with a live shot from our roof cam. we are dealing with partly cloudy skies. last fall for today. this is what your temperatures are born to look like. san francisco or 53 degrees. 48 degrees for san jose. low 50's in concord. 48 degrees in livermore and 53 degrees for santa rosa. we do have rain to talk about and not attractive for you coming up. >> breaking news: a fight leads to a deadly hayward. police say it happened just parking lot behind "buffalo bill's brewery" on b street. on february 15, 2014, at 12:22 am hayward police dispatch received the report of a fight in the parking lot to the rear of 1082 b st., and someone possibly stabbed. when officers arrived on scene they found a male subject in the parking lot suffering from a stab wound. medical personnel rendered aid to the subject, but he was pronounced deceased at the scene. six minutes later, hayward police dispatch received a call of a solo vehicle collision on a st. at south garden ave. officers responded to this location and found the vehicle involved to be unoccupied. nine minutes after being notified of the solo vehicle collision, hayward police dispatch received a call from a local hospital advising they had two patients enter the emergency room suffering from stab wounds. at this time it appears all three incidents may be related, however this remains under investigation. the name of the deceased is not being released at this time pending notification of the next of kin. anyone with information regarding any of these incidents is encouraged to call the hayward police department's investigations bureau at 293-7034. >> in san francisco, a motorcycle driver has died after falling 30 feet. it happened early this morning when the rider was entering 101 at 10th street. he was then ejected from the bike. c-h-p says the bike remained on the roadway while the rider fell 30 feet down to the roadway below the on- ramp. the on-ramp has been reopened. no further details are available at this hour. >> a police chase in oakland ended with a deadly crash. officers say a chase involving the c-h-p ended at 98th avenue and san leandro street late last night. that's where the stolen van officers were chasing. crashed into some other cars, injuring two other drivers. one person was killed. >> stunning allegations against a south bay firefighter. mario enrique cuestas is behind bars. he's accused of selling methamphetamine to an undercover officer, and molesting a 17-year old boy. cuestas was arrested on thursday on federal drug and sex assault charges. those who know the 20-year veteran say the allegations have rocked the close-knit department. >> ".feeling sad." >> cuestas served for years at fire station one. more recently he had been assigned to the department's community outreach program. an internal investigation is underway. >> and a department of justice spokesperson says there may be more victims. kron 4 went to the san lorenzo home where neighbors say cuestas lives with his parents. the house is a couple of blocks away from two schools. when they heard the allegations, students who normally walk by the home said they were disgusted. >> you are supposed to be saving lives, not destroyed homes. >> those are the top of things to get to put in jail. >> the task force seized two hard drives, papers and other records as evidence in this case. authorities say cuestas used a gay dating website to connect with other men. >> the man who police say fatally stabbed a man outside a san jose bar. will not face murder charges. police say mark gutierrez was acting in self defense. the stabbing happened early wednesday morning. investigators say gutierrez was asked to leave a bar. the victim, ryan viri, followed him down the street. police say bar surveillance video shows viri holding a knife. while chasing after gutierrez. >> a c-h-p dash cam video captures a bay area traffic and now, the officer is being sued because of what happened. the passenger in that car says, the c.h.p. officer used excessive force. she charges the officer -quote - incineration could happen as early as tomorrow. >> an earthquake that shook south carolina and georgia was felt for hundreds of miles. the four-point-one magnitude earthquake happened around 10:30 last night. it was centered near the south carolina- georgia border. it felt as far as 150 miles in multiple directions. no damages or injuries have been reported. >> north carolina officials are are worried about another toxic spill. they fear a second pipe running under a coal ash dump might fail. this comes more than a week after a similar pipe collapsed and triggered a massive toxic spill into the dan river. the state said video taken inside the concrete pipe shows wide gaps between seams. they say potentially contaminated water could seep through those gaps. the states doesnt have an estimate of how much contaminated water from the dump is currently spilling into the river. officials have given the comany 10 days to come up with a plan to fix the leaks. >> an actress who says she "vindicated" by a report out now. it finds martin was bullied by three of his teammates. an independent investigation by attorney ted wells found richie incognito, john jerry and mike pouncey harassed martin, another offensive lineman and an assistant trainer. the harassment included racial slurs, homophobic name-calling and improper touching. but the report says the harassment was not meant to drive martin from the team or cause "lasting emotional injury." >> this morning -- an exclusive investigation into the team doctor of the san francisco 49ers. last october, kron4 broke the story about how doctor daniel garza was the target of a criminal probe, for alleged inappropriate behavior with adult interns. in addition to treating superstar athletes, garza was also a prominent researcher and associate professor at stanford university. the elite sports medicine physcian killed himself. after the san mateo county sheriff investigators. searched his home for evidence. now kron 4 has uncovered past allegations against the doctor. kron 4's maureen kelly spoke to three men who say, they were victiminzed by garza when they were teenagers. it's a story you'll see only on four. >> 16:14 i woke up in the middle of his quote unquote experiments and he was just sort of you know fondling me and kind of playing with himself >> that's the voice of a man who says he was drugged and molested by doctor daniel garza nearly 20 years ago, and he's not the only one who's accusing the doctor of sexual abuse. >> 15: for him to do what he did, just doesn't even seem human. >> in all i spoke to three victims, none of whom wanted to appear on camera. in order to protect their privacy.i've changed their names to peter, john and carlos. they say it started when garza was their young, influential teacher at cathedral high school in el paso texas. it's a catholic all boys' schoolserving mostly latino students coming from