we were funded with in the last budget cycle is nearing the point of announcement, and filling. So, again, this is an outdoor event analyst position. With an emphasis on analysis. Its been classified as an 823. The position announcement is final but will wont be posted until after the holidays because i wanted to get the most attention it can get. The last thing that i want to do is tell you about a corrective action its been a long time since anything under the heading of corrective action has taken place and that was a good thing. Unfortunately, or not, we did issue a direct order on november 20 based on the incident that i think you may heard about. That happened that the seller on saturday, november 14. Based on that incident, and the concern we had , that or maybe some reaches with security protocol, we basically included a revision of the security plan, which then basically puts a bunch of new conditions on their permits. So, in a memo. It tells you what those are and essentially eliminated one weeknight of operation provides the security plan in writing which they did. Adding a ratio of 1 to 25 which is a lot we think its important right now to help with end of the night crowd control and dispersion, which is where this problem happened. Adding at least one longrange night vision camera to the outside of the front door. And having all those be functional which we know thats been a problem. Then, letting the commission, as well as the Police Department know about anything out of the ordinary during special events. So, we feel pretty good aboutthey were receptive. They signed document and did not argue with the city. It comes and goes at that location its a tough location. Theyre doing a brisk business. Things happen. So, that concludes my part of the report. Its been a while since we spoke so i want to kind of cover some trends ive seen out in the city the past few weekends. We did get our first complaint since ive been on, ive been inspector for the regency center. The complaint came in for the regency ballroom and right now working with the complainants and management and monitoring the situation to figure out exactly where the sound is escaping from. They do have a new dining in the basement called a social hall. I have a suspicion that maybe some of the doors or windows that are facing sutter towards this newish apartment complex maybe its the cause of the issue. Humanitarian has been very responsive and have been in touch with the complainants overtime to Work Together to bring this to conclusion. I have been working with Mission District pd at trying to monitor a situation in which neighbors are complaining about jukebox mariachi band and although this does not fall necessarily within our jurisdiction but im trying to monitor with the help of pd to try to bring some closure for the residence. Theres some confusion around permitting. Confusion around jurisdiction. The operator now is attempting to obtain permits. They just dont exist for it. So its a little bit of organization and a lot of communication and event agencies working together. There is a block in upper haight. A complaint came through mary ellis trophy room. Theres a couple different establishments on that block. The complainant is on the other end of the block and im trying to right now establish this complaint just came through this weekwhich i do establish the source of the issue. If there are any permits that need to be updated or apply for, and get to the source of that problem as well. A quick update forthat i mentioned recently, i believe there are some new this is on mission streetacross from the newish complex called beta. I noticed recently some new security staff, new promoters and were trying to work it Work Together to make sure that stay safe and quiet and in that corridor of the mission. A lot of new residential. A lot of new it seems like some changes in entertainment, new promoters with new venues and new venues popping up. So, well keep an eye there as well. It wasnt a complaint or something . Weve had complaints come in about balance walk but thereve been anonymous so its hard to coordinate an anonymous complainant regarding when things are happening. So for me to be on call and witness something as it happens has been difficult. The particular incident that i mentioned here was something that i drove by just on patrol. Weve had ongoing complaint with the basement, 222 hide. I received another noise complainant that im probably can i go by this weekend to see if maybe another violation can i suspect that i might. Its been maybe about five weeks since ive been by there. Our issue the citation form. Ive reported that the previous hearing. It has not been paid yet, so action is pending, but i do think were going to continuously have problems with the basement. I mean i been doing it with it like eight months now and its pretty clear thats going to be the case. So i will report to you whatever action that we may want to take. Ill report to you about whatever happens you can decide what action you want to take. Are the complaints going to you . Directly to me. I think a couple times they may have went to 311 or something. This ever been Police Involved . No. Not that im aware. In your estimation by these complaints about . The complaints are valid. I been by several times. They are valid. Basically. I could go on and on but about. Neighbors and the building. Other residents . Residence above him. The equipment he was getting when he was first applying is already overkill. Its huge. Have eight attempted to take any the out . He actually added baby like two months ago at a sub water in the bar area so i told him, first of all, its a violation of the permit anyway. Also, i told him to turn it off when he first got it. They, you know you need to fly under the radar basically because there was a lot of issues in you getting