The Bar Association of the Kingdom of Cambodia (BAKC) has vowed to expand the scope of pro bono defence consultations for the poor and called on lawyers around the country to participate in serving social justice and contribute to reducing the effects of poverty.
The Bar Association of the Kingdom of Cambodia (BAKC) has expressed strong concerns over the conduct of some “competent authorities” which they say is tantamount to usurpation of the bar’s authority over the legal profession.
Some of the practices that the association objects to specifically are the act of holding lawyers who are representing their clients; forcing lawyers to refer clients to the judicial police; forcing lawyers to violate attorney-client privilege by disclosing confidential information; filing lawsuits against lawyers for defamation due to statements made in the course of representing a client; and lawsuits for incitement based on the legal counsel that a lawyer provides to their clients.

Court begins hearing of Rainsy, activists on incitement charges

The Phnom Penh Municipal Court began hearing the case of Sam Rainsy, former president of the Supreme Court-dissolved Cambodia National Rescue Party (CNRP), and 21 alleged accomplices on charges of treason, incitement to cause social chaos and incitement of the military to engage in rebellion.
The hearing was held on December 29 under tight security conditions both inside the courtroom and outside the municipal court building.
Thirteen of the 22 defendants attended the hearing, while nine others remained at large after fleeing Cambodia to take up residence in various countries abroad.

Foreign lawyers told to register with BAKC

The Bar Association of the Kingdom of Cambodia (BAKC) has announced new requirements for professional foreign lawyers who are working at the Extraordinary Chambers in the Courts of Cambodia (ECCC) to register with the BAKC for certificates authorising them to practice law in the kingdom, according to a notice dated December 18.
“Foreign lawyers who fulfil the required conditions in accordance with the internal rules of the ECCC must submit application forms for registration via defence support units or victim support units,” the decision said.
Support units must examine and accurately translate English-language documents into Khmer then submit completed application forms to the BAKC. After receiving submissions, the BAKC will reply within 30 days.
