be going in front of this committee without cutting some kind of a deal, right, kheus. reporter: we are not done yet. i would imagine the final minutes now until we get to this hearing will probably be given over to continued negotiations between not only speaker pelosi and her team, but also from between rangel and the four democratic members particularly of the eight-person ethics panel that is going to bring forward what is essentially an indictment today. they are going to bring forward the ethics charges against the congressman. i bet they are taking this right down to the wire, there is so much at stake for everyone involved. jon: you re thinking there could be a last minute deal and we are talking literally last minute. reporter: last minute. i think there is a chance for that. what rangel has obviously decided, and this has street end his bargaining position in the process, that if he s going to
court was very interesting it basically says the arizona law conflicts with our law and that it will disrupt our enforcement priorities and make us focus on arizona, and illegal aliens present in arizona to the exclusion of other enforcement responsibilities, aliens in other states and that sort of thing. they framed the issue as unfairly burden evening the federal government rather than a square conflict with a particular provision of federal law. jon: i know when you go to appeals court you can t just say the federal judge got it wrong, you have to focus in on specific issues in her decision. where does arizona stand the best chance, do you think? well i think arizona is likely to focus its efforts on the provision that s gotten a lot of attention, namely the one that grants arizona officers the power, or requires them really to question someone if they have reasonable suspicion that the person is present in the country illegally. and i think arizona s best argument at this point i
the republicans will still get to talk about it a bit nobody ever has to reached the charges and this can, barring any sort of criminal investigation into these things that have to do with taxes and other very tricky issues, then republicans sort of lose a talking point, that is bad news for republicans if rangel leaves the congress and bows out gracefully. if the deal involves some sort of censure where he stays in congress but has to take a public reprimand, then he s still there and running for office and some of the facts may come out, or at least to a greater degree than if he were to leave congress. it will depend on what kind of accommodation i guess i should say the democrats have reached with angle as to how good or bad this will be for them. jon: what does it say about speaker pelosi s promise to drain the swamp of corruption? reporter: that is a tough swamp to drain, and over the years many people have said that they were going to have clean

jenna: that s why the gunshots on the tape are information because the body was shot many times. reporter: the body was shot many times. again, important to point out memphis police have not tied the bow around that to see. we are expecting a news conference later today. we ll have to see if they bring that out in their investigation. jenna: thank you so much. jon: arizona s governor jan brewer says she will fight the injunction against her state s new immigration law all the way to the supreme court if necessary. that court fight could begin today. tom duprey is the former deputy attorney general there. what happens now, tom. the next step is arizona will take this battle to the 9th circuit. i anticipate they will file their appeal today, they ll have the 9th circuit to overturn the district court s order there by allowing the arizona law to go into effect. jon: are you making any predictions? the 9th circuit, a pretty liberal circuit court of appeals. it sure is.
