Issuing notice to Shailendra Kumar Pathak Vyas - Acharya Ved Vyas Peeth Temple Varanasi and the Board of Trustees of Shree Kashi Vishwanath Temple, the bench ordered that only the priest appointed by the Vishwanath Temple Trust would perform puja at Vyas Tahkhana.

The Allahabad high court on Tuesday heard both the Hindu and Muslim sides on the Gyanvapi mosque committees appeal challenging the Varanasi district court order allowing Hindu prayers in a cellar of the mosque.

The Varanasi court had ruled on Wednesday that a priest can perform prayers before the idols in the southern cellar of the Gyanvapi mosque.

The Allahabad high court on Friday did not give any immediate relief to the Gyanvapi Masjid committee which had challenged the order of the Varanasi court allowing Hindu prayers in a cellar of the mosque.

Advocate Vishnu Shankar Jain, representing the Hindu side, pointed out that the district court by means of order dated January 17 had appointed District Magistrate, Varanasi receiver of the property in pursuance of which he took possession of the same on January 24

The Allahabad High Court did not provide relief to the Muslim side in the Gyanvapi mosque case after the Varanasi court allowed Hindu prayers in the mosques cellar. The court will hear the case on February 6. The order was passed on the day of Varanasi district judge Ajaya Krishna Vishveshas retirement. The district court had appointed the Varanasi District Magistrate as the receiver of the property on January 17. The appeal filed by the Muslim side also challenges this order.

The committee had moved the high court within hours of the Supreme Court refusing to hear its plea against the Varanasi district court order and asking it to approach the high court.
