Im to that one very big seat vacant our first item is general Public Comment this is for business that pertains to the Entertainment Commission is there my Public Comment that you do not see currently on the agenda seeing none, Public Comment is closed. Well pontiff to item 2 is actually struck from the agenda because we dont have minutes to review today move on to item 3 the report from the executive director just so that the staff not the staff but commissioners are aware ive active asked to split the executive director report seeing that kind of our load of business to discuss has increased over time so well have Public Comment separate for the executive directors report and then the sound intersections report Deputy Director jocelyn kane. Good evening trying to be brief so allow me this evening under the legislation and policy update as you may know know the addition or amendment to chapter is an chifd that protection of night life was moving through the pace to add hotel and molts as used well be reviewing residential and so yesterday worthwhile that at the submit the Land Use Committee approved with i think a anywhere amendment the legislation onto the full board that amendment i watched it today on review was simply to exclude hotels that already have entitlements so that was so obvious but needed to state that on the 0 record i think the 14 will be First Reading and a week later a done deal from the board and the mayor will sign that in midmarch early april i should get indication information 17 or 18 hotels i know are in the pipeline i already have their addresses we did that research so we should be able to host them through the process maybe well have to change the name the Residential Development committee didnt include molts and hotel. Is that on for those of you who dont know im ben blind man the chair of the california currently association and organized the bar owners 90 in San Francisco and right now three hundred and 10 bar owners every single is going to equity in a bar of a group i founded and the owner and weve had 11 bars and restaurants in San Francisco some entertainment permits right now 5 brickandmortar locations and we also have a Events Company that we did over three hundred events mostly in San Francisco a lot of attempt ill excited about this opportunity ive been practicing for this for years i think im excited laughter . So, yeah i dont know if ben knows when theyre putting on agenda rules but obviously the sooner than later as far as were concerned want to have a compliment of commissioners i wanted to update also the commission on a couple of things that started more recently one of them i think i might have discussed the creation of lgbtq workshop that is doing Historic Preservation or Cultural Heritage preservation citywide by supervisor wiener or then supervisor wiener and so ear had one initial meeting planning is really going to take the lead it is appropriate but you know were main involved i think that is a role to play for night life in lgbtq historic or currently preservation so that next meeting is open to anybody who is interested in helping this process going to be a long process because this kind of effort in figuring out what youre currently assets are so youre not as inclusive as possible and moving through the process and commissioner perez is shaking his head he the this in the filipino so this work it takes time and the next meeting fy in city hall there will be mailings and announcements if youre interested please come and take a look at it and see what were doing and then also quite recently the building inspection decided to take or really a few commissioners described to look at how the city regulatory agencies were working towards warehouse safety all of the ghost ship is important for everybody so they created theyre calling a warehouse Task Force Im not sure that is an accurate description but invited the commission to be part of that there are two ways dealing with residential issues we dont deal with here but the issues p of taking a warehouse and making that safe for people to assembly is where we are most important so we met once i think that is workout itself and little intention to make it to april at the moment and hopefully come out with policy guidelines or new legislation that is not clear all the agencies with you i can imagine were there at the table and spearheaded by the Building Department well see where this goes ive not sat on third degree that the Building Department before so theres that and lastly i wanted to update you on corrective actions since weve met weve not been here together in sometime because we had holidays and Christmas Parties and cancelations so a few incidents we were obviously wanted to get ahead of it put it on the agenda one on in Office Meeting with the sill last year on branding street a city owned piece of property run by a nonprofit and they have had Management Changes and dependent on foil with us or are very old really there was an incident outside of the viewpoint was very serious and it occurred after a youth fended so when we have obviously violence outside of anything we permit we take that seriously we had a meeting with the management and the Arts Commission that a oust of oversight body were on target to basically move the new administration there, there a process as their politically through a permit theyll not come in front of you not required the permit is valid but