A High Court judge has criticised An Bord Pleanála for âa certain laxityâ in its scrutiny of a developerâs documents in his judgment overturning the boardâs permission for a strategic housing development of more than 300 apartments in Dublinâs docklands.
Mr Justice Richard Humphreys said, given his findings, it would not be appropriate to remit the planning application for reconsideration by the board, with the effect a new planning application will have to be made.
Atlantic Diamond Ltd challenged the August 2020 permission for what it described as a âfactory-cum-apartmentâ development of 336 apartments, in six blocks ranging in height from four to ten storeys, childcare facilities and associated works, to replace most of the existing commercial units at Docklands Innovation Park, East Wall.

The High Court has overturned a fresh planning permission for a controversial development of 657 dwellings on lands near St Anne’s Park in Raheny. The proposed development has so far clocked up four decisions by An Bord Pleanála and ten sets of legal proceedings “and counting”, Mr Justice Richard Humphreys noted.
In a judgment on Friday, he quashed the board’s third permission, dated August 2020, for the proposed development on former lands of St Paul’s College, Sybil Hill Road, Raheny, by Crekav Trading GP Ltd, part of Pat Crean’s Marlet group.
