Delta-8 Tetrahydrocannabinol, Delta-8 THC, is an isomer of Delta-9 THC, the intoxicating component of certain cannabis plants. It is naturally occurring at very low levels in hemp.

FDA posted warning letters to 7 companies for selling dietary supplements with claims that caused products to be drugs, violating Federal Food, Drug, and Cosmetic Act FD&C Act. Products to diagnose, cure, treat, prevent disease are subject to same requirements as drugs.

FDA has resumed routine surveillance inspections of registered food facilities after temporary pause due to omicron variant of COVID-19. FD&C Act requires FDA to inspect domestic food facilities either once every three years or every five years.

Cosmetic manufacturers can sometimes violate the law by marketing a cosmetic product with a drug claim or marketing a drug product as a cosmetic, failing to comply with regulatory requirements for drugs. FDA has the authority to regulate cosmetic labeling claims.
