Barry Morphew, charged with murdering his still-missing wife, Suzanne, is expected to sue the Colorado DA, and local, state and federal investigators for malicious prosecution and “extreme and outrageous conduct,” alleging crucial DNA evidence pointing to an alleged sex offender was omitted.

Barry Morphew has plans to sue prosecutors and investigators for extreme and outrageous conduct after they allegedly withheld evidence about his wife Suzannes disappearance and death.

Attorneys representing Barry Morphew intend to sue prosecutors and investigators for what they claim is unlawful arrest, malicious prosecution, and defamation, according to documents obtained by Denver7.

Barry Morphew was pictured with alleged girlfriend Shoshona Darke for the first time, as he loaded bins of mens clothing into the back of his truck at a Salida storage unit on Monday.

The woman is the alleged mistress of Barry Morphew.

Shoshana Darke, 51, was arrested Tuesday for trespassing Monday at the home  on Puma Path, Salida, which Morphew sold to new owners back in March.

Barry Morphew turned to aggressive fauna to explain away evidence linking him to his wifes disappearance last year, including chasing a chipmunk with a gun around the house.

The court will reconvene on September 17.