working class families near the west texas border town. garzaa recent stanford college gradwas teaching freshman science. to many, he was a trusted role model they greatly admired. >> 19:01 he was a phenomenal teacher. a phenomenal teacher. and he was able to paint pictures about science in just a beautiful way. >> even then he was closely involved with sports. here's a photo from the school's yearbook showing garza as coach of the school's tennis team. all of the victims i spoke to had been young athletes, who say they were approached by garza to participate in a research study involving physcially fit young men. the man i'm calling "carlos" says he was only 15 when approached by garza while at swim practice. he says more than once, garza took him into an empty classroom under the guise of taking his measurements for a study. he says garza had him pull down his pants and touched him in a way he considers sexual abuse. he never reported it. peter and john say they became garza's targets after joining his informal afterschool science group. at the time, they felt like they were being given an exciting opportunity by their mentor to help them succeed. peter now feels garza was laying a trap for them.from the very beginning. >> * *20:20 the way he picked us, it was very strategic. all of us had very dysfunctional homes, he knew we were over achievers and wouldn't want to disappoint. he was very, very >> near the end of 1993 garza convinced peter and john's parents to let him take the two boys on a ski trip to new mexico as a reward for all of their hard work. while they were alone in their ski cabingarza asked them to participate in his research study. >> 14:25 he explained to us how he needed to do some research for stanford on how young athletes' metabolic rates behave when they are in restful states versus athletic states, so he pulled out charts and everything looked very official. >> they say garza brought along something that he said would help them get into that restful state. a drug called halothanea powerful anestetic which when given in high enough concerntations renders one completely unconcious. they say garza told the teens to inhale from the peter volunteered. >> 15:57 i remember the first time i inhaled this drug i dropped the bottle, a lot of it poured out. then you know, i was knocked out and woke up in my bed the next morning. >> john agreed help in the study, but was uncomfortable with the idea of being gassed by the drug. but one night during that trip john woke up to an unusal smelland opened his eyes to find garza's silolette looming above him. >> 03:35 he had been putting the liquid of that bottle on to a washrag from the hotel and was putting it on my face. i rolled over you know, pretending that i was still asleep and i rolled my face away from him and he went back to the other side of the bed and put it back on me i rolled back the other way, i grabbed the towel and thew it on to the floor. the next morning i woke up thinking was that a dream or what? and i see the towel on the floor. it was pretty scary. >> john was rattled by the experiencebut chose not to report it to authorities. >> 04:42 at that point my home life wasn't the greatest and he seemed to be a stable figure in my life.so, i decided that i didn't have to tell anybody, i thought that he knew what was in my best interest and that he was looking out for me. >> only his best friend peter knew the truth. the victims didn't come forwarduntil it happened again. in the spring of 1994 garza took peter and john along with the rest of their science group to california in order to tour college campuses. it was during a visit to stanford university, that the "testing" began again. but this time peter says the drug wore off and he woke up to the unthinkable. >> 22: i actually woke up with my shirt off and his hand, in my genitalia, on my genitalia, you know, kind of caressing me and him sort of rubbing himself. >> peter told john and together they decided they had to come forward. they say parents, school officials and even the fbi were brought in.but in the end garza was not criminally charged.tomorrow in the next installment of our exclusive investigation you'll find department now confirms 243 flu deaths were related to this season with 41 cases of just one week. however, the total this past week, is lower than in the past weeks. the state health director says that the downward trend is a good sign. there are 45 confirmed flu related deaths in the bay area, with santa clara county reporting the highest. >> an update now on a measles warning, which started with a case involving bart. a second case of the measles in the bay area is being reported, unrelated to the bart exposure both cases are in contra costa county and both involve international travel. meantime, state health officials report three measles cases, raising some fears about a potential outbreak. we spoke with an infectious disease doctor at kaiser to find out the risks of contracting shark fins. for sale inside a business. officers were tipped off in january that an emeryville restaurant was selling shark fin soup. when officers arrived at the hong kong east ocean restaurant.the delicacy was on the menu and being openly sold to patrons. it's the largest bust since the ban went into effect last july. police say the kwong yip fish company in san francisco sold the shark fins to the restaurant. officers discovered thousands of pounds of shark fins stored at the warehouse. the owner was charged with a misdemeanor. that charge could land the owner in jail for up to six months. >> happening today, tens of thousands will fill the streets of san francisco. >> there was a report of a fight and one man was suffering from a stab wound. he died at the scene. six minutes after the police responded to a single vehicle crashed on a street and no one was in the car at the time. nine minutes later, a nearby hospital stated that they had to patients with stab wounds. all of these incidents are related. they have been treated their release. an investigator is still try to piece this together and they have guards in the area but they do not believe that these people involved were at the bar. authorities did not believe that the suspects knew each other and they're still trying to find out what led up to the site. site. police tell me that they are looking for two to five authorities say cuestas used a gay dating website to connect with other men. >> the man who police say fatally stabbed a man outside a san jose bar. will not face murder charges. police say mark gutierrez was acting in self defense. the stabbing happened early wednesday morning. investigators say gutierrez was asked to leave a bar. the victim, ryan viri, followed him down the street. police say bar surveillance video shows viri holding a knife. while chasing after gutierrez. >> a c-h-p dash cam video captures a bay area traffic stop. and now, the