with a live shot from our roof cam. we are dealing with partly cloudy skies. last fall for today. this is what your temperatures are born to look like. san francisco or 53 degrees. 48 degrees for san jose. low 50's in concord. 48 degrees in livermore and 53 degrees for santa rosa. we do have rain to talk about and not attractive for you coming up. >> breaking news: a fight leads to a deadly hayward. police say it happened just parking lot behind "buffalo bill's brewery" on b street. on february 15, 2014, at 12:22 am hayward police dispatch received the report of a fight in the parking lot to the rear of 1082 b st., and someone possibly stabbed. when officers arrived on scene they found a male subject in the parking lot suffering from a stab wound. medical personnel rendered aid to the subject, but he was pronounced deceased at the scene. six minutes later, hayward police dispatch received a call of a solo vehicle collision on a st. at south garden ave. officers responded to this location and found the vehicle involved to be unoccupied. nine minutes after being notified of the solo vehicle collision, hayward police dispatch received a call from a local hospital advising they had two patients enter the emergency room suffering from stab wounds. at this time it appears all three incidents may be related, however this remains under investigation. the name of the deceased is not being released at this time pending notification of the next of kin. anyone with information regarding any of these incidents is encouraged to call the hayward police department's investigations bureau at 293-7034. >> in san francisco, a motorcycle driver has died after falling 30 feet. it happened early this morning when the rider was entering 101 at 10th street. he was then ejected from the bike. c-h-p says the bike remained on the roadway while the rider fell 30 feet down to the roadway below the on- ramp. the on-ramp has been reopened. no further details are available at this hour. >> a police chase in oakland ended with a deadly crash. officers say a chase involving the c-h-p ended at 98th avenue and san leandro street late last night. that's where the stolen van officers were chasing. crashed into some other cars, injuring two other drivers. one person was killed. >> stunning allegations against a south bay firefighter. mario enrique cuestas is behind bars. he's accused of selling methamphetamine to an undercover officer, and molesting a 17-year old boy. cuestas was arrested on thursday on federal drug and sex assault charges. those who know the 20-year veteran say the allegations have rocked the close-knit department. >> ".feeling sad." >> cuestas served for years at fire station one. more recently he had been assigned to the department's community outreach program. an internal investigation is underway. >> and a department of justice spokesperson says there may be more victims. kron 4 went to the san lorenzo home where neighbors say cuestas lives with his parents. the house is a couple of blocks away from two schools. when they heard the allegations, students who normally walk by the home said they were disgusted. >> you are supposed to be saving lives, not destroyed homes. >> those are the top of things to get to put in jail. >> the task force seized two hard drives, papers and other records as evidence in this case. authorities say cuestas used a gay dating website to connect with other men. >> the man who police say fatally stabbed a man outside a san jose bar. will not face murder charges. police say mark gutierrez was acting in self defense. the stabbing happened early wednesday morning. investigators say gutierrez was asked to leave a bar. the victim, ryan viri, followed him down the street. police say bar surveillance video shows viri holding a knife. while chasing after gutierrez. >> a c-h-p dash cam video captures a bay area traffic and now, the officer is being sued because of what happened. the passenger in that car says, the c.h.p. officer used excessive force. she charges the officer -quote - explosives at the home after an explosion thursday. that explosion resulted in the man inside the home almost blowing off his hand. fifty-five homes have been evacuated ahead of the burning. the incineration could happen as early as tomorrow. >> an earthquake that shook south carolina and georgia was felt for hundreds of miles. the four-point-one magnitude earthquake happened around 10:30 last night. it was centered near the south carolina- georgia border. it felt as far as 150 miles in multiple directions. no damages or injuries have been reported. >> north carolina officials are are worried about another toxic spill. they fear a second pipe running under a coal ash dump might fail. this comes more than a week after a similar pipe collapsed and triggered a massive toxic spill into the dan river. the state said video taken inside the concrete pipe shows wide gaps between seams. they say potentially contaminated water could seep through those gaps. the states doesnt have an estimate of how much contaminated water from the dump is currently spilling into the river. officials have given the comany 10 days to come up with a plan to fix the leaks. >> an