the permit because of this. You need to fly under the rape. He turned it off for a little while but nevertheless its back on. I dropped in a month and a half ago. It was at 20 db above. Grossly out of compliance. So, we will see Going Forward and ill report to you about that. Update you about it. I received a complaint about the doing a covert location it 917 fulsome. Theres an issue with a neighbor could obviously its just opened last month, so i talked to the neighbor. I talked to barry. I put them in contact with each other, so i believe it will get resolved. Barry is responsive so i think itll get resolved. Im just going to wait and see how that plays out but i think it will get resolved. I received another complaint about hawthorne, 46 complaint about hawthorne, 46 dear st. I been receiving a lot of complaints about hawthorne but ive been by. Its on my regular route. Id never hear what the complaint complainants are hearing. I stood out there and talk to security for 10 min. In attention to what im hearing. I never hear sound issues in regards to noise coming out of the venue and theyre saying its coming out of the venue, this type of thing. Patrons are lucky i never witnessed that. Im not sure whats going on there. A reader Something Else going on. Maybe it something where this and interior noise issue. Im going to follow up and see what we can buy, but at this point, i reallywith my experience in dealing with a lot of different venues in these types of issues i dont think theres an issue there, but well treated fairly what about the basement of the building . They are belowground is there a lot of president ial run their . I think mostly commercial, right . Osa its mixed. Theres a little bit of commercial and residential also. This am across the street. People always in and out of the building across the street so theres names from taxis or whatever. People standing across the street. Theres a lot of stuff going on that. Art galleries and clothing stores. And the market is right there. So, i mean, im not sure what they are hearing but hopefully well get more detail about it. We were doing with it last year and i dont think i could we did not find any compliance issues. What about maven lane, in the back . This sum was coming there from other places, but are they confused . I dont think they are confused but im not sure ive not gone back there. They used to connect. They used to smoke out in the back but i dont know if they sealed off now. Now people smoke maybe two storefronts down. Can go down there no more. Speak people smoke in front. They probably bought blocked it off now but its weird. Two different complainants. One of the complainants was in contact with inspector burke last year so they been affording new complaints, and then i had a separate complaint that i believe came 2311. I too look in my email to figure out exactly the details but two different complainants right now. Two or three. So, itll be on my regular route but we will see how that turns out. I received a complaint about audio. Nightclub noise issues. I went by. I went to the gm. I went to walk through inspection. They were compliance. Really i think theres a bunch of been using it even if every venue was more than compliant, there was to be a noise issue for people because theres multiple venues. Nevertheless, will treat the complaint as we treat every other complaint. Well do some followup investigation it will start with her residential. See if we can isolate noise to anyone venue. I suspect we cant but audio and beatbox are literally next door to egypt. You have a beatbox complaint also . I do. You cant distinguish from a right . This person is on the corner towardswhat is the cross street. Fulsome. 4 howard st. The audio complainant is on howard street. Are easily dna a complete city block away . Reichard doesnt howard. Andyes, beatbox and audio are located between harrison. Its not harrison. Theres butter. There is dna. There slims. Theres a bunch of venue. So, i dont know shes attributing that to the venue but nevertheless all check it out. Well get to the bottom of that. I also received a complaint from a neighborhood is located behind 11 street on norfolk and he was complaining about beatbox kid i went by on the night i tempted to do a santos. My meter was not working get a minor issue but nevertheless it was not critical to what i was trying to discover anyway. Where he is located, he is adjoined with wish lounge. There is holy cow. Theres beatbox. Theres audio. Its the same issue. Im not sure how to isolate the noise to anyone venue, but nevertheless its the same thing. I went by and so one of the venues is working to try to bring their level into something thats reasonable for him and if it works and works but i suspect it wont. Will do everything we can to respect his complaint and try to do something to help him but this is the beatbox complaint . Yes. The night i went by there was no issue at beatbox. So, its the same as the audio situation. I dont think theres really did he just moved to the neighbor . He did get six months ago. He said he knew about the sound issues but nevertheless this is the situation. Its a minor issues, minor compliance issues. A bar on bush street maybe two books from the seller and other nightlife establishments. About windows open, pager noise or whatever but since its got cold, there has not been any issue with them having the windows open. So thats a nonissue. And the vessel, open back up under new handle 11 propaganda ive not had a chance to do a walkthrough inspection but to security. He came and seems like things are going fine there. I will be by to check it out and ill report to you blog about what i find is it the same management their . And a bunch of issues i vessel its the same. And it knew Security Team. Its right over there. Two avenue sound system . On archer of the