The trial court that denied Lake County Sheriff Oscar Martinez’s motion to dismiss charges of reckless driving and resisting law enforcement was proper, and the state is allowed to refile charges if they’re dismissed, according to the Indiana Attorney General’s office.

Attorneys agreed to the delay because the Indiana Court of Appeals is in the process of reviewing Special Judge Jeryl Leachs decision in March to deny Martinezs motion to dismiss