actress who says she was tired of hiding decided to *come out. she did so with an emotional speech that received a standing ovation. that was ellen page last night. publicly coming out as gay while giving a speech at an "vindicated" by a report out now. it finds martin was bullied by three of his teammates. an independent investigation by attorney ted wells found richie incognito, john jerry and mike pouncey harassed martin, another offensive lineman and an assistant trainer. the harassment included racial slurs, homophobic name-calling and improper touching. but the report says the harassment was not meant to drive martin from the team or cause "lasting emotional injury." >> this morning -- an exclusive investigation into the team doctor of the san francisco 49ers. last october, kron4 broke the story about how doctor daniel garza was the target of a criminal probe, for alleged inappropriate behavior with adult interns. in addition to treating superstar athletes, garza was also a prominent researcher and associate professor at stanford university. the elite sports medicine physcian killed himself. after the san mateo county sheriff investigators. searched his home for evidence. now kron 4 has uncovered past allegations against the doctor. kron 4's maureen kelly spoke to three men who say, they were victiminzed by garza when they were teenagers. it's a story you'll see only on four. >> 16:14 i woke up in the middle of his quote unquote experiments and he was just sort of you know fondling me and kind of playing with himself >> that's the voice of a man who says he was drugged and molested by doctor daniel garza nearly 20 years ago, and he's not the only one who's accusing the doctor of sexual abuse. >> 15: for him to do what he did, just doesn't even seem human. >> in all i spoke to three victims, none of whom wanted to appear on camera. in order to protect their privacy.i've changed their names to peter, john and carlos. they say it started when garza was their young, influential teacher at cathedral high school in el paso texas. it's a catholic all boys' schoolserving mostly latino students coming from working class families near the west texas border town. garzaa recent stanford college gradwas teaching freshman science. to many, he was a trusted role model they greatly admired. >> 19:01 he was a phenomenal teacher. a phenomenal teacher. and he was able to paint pictures about science in just a beautiful way. >> even then he was closely involved with sports. here's a photo from the school's yearbook showing garza as coach of the school's tennis team. all of the victims i spoke to had been young athletes, who say they were approached by garza to participate in a research study involving physcially fit young men. the man i'm calling "carlos" says he was only 15 when approached by garza while at swim practice. he says more than once, garza took him into an empty classroom under the guise of taking his measurements for a study. he says garza had him pull down his pants and touched him in a way he considers sexual abuse. he never reported it. peter and john say they became garza's targets after joining his informal afterschool science group. at the time, they felt like they were being given an exciting opportunity by their mentor to help them succeed. peter now feels garza was laying a trap for them.from the very beginning. >> * *20:20 the way he picked us, it was very strategic. all of us had very dysfunctional homes, he knew we were over achievers and wouldn't want to disappoint. he was very, very >> near the end of 1993 garza convinced peter and john's parents to let him take the two boys on a ski trip to new mexico as a reward for all of their hard work. while they were alone in their ski cabingarza asked them to participate in his research study. >> 14:25 he explained to us how he needed to do some research for stanford on how young athletes' metabolic rates behave when they are in restful states versus athletic states, so he pulled out charts and everything looked very official. >> they say garza brought along something that he said would help them get into that restful state. a drug called halothanea powerful anestetic which when given in high enough concerntations renders one completely unconcious. they say garza told the teens to inhale from the peter volunteered. >> 15:57 i remember the first time i inhaled this drug i dropped the bottle, a lot of it poured out. then you know, i was knocked out and woke up in my bed the next morning. >> john agreed help in the study, but was uncomfortable with the idea of being gassed by the drug. but one night during that trip john woke up to an unusal smelland opened his eyes to find garza's silolette looming above him. >> 03:35 he had been putting the liquid of that bottle on to a washrag from the hotel and was putting it on my face. i rolled over you know, pretending that i was still asleep and i rolled my face away from him and he went back to the other side of the bed and put it back on me i rolled back the other way, i grabbed the towel and thew it on to the floor. the next morning i woke up thinking was that a dream or what? and i see the towel on the floor. it was pretty