“This business fits their criteria of the ordinance we have in place. We don’t really have any grounds to deny it,” council member Susan Tjarks said of the Flower Shop dispensary.

“The dispensary issues are uncontrollable, and it brings an element into society that is not conducive, I believe, to what the city is planning to do with Main Street,” Don Dahl said at the meeting.

Traffic concerns, noise and increased dust from vehicles were several concerns that nearby property owners had over the buyer behind the $1.59 million approved offer of the former Kelley home.

Concerns centered around the proposed height of the building and aesthetics of the metal roof led the Planning and Zoning Commission to suggest a new design be drummed up

“I am doing my best to find another location, but it’s been very tough because costs of those locations are high," said Emmett Reistroffer, a Sioux Falls medical marijuana entrepreneur seeking to open a dispensary in downtown Mitchell.

“My gut tells me whatever the ordinance is for being a part from another business or educational institution, I think I would adhere to that,” said Chairman Larry Jirsa.