officer is being sued because of what happened. the passenger in that car says, the c.h.p. officer used excessive force. she charges the officer -quote - "violently forced her to the ground." it happened back in october. jennifer donovan says she and her partner were pulled over by officer j-a phillips,because one of their headlights was out. jennifer's partner donna was driving and was given field sobriety tests. donavan first refused to take a breathalyzer. she then calls to donna, who is still in the vehicle. that's when jennifer says the officer "violently forced her to the ground" causing her to tear her rotator cuff. now, she's suing the officer for excessive force >> simply because you may have probable cause or a legitimate reason to detain a person does i give you the license to ruffled some one and physically or injuries have been reported. >> north carolina officials are are worried about another toxic spill. they fear a second pipe running under a coal ash dump might fail. this comes more than a week after a similar pipe collapsed and triggered a massive toxic spill into the dan river. the state said video taken inside the concrete pipe shows wide gaps between seams. they say potentially contaminated water could seep through those gaps. the states doesnt have an estimate of how much contaminated water from the dump is currently spilling into the river. officials have given the comany 10 days to come up with a plan to fix the maligned >> the jury will be back in court today to decide the fate of the man charged with first-degree murder of a 17- year-old over loud music. the jacksonsville, florida, jury in michael dunn's case deliberated all day friday and did not reach a decision. dunn is charged in the november 2012 death of 17- year-old jordan davis. dunn allegedly shot an suv davis was in with four other black teenagers. >> the family of a kidnapped newborn from wisconsin wants justice. baby kayden powell was abducted from a home in beloit, wisconsin last week. his aunt, kristen smith, has been charged. police say she took the baby across state lines to iowa, where she was arrested. an officer found the baby at a gas station. despite being left in the cold, confirms 243-flu-related deaths this season. with 41-new cases in just one week. however, the total this past week. is lower than in past weeks. the state health director says the downward trend is a good sign. even though flu season is not over until may. there are 45-confirmed flu- related deaths in the bay area, with santa clara county reporting the highest numbers. >> an update now on a measles warning, which started with a case involving bart. a second case of the measles in the bay area is being reported, unrelated to the bart exposure both cases are in contra costa county and both involve international travel. meantime, state health officials report three measles cases, raising some fears about a potential outbreak. we spoke with an infectious disease doctor at kaiser to find mike pelton is live at the scene with more. mike? >> this is a lot for police to secure. they are treating this as a triple stabbing. all that they stated started from a fight in this parking lot. >> as you can see behind a police markings are still on the ground and authorities tell me about 12:20 p.m. they heard of a fight that started. one man died on the scene. a few minutes later they responded to a car crash on a street. minutes after thatl reported that two patients showed up with stab wounds. they do believe that these incidents are related. authorities will interview them this morning. police are investigating what led to the stabbing and how the suspects and victims crossed paths. there are several bars in the area but they do not believe that any of them played a role in the incident. there are looking for two to five suspects. they either do not have or they're just not releasing the information. >> that was mike pelton reported. >> stunning allegations against mario enrique cuestas is behind bars. he's accused of selling methamphetamine to an undercover officer, and molesting a 17-year old boy. cuestas was arrested on thursday on federal drug and sex assault charges. those who know the 20-year veteran say the allegations have rocked the close-knit >> it hurts. it just goes against everything that we are for. >> we're angry, we are shocked. trump/clinton matchup. caution, you are about to enter the no spin zone. the factor begins right now. ♪ ♪ hi, i'm bill o'reilly. thanks for watching us tonight. we'll analyze yesterday's vote with karl rove and rudy giuliani in a moment. plus, brand new fox polling in ohio and florida. but, first, the talking points memo. fascism and donald trump. as predicted here, some in the media both left and right are portraying mr. trump as a 1930s type fascist and his supporters as budding brown shirts. the nazi party street army ink' germany. >> mr. trump, with some of the rhetoric you've used on the campaign trail over the last several months, targeting groups like muslims and mexicans, that that evokes images of nazi, germany and the scapegoat of jews there back in the 1930s and 40s. >> well, i think that's a big, big stretch. >> it's more than a big stretch. it's a strategy with the intention of not only demeaning trump but his supporters as well. the candidate aside, it's not hard to understand why many americans are voting for donald trump. for the past seven years the folks have been witness to the following: intense verbal attacks on police officers, labeling them racist who hunt down young black men, a porous southern border where narcotics and people smuggling continue unabated, a stagnant economy, where workers have little bargaining power, a growing jihadist terror threat, that the democratic party refuses to define not even using the words islamic terrorism. a democratic president who, after he announces the beheading of an american citizen by isis goes out to play golf. a cull purr that now demands political correctness even if it goes against sincerely held religious beliefs. a legal system that may actually harm a business owner if he or she does not want to participate in a gay marriage. or catholic nuns who don't want to distribute birth control. a press corps that generally embraces liberalism using its constitutional privilege to diminish non-liberals who have the at temerity to speak out. leftist system teachers and administrators who often impose their view on the world on defenseless children. grievance industry that is often promoted boy the media, thus, allowing anti-american zealots to define this country as evil and oppressive, ie america is the reaproblem in the world. in the face of all of that, an avenger named trump has risen, promising to stop the madness and giving blunt voice to millions of angry americans. the movement that trump represents has nothing to do with fascism, everything to do with furious dissent. this memo is