Rep. Angela Romero, D-Salt Lake City, is sponsoring HB98 which would create a third-degree felony offense of sexual conduct without affirmative consent. Current Utah law defines sexual abuse as when “the victim expresses lack of consent through words or conduct.”

Sexual conduct without affirmative consent would be considered a third-degree felony in Utah under a proposed piece of legislation.

HB98, sponsored by Rep. Angela Romero, D-Salt Lake City, would make sexual conduct without affirmative consent a third degree felony, punishable by up to five years in prison and a $5,000 fine.
