In a significant decision that is set to affect Uttar Pradesh politics by large, the Allahabad High Court on Tuesday quashed the state governments draft notification regarding urban body elections, and ruled that the polls will take place without OBC (Other Backward Classes) reservation. A bench of Justice Devendra Kumar Upadhyay and Justice Saurabh Lavania passed the order and said OBC will be given reservation only after a dedicated commission is formed. 

An exclusionary and discriminatory principle

Upholding the EWS reservations exposes the Supreme Court’s limited understanding of social justice and equality.

New Delhi, Nov 7: The Supreme Court has upheld the 103rd Constitution Amendment providing for 10% quota for the economically weaker sections (EWS) from unreserved categories. The beneficiaries can avail the quota for admission to central institutions and Central government jobs.

The judge observed that the constitutional amendment granting reservation was creating a delusional belief that those getting social and backward class benefit are somehow better placed than the other reservations.