details their old sound system was a functional and without a box. Its 8000 squarefoot main room is going to host bands and djs, but also farmers and art markets. As well as community events. Theres also nine art studios of their teaching kitchen art gallery, cafe, lounge so its very unique. They plan to be open seven days a week with varying days and times of entertainment. They view a station approves the entertainment and disapproves the extended hours premises permit. Theyre still in conversation with the applicant regarding this. So, the midway actually today is requesting to continue their application for extended hours premises permit until Commission Meeting next year but will still hear their place of entertainment. In front of you, i believe you should have a packet that is fairly large with a bunch of information about what the budget is. Ill run through it for those in the audience to follow along to the extent. The midway is a 29,000 squarefoot row house and we are looking to convert into a multifaceted entertainment complex. Which things together a number of San Franciscos unique and creative community. We plan to support and involve not only local artists positions but also nonprofit organizations that focus on music art and the community. Below that introduction paragraph youll see a couple book points about what the project is. Looking to do an 8000 squarefoot performance and event space that was everything from bands, djs, music, and Fun Committee art markets hopefully farmers markets and to me that. The weekend artists studios of the 100 subsidized by us. Well go to a local San Francisco artist to come in and have a here in residence potentially six monthsa year for free space to them to continue their art to make San Francisco to make it attainable for the artist. Well three gallery spaces in the midway. One of which being a the actual midway. Well get there in a minute on the map that i can show to you. Two other spaces that will be specifically designed for showcasing local and international arts. There will be a bar and lounge which again will showcase local and National Music talent and auditorium teaching kitchen which personally i most excited for. So, all tangent away quickly about that one. The teaching kitchen is going to be a live kitchen sort of space that will be bringing in talent, talent being chefs around the country and the world to showcase their signature dish. We are working on now to be the chef to showcase the first time being we just signed eikomichael nina. Michael nina is going to be doing being the first chef is going to be coming in and demonstrating at our teaching kitchen. We are also working trying to to treat some of the chefs were celebrities as are viewed on tv and in the public at this point. And routing them through as you would a dj, a ban and all that stuff. So grooming a completely different form of entertainment. I do know for requires a different permits or not. Well discuss that later. But, really getting in and showcasing not just a typical nightclub that does bands and djs on friday saturday night. Willie changing the way that folks are looking at entertainment here in San Francisco. After that were looking at having a cafe which is going to serve breakfast and lunch and dinner as well as a latenight menu. Lastly, as thats not enough already emerging technologies room. A room that we showcasing all the cuttingedge Pioneering Technology of light and sound inside of the space. So, as of right now, a group called the is doing 3d sound and light. To give you an example what that is, you may withstand the middle of the room. Train drive around you 365. Honestly very much oversimplifying it. Also able to take any notes out of any song but really in a corner or any direction of the room. Some logistical things about the space. Theres plenty of parking all throughout. So many of them write a monthly basis as it is but we made it a point to make sure folks in the neighborhood know were coming. Hope we are very excited we are coming and been able to answer and alleviate concerns the neighborhood has. So, always individual small spaces that we fortunately enough were able to put skylights in which a little bit of attention but pretty cool for folks want to get Natural Light for doing their artwork. Some office they said things like that along the side. The Community Room that were going to be hosting a number of the local labor organizations and Community Groups and no cost, and the space that is needed in the bayview area. And the dogpatch area. I give it, the teaching kitchen, right there. The teaching kitchen is directly adjacent to the cafe. Another bathroom there. An outside area right along here and kind of the whole rest of the space, this area here consisting of the lounge and bar area. As some of you may know, when we presented peers 70, one thing that was very very important to us was to give back to the community as a whole and also in our direct area. The model weve adopted in all our venues now and have taken really strong approach on being able to give back directly. So, committee benefits program is something that, if we bring in an event or corporate event or promoter, want to be looking back and subway. As you can see with the layout of the entire space, we were thinking about that with the artists but on a bigger scale we want to be able to be get back to it in the directly. Not just writing a check to a local nonprofit but getting involved, supporting both our time and efforts and our energies into being able to get back. We now have a number of different businesses in the area and think its incredibly important not just in that neighborhood but San Francisco as old to make a significant positive impact with what we are doing. There were many many asks for Public Transportation to go to the event itself. The were many many opportunities