not a campaign ad for trump. i know for a fact that some very bad people are trying to exploit his campaign to disguise racial and social hatred. they are doing that. donald trump should loudly condemn those people and tone down some of his own inflammatory rhetoric. just tell us what you want to do. no need to incite. same thing is happening with the bernie sanders crew where some haters are supporting bernie in order to tear down marketplace freedoms and inflict pain on prosperous americans. the cold truth is, charges of racism and fascism are easy smears designed to stop freedom of expression and stifle debate. here's more truth. the u.s.a. turn for the worse long before donald trump ever entered the political arena. and germany has nothing to do with it. and that's the memo. now for the top story tonight, reaction. joining us from miami bernie goldberg who has written a column on this fascism business on his website. and you say? >> bill, the crazy wing of the far left accused george w. bush of being hitler and a nazi. some conservatives have done the same to barack obama. now, we have the latest edition of this slander. donald trump, donald trump is hitler. you know what? there are plenty of reasons, in my view, plenty of legitimate reasons to criticize donald trump. but to make comparisons to hitler is beyond disgraceful. let me give you some specifics that you alluded to in a+ñse vague way. a professor from harvard wrote an op. he ed in the "the washington post" recently comparing the rise of hitler to the rise of trump. "saturday night live" just the other day made the comparison, bill maher made the comparison and lewis c.k. a very big time comedian flat out said trump is hitler. on the other side glenn beck made the comparison. david brooks of the "new york times" went on a sunday talk show and said if we're going to get trump,cq we might as well get the nuremberg rallies to go with it. i'm going to read you two sentences from what i wrote in that article on my website. two sentences. building a wall to keep illegals out is not the same as rounding up jews and sending them to the gas chamber. promising to temporarily ban all muslims from entering our country is wrong headed but it's not the same as putting into place an efficient, cold blooded apparatus to create a master race by eliminating anyone and everyone who doesn't fit the description. so, look, if you don't like donald trump, fine. i don't like his unpresidential demeanor but,> please, and i mean this, please don't demean the memory of the millions of people hitler murdered just for a cheap laugh or, as you said in the talking points, to stifle dissent. don't do that. >> i agree 100 percent. i don't think many americans understand what really happened in germany and italy. some extent spain during the 1930s where you had a concerted effort, a brutal effort to basically stop all -- you know, it's funny, because the people who are doing this, they are using techniques that the nazis used. so -- >> -- that's right. >> by them calling trump arb+ nazi and his4 supporters little brown shirts, they're doing the same thing that gerbles minister of propaganda and adolf and all those boys did. because they demonized the jews, the intellectuals, the communists, the gypsies, the homosexuals, they demonized them in a way to try to get anger on the part of the german population toward those groups. it's the same thing that those in america are doing to try to get anger toward trump and his followers. >> let me make two points. one, on the brown shirts matter. if there are any brown shirts in this country, it's liberals on college campuses who break up demonstrations and speeches because they disagree that's what the brown shirts did and that's what some crazy liberals on college campuses are doing when you say trump supporters are fueled and motivated by legitimate anger and not fascism. here's my question, bill is the anger legitimate? is it enough, rather, to support this feeling among some of these people that they embrace donald trump even after he said george w. bush lied to get us into a war? not that he made a mistake. not that the intelligence was bad, but that he flat out lied? this goes way beyond regular nonsense. >> it does. but that's not all trump supporters. look. >> no, of course not. of course not. >> many overlook -- many trump supporters overlook the candidates' idiosyncrasies and overstatements because they believe that the message they are sending by supporting him is more important. so that they accept the excess to send the message. >> absolutely. but, but, when you make a career as people on talk radio do, and some people ontj conservative television do, make a career by being conservative, that's not a side issue; that is the essence of what they are. to support a guy who said bush lied is a.[?port -- to look the other way when john mccain is insulted by trump. not john mccain the politician but john mccain the pow. >> they don't look at it that way. >> i don't care if they look at it -- i have seen too many people in conservative media are acting like school girls at a justin bieber concert. they are gushing over him, and i understand the anger. i want to make that clear. >> it's divided as you know. as you pointed out glenn beck doesn't like him and there are2conservative. i don't think breitbart likes him very much. it's divided. it's not a movement. anyway, bernie, good debate. good column. check it out. next on the rundown, while donald trump has momentum, the republican race is still pretty close as far as delegates are concerned. we'll have the numbers for you. later, rudy giuliani on a clinton trump matchup. s are dennis ahh... yeah! ahh... you probably say it a million times a day. ahh... ahh! ahh... ahh! but at cigna, we want to help everyone say it once a year. say "ahh". >>ahh... cigna medical plans cover one hundred percent of your in-network annual checkup. so america, let's go. know. ahh! and take control of your health. cigna. together, all the way. campaign 2016 tonight. after last night's vote here are the republican delegate tallies. donald trump 458. ted cruz, 359. marco rubio 151, john kasich 54. 1237 delegates need to do win the nomination. also, we have two new polling reports from fox news. in ohio john kasich leads now 34%, trump 29%. cruz 19%. rubio 7%. that's in ohio. 66 delegates in play. winner take all. in florida, trump way out in front 43%, rubio 20%, cruz 16%, kasich 10%. about a quarter of all florida republicans have already voted. most for trump. 