A judge has dismissed two of three counts in a lawsuit challenging the secret process used to appoint Genesee County Clerk-Register Domonique Clemons but the case can move forward on the single question of whether the appointment violated the state’s Open Meetings Act.

GENESEE COUNTY — Plaintiffs in a pair of lawsuits are alleging Genesee County circuit court judges broke state law when they selected a new county clerk-register this past month. Nichole Ruggiero of Hemlock and Flushing resident Archie Bailey have both filed suit against an unnamed body consisting of circuit court judges who appointed Domonique Clemons
