Visiting Judge Cynthia Arvant of 41B District Court in Clinton Township sentenced Ben Liston to 60 days in jail, $11,000 in restitution and over $3,000 in fines and costs and then sentenced William Weber, an Eric Smith business associate, to two years probation both for their roles in the case involving Smith for which Smith was sentenced last month.

Miller’s attorney, Steve Fischman, was joined by Judge Grant and Assistant Attorney General Mike Frezza in trying to dispel allegations among the public and in letters received by Grant that Miller received special treatment and committed more wrongdoing than he actually did.

All three agreed to testify against Smith at his trial but it never took place due to his plea deal.

Smith insisted in front of several reporters and cameras he spent forfeiture dollars – which was initially alleged to be $600,000 – properly on fighting crime, for which it was intended.

Eric Smith pleaded guilty to official misconduct in office, tampering with evidence and conspiracy to commit forgery at a Tuesday hearing.
