NJBIA Files Amicus Brief Concerning Constitutionality of Pennsylvania’s Business Closure Order  January 13, 2021, 9:53 am | in NJBIA Files Amicus Brief Concerning Constitutionality of Pennsylvania’s Business Closure Order    The New Jersey Business & Industry Association has filed an amicus brief in the U.S. Court of Appeals for the Third Circuit in support of a recent lower court decision addressing the constitutionality of key aspects of Pennsylvania’s COVID-19 emergency orders. In its filing, NJBIA argues that, while a state’s chief executive should have broad powers to act to protect public health during an emergency, those powers are not unlimited and must be subject to constitutional limitations.

According to the court’s order, one of many handed down on Monday, “The respondents are directed to file a response to the petition on or before noon, Tuesday, January 19, 2021. Petitioner may file a reply brief on or before noon, Thursday January 21, 2021.” The Lyon County-based Calvary Chapel Dayton Valley has been engaged in a lengthy legal battle with Gov. Steve Sisolak, D-Nev., Attorney General Aaron Ford, and Lyon County Sheriff Frank Hunewill over worship restrictions imposed in the state as a result of the novel coronavirus pandemic.

SCOTUS shirks its responsibility when needed most

On that date the United States Supreme Court (SCOTUS) refused to hear:  The case challenged the 2020 Presidential election results an election whose legitimacy was being questioned by President Trump and the 74 million people who voted for him but was also being affirmed by President-elect Joe Biden and the 85 million people who voted for him.