needed to start from miami it maggie and i are working have not process and we had the southern station captain and the permit officer to do what we could to make that clear that is Serious Business and we wanted the Community Spaces for healthy and safe so that happened and there was also some violence remind me at christmastime and oddly the night after or the other way around at the holy cow again in the southern to it was handy to have the permit officer in the room but i think you in each case they are different scenarios the grand was i think over promotion promotion sorry i didnt i have this was so a long time but it is important we did the same kind of review with both of these maybe a promoterer at the grand and holy cow was down around the corner but again none will be a suspension because not what were after were after compliance weve gotten i think got a new security plan from holy cow and signage outside i know the grand get rid of the promoter for good forever and we have not had a problem since theres that so nonetheless you have my question ill hand it over go ahead commissioner lee. I hope it goes through rules it is good to have a small venue bar owner weve been missing that ive worked with him in c mac i have a questions are they asking us to be advisors on this thing er planning to parapet in some of the i dont think theyre going into permitting theyre not asking store permits kind of a gray area of what theyll do with those you know assembly is usually the Police Department or for im curious how we get involved with that later and i think that ultimately the Building Department didnt know exactly what theyre after their doing like all the task forces to investigate what is working and what is broken and what can we do better and what policy decisions going down the path and when o which ones need to turn the Mayors Office is at the table the city family was there more advisory. Good evening ill try to keep that short more substantive issues a few inspections i did a few but the last couple of months issues where the police and the venue on sidewalks and patrons and crowds personally i dont think that is an issue but nevertheless, the venue has been working with the Community Benefit district and the Police Department to resolve that the broadway benefit district they step forward and instead of having Security Guards but 10 b you see at the end of the night theyll move the ubers did you observe the street and keeps issues from reconcurring theyre working together i think this will eliminate most of problems around the sidewalks being overcrowded or whatever there was an issue in december they had a lebron james on a flier so they over promoted it was crazy no issues as far as fighting or things like that but you, you know 3w450 people and the Police Department took extension we worked together next door at the monroe a minor security change a guy not doing his job to note they switched one the person but no issues there going back to new years stopped by a few parties the westerfield party a lot of preordainments that used is to hang out with sebastian and midnight that party was fine more compliance underground it came up before with the there was several karaoke problems during the fall or whatever and this was a venue that was unpermitted that of ref a lot of complaints and i went by there several times and wrote them a certification the pd went but on new years and closed them they end up coming into the office he talked with them we arrived at they have a couple of steps before a planning permit so i let them know if they keep on operating theyll keep on greeting me and the Police Department and maybe not inclined to grant their conditional use their in process and stopped the operation and confirmed with the Police Department i check theyre not operating and havent been so this seems fine back in december i did a sound teste rip tide and had a fire i guess they applied for a permit mayor four or five months ago but the sound test they passed 97 bci couldnt hear 2 outside some other complaint but sharon and i switched those areas he passed that open ill be happy to answer any questions you may have. Good evening shawn burke here a couple of quick notes a hefty list but highlight the more important ones i conducted a sound teste armory this was just before new years eve working with one of the neighbors and work with the operators and armory we conducted a test in the parking lot so the parking lot behind the armory we thought the weakest point that have that structure we confirmed that they did day the armory was within 8 decimal above the age bitten in the code and increased the sound rating on the condition the permit by one decimal i followed up again new years eve during the event multiple times and conducted tests inside and outside they were in compliance i wanted to update you on that a couple of new complaints got interesting things going on the de bois truck stop an outdoor music event unpermitted trying to track down the operator theyre not doing much i think that was a one of event i just founded with the mission permit officer about this establishment pizza joint on mists i was informed that the complaint may not be coming from this particular new business that operating out that have that location but associated with a gambling venue that popped up you may recall from a few months back i think 6 months ago so the alu and sfpd with working