eCommerce distribution centre could face millions in penalties for underpaying vulnerable workers

The Fair Work Ombudsman (FWO) is taking action against warehousing and distribution provider Winit (AU) Trade Pty Ltd, alleging the company underpaid 30 vulnerable workers in Sydney. The company could face millions of dollars in penalties, and the company’s director and general manager Song Cheng could be slapped with hundreds of thousands of dollars in fines himself. While the alleged underpayments range from $446 to $28,202, the Ombudsman alleges that 19 employees were underpaid more than $10,000. The FWO said it has commenced action under the ‘serious contravention’ provisions of the Protecting Vulnerable Workers laws, alleging the underpayment of 30 migrant employees on working holiday visas.

Facing court is Michael James Henshaw, a sole trader operating Spit and Polish Professional Cleaning. The regulator began an investigation after receiving a request for assistance from a former part-time employee who worked for the Merewether-based business between January and October 2019. A Fair Work Inspector issued a Compliance Notice to Mr Henshaw in January 2021 after forming a belief that the cleaner had not been fully paid wages and annual leave entitlements, including leave loading, she was owed under the Cleaning Services Award 2010 when her employment terminated.

The Federal Circuit Court has imposed a $6,000 penalty against Available Dental Care Pty Ltd and $1,400 against Doctor Seyed Shahabeddin Lajevardi, also known as Shaun Lajevardi, the company’s director. The penalties were imposed in response to Dr Lajevardi breaching the Fair Work Act by failing to comply with a Compliance Notice requiring him to calculate and back-pay entitlements owing to three workers. The affected workers were two dental assistants and a 19-year-old receptionist, all employed on a part-time basis.
