A group of pests desperate to stop a rezoning that would transform 80 Brooklyn blocks surrounding the toxic-waste-filled Gowanus Canal belongs in the Bad Faith Legal Argument Hall of Fame. They sued to kill the plan, arguing that COVID-required remote public hearings stymie participation in the review process, violating the First and Fourteenth Amendments. If the rezoning moves forward, plaintiffs argue, the whole process will be “tainted with illegality.”
