Good evening shawn burke here a couple of quick notes a hefty list but highlight the more important ones i conducted a sound teste armory this was just before new years eve working with one of the neighbors and work with the operators and armory we conducted a test in the parking lot so the parking lot behind the armory we thought the weakest point that have that structure we confirmed that they did day the armory was within 8 decimal above the age bitten in the code and increased the sound rating on the condition the permit by one decimal i followed up again new years eve during the event multiple times and conducted tests inside and outside they were in compliance i wanted to update you on that a couple of new complaints got interesting things going on the de bois truck stop an outdoor music event unpermitted trying to track down the operator theyre not doing much i think that was a one of event i just founded with the mission permit officer about this establishment pizza joint on mists i was informed that the complaint may not be coming from this particular new business that operating out that have that location but associated with a gambling venue that popped up you may recall from a few months back i think 6 months ago so the alu and sfpd with working on that a new complaint on hawaii street im trying to get them into compliance with a llp a complaint from the church about the alamo not movies but music well pass that off to the Police Department one unpermitted after hours report about 960 folsom ill investigate this were adjourned and a complaint about entertainment at Health Care Operations on castro stopped by there last week they have entertainment i talked with them about our permitting process i told you what theyre allowed to do ill keep you posted on the enforcement on the 11 street corridor im out there in touch with operators trying to make sure that all the many nightclubs are operating within their limits and just proving to be quiet an endeavor but things are moving forward once a third certification we actually brought them in and talked with the staff we felt like they needed to permitting provide some xremgsz and timelines for improvements and they were able to give that to us and residents so ill continue to keep you posted im out there ever weekend to make sure they understand my exceptions and what is going on. Your wanting a one time permit if youre, however, your activity that you described to us didnt include what we consider big entertainment as told you need to fixed place outdoor amplified sound or a one time outside am mid sound permit following where does parade entertainment fall. I put it on the chart ive the sound permit is based on an additional not often the sound trucks are what we use for amplified sound during parades thats the moving thing at this point there are few you know how many parades there are so yeah. I guess i should have put the bubble for timing yes so this is i think pretty much the way to describe what i did giving you more information and what the difference is entertainment is one big issue; right . And how we play this out no such thing as a fixed place outdoor door were calling it no such thing when we create a permit with the loophole will that figure out what the bounds of those things are so o. Use of Outdoor Entertainment and sound entertainment is not furnished we might end up doing more than just recycle restaurants or wine bars might end up with Retail Stores for the outdoor fixed amplified sound weve gotten complaints and no answers to Retailer Stores and many that think this is the way to advertise their business didnt sit well, that with the venues and offices around there by the didnt have an answer were creating something and then because he with a fixed place permit were limiting our one time outdoor use to 12 times a year that is the consistent thing weve done in the past with using one time like event permit for inside space if you do that why not get a fixed place permit we decided that was a reasonable consistent way to assume that maybe it is a better plan again entertainment permits get impacted by the changes that were making to now include you outdoor spaces so instead of saying to Small Business owner someone we have in the past we inherited this we only building it is regulates the inside i dont believe that technically there is anything in the code that says that weve come to you and you guys are managed to exchange the policy one time or whatever to say okay. Those rules and conditions apply to the inside if you want to do those own the inside then those rules apply but outside that is other rules well include outdoor and indoor under the permits you might end up having to consider in the process of determination those to areas somewhat separately they have potential; right . For bothering neighbors in a devastate way you know if theyre not done correctly same holes for limited Live Performance and then the one time treatment permit indoor arrest or outdoor were limiting to 12 times a year in theyre doing a fixed use consistently well, let me get through this. Ill ask a quick question. I forgot this is after having read this but for the poe and lp they have an outdoor permit attached or have to check a box and opt into that. Were dealing with someone that comes to us with an operation in mind and decided to privet towards something new we go back and say hey weve got to figure out what youre doing now you changed our mind it is in our discretion at the outset to say someone do you plan to have an outdoor space obviously; right . If they have the room it might suggest they consider it well probably consider in the office if they dont say a backyard it may not be an issue. In the settlement we had a hearing and there was close to two years ago now here we are with a very basic solution which is so create a permit that is a two year permit that note a cites specific permit that basically says you can use this for street performance arrest other people if i had sound and use it for not closer than 50 federate from another performer but a set of rules minimal that would require them to have a visual permit on their body, and then see how that goes from here. laughter because i have no intention nor the resources i feel to curate what frns good and bad performance exactly you should perform and how long you should perform that is the way the port does it on rejection they have a whole podium of staff that deals with deciding who comes and what letters and can someone play or here and there not interested if that dont think we can do that not the resources for that at all so this is the concept obviously we havent tried it i that the street performance in San Francisco is important