scary. >> john was rattled by the experiencebut chose not to report it to authorities. >> 04:42 at that point my home life wasn't the greatest and he seemed to be a stable figure in my life.so, i decided that i didn't have to tell anybody, i thought that he knew what was in my best interest and that he was looking out for me. >> only his best friend peter knew the truth. the victims didn't come forwarduntil it happened again. in the spring of 1994 garza took peter and john along with the rest of their science group to california in order to tour college campuses. it was during a visit to stanford university, that the "testing" began again. but this time peter says the drug wore off and he woke up to the unthinkable. >> 22: i actually woke up with my shirt off and his hand, in my genitalia, on my genitalia, you know, kind of caressing me and him sort of rubbing himself. >> peter told john and together they decided they had to come forward. they say parents, school officials and even the fbi were brought in.but in the end garza was not criminally charged.tomorrow in the next installment of our exclusive investigation you'll find demanded her beloved is. police said the proper got away in a dark green ford worker. >> flu season has claimed more lives, but the fatality rate seems to be slowing down. the state's health department now confirms 243 flu deaths were related to this season with 41 cases of just one week. however, the total this past week, is lower than in the past weeks. the state health director says that the downward trend is a good sign. there are 45 confirmed flu related deaths in the bay area, with santa clara county reporting the highest. >> an update now on a measles warning, which started with a case involving bart. a second case of the measles in the bay area is being reported, unrelated to the bart exposure both cases are in contra costa county and both involve international travel. meantime, state health officials report three measles cases, raising some fears about a potential outbreak. we spoke with an infectious disease doctor at kaiser to find out the risks of contracting the measles. as contagious as it is, the chances of catching the measles, is very unlikely. >> the measles is a live a bacterial back say that gives you long-lasting immunity. the only people would entered her plea in court yesterday. badger is out of custody, and will return in april to set a date for her preliminary hearing. two people went to the hospital after eating marijuana-laced food she allegedly served at a potluck last november. badger is on paid leave from her job at matthew turner elementary school. >> california department of fish and wildlife collected more than a ton of banned shark fins. for sale inside a business. officers were tipped off in january that an emeryville restaurant was selling shark fin soup. when officers arrived at the hong kong east ocean restaurant.the delicacy was on the menu and being openly sold to patrons. it's the largest bust since the ban went into effect last july. police say the kwong yip fish company in san francisco sold the shark fins to the restaurant. officers discovered thousands of pounds of shark fins stored at the warehouse. the owner was charged with a misdemeanor. that charge could land the owner in jail for up to six months. >> happening today, tens of thousands will fill the streets of san francisco. >> there was a report of a fight and one man was suffering from a stab wound. he died at the scene. six minutes after the police responded to a single vehicle crashed on a street and no one was in the car at the time. nine minutes later, a nearby hospital stated that they had to patients with stab wounds. all of these incidents are related. they have been treated their release. an investigator is still try to piece this together and they have guards in the area but they do not believe that these people involved were at the bar. authorities did not believe that the suspects knew each other and they're still trying to find out what led up to the site. site. police tell me that they are looking for two to five authorities say cuestas used a gay dating website to connect with other men. >> the man who police say fatally stabbed a man outside a san jose bar. will not face murder charges. police say mark gutierrez was acting in self defense. the stabbing happened early wednesday morning. investigators say gutierrez was asked to leave a bar. the victim, ryan viri, followed him down the street. police say bar surveillance video shows viri holding a knife. while chasing after gutierrez. >> a c-h-p dash cam video captures a bay area traffic stop. and now, the officer is being sued because of what happened. the passenger in that car says, the c.h.p. officer used excessive force. she charges the officer -quote - "violently forced her to the ground." it happened back in october. jennifer donovan says she and her partner were pulled over by officer j-a phillips,because one of their headlights was out. jennifer's partner donna was driving and was given field sobriety tests. donavan first refused to take a breathalyzer. she then calls to donna, who is still in the vehicle. that's when jennifer says the