to link you with all the Car Sharing Services so that if you wanted to take a car or hire a car to the event, you could. But the most important thing which stood out to me, they gave the name and number of an onsite manager so that if we heard any noise or if we had any issues we could call this onsite manager directly. There were no issues. Ive no complaints at all. Its a beautiful space. Ive only seen the gallery part of it but like you said about the kitchen as well. As far as the bayview underground we had the popup market at the opera house which is been under renovation promise two years now. Once the opera was shut down we were without a home and without asking jordan approached us. He approached us and said, hey, im willing to help you guys. A lot of you are space to your popup market. That just sent a loud message throughout the Bayview Hunters Point Community that these guys are for real. Theyre coming into the committee will be meeting what they say so here to tell you the direct result of that and we so appreciate that happening. As far as Community Benefits go, i do agree. Ive seen already in action the artist in Residence Program that is offering or they are offering the open kitchen which is really really excited. I think its going to be cutting edge and i think were going to see that been one of the first in the city and will see a lot more of that. The two galleries, exhibits a scene were from local artists and that really spoke volumes to the fact they were focusing on our community. Of course, theyre committed to the local hire. So its a great project. I think these guys come as youve already commented on, commissioners, theyve done everything right. One thing that we dont have as of yet, is more entertainment type options. We are sort of having to go to other neighborhoods to do that and i think this is a really great addition to the neighborhood. Two of entertainment both music as well as other cultural events that people can enjoy at all hours. I think it is great. One thing that is, as you guys im sure you know, happening that artists are having a hard time staying in the city. I think these artists studios are great addition to the neighborhood and allowing those artists to live and work in that community. Then we send them to this particular place. Im not talk about the individual security guards. That is a garda card. It would be good if they did lead trading which is for algol, as well but are you licensed, sir, to have inhouse security . No. That something you have to get from the state of california and after your hearing you can get a card from one of our inspectors and they will give you the name of where to apply for that but you must have that in order to have inhouse security. Okay, because i took that particular training in order to train the rest of them. What your business has to be licensed to have inhouse security. If right next door you have warehouses, thats great. That helps you a little bit because of not going to be bothered but a few doors down from that theres a family or other residence that might hear even just people walking to their car, we get complaints about that all the time. We have a recommendation. The officer, which i feel comfortable with all this. According to my experience, we practically all the requires requirements a Good Neighbor policy and we are aware of that. We strongly for 21 years [inaudible]. He mentioned it was workers compensation, so pending seen proper proof over probate Liability Insurance for the business, i would like to see what that liability is. Commissioner caminong i know we dont get a lot of permits from ingleside. I have a bunch of questions and i the little bit of information for you. It would be in the best interest of this venue to have a general liability policy on trip and fall and a liquor liability policy. They are not required to have an assault and battery policy. If they want to but they can buy it. Its not required by anybody. Probably not by the Building Owner if they dont own the building. Thats number one. So, that cant be a condition of any condition. Secondly, to assume something may happen that is not already happened, this commission usually does not allow that. You cant assume something may happen in the future by bad behavior if it is not occurred. So thats convicting somebody of a crime before the crime is committed. Thats how we look at it. In looking at your conditions, give limited them to thursday, friday, saturday and sunday between 9 pm and 2 am. If they dont have a problem with that, i dont have a problem with that. All the windows and doors to remain close. That is a condition of our Good Neighbor policy are you familiar with that . Because that is automatically attached to all of our permits. So, to be redundant with the Good Neighbor policy something we usually strike because its a condition anyway. Number two, your captain does not have the right to discontinue the permits. The only way the permit can be discontinued it to be brought before this commission for suspension or revocation hearing. So the capt. Can no longer do that and has not been able to do that for years. So, thats just for your edification. I dont know what this planning code section is, but in order for him to be heard today, he had to posted his permits and sign an affidavit as such. So, having him we post is a condition of the permit isdoesnt make sense to me unless that has a different idea about that. Its not a change of use. As far as im concerned, its been his business for years. You are asking him to have the sf 21 because hes a 48. But in my correct in assuming that for 224 people youre asking for five security guards mount 150 and could you please tell me what you base that on . They can go around and bus them for not having it. I dont know we have the authority to do that. They will first go to the committee