The European Commission has adopted its adequacy decision for the EU-U.S. Data Privacy Framework, which will allow personal data to be transferred from Europe to U.

After a three year impasse over the transatlantic transfer of Europeans’ personal information, the EU and the US have come to a new agreement that will restore the open exchange of consumer data. It’s a welcome change for the ad industry.

The European Commission said Monday it has adopted a new legal framework to protect Europeans' personal data in exchanges with the United States -- its third attempt to get past legal challenges.The latest framework still has "the fundamental problem" that the United States "takes the view that only US persons are worthy of constitutional rights" protecting them from American electronic snooping, he said.

The United States ensures an adequate level of protection for personal data transferred from the European Union to US companies under the new framework, the EU concluded on Monday.

Under the deal, U.S. intelligence agencies access to data is limited to whats "necessary and proportionate" to protect national security. Europeans who suspect U.S. authorities have accessed their data will be able to complain to a new Data Protection Review Court, made up of judges appointed from outside the U.S. government. The threshold to file a complaint will be "very low" and wont require people to prove their data has been accessed, Reynders said.

The data transfer deal means that personal data can flow safely from the EU to US companies participating in the framework.
