After court struck $3 fee for sheriffs’ retirement, new case targets several others like it.

BNSF filed a complaint to compel arbitration in federal court Tuesday regarding instances in which the company was named in lawsuits related to a deadly Amtrak train derailment in Mendon, Missouri.

The train was traveling at 89 miles per hour when the emergency brake system initiated, and the NTSB previously said the trains speed at impact was 87 miles per hour.

Amtrak and BNSF Railroad are suing the owner of the dump truck the train hit.

12 family members were onboard, including 82-year-old Bihn Phan who was killed.

The family of 82-year old Binh Phan is now represented by a Kansas City personal injury attorney, who spoke to KSHB 41 about what happens next.
