A Montana prosecutors group in February pushed back against the proposal, contending that a small number of people could force prosecutors to circumvent an individuals due process rights.

A proposed amendment to Montana’s constitution that would allow a certain percentage of voters in a county to convene a grand jury will – if it clears the hurdles to be put on the 2024 ballot – show that a majority of the members of a legislative interim committee felt the measure should not have been on the ballot in the first place.

After twice rejecting legislation this year that aimed to allow groups of Montanans to form their own grand juries, most lawmakers have not warmed to the idea in the seven months since those bills were tabled.

A bill heard in the House Judiciary Committee Monday seeks to send a proposal to voters in the 2024 election that would amend the Montana Constitution to allow groups of citizens to form grand juries which could return indictments county attorneys would be forced to prosecute lest they be indicted themselves.

"Not only would it force the county attorney to prosecute that person, but it would also force the judge as well," the bills supporter said Thursday.
