The trial for a Grand Rapids police officer charged with carelessly discharging his gun is set to start Thursday.

The trial for a Grand Rapids police officer charged with carelessly discharging his gun ended Friday after the jury came back with a not guilty verdict.

Daevionne Smith is suing the Grand Rapids Police Department, the city of Grand Rapids and Officer Gregory Bauer for $7.5 million to compensate him for “mental and physical anguish, loss of enjoyment, and the post-traumatic stress.”

"I'm not even able to sleep straight anymore," said Daevionne Smith, "and their actions were reckless."

Daevionne Smith is claiming assault, battery and gross negligence, along with asking for $7.5 million in the federal lawsuit.

Daevionne Smith is suing the Grand Rapids Police Department, the city of Grand Rapids and Officer Gregory Bauer for $7.5 million to compensate him for “mental and physical anguish, loss of enjoyment, and the post-traumatic stress.”

Body camera footage released to FOX 17 shows Officer Greg Bauer with the Grand Rapids Police Department on the night he allegedly fired his gun unintentionally during a pursuit.

The Kent County prosecutor says an officer with the Grand Rapids Police Department will face a misdemeanor charge after police say he unintentionally fired his gun.
