In the decades that have passed, memories have faded, key witnesses and law enforcement investigators have died, records can’t be found or have been purged and evidence has not been properly preserved, Sheila Keen Warren’s defense attorneys argued in court Wednesday, asking Judge Scott Suskauer to dismiss the case as witnesses and evidence needed for her defense are long gone.

In a new motion filed Tuesday, lawyers include evidence pictures of a clown costume and wig detectives bought at Spotlight Capezio in 1990 right after the murder of Marlene Warren, shot by someone wearing a clown costume.
