She can find him not guilty, guilty of premeditated murder, murder, which is like Second Degree murder in the u. S. , or something called culpable homicide, which we call manslaughter. Well be back here for the verdict, which, again, is on september 11th. Jeff rossen, nbc news, pretoria, south africa. The death of james brady has been ruled a homicide. He died on monday. Youll recall nbc news justice correspondent Pete Williams joins us in the studio to explain. This is taking us back to 1981. Although james brady just died this week, there is no statute of limitations on murder in either the federal or the state system, and the authorities have ruled his death a homicide from this event that you are looking at right now. The 1981 shooting of james brady, the attempted assassination of president reagan, of course, is what he was charged for, and the jury found him not guilty by reason of insanity. Now, were a long way from knowing what the federal authorities are going to do with this. Whether theyre going to do anything with it. They, in theory, could file murder charges because, as i say, theres no statute of limitations on murder. But they have to make some pretty serious decisions here. Number one, if they did that and they were going to have a trial and they were going to get another verdict of not guilty by reason of insanity, and, of course, the question would be what was his mental state at the time, not what it is now. His families and doctors have said that he is greatly improved, so you go back to his mental condition at the time. If you are going to get the same verdict, is there a point in doing it . However, the second thing, i think, that the federal authorities will have to consider here is, as you know, his family has been undergoing a multiyear Long Campaign to get him longer and longer leave from st. Elizabeths to visit the family home in williamsburg, and as you know, there is pending now still in federal court a request basically to have permanent leave down there. He has been on these multiweek trips. They want to get him down there all year, basically. If the federal authorities were to take decide to pursue these charges, that could potentially complicate that. There are, you know, many possible moving parts here, and were a long way from knowing what the consequences, if any, of this will be. Couldnt, say, a defense lawyer for hinckley say, but james brady was 30 plus years ago, and he reached his Life Expectancy so to speak . Is that something someone could say to counter this if they pursue this . I think one thing that a defense lawyer could say is there were intervening causes of
