Mxolisi Donda was handed the sentence in the Pongolo Magistrate’s Court on Wednesday afternoon for shooting a man during an altercation in KwaZulu-Natal in 2018.
“The officer was charged with murder following an investigation by the Independent Police Investigative Directorate (IPID), which found that on 1 December 2018 the police officer was on his way home in a state vehicle,” IPID spokesperson Ndileka Cola said.
As the vehicle exited the N2 freeway, another vehicle was parked in the road, causing an obstruction.
“The deceased was standing next to that vehicle. An argument ensued and they got into a brawl which led to the deceased delivering a blow to the accused and he fell on his back. The accused went to the state vehicle (and) came back with a firearm. The deceased tried to run away but the accused shot him,” Cola said.
“What happens outside the perimeters of the university becomes public order,” said Vilakazi.
“It is regrettable that someone died because of disproportionate use of containing the protest. I think the situation could have been dissolved better.”
Vilakazi said that he was “gutted” by the death of the man.
He said that the university will closely monitor the case’s developments as the Independent Police Investigative Directorate (Ipid) investigate Ntumba’s death.
“We do not want this to be a cold case.”
According to Ipid’s Spokesperson, Ndileka Cola, the case of ‘death as a result of police action’ is under investigation by the directorate.
On Thursday, Minister of Higher Education, Science and Innovation Blade Nzimande outlined plans for additional funding for students in higher education. This comes amid widespread outrage over the death of 35-year-old Mthokozisi Ntumba, who was killed when police opened fire on unarmed students protesting at Wits University on Wednesday. The police allegedly opened fire and Ntumba was hit as he came out of a nearby healthcare facility.
During a post-Cabinet briefing, Nzimande expressed his condolences to Ntumba’s family, friends and colleagues.“I have directed that the Wits University Council, the Wits Management and… relevant law enforcement authorities provide us with an explanation on what caused this tragedy, and to take whatever steps to ensure justice is done and appropriate responsibility is accorded.”
The Independent Police Investigative Directorate has revealed the identity of the man who died during a student protest in Braamfontein as Mthokozisi Ntumba.
Although it reported that Ntumba was a father of two, his family clarified that he was married and had four children.
Reporters were also told that Ntumba was an employee at the Department of Human Settlements and had just completed his master s degree
Mthokozisi Ntumba, who was shot dead during a student protest in Braamfontein this week and leaves behind a wife and four children, was determined, hardworking and positive. He was a progressive, young man - very determined. He lost his parents at a young age but with his brothers, they have really worked hard to be where they are, his cousin, Sthembiso Jwara, told the media outside their Kempton Park home on Thursday morning.