99 delegates in play winner take all there as well. joining us from los angeles, karl rove. so it looks like trump will be unbeatable in florida or am i wrong? >> well, he has a very good poll here and it does reflect his numbers in the same range ofs6'7other polls that have him in the high 30's and low 40's. this is the highest number. but it's a big gap between he and marco rubio in rubio's home state. this would be deadly if it happens. this is in conflict with the fox poll is pretty good generally, but this is in conflict with another recent poll that said the majority of the people who had voted early had voted for rubio. so, this is why we have elections. >> that's why we have elections. but there is no doubt< that rubio has lost momentum. he didn't win any delegates last night. he is a good campaigner, i think. i wouldn't count him out in florida. but i think we have to look forward and assume that i would say the odds are 4 to 1 trump wins the 99 delegates. let's just stay there for now. he takes 99 delegates away. i don't know if he is stoppable after that. >> well, if the other side of the equation ohio goes for kasich, then that denies him 66. and then it depends a little bit on the outcome of the other three big contests that night. north carolina where i think cruz is going to be a big player and illinois and missouri. missouri, again, could be a place where cruz is a player. can we step back for just a minute and contemplate for a moment last night? because it was trump's best night th7z]:u far. heretofore he has gotten about 34.4% of the vote. last night he edged up to 37.8. and he came the closest he has ever come to getting the majority of the delegates on any given night. last night he got 71 delegates. 73 delegates were split between cruz at 56 and kasich at 17. but you're right. right now the delegate count is 458 for trump and 598 not for trump. that is to say for cruz, kasich, rubio, other candidates or a small number of uncommitteds. his problem remains his opportunity and his problem remains, is he getting 34.9% of the total vote. we have had 12.93 people vote. he has had 4 million. everybody else has had 8 million. the divided field is giving him a plurality. the question is when we get to these winner take all states, you know, he wins 100 percent of the delegates even f. he only gets 34.9% of the vote like he has been averaging. it's both a challenge for him and he has got to ultimately unite the party. 12 million people have voted. 8 million of them didn't vote for him. and then at the same time though, he has got the plurality of the delegates. even when it's proportional, some of these thresholds and other rules have made it drift his way. he is still behind and does not have yet a majority of the delegates. >> okay. and he doesn't play well west of the mississippi as he does east of the mississippi and his delegate total and vote total was inflated by mississippi last night. so, you have to look at -- if you look at oklahoma and idaho, two very very3tqitjju went against trump. all right. and then you have the enormous delegate haul out in california. if kasich wins, he becomes a player. i don't know how much of a player, but he becomes one. so it goes cruz, kasich, trump. and to me i don't know if trump is going to+tz0 get to 1200 by the time he rolls into cleveland. it doesn't look like he will to me, unless he wins ohio. >> yeah. look, i think you're right. i mean, it depends again on the distribution of the delegates and the other states. but it's getting increasingly harder to see that somebody is going to walk in to the convention with an absolute majority. we may be -- i think we are likely to be back in 1976, which is the last convention where the republicans entered the convention with somebody in front. that was gerald ford, ronald reagan slightly behind him, but a small group of uncommitted delegates or delegates bound by the rule and what happened was mississippi led the way and moving ford and ford won on the first ballot. went into the convention without a lead. >> if you really want to know what happened in that 1976 brawl, "killing reagan" we go all over it and all the back stuff. >> book sales. ladies and gentlemen, available on amazon.com tonight. all proceeds go to bill's charitable foundations so feel good about your purchase. >> available everywhere. mr. rove, thank you. directly ahead, new poll on donald trump6 clinton. rudy giuliani will analyze, of course. and the former governor of michigan blaming fox news for secretary clinton's trust problem. yes, she is. messages. personal story segment tonight. new poll from "the washington post/abc news folks matches hillary clinton up against donald trump in the presidential race. here are the stats. poll has clinton at a o%, trump up 41%. independents making the difference here, 48% breaking for mrs. clinton, 39%, mr. trump. with us here now in new york city rudy giuliani who was informally advising donald trump. i think everybody is informally. nobody really formally advising. look, we all know this is a snapshot in time and then when you get in a campaign, things change and all of this. but it is worthy because, as i said, if trump winsg; florida, he has got to really good chance to get this nomination. >> if he winning florida, he has got a very good chance of getting it. if he wins florida and ohio. >> then he has got it. >> then he has got it. >> absolutely. so right now you would have to make him -- >> -- i would say 3 to 1 favorite. >> 4 to 1 favorite to get it hard to see how cruz really catches him. >> cruz could catch him if he losing ohio, trump that is. and you know, the rubio people go to cruz, you know, all of the -- >> --a lot of the states coming up are going to be good states for trump like new york. like illinois, like california. republicans there. >> i don't know about california though. do you think california republicans? >> yeah. >> you think they will go for trump. >> yeah. >> because they conservative off the coast. >> right. >> and i think cruz may have, you know, a pretty good appeal there. >> he won mississippi. >> he what? >> he won mississippi. >> trump did? >> yeah. because the evangelicals interestingly enough. there aren't any evangelicals in california. >> it's got to be gulling to cruz. those states were built for him. >> i don't think cruz campaigned very much in mississippi. i think they knew they weren't going to do well there. >> the best news for donald trump last night was michigan, not just winning it. >> winning it big. >> and sanders winning it. hillary obviously has some weaknesses in the rust belt. donald has a lot of strength in the rust belt that could switch the electoral map it could be a different electoral map than what we have been seeing in the past. >> hillary clinton losing doesn't really matter though because she has twice as many delegates as sanders. and she is going to clean up next tuesday with florida and ohio. there is no way sanders is even competitive at that point. that's almost a given. hillary at 50% of the electorate though, i don't see her holding that number. >> i don't see her holding that number either. when you look at some of the underlying things in the polls like the 60, 65% of democrats who don't trust her, nobody has exploited that yet. no