on that a new complaint on hawaii street im trying to get them into compliance with a llp a complaint from the church about the alamo not movies but music well pass that off to the Police Department one unpermitted after hours report about 960 folsom ill investigate this were adjourned and a complaint about entertainment at Health Care Operations on castro stopped by there last week they have entertainment i talked with them about our permitting process i told you what theyre allowed to do ill keep you posted on the enforcement on the 11 street corridor im out there in touch with operators trying to make sure that all the many nightclubs are operating within their limits and just proving to be quiet an endeavor but things are moving forward once a third certification we actually brought them in and talked with the staff we felt like they needed to permitting provide some xremgsz and timelines for improvements and they were able to give that to us and residents so ill continue to keep you posted im out there ever weekend to make sure they understand my exceptions and what is going on. And then a one of permits we issued for one night all with well, there i think that wraps up. I have a question about 960 folsom i know youve not investigated that is that weve had over the years various places in soma had records or reports on after hours is that one that pops up. First application is an llp for drink this is located on san bruno after a brewery and at that point room they plan to use the loophole will that for acoustic bands and karaoke and theyve done a lot of outreach in the area to neighbors, patrons and surrounding businesses and our Neighborhood Associations so youll see 70 signatures of support in our file as well as a couple of letters if neighboring businesses and a letter from the portfolio Neighborhood Association one letter of opposition in our file that is the final letter in the packet that of mailed to me from a neighbor who was elderly but basically in the letter say theyre okay with the permits of adrc treatment as long as it didnt disturb them the applicant can speak to that in particular. Its been approved lets bring up the owner this is shay england. Im shaw my husband and i kevin are coowners a brand new brewery with 23 licenses on san bruno avenue an area that is a little bit up and coming but needs something happening we felt that was in the Community Interest to have something to do in the early part of evening and San Francisco also help us bring in people into the doors because were largely separated from the rest of the city being or being is 101 and 280 we felt we needed to do something in order to make us a little bit more known in the area and provide much needed entertainment outside of el torito it is largely hispanic music and i believe theyre open until 2 i think were the only other 1 on the street that is applying for an entertainment license ive not ive reached out to the gentleman with wrote the letter not in touch with him but let him know were a small brewery looking for jazz on sunday and from time to time maybe some karaoke but not often hose on the edge of our three hundred foot radius i feel like well not be disturbing him in the interest of time. So your second and final permit is another llp is located in the tenderloin 835 larkin street a cafe and record store it is a dynamic premises they want to add live musics a few times a month and want to have djs and also working with their neighbors and patrons and surrounding businesses and 8 letters of support including a letter from the larkin association and approximately 85 signatures of support in our file we didnt receive my letters of opposition to this one and tenderloin station approved it with the Good Neighbor policy and one security personnel and scheduled is to be sent to the station one week prior to the events here is one the owners rob maybe all 3 of them. Working on a record store and do event there as well and wanted to bring a similar thing here the whole environment of our store is very different from anything you know at it provides a space for artists to showcase their work on a personal level given that it is a record store and cafe together we want to go to 10 00 p. Hang on one i do to while we get set up to make a point i think a lot of the sort of suggested changes to the code are actually sort of clean up rather than new sort of new policy and there is going to be points were talking about sort of a new tool that are created for venues particularly around the outside sound of a youre worried about the thickness of packet the whole sections are moved to other parts of code so sergeant will highlight the new things were consider and at this point no sponsors of the legislation it is really in an early draft before we can shop around and get either the board of supervisors or the mayor to support so i want to just to be clear about that. Your wanting a one time permit if youre, however, your activity that you described to us didnt include what we consider big entertainment as told you need to fixed place outdoor amplified sound or a one time outside am mid sound permit following where does parade entertainment fall. I put it on the chart ive the sound permit is based on an additional not often the sound trucks are what we use for amplified sound during parades thats the moving thing at this point there are few you know how many parades there are so yeah. I guess i