After thorough investigation and concluding that the driver was not under the influence of alcohol and that it was an accidental death, the Sessions Court granted bail.

The plea said that there was no evidence to show that a case was made out against Merchant under section 304(2) (culpable homicide not amounting to murder) of the IPC.

Seeking bail, Merchant had told the court in his bail application that the police had not made a urine report that purportedly showed no alcohol content, a part of its chargesheet in the case.

Merchant’s own friend Riya Bhatia is a witness, too. She has stated that on reaching Worli Sea Face, Merchant picked up speed. She said she asked him to slow down as she was frightened but he did not pay heed.

The woman claimed that she opened her eyes only after she heard a loud noise of the accident.

The accused Sumer Merchant made the claim in the statement given to the police, which is part of the chargesheet filed recently before a court in Mumbai

The chargesheet, citing his blood sample report, stated that the alcohol content in Merchant's blood was 137 mg in 100 ml, which is way above the permissible limit

A sessions court in Mumbai on Tuesday denied bail to the motorist who allegedly ran over and killed a 57-year-old jogger in Worli area of south Mumbai last month.

Prosecution pointed out that his blood alcohol report received from the Kalina laboratory shows there was 137 mg per 100 ml of blood.