and then come to full commission. So that what this longstanding item is. These are two items underneath that, because we could not formally meet on the first because of a quorum issue just like this commission did not meet on the first, these are honestly like for your review again per the code. I mean sometimes goes permit holders shop and sometimes they dont, then they are at that meeting at the committee is where we negotiate the terms, but we learn about the project, we primarily asked questions about Committee Outreach and about sound studies. So, thats what you kind of see before you today. What we need today is an action to approve what is recommended. We were not able to have the Committee Meeting so we can review it as a full commission today, but after what we were able to do, i was able to meet with the staff in the project sponsors and some of the affected poe holders. To negotiate those terms. Was in a formal hearing but we got to learn and understand those projects after each of those, we i think stephanie felt like we do not have extra conditions to add upon the standard ones weve already approved as a commission. So, thats what we are asking to forward on today. So, i can go into the specifics of the project if you want. For 950 market, its a very large project. In the meeting were only both get the word feels theater to come out who is directly adjacent to 950 market. As you know, they were with the huge live music venue. They did not have Major Concerns that. There probably concerns were around construction. Theyve artie been in contact about the design, about what to do in terms of mitigation. If you look at, lets see,if you look at this page, which has pictures on them, they are actually buffered a little bit by crazy horse which is right nextdoor than the warfield is there. On, i believe, is that turk street on the Church Street side, i think ashley on the Taylor Street start with the Warfield Theater does about this project. Is going to be a little alleyway that separates them so theyre not actually adjacent to each other. Theres no windows on the Warfield Theater side where he would face the project. So, long story short, i think they felt pretty comfortable in terms of having direct communication with the project sponsor with 950 market. They currently share sort of office space currently because theyre in the same building. So theyve had to negotiate terms of how to deal with music is just neighbors renting the same offices now. So, like i said, the biggest concern was around construction the possibility of things like infestation. We felt like that level of detail was too far down the line from what were concerned about. They also presented, not a actual sound study but of limitary one. Thats what i think our staff has presented to us today. So, again, i think because the facilityunsightly poe holder the Warfield Theater themselves felt comfortable with the project we do not have any extra conditions do apply to it. If theres any questions about that the village and pn oh fight did not show. They were definitely notified i can add, ive been contacted by the acoustical consultants who asks further information of us with respect to a proper sound study as her legs and places of entertainment. So, that was a great outcome in the kind of thing we are looking for across the board with projects that have between entitlement and finally being built and populated, but theres good communication throughout that process and we facilitate the places of entertainment. Also, just you know, 950 market has been a project was a whole different formats for some years. As part of the midmarket redevelopment in the Mayors Office assistant, does a lot of meetings. So, i feel as if the village and the pn oh flight folks are comfortable with the project sponsor is a met with them many times. Even though this project has changed in the last iteration, intrusive les arts and more residential and hotel and commercial, theres open lines of communication. So i didnt feel they didnt show up, i think, because they felt comfortable. If they have a concern they know where to go to. With that, but we are hoping for is a motion to approve with the standing conditions, item 6a. I dont know if theres questions or happy to answer them . Project sponsor is not here today because they asked him. We saw this more as a procedural measure than to actually hold yet another hearing. So, the only thing is if we are supposed to review all this it would like to get it a little bit earlier if possible, but im going based on what the committee has artie gone through. But, they seem very well equipped with doing other homework in terms of making sure that its reviewed. The playground is unique in that it serves a number of age groups, unlike many of the other properties, it serves small children with the childrens play grounds and clubhouses that has basketball courts, it has an outdoor soccer field and so there were a lot of people that came to the table that had their wish list and we did our best to make sure that we kind of divided up spaces and made sure that we kept the old features of the playground but we were able to enhance all of those features. The playground and the soccer field and the tennis fields and it is such a key part of this neighborhood. We want kids to be here. We want families to be here and we want people to have athletic opportunities. We are given a real responsibility to insure that the publics money is used appropriately and that something really special comes of these projects. We generally have about an opportunity every 50 years to redo these spaces. And it is really, really rewarding to see children and families benefit, you know, from the change of culture, at each one of these properties and as a result of, what you see behind us, more kids are playing on our soccer fields than ever before.