should have put the bubble for timing yes so this is i think pretty much the way to describe what i did giving you more information and what the difference is entertainment is one big issue; right . And how we play this out no such thing as a fixed place outdoor door were calling it no such thing when we create a permit with the loophole will that figure out what the bounds of those things are so o. Use of Outdoor Entertainment and sound entertainment is not furnished we might end up doing more than just recycle restaurants or wine bars might end up with Retail Stores for the outdoor fixed amplified sound weve gotten complaints and no answers to Retailer Stores and many that think this is the way to advertise their business didnt sit well, that with the venues and offices around there by the didnt have an answer were creating something and then because he with a fixed place permit were limiting our one time outdoor use to 12 times a year that is the consistent thing weve done in the past with using one time like event permit for inside space if you do that why not get a fixed place permit we decided that was a reasonable consistent way to assume that maybe it is a better plan again entertainment permits get impacted by the changes that were making to now include you outdoor spaces so instead of saying to Small Business owner someone we have in the past we inherited this we only building it is regulates the inside i dont believe that technically there is anything in the code that says that weve come to you and you guys are managed to exchange the policy one time or whatever to say okay. Those rules and conditions apply to the inside if you want to do those own the inside then those rules apply but outside that is other rules well include outdoor and indoor under the permits you might end up having to consider in the process of determination those to areas somewhat separately they have potential; right . For bothering neighbors in a devastate way you know if theyre not done correctly same holes for limited Live Performance and then the one time treatment permit indoor arrest or outdoor were limiting to 12 times a year in theyre doing a fixed use consistently well, let me get through this. A venue that plans to be a indoors is the permit allows for both and at a later time they do an outdoor and not getting through the permit process. Were dealing with someone that comes to us with an operation in mind and decided to privet towards something new we go back and say hey weve got to figure out what youre doing now you changed our mind it is in our discretion at the outset to say someone do you plan to have an outdoor space obviously; right . If they have the room it might suggest they consider it well probably consider in the office if they dont say a backyard it may not be an issue. We did both that was out of the box we spent a lot of time looking at you shawn talking about the doors and the music and having the doors open you remember that are the doors open or closed. Yeah. In the settlement we had a hearing and there was close to two years ago now here we are with a very basic solution which is so create a permit that is a two year permit that note a cites specific permit that basically says you can use this for street performance arrest other people if i had sound and use it for not closer than 50 federate from another performer but a set of rules minimal that would require them to have a visual permit on their body, and then see how that goes from here. laughter because i have no intention nor the resources i feel to curate what frns good and bad performance exactly you should perform and how long you should perform that is the way the port does it on rejection they have a whole podium of staff that deals with deciding who comes and what letters and can someone play or here and there not interested if that dont think we can do that not the resources for that at all so this is the concept obviously we havent tried it i that the street performance in San Francisco is important i think we really want to provide a protection and clear guidelines the reason we get stuck and surrounded by that police and the ids fussing one person is too long in front of one store no clearcut way to see what we expect and a bunch of time like days like today no issues and a heavy tourist type and tourist area we know there is a lot of events this is not curtailing free speech and didnt apply to larry the bucket man and people yelling about the new testament on the sidewalk outside of city hall free speech is protected in San Francisco ucsf and not trying to manage all of that just amplified sound from a street performer commissioner thomas. We have to come up with pricing and schemes weve been working with the folks in g a s and their Budget Office so we think we can do wfrld permit for too years and again based on what we believe is administrative time with the back up material we can keep that number low enough for completely racially and i expect people to achieve that permit and not say that is too much money we have a wildfire process in place for amplified sound permit i believe that will if someone is frankly destitute and can show us via our system in the code they have no money we have a way to waive fees on paper remember that i think too the example your giving most of chinatown performs are playing their own instrument and not amplified and they do plug into a soundbox. Oh, okay. So i think