Mills | Buchanan Ingersoll & Rooney PITTSBURGH – For the third time, counsel for Dollar General and Aldi argue that allegations brought against them and other retailers which said they unlawfully charged sales taxes on the purchases of face masks during the COVID-19 pandemic are unsupported, and should be dismissed. Joshua James of Freeport (and on behalf of all others similarly situated) first filed suit in the Allegheny County Court of Common Pleas on Nov. 12. (The case was later removed to the U.S. District Court for the Western District of Pennsylvania on Feb. 11.) The lawsuit took aim at many different retailers, including Marshall’s, Forever 21, Sally Beauty Supply, Dry Goods, Amazon, Zazzle, Etsy, Brave New Look, Outdoor Research, Aldi, Dollar General and eBay.

Crisis Pregnancy Center Advertising Targeted by Pending Legislation in State Legislature May 13, 2021 A bill that would ban what abortion rights advocates describe as deceptive advertising at crisis pregnancy centers is waiting for a vote on the House floor after passing the Senate 21-15 on May 5th. The legislation has faced bipartisan opposition, with Sen. Cathy Osten, D-Sprague, and two other Democrats joining the Republicans to vote against the legislation. The proposal has been considered by legislators in four previous legislative sessions, most recently passing the Health Committee and House, but dying without a vote in the Senate in 2019.  Supporters of the proposal argue that “limited services pregnancy centers,” which do not offer referrals for abortion or emergency contraception, masquerade as comprehensive medical facilities, luring pregnant women in an effort to dissuade them from abortions. Bill to penalize social media censorship introduced in Senate

Harrisburg, Pa. – Social media sites that censor free speech could face civil penalties under a new Senate bill introduced on Thursday. Senate Bill 604 would make social media censorship a violation of the Unfair Trade Practices and Consumer Protection Law. The law would only apply to social media websites with more than 75 million subscribers. Under the measure, users whose content is purposely deleted or disfavored via a social media site s algorithm could sue for damages, including statutory damages up to $75,000. The bill would fine a social media company $100,000 per day if found to be censoring a political candidate for statewide office. The company would be required to disclose their algorithmic bias for or against a political candidate as a campaign contribution.