one has faced people -- >> --could would he be facing, mr. mayor, who are johnny carson used to do it. who do you trust least? and i'm doing that in a way that is accurate according to the polls because trump has very high negatives. >> they both do. but hillary also still has the fbi investigation. >> yep. >> i don't see how she comes out of it in good shape. either they indict her and if they don't indict her, you are going to have a scandal. >> as a former prosecutor, right? you are watching this? >> i have been for months. >> so i have said and i'm not as nearly sophisticated in my analysis here that i believe the fbi doing is honestninvestigation. do you believe that? >> no doubt about it. jim comey was one of my assistant u.s. attorneys. >> he is an honest man. >> straight as an arrow and very smart. >> okay. so you have to then consider that within 60 days they're going to have to have something. they can't let it drag on too much$ longer, can they. >> i'm surprised actually it's taken this long. >> all right. when you offer someone immunity as they did in this case, all right, does that mean a grand jury is already impaneled to hear what the man says? >> no. they offered him what's called queen for a day. they offered him immunity with regard to what is he telling the fbi. i don't know. they may have put him before a grand jury there could be a grand jury already convened in this case? it's possible? >> it would be very unlikely. >> very unlikely at this point. >> that you wouldn't convene a grand jury given the facts that exist. i would find that very surprising. >> so there could be a grand jury secretly convened because we haven't gotten any confirmation of that. >> not allow to do talk about it. >> right. so they are hearing now, regular folks, because that's what a grand jury is, regular people, hearing the information that the fbi is bringing, okay. and, remember, hillary clinton's side doesn't get to rebut, it's just what the fbi is bringing. >> that's all confidential rule 9 e protects it. it's a crime to reveal any of it. and the reality is, just, you know, from the public record, there's at least enough evidence to present to a grand jury. i mean -- >> -- do you want to make a prediction? >> first of all nationally the polls that you show have been held steady about a year or so. fewer four out of 10 democrats do not consider her honest and trust worthy. in the democratic races i will give you one example. in new hampshire the exit polling showed 40% of democrats voting in that primary felt that honest and trustworthiness were their number one issue, by 92% bill they went for#6wçñ bernie. this is the mostap serious problem among democratic voters. >> most democrats think she is okay and they think as miss governor granholm does it is blown out out of proportion and fox news exploits it i haven't seen that exploitation. >> are there people at fox news bill and monica that certainly talk about her being untrustworthy, absolutely. >> i haven't seen a lot of it. >> also my point being that people who defend her vehemently on your network on your program wreak after week that work for fox news that come to hillary clinton's defense. i think there has been equal portions of that. >> i think what governor granholm is conflating is we have covered the email scandal as we talked with rudy giuliani about it. we have covered not coverage of conviction. maybe some people do that. i don't do that and i don't know a lot of other people -- our hard news people never do that. >> we can name contributors that come on your program that absolutely defend her. to label her this does the camp no my momma said you can't change something until you acknowledge it. evenue if 59 statistics are dead on, find her untrust worthy. you can change their minds. >> yeah i know i might have a problem in this area but here is why. >> lay out some documents. talk about. here is at least one or two transcripts from my wall street, you know, big speeches so that you back up. >> yeah. >> her problem there is that her honesty and trustworthy problem predates fox news. this network launched in '96. she became first lady in '93. this goes way back. she cannot correct this problem and it is a serious and great one for her. >> calculation is that she is going to get the nomination. it doesn't really matter unless the fbi. >> it will matter in a general election. it matters among the democratic base now. it will certainly be amplified in a general. >> whoever the republican nominee is going to go right in for that. >> yeah. >> and they are going to have those women, families from benghazi saying she said this to me. i know it. that will be like the first commercial. all right, ladies, thanks very much. we appreciate it miller son deck. he has some material on the political landscape. can't wait to hear it factor tip of the day. who is going to nancy reagan's funeral? then it's unbelievable. hey, donald trump is a head shaker. but i must admit this. there are days i find myself shaking my head up and down. and this whole thing about adolf hitler, can i tell you when i hear the name adolf hitler and i'm sure this is most of us, i have a rorschach 6 million dead jews. i don't want to hear that is he like hitler, trump is like hitler because is he a bad painter or he had a bad mustache or something like that. that's what that means when they say hitler like. the guy is never, never going to kill 6 million people. is he not going to kill one person. unless, guess what, it's isis who says they want to kill the 6 million jews in israel. so, we'll trump kill somebody down the road if he is president? trump/clinton matchup. caution, you are about to enter the no spin zone. the factor begins right now. ♪ hi, i'm bill o'reilly. thanks for watching us tonight. we'll analyze yesterday's vote with karl rove and rudy giuliani in a moment. plus, brand new fox polling in ohio and florida. but, first, the talking points memo. fascism and donald trump. as predicted here, some in the media both left and right are portraying mr. trump as a 1930s type fascist and his supporters as budding brown shirts. the nazi party street army ink' germany. >> mr. trump, with some of the rhetoric you've used on the campaign trail over the last several months, targeting groups like muslims and mexicans, that that evokes images of nazi, germany and the scapegoat of jews there back in the 1930s and 40s. >> well, i think that's a big, big stretch. >> it's more than a big stretch. it's a strategy with the intention of not only demeaning trump but his supporters as well. the candidate aside, it's not hard to understand why many americans are voting for donald trump. for the past seven years the folks have been witness to the following: intense verbal attacks on police officers, labeling them racist who hunt down young black men, a porous southern border where narcotics and people smuggling continue unabated, a