that is where the differentiation would be; right . A plug in. Commissioner perez and want to wrap up im wondering in the 200 per year is compatible to jefferson street. I dont know what the i can look at but heres the thing we have to charge fees based on the cost of doing the work; right . The permit a question about the size of their sound system many times people dont know so they stand in our office for about an hour on the phone trying to figure out how many watts and what do you mean and we try our best you know we give the sound inspectors the information around those one time amplified permits every week they can go and try to monitor i dont know how else to do that is speculation. Well, i could bring up brad reminded me we did take the opportunity draft to include at ability to charge people for their time to charge an applicant for the time the sound inspectors spend and one of the reasons for that is that the pattern that weve seen with this commission in particular of imposing when we bring something out of ordinary in terms of outdoor amplified sound requests imposing the use of those inspectors during that performance or before it or after it; right . And we have absolutely no way to pay for that so this is building in a tool for that at the moment i dont have a number but basically authorized to their salary range so we can do that perspectively or perhaps another inspector person. For the outdoor festivals the Fire Department charges a fee for coming out and inspecting. Many, many departments charge fees we know were doing this with with dill lesson youll hear about around permits and services that the city provides and yeah i dont love charging fees but sometimes, it is important. San francisco is known worldwide for its atmospheric waterfront where spectacular views are by piers and sight and sounds are xhanl changing we come to the here for exercise relax ball games entertainment, recreation market, exhilaration a wide variety of contributions easily enjoyed look up the bay the waterfront is boosting for activities boosting over 25 visitors every year the port of San Francisco manages 7 may have Million Dollars of waterfront from hyde street and Fishermans Wharf to the cargo terminals and name shoreline the architecture like pier 70 and the Ferry Building is here for the embarcadero and a National Treasure the port also supports 10 different Maritime Industries alongside with the recreational attractions making San Francisco one of the most viable working waterfronts in the world but did you think that our waterfront faces serious challenges if earthquake to damage the seawall and the embarcadero roadway rising seawalls will cause flooding at high tides and Major Repairs to a safe many of the piers the port is at a critically turnl point time to plan for the future of San Franciscos waterfront this year the port is updating its marts plan the Plan Working Group to invite a wide variety of poichdz from the city and bayview and other advisory teams to share their expertise if intense and Maritime Operations the waterfront Land Use Plan has guided the use and development of the lanes for the last 20 years major physical changes take place along the waterfront and now is the time to update the waterfront plan to continue improvements that will keep our waterfront vibrate, public and resilient the Biggest Challenges facing the waterfront are out the site an aging seawall along the embarcadero roadway and seawalls that will rise by 21 hundred to provide and productivity of tides seawall is built over weak soils and mud the next earthquake will cause it to settle several feet without the urgent repairs that will damage the promenade and other things weve been fortunate over the last hundred years less than one foot of seawall over the next hundred years Scientists Say well have 6 feet of seawall rise imagine the pier 30 32 will be floated, the embarcadero will be flooded our Transportation System is fog to be heavy impacts unfortunately, the port didnt have the Financial Resources to repair all the deteriorating piers let alone the adaptations for Sea Level Rise. It is clear that the port cant pay for the seawall reinforcement or deal with the Sea Level Rise on its own needs to raise money to take care of the properties at take care of the maintenance on the properties no way absent anti funding the issues of Sea Level Rise or the schematic conditions of seawall can be development. As studies talk about the seawall challenges the working group is look at the issues please come share our ideas about recreation, pier activities, shoreline habitat, Historic Preservation and transportation issues and viral protection. We know this planning process will not have one question and one answer we need the diversity of the opinions how people feel about San Francisco waterfront and want to hear all the opinions. The challenges call for Big Decisions now is the time to explore now and Creative Ideas to protect and preserve San Francisco waterfront. Now is the time to get involved to help to shape the future of our waterfront. We need the debate please come forward and engage in the process. This is your waterfront and this is your opportunity to get involved be part of solution help San Francisco create the waterfront we want for the future. This is really to dream big and i think about what our waterfront looked like for all san franciscans today and generations to come.