i think we really want to provide a protection and clear guidelines the reason we get stuck and surrounded by that police and the ids fussing one person is too long in front of one store no clearcut way to see what we expect and a bunch of time like days like today no issues and a heavy tourist type and tourist area we know there is a lot of events this is not curtailing free speech and didnt apply to larry the bucket man and people yelling about the new testament on the sidewalk outside of city hall free speech is protected in San Francisco ucsf and not trying to manage all of that just amplified sound from a street performer commissioner thomas. We have to come up with pricing and schemes weve been working with the folks in g a s and their Budget Office so we think we can do wfrld permit for too years and again based on what we believe is administrative time with the back up material we can keep that number low enough for completely racially and i expect people to achieve that permit and not say that is too much money we have a wildfire process in place for amplified sound permit i believe that will if someone is frankly destitute and can show us via our system in the code they have no money we have a way to waive fees on paper remember that i think too the example your giving most of chinatown performs are playing their own instrument and not amplified and they do plug into a soundbox. Oh, okay. So i think that is where the differentiation would be; right . A plug in. Commissioner perez and want to wrap up im wondering in the 200 per year is compatible to jefferson street. The permit a question about the size of their sound system many times people dont know so they stand in our office for about an hour on the phone trying to figure out how many watts and what do you mean and we try our best you know we give the sound inspectors the information around those one time amplified permits every week they can go and try to monitor i dont know how else to do that is speculation. Well, i could bring up brad reminded me we did take the opportunity draft to include at ability to charge people for their time to charge an applicant for the time the sound inspectors spend and one of the reasons for that is that the pattern that weve seen with this commission in particular of imposing when we bring something out of ordinary in terms of outdoor amplified sound requests imposing the use of those inspectors during that performance or before it or after it; right . And we have absolutely no way to pay for that so this is building in a tool for that at the moment i dont have a number but basically authorized to their salary range so we can do that perspectively or perhaps another inspector person. For the outdoor festivals the Fire Department charges a fee for coming out and inspecting. Many, many departments charge fees we know were doing this with with dill lesson youll hear about around permits and services that the city provides and yeah i dont love charging fees but sometimes, it is important. San francisco is known worldwide for its atmospheric waterfront where spectacular views are by piers and sight and sounds are xhanl changing we come to the here for exercise relax ball games entertainment, recreation market, exhilaration a wide variety of contributions easily enjoyed look up the bay the waterfront is boosting for activities boosting over 25 visitors every year the port of San Francisco manages 7 may have Million Dollars of waterfront from hyde street and Fishermans Wharf to the cargo terminals and name shoreline the architecture like pier 70 and the Ferry Building is here for the embarcadero and a National Treasure the port also supports 10 different Maritime Industries alongside with the recreational attractions making San Francisco one of the most viable working waterfronts in the world but did you think that our waterfront faces serious challenges if earthquake to damage the seawall and the embarcadero roadway rising seawalls will cause flooding at high tides and Major Repairs to a safe many of the piers the port is at a critically turnl point time to plan for the future of San Franciscos waterfront this year the port is updating its marts plan the Plan Working Group to invite a wide variety of poichdz from the city and bayview and other advisory teams to share their expertise if intense and Maritime Operations the waterfront Land Use Plan has guided the use and development of the lanes for the last 20 years major physical changes take place along the waterfront and now is the time to update the waterfront plan to continue improvements that will keep our waterfront vibrate, public and resilient the Biggest Challenges facing the waterfront are out the site an aging seawall along the embarcadero roadway and seawalls that will rise by 21 hundred to provide and productivity of tides seawall is built over weak soils and mud the next earthquake will cause it to settle several feet without the urgent repairs that will damage the promenade and other things weve been fortunate over the last hundred years less than one foot of seawall over the next hundred years Scientists Say well have 6 feet of seawall rise imagine the pier 30 32 will be floated, the embarcadero will be flooded our Transportation System is fog to be heavy impacts unfortunately, the port didnt have the Financial Resources to repair all the deteriorating piers let alone the adaptations for Sea Level Rise. It is clear that the port cant pay for the seawall reinforcement or deal with the Sea Level Rise on its own needs to raise money to take care of the properties at take care of the maintenance on the properties no way absent anti funding the issues of Sea Level Rise or the schematic conditions of seawall can be development. As studies talk about the seawall challenges the working group is look at the issues please come share our ideas about recreation, pier activities, shoreline habitat, Historic Preservation and transportation issues and viral protection. We know this planning process will not have one question and one answer we need the diversity of the opinions how people feel about San Francisco waterfront and want to hear all the opinions. The challenges call for Big Decisions now is the time to explore now and Creative Ideas to protect and preserve San Francisco waterfront. Now is the time to get involved to help to shape the future of our waterfront. We need the debate please come forward and engage in the process. This is your waterfront and this is your opportunity to get involved be part of solution help San Francisco create the waterfront we want for the future. This is really to dream big and i think about what our waterfront looked like for all san franciscans today and generations to come.