stagnant economy, where workers have little bargaining power, a growing jihadist terror threat, that the democratic party refuses to define not even using the words islamic terrorism. a democratic president who, after he announces the beheading of an american citizen by isis goes out to play golf. a cull purr that now demands political correctness even if it goes against sincerely held religious beliefs. a legal system that may actually harm a business owner if he or she does not want to participate in a gay marriage. or catholic nuns who don't want to distribute birth control. a press corps that generally embraces liberalism using its constitutional privilege to diminish non-liberals who have the at temerity to speak out. leftist system teachers and administrators who often impose their view on the world on defenseless children. grievance industry that is often promoted boy the media, thus, allowing anti-american zealots to define this country as evil and oppressive, ie america is the reaproblem in the world. in the face of all of that, an avenger named trump has risen, promising to stop the madness and giving blunt voice to millions of angry americans. the movement that trump represents has nothing to do with fascism, everything to do with furious dissent. this memo is not a campaign ad for trump. i know for a fact that some very bad people are trying to exploit his campaign to disguise racial and social hatred. they are doing that. donald trump should loudly condemn those people and tone down some of his own inflammatory rhetoric. just tell us what you want to do. no need to incite. same thing is happening with the bernie sanders crew where some haters are supporting bernie in order to tear down marketplace freedoms and inflict pain on prosperous americans. the cold truth is, charges of racism and fascism are easy smears designed to stop freedom of expression and stifle debate. here's more truth. the u.s.a. turn for the worse long before donald trump ever entered the political arena. and germany has nothing to do with it. and that's the memo. now for the top story tonight, reaction. joining us from miami bernie goldberg who has written a column on this fascism business on his website. and you say? >> bill, the crazy wing of the far left accused george w. bush of being hitler and a nazi. some conservatives have done the same to barack obama. now, we have the latest edition of this slander. donald trump, donald trump is hitler. you know what? there are plenty of reasons, in my view, plenty of legitimate reasons to criticize donald trump. but to make comparisons to hitler is beyond disgraceful. let me give you some specifics that you alluded to in a+ñse vague way. a professor from harvard wrote an op. he ed in the "the washington post" recently comparing the rise of hitler to the rise of trump. "saturday night live" just the other day made the comparison, bill maher made the comparison and lewis c.k. a very big time comedian flat out said trump is hitler. on the other side glenn beck made the comparison. david brooks of the "new york times" went on a sunday talk show and said if we're going to get trump,cq we might as well get the nuremberg rallies to go with it. i'm going to read you two sentences from what i wrote in that article on my website. two sentences. building a wall to keep illegals out is not the same as rounding up jews and sending them to the gas chamber. promising to temporarily ban all muslims from entering our country is wrong headed but it's not the same as putting into place an efficient, cold blooded apparatus to create a master race by eliminating anyone and everyone who doesn't fit the description. so, look, if you don't like donald trump, fine. i don't like his unpresidential demeanor but,> please, and i mean this, please don't demean the memory of the millions of people hitler murdered just for a cheap laugh or, as you said in the talking points, to stifle dissent. don't do that. >> i agree 100 percent. i don't think many americans understand what really happened in germany and italy. some extent spain during the 1930s where you had a concerted effort, a brutal effort to basically stop all -- you know, it's funny, because the people who are doing this, they are using techniques that the nazis used. so -- >> -- that's right. >> by them calling trump arb+ nazi and his4 supporters little brown shirts, they're doing the same thing that gerbles minister of propaganda and adolf and all those boys did. because they demonized the jews, the intellectuals, the communists, the gypsies, the homosexuals, they demonized them in a way to try to get anger on the part of the german population toward those groups. it's the same thing that those in america are doing to try to get anger toward trump and his followers. >> let me make two points. one, on the brown shirts matter. if there are any brown shirts in this country, it's liberals on college campuses who break up demonstrations and speeches because they disagree that's what the brown shirts did and that's what some crazy liberals on college campuses are doing when you say trump supporters are fueled and motivated by legitimate anger and not fascism. here's my question, bill is the anger legitimate? is it enough, rather, to support this feeling among some of these people that they embrace donald trump even after he said george w. bush lied to get us into a war? not that he made a mistake. not that the intelligence was bad, but that he flat out lied? this goes way beyond regular nonsense. >> it does. but that's not all trump supporters. look. >> no, of course not. of course not. >> many overlook -- many trump supporters overlook the candidates' idiosyncrasies and overstatements because they believe that the message they are sending by supporting him is more important. so that they accept the excess to send the message. >> absolutely. but, but, when you make a career as people on talk radio do, and some people ontj conservative television do, make a career by being conservative, that's not a side issue; that is the essence of what they are. to support a guy who said bush lied is a.