officer "violently forced her to the ground" causing her to tear her rotator cuff. now, she's suing the officer for excessive force >> simply because you may have probable cause or a legitimate reason to detain a person does i give you the license to ruffled some one and physically preserve access. while tourists can still bike and raft, the rental facilities will be moved farther away from the merced river. the park also plans to ease congestion by adding shuttle buses and improving traffic flow. >> the napa unified school district is offering a reward to find the people who vandalized and burglarized a napa school. police say laptops and other items were stolen from a miles. the four-point-one magnitude earthquake happened around 10:30 last night. it was centered near the south carolina- georgia border. it felt as far as 150 miles in multiple directions. no damages or injuries have been reported. >> north carolina officials are are worried about another toxic spill. they fear a second pipe running under a coal ash dump might fail. this comes more than a week after a similar pipe collapsed and triggered a massive toxic spill into the dan river. the state said video taken inside the concrete pipe shows wide gaps between seams. they say potentially contaminated water could seep through those gaps. the states doesnt have an estimate of how much contaminated water from the dump is currently spilling into the river. officials have given the comany 10 days to come up with a plan to fix the maligned >> the jury will be back in court today to decide the fate of the man charged with first-degree murder of a 17- year-old over loud music. the jacksonsville, florida, jury in michael dunn's case deliberated all day friday and did not reach a decision. dunn is charged in the november 2012 death of 17- year-old jordan davis. dunn allegedly shot an suv davis was in with four other black teenagers. >> the family of a kidnapped newborn from wisconsin wants justice. baby kayden powell was abducted from a home in beloit, wisconsin last week. his aunt, kristen smith, has been charged. police say she took the baby across state lines to iowa, where she was arrested. an officer found the baby at a gas station. despite being left in the cold, doctors gave kayden a clean bill of health. >> she should be totally punished. she had plenty of time, when they arrested her to tell her where that baby was. >> smith faces kidnapping and child confirms 243-flu-related deaths this season. with 41-new cases in just one week. however, the total this past week. is lower than in past weeks. the state health director says the downward trend is a good sign. even though flu season is not over until may. there are 45-confirmed flu- related deaths in the bay area, with santa clara county reporting the highest numbers. >> an update now on a measles warning, which started with a case involving bart. a second case of the measles in the bay area is being reported, unrelated to the bart exposure both cases are in contra costa county and both involve international travel. meantime, state health officials report three measles cases, raising some fears about a potential outbreak. we spoke with an infectious disease doctor at kaiser to find attack on a woman during pride weekend last year in san francisco. the district attorney's office says a jury on thursday found christopher porter-bailey guilty of robbery, assault, and battery. the attack happened on june 30th near market and dolores streets. a group of people robbed the victim and knocked her down. porter-bailey kicked her in the head while she was on the ground. the victim did mike pelton is live at the scene with more. mike? >> this is a lot for police to secure. they are treating this as a triple stabbing. all that they stated started from a fight in this parking lot. >> as you can see behind a police markings are still on the ground and authorities tell me about 12:20 p.m. they heard of a fight that started. one man died on the scene. a few minutes later they responded to a car crash on a street. minutes after thatl reported that two patients showed up with stab wounds. they do believe that these incidents are related. authorities will interview them this morning. police are investigating what led to the stabbing and how the suspects and victims crossed paths. there are several bars in the area but they do not believe that any of them played a role in the incident. there are looking for two to five suspects. they either do not have or they're just not releasing the information. >> that was mike pelton reported. >> stunning allegations against mario enrique cuestas is behind bars. he's accused of selling methamphetamine to an undercover officer, and molesting a 17-year old boy. cuestas was arrested on thursday on federal drug and sex assault charges. those who know the 20-year veteran say the allegations have rocked the close-knit >> it hurts. it just goes against everything that we are for. >> we're angry, we are shocked. wisconsin wants justice. baby kayden powell was abducted from a home in beloit, wisconsin last week. his aunt, kristen smith, has been charged. police say she took the baby across state lines to iowa,