[?port -- to look the other way when john mccain is insulted by trump. not john mccain the politician but john mccain the pow. >> they don't look at it that way. >> i don't care if they look at it -- i have seen too many people in conservative media are acting like school girls at a justin bieber concert. they are gushing over him, and i understand the anger. i want to make that clear. >> it's divided as you know. as you pointed out glenn beck doesn't like him and there are2conservative. i don't think breitbart likes him very much. it's divided. it's not a movement. anyway, bernie, good debate. good column. check it out. next on the rundown, while donald trump has momentum, the republican race is still pretty close as far as delegates are concerned. we'll have the numbers for you. later, rudy giuliani on a clinton trump matchup. s are dennis miller on political chaos in america. upcoming. sundown. we'll be with him all day as he goes back to taking tylenol. yeah, i was ok, but after lunch my knee started hurting again so... more pills. yep... another pill stop. can i get my aleve back yet? for my pain... i want my aleve. get all day minor arthritis pain relief with an easy open cap. hi i'm kristie. and i'm jess. and we are the bug chicks. we're a nano-business. windows 10 really helps us get the word out about how awesome bugs are. kids learn to be brave and curious and all kids speak the language of bug. >> well, he has a very good poll here and it does reflect his numbers in the same range ofs6'7other polls that have him in the high 30's and low 40's. this is the highest number. but it's a big gap between he and marco rubio in rubio's home state. this would be deadly if it happens. this is in conflict with the fox poll is pretty good generally, but this is in conflict with another recent poll that said the majority of the people who had voted early had voted for rubio. so, this is why we have elections. >> that's why we have elections. but there is no doubt< that rubio has lost momentum. he didn't win any delegates last night. he is a good campaigner, i think. i wouldn't count him out in florida. but i think we have to look forward and assume that i would say the odds are 4 to 1 trump wins the 99 delegates. let's just stay there for now. he takes 99 delegates away. i don't know if he is stoppable after that. >> well, if the other side of the equation ohio goes for kasich, then that denies him 66. and then it depends a little bit on the outcome of the other three big contests that night. north carolina where i think cruz is going to be a big player and illinois and missouri. missouri, again, could be a place where cruz is a player. can we step back for just a minute and contemplate for a moment last night? >> yeah. >> you think they will go for trump. >> yeah. >> because they conservative off the coast. >> right. >> and i think cruz may have, you know, a pretty good appeal there. >> he won mississippi. >> he what? >> he won mississippi. >> trump did? >> yeah. because the evangelicals interestingly enough. there aren't any evangelicals in california. >> it's got to be gulling to cruz. those states were built for him. >> i don't think cruz campaigned very much in mississippi. i think they knew they weren't going to do well there. >> the best news for donald trump last night was michigan, not just winning it. >> winning it big. >> and sanders winning it. hillary obviously has some weaknesses in the rust belt. donald has a lot of strength in the rust belt that could switch the electoral map it could be a different electoral map than what we have been seeing in the past. >> hillary clinton losing doesn't really matter though because she has twice as many delegates as sanders. and she is going to clean up next tuesday with florida and ohio. there is no way sanders is even competitive at that point. that's almost a given. hillary at 50% of the electorate though, i don't see her holding that number. >> i don't see her holding that number either. when you look at some of the underlying things in the polls like the 60, 65% of democrats who don't trust her, nobody has exploited that yet. no one has faced people -- >> --could would he be facing, mr. mayor, who are johnny carson used to do it. who do you trust least? and i'm doing that in a way that is accurate according to the polls because trump has very high negatives. >> they both do. but hillary also still has the fbi investigation. >> yep. >> i don't see how she comes out of it in good shape. either they indict her and if they don't indict her, you are going to have a scandal. >> as a former prosecutor, right? you are watching this? >> i have been for months. >> so i have said and i'm not as nearly sophisticated in my analysis here that i believe the fbi doing is honestninvestigation. do you believe that? >> no doubt about it. jim comey was one of my assistant u.s. attorneys. >> he is an honest man. >> straight as an arrow and very smart. >> okay. so you have to then consider that within 60 days they're going to have to have something. they can't let it drag on too much$ longer, can they. >> i'm surprised actually it's taken this long. >> all right. when you offer someone immunity as they did in this case, all right, does that mean a grand jury is already impaneled to hear what the man says? >> no. they offered him what's called queen for a day. they offered him immunity with regard to what is he telling the fbi. i don't know. they may have put him before a grand jury there could be a grand jury already convened in this case? it's possible? >> it would be very unlikely. >> very unlikely at this point. >> that you wouldn't convene a grand jury given the facts that exist. i would find that very surprising. >> so there could be a grand jury secretly convened because we haven't gotten any confirmation of that. >> not allow to do talk about it. >> right. so they are hearing now, regular folks, because that's what a grand jury is, regular people, hearing the information that the fbi is bringing, okay. and, remember, hillary clinton's side doesn't get to rebut, it's just what the fbi is bringing. >> that's all confidential rule 9 e protects it. it's a crime to reveal any of it. and the reality is, just, you know, from the public record, there's at least enough evidence to present to a grand jury. i mean -- >> -- do you want to make a prediction? tell me the truth. she lost in michigan, so what? she has double the delegates. she is going to sweep in florida. she is going to win in ohio. what do they care. >> maybe she wins ohio. that's the question mark. yes, clinton is in command of this lace she is more than half way of clinching this nomination. just among the early states this is a close race. super delegates yes she is far ahead. >> no one knows what you are talking about, henry. super delegates? so it doesn't matter who anybody votes for and how many super delegates are there? this gives me a headache. >> about several hundred. >> so she has already won then. >> about 15%. >> none of those people are going to vote for bernie sanders because they are all making a lot of money and they don't want bernie to take it. it's as simple as that. >> here's the deal. he has largely lost the south. that has put anymore a defensive posture. he thinks he can win the rust belt and the industrial mid west. why does it matter in hillary clinton was up 20 points a few days ago. closed and closed hard. you mentioned she is going to win!l ohio next tuesday, we don't know that maybe. >> the polls have her up strong. i know they had her up strong in michigan. i understand. that is there any truth to the matter that bernie was in his jammies sleeping when michigan was called and he had to get dressed and come down?
